For the purposes of this Regulation, the following shall be understood by:
Collective supply (Abastecimiento colectivo): When one connection provides water to more than one consumption unit.
Individual supply (Abastecimiento individual): When one connection provides water to a single consumption unit.
Water connection pipe (Acometida de agua): Pipe extension installed from the distribution network to the point of installation of the service connection, up to the property boundary.
Sanitary sewer connection pipe (Acometida de alcantarillado sanitario): Pipe extension installed from the collection network to the outlet accessory of the inspection box (caja de registro) or sanitary siphon.
Aqueduct (Acueducto): The set of sources, potabilization plants, storage tanks, conduction networks, distribution networks, and other elements necessary for supplying water to a population.
Water for population use (Agua para uso poblacional): Water supplied through public systems for the diverse direct or indirect activities of users, aimed at meeting the various needs of the population, provided technical feasibility (factibilidad técnica) exists. This use includes: human consumption, ornamental irrigation, industrial, technological, cooling systems, and fire protection. Agricultural, livestock, and forestry irrigation activities are excluded from this use.
Potable water (Agua potable): Treated water meeting the provisions for recommended values or maximum admissible aesthetic, organoleptic, physical, chemical, biological, and microbiological levels established in the Regulation for Potable Water Quality.
Wastewater (Agua residual): Water subjected to a use, which has caused its contamination with organic matter, chemical substances, or suspended solids. To discharge it into the public sanitary sewerage system, environmental regulations issued by other competent authorities must be complied with.
Special-type wastewater (Agua residual de tipo especial): Wastewater of a type different from ordinary.
Ordinary-type wastewater (Agua residual de tipo ordinario): Wastewater generated by domestic human activities (use of toilets, showers, washbasins, sinks, laundry, etc.).
Billing adjustment (Ajuste a la facturación): Modification to billed amounts when high consumption occurs.
Sanitary sewerage system (Alcantarillado sanitario): Public network of pipes used to collect and transport wastewater to its point of treatment and disposal. This concept is understood as a synonym for collection network or system.
Technical feasibility analysis (Análisis de factibilidad técnica) (Replaces the concept of technical feasibility): Verification of the real and current existence of sufficient water, hydraulic, material, technical, legal, and environmental resources to grant availability (disponibilidad) and eventual connection (conexión) of the service.
Works approval (Aprobación de obras): Action resulting from validating a water or sanitation work or infrastructure constructed by a private party, once technical and legal compliance with the requested requirements has been verified.
Areas subject to urban control (Áreas sujetas a control urbanístico): Administrative territorial demarcation, whose delimitation corresponds to the application radius of a regulatory plan. In the absence of a regulatory plan, it is the area over which surveillance and oversight are exercised regarding compliance with the set of urban planning limitations established in current regulations.
Urban area (Área urbana): The territorial scope of development of a population center. It includes the urban quadrant or any other city system developed radially or polygonally. It may be located within or outside the Greater Metropolitan Area.
Payment arrangement (Arreglo de pago): Agreement between parties (AyA and the owner or user) in which both agree that the service debt shall be canceled in installments, whose amounts and terms are established in this regulation.
Inspection box (Caja de Registro): Structure located on the sidewalk or public green zone, whose objective is to facilitate access to the sanitary siphon for performing maintenance work on the public network.
Street or public thoroughfare (Calle o vía pública): Any public domain access for the free transit of persons and/or vehicles, declared as such by the competent authority.
Hydraulic capacity (Capacidad hidráulica): Existence of installed and operational infrastructure of the supply and sanitation systems to convey the flow rates for the effective provision of services.
Water resource capacity (Capacidad hídrica): Existence of the water resource with technical and operational feasibility (factibilidad técnica) for the production of potable water for supply by AyA.
Collection and/or treatment capacity (Capacidad de recolección y/o tratamiento): Existing technical condition for the collection and/or treatment of wastewater.
Fortuitous event (Caso fortuito): A situation that cannot be foreseen by any intelligence as it occurs casually and unexpectedly. The generation of such a circumstance implies alteration of the conditions of an obligation.
Land use certification (Certificación de uso de suelo): Public document issued by the competent entity certifying the use of a property, compatible with the implemented zoning.
Condominium (Condominio): Real estate susceptible to utilization by different owners, with common elements of an indivisible nature, constituted under the protection of the Condominium Property Law, Law No. 7933 and its reforms, as well as its Regulation.
Built condominium (Condominio construido): Unlike a lot condominium, this is a condominium developed and constructed in its entirety by the developer, such that each filial plot (finca filial) is sold to new owners with its building finished.
Condominium of condominiums (Condominio de condominios): Project where filial plots (fincas filiales) are formed from the subdivision (fraccionamiento) of a parent filial plot.
Lot condominium (Condominio de lotes): Condominium where the filial plots (fincas filiales) correspond to horizontal plots, which can be used for industrial, tourist, commercial, residential, and recreational purposes. They may be intended for providing services or for constructing buildings. In horizontal lot condominiums, each filial plot shall be called an individualized primary filial plot.
Concession (Concesión): Contract through which the State grants the management and exploitation of certain public assets to companies or private parties.
Water resource capacity certificate (Constancia de capacidad hídrica): Document issued by the operator entity in response to a denial of service availability (disponibilidad de servicios), certifying that the aqueduct has real water resource capacity and the potential availability of the water supply service to the property; availability is subject to the construction, by the interested party, of the infrastructure indicated in this document.
Water resource capacity certificate with public works investment (Constancia de capacidad hídrica con inversión de obra pública): Document issued by the operator entity in response to a denial of service availability, solely due to a lack of hydraulic capacity (infrastructure), certifying that the aqueduct system offers, for the demand of the real estate development, real water resource capacity, and that the availability of the potable water supply service to the property will depend on the construction of infrastructure works by the public operator, in accordance with the execution of a viable project regarding future operational sustainability, budgetary content, and with a certain date for its operation.
Collection and/or treatment capacity certificate (Constancia de capacidad de recolección y/o tratamiento): Document issued by the operator entity in response to a denial of service availability, certifying that the systems have the capacity for the availability of the wastewater collection and/or treatment service; availability is subject to the construction, by the interested party, of the infrastructure indicated in this document.
Service availability certificate (Constancia de disponibilidad de servicios): Document issued by the operator entity to certify to the interested party the real existence, in a property, of water resource capacity, hydraulic capacity, as well as collection and treatment capacity, allowing the eventual request for the services of potable water supply, wastewater collection, and treatment; without causing detriment to the rights of existing users.
Certificate of general information on the existence of potable water supply and collection systems in a determined zone (Constancia de información general de existencia de sistemas de abastecimiento de agua potable y de recolección en una zona determinada): Document issued by the operator entity certifying that a property that has a registered cadastral plan (plano catastrado) and is registered in the Public Registry is located in an area of influence of one of its water supply systems, sanitary sewerage systems, or both, and consequently, within the jurisdiction of the operator entity.
Certificate of infrastructure existence along the boundaries of a property (Constancia de existencia de infraestructura frente a linderos de un inmueble): Document issued by the operator certifying, in accordance with the provisions of the Urban Planning Law, that a property located in an urban area or any other area subject to urban control faces, on one of its boundaries, an existing public thoroughfare duly equipped with indispensable potable water and sanitary sewerage services or both. This document is not equivalent to a service availability certificate, therefore it does not entail a flow rate or infrastructure commitment for the operator and is issued solely for the purposes of processing a cadastral plan for a duly registered property lacking municipal approval (visado) or a survey plan (plano de agrimensura) corresponding to the merger of properties.
This document shall only serve to accredit the geographic location of a property within or outside the coverage area of a public aqueduct system, sewerage system, or both, as well as the general situation regarding the water resource capacity, hydraulic capacity, collection, and treatment capacity of the administered systems. This document does not replace nor achieves the legal effects of a water resource capacity certificate, nor a service availability certificate, and does not constitute authorization for construction permit procedures, constructions, interconnections (interconexiones), enabling of the property with services provided by the operator entity, or procedures for well drilling permits or surface or groundwater concessions.
Certificate of existing potable water service with inventoried flow rate and/or sanitary sewerage service with authorized discharge flow rate (Constancia de servicio existente agua potable con caudal inventariado y/o de alcantarillado sanitario con caudal de descarga autorizada): Document issued by the operator entity certifying the real and material existence of potable water and/or sanitary sewerage services associated with a specific property, which is registered in AyA's database. This certificate may be presented by the applicant as a requirement for processing bank transactions, procedures before APC, municipal permits for expansion and remodeling, municipal licenses, operating permits, approval of housing bonds, among other procedures of a similar nature.
This certificate does not guarantee the approval of additional services, nor does it authorize a change of use authorized for said service. Any request involving a change of service use, increase in diameter and flow rate, or additional service requirement must be processed as a new service availability (disponibilidad de servicios) request.
Connection (Conexión): Union of the public water supply or sanitary sanitation system with the private system.
