"Article 15.—Protection of the Population's Health. The Ministry of Health is responsible for ensuring that all drinking water supplies, their constituent elements, their functioning, and maintenance guarantee an adequate and safe supply for the population's consumption, pursuant to Law N° 5395 of October 30, 1973, 'Ley General de Salud'. As well as the granting of location permits, the review and approval of construction plans, and the sanitary operating permit for Wastewater Treatment Plants (Plantas de Tratamiento de Aguas Residuales), including septic tanks and systems that provide treatment to third parties. In the case of ordinary-type wastewater treatment plants, the review and approval shall be carried out in accordance with the provisions of articles 17, 18, 19, and 24 of Executive Decree Nº 36550-MPMIVAH-S-MEIC of April 28, 2011, 'Reglamento para el Trámite de Revisión de los Planos para la Construcción', and Executive Decree Nº 39887 S-MINAE of April 18, 2016, 'Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales'." "Article 16.—Competencies of AyA: Within the framework of its own competencies and without prejudice thereto, AyA is responsible for governing in the area of directing, setting policies, establishing and applying norms, carrying out and promoting the planning, financing, and development of the supply of drinking water, collection, and treatment of ordinary wastewater; the normative aspect of the design and operation of potable water and sanitary sewer systems, as well as the normative aspect of the design of storm drainage systems, for the entire national territory."
