In accordance with the composition contained in Article 28 of Law No. 7384, the appointment of the members of the Commission shall be governed by the following provisions:
- a)The representatives of the institutions must be appointed within each institution at the request of Incopesca, and such appointment must be notified by official letter to the Board of Directors of Incopesca, with the exception of the representative from subsection d) of Article 28 of Law 7384, who shall be appointed by the Board of Directors from the shortlists proposed by non-governmental entities.
- b)The Board of Directors shall send an agreement requesting the competent institutions to appoint their representatives to this Commission. It shall also establish the call for non-governmental entities to propose shortlists to elect the member referred to in subsection d) of Article 28.
- c)The members of the Commission shall be appointed for a term of four years and may be re-elected.
- d)When a vacancy occurs, a new representative must be appointed within a maximum period of one month.
- e)The revocation of the appointment of members may be requested from the represented entity, in the event of non-compliance with duties or anomalous conduct by any member in the performance thereof.
