in the entirety of the text - Full Text of Norma 0071 Closed Season for the Year 2020 Full Text of acta: 13633B COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/0071-2020.-Puntarenas, on the sixteenth day of April, two thousand twenty.
I.-That by agreement of the National Closed Seasons Commission adopted at the ordinary working session Acta CNV-01-2020 held on January 24, 2020, whereby technical reports DDI-012-02-2019 and DDI-073-08-2019 issued by the Department of Research and Development are accepted, the proposal for a total closed season in the Gulf of Nicoya for fishing during the year 2020 is remitted.
II.-That in the present session, Mr. Álvaro Otárola Fallas, Acting Technical General Director, in his capacity as Coordinator of the National Closed Seasons Commission (CNV), by official communication DGT-A-006-2020 presents for study and evaluation the proposal for a total closed season in the Gulf of Nicoya for fishing during the year 2020.
III.-That once the proposal was discussed and analyzed by the Directors, the Board of Directors, Therefore, AGREES:
1°-To approve the closed season proposal for the year 2020, under the following terms and conditions: 1.1 To establish a total closed season for fishing, in the area bounded by an imaginary straight line running from Punta Torres known as Peñón (09°53'31" North Latitude, 084°43'52" West Longitude) to the Lighthouse on Isla Negritos offshore (09°49'14" North Latitude, 084°49'35" West Longitude) and from there to the East part of Punta Cuchillos on the Nicoya Peninsula (09°50'03" North Latitude, 084°53'42" West Longitude) and from that line inward to the mouth of the Tempisque River. This fishing prohibition applies from June 1st to August 31st, 2020, both dates inclusive.
1.2. Taking into consideration the difficult socioeconomic situation of the coastal communities due to the COVID-19 issue, as long as the national state of emergency is in effect, fishing for domestic consumption is excepted and therefore permitted in the zone defined in point 1 of this agreement during the present closed season. Those who choose to carry out this fishing must comply with the regulations as established by Board of Directors agreement No. AJDIP-511-2017.
1.3. Due to the pandemic caused by the coronavirus, COVID-19, as long as the national state of emergency remains in effect, INCOPESCA shall not authorize sport fishing tournaments during the effective period of this closed season, in the area indicated in point 1.
1.4. The owners of vessels of the small-scale artisanal fleet of the Gulf of Nicoya, with fishing licenses to operate in zones a and b, may opt out of the closed season, provided they expressly request it from INCOPESCA. They may only fish using hand lines and line, regardless of the fishing gear they are authorized to use, outside the closed area indicated in point 1; and may carry out their fishing operations with the recognition of fuel at a competitive price, from June 1st to August 31st, 2020.
1.5. The Board of Directors of INCOPESCA, taking into account the national emergency and its socioeconomic consequences, shall periodically review the scope of this closed season in order to ensure food security and social well-being.
1.6. To instruct the Executive Presidency of INCOPESCA to explore the possibilities of maintaining subsidies for the fishing sector during the closed season, even if the conditions thereof are modified.
1.7. The map attached in the following table shall be considered an integral part of this Agreement:

I.-Que mediante acuerdo de la Comisión Nacional de Vedas adoptado en la sesión de trabajo ordinaria Acta CNV-01-2020 celebrada el 24 de enero de 2020, mediante el cual se acogen informes técnicos DDI-012-02-2019 y DDI-073-08-2019 emitidos por el Departamento de Investigación y Desarrollo, se remite propuesta de veda total en el Golfo de Nicoya, para la pesca durante el ario 2020.
II.-Que en la presente sesión el señor Álvaro Otárola Fallas, Director General Técnico a. í., en su condición de Coordinador de la Comisión Nacional de Vedas (CNV), mediante oficio DGT-A-006-2020 presenta para estudio y valoración la propuesta de veda total en el Golfo de Nicoya, para la pesca durante el ario 2020.
III.-Que una vez discutida y analizada la propuesta por los señores Directores, la Junta Directiva, Por tanto, ACUERDA:
1°-Aprobar la propuesta de veda para el año 2020, en los siguientes términos y condiciones: 1.1 Establecer una veda total para la pesca, en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53'31"Latitud Norte, 084°43'52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49'14" Latitud Norte, 084°49'35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50'03"Latitud Norte, 084°53'42" Longitud Oeste) y de esa línea aguas adentro hasta la desembocadura del río Tempisque. Esta prohibición de pesca va desde el 01 de junio hasta el 31 de agosto del 2020, ambas fechas incluidas.
1.2. Tomando en consideración la difícil situación socioeconómica de las comunidades costeras por el tema del COVID-19, en el tanto este vigente el estado de emergencia nacional, se exceptúa y por ende se permitirá en la zona comprendida en el punto 1 de este acuerdo, la pesca para el consumo doméstico durante la presente veda. Quienes opten por realizar esta pesca, deberán cumplir con la normativa según lo establecido por el acuerdo de Junta Directiva N° AJDIP-511-2017.
1.3. En razón de la pandemia provocada por el coronavirus, COVID-19, en tanto se mantenga vigente el estado de emergencia nacional, el INCOPESCA no autorizará torneos de pesca deportiva, durante el periodo de vigencia de la presente veda, en el área comprendida indicada en el punto 1.
1.4. Los propietarios de embarcaciones de la flota artesanal en pequeña escala del Golfo de Nicoya, con licencias de pesca para faenar en las zonas a y b, podrán no acogerse a la veda, siempre y cuando lo soliciten de manera línea, independientemente del arte de pesca que tengan autorizado, fuera del área vedada indicada en el punto 1; pudiendo realizar sus faenas de pesca con el reconocimiento del combustible a precio competitivo, del 01 de junio al 31 de agosto del 2020.
1.5. La Junta Directiva del INCOPESCA, tomado en cuenta la emergencia nacional y las consecuencias socioeconómicas de la misma, revisará de manera periódica los alcances de la presente veda con el fin de asegurar la seguridad alimentaria y bienestar social.
1.6. Instruir a la Presidencia Ejecutiva del INCOPESCA, para que explore las posibilidades de mantener subsidios para el sector pesquero durante la veda, aun cuando las condiciones de la misma se modifiquen.
1.7. Téngase como parte integral del presente Acuerdo, el mapa que se anexa en el cuadro siguiente:
