in the entirety of the text - Full Text of Norm 072 Distribute the 330,000 anchovetas of catch, recommended by the National University, among the 15 fishing associations that expressed interest Full Text of record: 137010 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/072-2020.-Puntarenas, on the sixteenth day of April, two thousand twenty.
Considering:
7384, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture, LCICPA, establishes that Incopesca, ". is a state public entity, with legal personality, its own assets, subject to the National Development Plan issued by the Executive Branch.". Therefore, Incopesca is constituted within the legal system as an autonomous entity, which provides it with the necessary legal characteristics for decision-making within the scope of its powers.
8436, the Fisheries and Aquaculture Law, LPA, is the executing authority of said law. Hence the importance that the agreements of the Board of Directors (Junta Directiva), to regulate fishing and aquaculture activities, must be issued on the basis of technical, scientific, economic, and social criteria that demonstrate that the exercise of fishing guarantees compliance with the constitutional principle of democratic access to sustainable development derived from the provisions of articles 21 and especially article 50 of the Political Constitution.
16804-MAG of December 16, 1985, published in La Gaceta No. 24 of February 4, 1986, determines that "small-scale artisanal fishing is considered to be that activity which is carried out directly by the fisherman with limited extent and means, within the territorial waters with a vessel whose operational capacity (autonomy) to carry out the fishing activity at sea does not exceed four consecutive days, without depending on coastal infrastructure."
10.-That according to the Bachelor's thesis in Marine Biology by biologist Rosa Soto, from the National University, the anchoveta populations were overexploited, which was another reason for Incopesca not to issue licenses for the fishing of this species.
11.-That in view of the new requests to fish anchoveta by small-scale fishermen of the Gulf of Nicoya, the Board of Directors (Junta Directiva) of Incopesca adopts AJDIP-497-2015, through which it requests a technical opinion from the Scientific Technical Coordination Commission (Comisión de Coordinación Científico Técnica, CCCT).
12.-That said Commission issued a technical recommendation to the Board of Directors (Junta Directiva) of Incopesca, not recommending the use of purse seine nets (chinchorro), based on the scientific research available, which determined that the anchoveta was overexploited, and therefore instead recommended the use of individual cast nets (atarrayas) and other management measures, in addition to the need to carry out new research to determine the recent status of the anchoveta population.
13.-That the Board of Directors (Junta Directiva) accepts the recommendations of the CCCT, through AJDIP-117-2016.
14.-That based on the previous point, the Department of Development and Research of Incopesca included in the institutional Operational Plan for the year 2016, the execution, through contracting, of the research "Estimation of the existing biomass of the anchoveta Cetengraulis Mysticetus, in the inner zone of the Gulf of Nicoya, Costa Rica," which was assigned to the National University and which continued until the year 2017, when the research report was submitted to Incopesca, in the month of December of that year.
15.-That said study recommends the capture of 15,000 individuals per month/fisherman, for a total of 22 vessels, which means that only 330,000 anchovetas per month could be fished sustainably. The distribution of this catch should be carried out by Incopesca as the governing body.
16.-In view of the foregoing, the Board of Directors (Junta Directiva) of Incopesca adopts AJDIP-482-2018, through which a Technical Committee (Mesa Técnica) is created to analyze said matter, with the first meeting taking place on December 11, 2018, and in which, once the research report from the National University was more widely known, the Department of Development and Research is requested to issue a technical recommendation.
17.-The foregoing is addressed through official communication DDI-104-12-2018, addressed to this Honorable Board of Directors (Junta Directiva), through which several technical recommendations are made, all of which are based on the research report on anchoveta submitted by the National University.
a. Individuals over 15 cm (TPMS) must be captured, with the objective of mainly protecting females in such a way that, when these are captured, at least 50% of them have already reproduced.
b. 330,000 anchovetas could be fished sustainably per month. For this reason, it is recommended that this quota be distributed among the interested fishing associations, since distribution per vessel could not be equitable, as there may be many vessels wanting to use this resource. This quota must be distributed to the fishing associations by right (a derecho) and only to vessels that have up-to-date fishing licenses, whose owners must keep a catch log, which must be submitted monthly to the Statistics Department of Incopesca.
c. Each interested Association must request from Incopesca the corresponding license, which includes the use of 1 or 2 purse seine nets (chinchorros) of a total length of 40 meters, for the live capture of anchovetas.
d. The Association must have 1 or 2 holding pens (potones) of 2 x 2 x 4 meters, for the maintenance of live anchovetas, and each vessel must also have a holding pen (vivero) of 1.5 cubic meters for the same purpose.
e. This quota must be distributed to the fishing associations by right (a derecho) and only to vessels that have up-to-date fishing licenses, whose owners must keep a catch log, which must be submitted monthly to the Statistics Department of Incopesca.
18.-That director Deiler Ledezma Rojas requested that the Department of Extension and Training of Incopesca consult the Fishing Associations of the Gulf of Nicoya, regarding whether they were interested in requesting licenses for the fishing of anchoveta.
19.-That once the relevant consultations were carried out, Biól. Nixon Lara Quesada, an official of said Department, informs the Executive Presidency, via email, that the associations interested in obtaining a license for the fishing of anchoveta are the following:

Considerando:
es un ente público estatal, con personalidad jurídica, patrimonio propio, sujeto al Plan Nacional de Desarrollo que dicte el Poder Ejecutivo.". Por ello, el Incopesca, se constituye dentro del ordenamiento jurídico como un ente autónomo, lo que le reviste de las características jurídicas necesarias para la toma de decisiones dentro del ámbito de sus competencias.
De ahí la importancia de que los acuerdos de Junta Directiva, para regular las actividades de pesca y la acuicultura, deben de dictarse sobre la base de los criterios técnicos, científicos, económicos y sociales que demuestren que el ejercicio de la pesca garantice el cumplimiento del principio constitucional de acceso democrático al desarrollo sostenible derivado de lo que disponen los artículos 21 y en especial el artículo 50 de la Constitución Política.
10.-Que según tesis de Licenciatura en Biología Marina de la bióloga Rosa Soto, de la Universidad Nacional, las poblaciones de anchoveta estaban sobreexplotadas, lo cual era otra razón para que el Incopesca no emitiera licencias para la pesca de esta especie.
11.-Que en vista de las nuevas solicitudes para pescar anchoveta por parte de los pescadores de pequeña escala del Golfo de Nicoya, la Junta Directiva del Incopesca toma el AJDIP-497-2015, mediante el cual se solicita criterio técnico a la Comisión de Coordinación Científico Técnica (CCCT).
12.-Que dicha Comisión emitió recomendación técnica a la Junta Directiva del Incopesca, no recomendando el uso de chinchorro, basados en la investigación científica que se tenía, la cual determinaba que la anchoveta estaba sobrexplotada, por lo que más bien recomendaba el uso de atarrayas individuales y otras medidas de manejo, además de que se debía de realizar una nueva investigación para conocer el estado reciente de la población de anchoveta.
13.-Que la Junta Directiva acoge las recomendaciones de la CCCT, mediante AJDIP-117-2016.
14.-Que en base al punto anterior, el Departamento de Desarrollo e Investigación del Incopesca, incluyó en el Plan Operativo institucional del año 2016, la realización, mediante contratación, de la investigación "Estimación de la biomasa existente de la anchoveta Cetengraulis Mysticetus, en la zona interna del Golfo de Nicoya, Costa Rica, la cual fue asignada a la Universidad Nacional y la cual continúo hasta el año 2017, cuando se presenta el informe de investigación al Incopesca, en el mes de diciembre de ese año.
15.-Que en dicho estudio se recomienda la captura de 15.000 individuos por mes/pescador, para un total de 22 embarcaciones, lo cual significa que solo se podrían pescar sosteniblemente 330.000 anchovetas al mes. La distribución de esta captura debería de ser distribuida por el Incopesca como ente rector.
16.-Por lo anterior, la Junta Directiva del Incopesca toma el AJDIP-482-2018, mediante el cual se crea una Mesa Técnica para analizar dicho tema, realizándose la primera reunión el día 11 de diciembre del 2018 y en la cual, una vez conocida más ampliamente el informe de investigación de la Universidad Nacional, se solicita al Departamento de Desarrollo e Investigación, se emita una recomendación técnica.
17.-Lo anterior es atendido mediante oficio DDI-104-12-2018, dirigido a esa Honorable Junta Directiva, mediante el cual se hacen varias recomendaciones técnicas, las cuales son todas basadas en el informe de investigación sobre anchoveta presentado por la Universidad Nacional.
a. Se deben de captura individuos por encima de los 15 cm (TPMS), con el objetivo de proteger principalmente a las hembras de tal manera, que cuando estas sean capturadas, ya se hayan reproducido al menos un 50% de ellas.
b. Se podrían pescar sosteniblemente 330.000 anchovetas por mes. Por esto se recomienda que esta cuota sea repartida entre las asociaciones de pescadores interesadas, ya que, la distribución por embarcación no podría ser equitativa, al existir posiblemente muchas embarcaciones que quieran utilizar este recurso. Esta cuota la deben de repartir a las asociaciones pesqueras a derecho y solo a embarcaciones que tengan licencias de pesca al día, cuyos propietarios deberán de llevar un registro de capturas, el cual debe de ser entregado mensualmente al Departamento de Estadística del Incopesca.
c. Cada Asociación interesada, debe de solicitar al Incopesca la correspondiente licencia, lo cual incluye el uso de 1 o 2 chinchorros de una longitud total de 40 metros, para la captura viva de las anchovetas.
d. La Asociación debe de tener 1 o 2 potones de 2 x 2 x 4 metros, para el mantenimiento de las anchovetas vivas y cada embarcación debe también de tener un vivero de 1,5 metros cúbicos para el mismo fin.
e. Esta cuota la deben de repartir a las asociaciones pesqueras a derecho y solo a embarcaciones que tengan licencias de pesca al día, cuyos propietarios deberán de llevar un registro de capturas, el cual debe de ser entregado mensualmente al Departamento de Estadística del Incopesca.
18.-Que el directivo Deiler Ledezma Rojas solicitó al Departamento de Extensión y Capacitación del Incopesca, se consultara a las Asociaciones de Pescadores del Golfo de Nicoya, si estaban interesadas en solicitar licencias para la pesca de anchoveta.
19.-Que una vez realizadas las consultas del caso, el Biól. Nixon Lara Quesada, funcionario de dicho Departamento, informa a la Presidencia Ejecutiva, mediante correo electrónico, que las asociaciones interesadas en obtener licencia para la pesca de anchoveta son las siguientes:
