in the entirety of the text - Full Text of Regulation 581 Submission of the management report (informe de regencia) for the second quarter of 2020, which will apply only to management sites under the category of artisanal restricted-management breeding facility (zoocriadero artesanal de manejo restringido) of arthropods that breed butterflies for exhibition Full Text of record: 137AB0 NATIONAL SYSTEM OF CONSERVATION AREAS DIRECTIVE No. 581-2020 In accordance with the provisions of Article 22 of the Biodiversity Law (Ley de Biodiversidad) No. 7788 and Article 7 of the Wildlife Conservation Law (Ley de Conservación de Vida Silvestre) No. 7317 and its Amendments;
1.—That in accordance with Article 50 of the Constitution, it is the duty of the Costa Rican State to seek the greatest well-being of all the country's inhabitants, as well as to guarantee the right to a healthy and ecologically balanced environment.
2.—That in accordance with the provisions of subsection d) of Article 4 of the Organic Environmental Law (Ley Orgánica del Ambiente) No. 7554 of October 4, 1995, the State, through the Ministry of Environment and Energy, is empowered to regulate human conduct, individual or collective, and public or private activity regarding the environment, as well as the relations and actions arising from environmental use and conservation.
3.—That in accordance with subsections a) and n) of Article 7 of the aforementioned Law No. 7317, the National System of Conservation Areas has the following powers: a) to establish the technical measures to be followed for the sound management, conservation, and administration of wildlife, the object of this law and of the respective international conventions and treaties ratified by Costa Rica; and n) to establish contingency plans for the protection of wildlife in the event of natural disasters.
4.—That Article 180 of the Political Constitution and Articles 29, 30, 31, and 32 of the National Law on Emergencies and Risk Prevention (Ley Nacional de Emergencias y Prevención del Riesgo), No. 8488, empower the Executive Branch to declare a state of emergency, which empowers the Public Administration to adopt extraordinary measures in cases of urgent or unforeseen needs in order to protect the most relevant legal interests, such as the life and health of people, which, once decreed, permits exceptional treatment so that the Government can swiftly obtain sufficient economic, material, or other resources to attend to people, goods, and services in danger of being affected, among other causes, by a public calamity, subject to subsequently rendering the accounts demanded by the economic, legal, and fiscal control laws.
5.—That the National Commission for Risk Prevention and Emergency Response (Comisión Nacional de Prevención de Riesgos y Atención de Emergencias) issued the Yellow Alert Declaration for the Entire National Territory, No. 09-20, on March 8, 2020, and within its framework, a series of measures have been taken with the objective of regulating the operation of public and private facilities where the spread of COVID-19 could be facilitated, whether through the attendance of users, clients, workers, and the general public.
6.—That the National Law on Emergencies and Risk Prevention No. 8488 of November 22, 2005, in its Article 2 states: "the purpose of these regulations is to provide an agile and effective legal framework that guarantees the reduction of the causes of risk, as well as the timely, coordinated, and efficient management of emergency situations." Likewise, this law empowers the administration to act urgently in a state of emergency, by carrying out immediate actions that operate in the face of an imminent danger, understood as the probability of contagion existing through a field inspection or through technical and scientific observations and studies, which entails an eventual emergency within an unpredictable timeframe. Therefore, an anticipated and effective response must be ensured against the possible negative impact, thereby seeking adequate control of the risk elements, through the management of factors that constitute a threat, as well as vulnerability factors.
7.—That the COVID-19 pandemic constitutes a global health emergency, as declared by the World Health Organization on March 11, 2020, and is affecting the health of the Costa Rican population.
8.—That the Executive Branch, through Executive Decree No. 42227-MP-S of March 16, 2020, based on the state of necessity and urgency caused by the circumstances generated by the COVID-19 pandemic, declared a national state of emergency throughout the territory of the Republic of Costa Rica.
9.—That on March 25, 2020, the Executive Branch issued Directive No. 077-S-MTSS-MIDEPLAN on the operation of state institutions during the declaration of national emergency for COVID-19, through which the Central Administration is instructed to reduce, by at least 80% of its payroll —during the time the declaration of the national state of emergency is in effect— the volume of servants performing their duties in person, thus limiting itself to guaranteeing the continuity of those tasks strictly necessary to ensure the institutional public purpose.
10.—That with the state of emergency mentioned having been ordered, and given that the main activity of artisanal restricted-management breeding facilities for arthropods —mainly butterfly gardens (mariposarios)— is the exhibition of wildlife specimens, it is necessary to apply measures to mitigate the economic and social effects derived from such declaration. Therefore, THE NATIONAL SYSTEM OF CONSERVATION AREAS Issues this DIRECTIVE:
Regarding the submission of the management report for the second quarter of 2020, which will apply only to management sites under the category of artisanal restricted-management breeding facility of arthropods that breed butterflies for exhibition nationwide, which have suffered or foresee a decrease in visits due to the indicated situation.
1.—SINAC, through the Conservation Areas (Áreas de Conservación), will authorize, by means of an administrative resolution, the management sites subject to this directive to submit the management report corresponding to the period of April, May, and June, jointly with the management report corresponding to the third quarter of 2020.
2.—To authorize this extension of the deadline for submitting management reports, the management sites must comply with the following conditions:
a. Submit a written request, digitally if possible, in accordance with the provisions of Law No. 8454 on Digital Certificates, Signatures, and Electronic Documents and its Regulation (Executive Decree No. 33018), using the attached form, requesting the extension for the submission of the report.
b. State in the request that, during the period of the third quarter, they commit to maintaining the breeding stock (pie de cría), in order to resume operations once the emergency is over.
c. Inform SINAC, by written note, when the wildlife specimen exhibition activities are resumed.
3.—That the mechanism for the Conservation Areas to authorize what is indicated in the directive is as follows:
a. Requests will be received primarily in digital format; therefore, an electronic address must be provided to the permit holder (permisionario) for them to send the request.
b. This request will be received within the established period of eight business days from the publication of this Directive.
c. Once the period for receiving requests is closed, the Conservation Area must issue an administrative resolution, based on the emergency decree and other directives generated, authorizing the permit holders to submit the management report for period II of 2020 jointly with period III of 2020. The Conservation Area may issue a single resolution that includes all the management sites whose requests are being resolved.
d. Once the resolution is issued, it will be notified electronically and filed in the administrative case file (expediente administrativo).
4.—Administrative responsibility and supplementarity. These issued measures are mandatory for all personnel of the National System of Conservation Areas. Any situation not contemplated herein must be resolved in strict observance of the official governmental provisions related to the response to the national emergency due to the COVID-19 disease, and interpreted in light of the applicable national legal system. Any administrative conduct that implies potential harm may signify the existence of strict liability (responsabilidad objetiva) on the part of the Administration, for not adopting the necessary and sufficient measures to avoid harm to wildlife.
5.—Scope. These measures aim to respond to the urgent need to protect life, ensure health, and seek at all costs the safety not only of public servants and users, but also of the wildlife present in its different habitats.
6.—Effective Date. It shall take effect upon its publication in the Official Gazette La Gaceta.

10.-Que al haberse ordenado el estado de emergencia mencionado y siendo que la principal actividad de los zoocriaderos artesanales de manejo restringido de artrópodos -principalmente mariposarios- es la exhibición de individuos de vida silvestre, es necesario aplicar medidas que permitan mitigar los efectos económicos y sociales derivados de tal declaratoria. Por tanto, EL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN Emite la presente DIRECTRIZ:
Sobre la presentación de informe de regencia para el segundo trimestre del año 2020, y que aplicará únicamente para los sitios de manejo bajo la categoría de zoocriadero artesanal de manejo restringido de artrópodos que reproduzcan mariposas para la exhibición a nivel nacional, que han sufrido o prevén una disminución en las visitas debido a la situación indicada.
1º-El SINAC a través de las Áreas de Conservación autorizará mediante resolución administrativa, a los sitios de manejo sujetos a esta directriz, para que puedan presentar el informe de regencia correspondiente al periodo abril, mayo y junio, de manera conjunta con el informe de regencia correspondiente al tercer trimestre del año 2020.
2º-Para autorizar esta ampliación de plazo de presentación de informes de regencia, los sitios de manejo deberán cumplir las siguientes condiciones:
a. Presentar solicitud por escrito de ser posible digitalmente, conforme a lo dispuesto por la Ley Nº 8454 de Certificados, Firmas Digitales y Documentos Electrónicos y su Reglamento (Decreto Ejecutivo Nº 33018), mediante el formulario adjunto en donde se solicite la prórroga a la presentación del informe.

c. Informar al SINAC, mediante nota escrita cuanto se retomen las labores de exhibición de individuos de vida silvestre.
a. Se recibirán las solicitudes principalmente en formato digital, por lo que se debe de brindar una dirección electrónica al permisionario para que éste envíe la solicitud.
b. Esta solicitud se recibirá dentro del plazo establecido de ocho días hábiles a partir de publicada la presente Directriz.
c. Una vez cerrado el periodo de recepción de solicitudes, el Área de Conservación deberá emitir una resolución administrativa, basada en el decreto de emergencia y demás directrices generadas, donde autoriza a los permisionarios la presentación del informe de regencia del periodo II del año 2020, en conjunto con el periodo III del año 2020. El Área de Conservación podrá emitir una sola resolución que incluya todos los sitios de manejo cuyas solicitudes se están resolviendo.
d. Una vez emitida la resolución se notificará vía electrónica, y se archivará en el expediente administrativo.
4º-Responsabilidad administrativa y supletoriedad. Las presentes medidas emitidas son de acatamiento obligatorio para todo el personal del Sistema Nacional de Áreas de Conservación. Cualquier situación no contemplada, deberá resolverse en estricto respeto de las disposiciones gubernamentales oficiales relativas a la atención de la emergencia nacional por la enfermedad COVID-19, e interpretarse a la luz del ordenamiento jurídico nacional aplicable. Toda conducta administrativa que implique un eventual daño, puede significar la existencia de responsabilidad objetiva por parte de la Administración, al no adoptarse las medidas necesarias y suficientes para evitar la afectación de la vida silvestre.
5º-Alcance. Estas medidas pretenden responder ante la urgente necesidad de proteger la vida, asegurar la salud y procurar a toda costa la seguridad, no sólo de los servidores públicos y de los usuarios, sino también de la vida silvestre que se encuentra presente en sus diferentes hábitats.
6º-Vigencia. Rige a partir de su publicación en el Diario Oficial La Gaceta.