Cross connections (Conexiones cruzadas): Interconnection of systems (water, wastewater, storm drainage water, non-potable industrial water, or others) that put the water system, the integrity of the sanitation system, and the storm drainage system at risk of contamination.
Fraudulent connection (Conexión fraudulenta): A connection that, having been suspended by AyA, is reconnected by a third party to the water and/or sanitary sewerage systems without the authorization of the system operator; or an active connection detected to be using a means that alters the service consumption record.
Unauthorized or illicit connection (Conexión no autorizada o ilícita): Connection made by third parties to the water and/or sanitation systems without the due authorization of AyA.
Consumption (Consumo): Volume of water used in a determined period.
Average consumption (Consumo promedio): The average of normal consumptions recorded in the last 12 months.
Wastewater spill (Derrame de aguas residuales): Wastewater overflow from the collection, treatment, or disposal systems of the system.
Maximum growth development formula for the approval of potable water and/or sanitary sewerage services in deficit zones (Desarrollo máximo de crecimiento para la aprobación de los servicios de agua potable y/o alcantarillado sanitario en zonas deficitarias): Formula through which the operator shall determine, in a deficit zone, the maximum volume in liters per second that allows establishing the maximum number of services that may be approved for individual housing and commerce, for each property located in an urbanized area with basic services. It must be determined that the granting of availability (disponibilidad) and eventual connections does not negatively impact the quality and continuity of the service, to the detriment of existing services. AyA shall resolve negatively those requests for availability or new services that, in their total, exceed the established maximum number.
Availability of water supply service (Disponibilidad de servicio para abastecimiento de agua): Real and current existence, not future or potential, of the necessary overall works and infrastructure and water resource capacity for supply to meet the service needs of a specific population.
Availability of collection and treatment service (Disponibilidad de servicio de recolección y tratamiento): Real existence, for a property, of the capacity for wastewater collection and treatment, and that eventually allows requesting the services. The foregoing, without causing detriment to the rights of existing users.
Residential use building or housing unit (Edificación de uso residencial o unidad habitacional): Any dwelling or apartment intended for permanent and continuous residential use, built to house persons exclusively for meeting their housing needs. The modality may be single-family or multi-family.
Service elimination (Eliminación del servicio): Action allowing the permanent cancellation of water supply provision, at the user's request or for reasons inherent to service operation.
Technical Study (Estudio Técnico): Study allowing the proposal and analysis of different technical options for service provision. Furthermore, it allows the verification of the technical feasibility (factibilidad técnica) of each option and the selection of the best alternative.
Branch extension (Extensión de ramal): Extension of aqueduct and sewerage coverage from the increase in length of a segment of the aqueduct network or the collection system to a determined point.
Technical feasibility for granting a service (Factibilidad técnica para el otorgamiento de un servicio):
- a)When distribution and collection networks exist along the property boundaries or have direct access by public thoroughfare or ingress/egress easement (servidumbre de paso) from the property for which a service is requested. b) That the systems have sufficient water resource, hydraulic, potabilization, and treatment capacity to serve new users. c) That the system meets the established quality attributes. d) That it is legally and environmentally possible. e) That the applicant(s) comply with urban planning regulations and the established requirements.
Technological feasibility (Factibilidad tecnológica): Real and current existence of the technological services platform, without disregarding internal or external factors that could eventually affect its operation due to fortuitous event or force majeure.
Invoice (Factura): Printed or digital document issued periodically by the operator, showing the concepts, consumption, due date, amounts to be charged for the services provided, and, among other items, information of interest to the user. It may also present information on past-due accounts receivable.
Billing (Facturación): Process by which the concepts, volumes, and amounts to be paid by the user are determined.
Filial plot (Finca filial): Private unit of property within a condominium, constituting an autonomous portion suitable for independent use and enjoyment, with direct access to the public thoroughfare or to a specific common space leading to it.
Parent filial plot (Finca filial matriz): Any filial plot that, due to its own characteristics regarding size, availability of access and services, allows for the constitution of a new condominium within the initial condominium.
Parent plot (Finca matriz): Property that originates the condominium, consisting of two or more filial plots and their corresponding common areas.
Subdivision (Fraccionamiento): The division of any property for the purpose of selling, transferring, negotiating, distributing, exploiting, or using separately the resulting parcels; it includes both partitions by judicial or extrajudicial adjudication, localizations of undivided rights, and mere segregations in the name of the same owner, as well as those situated in urbanizations or new constructions relevant to the control of the formation and urban use of real estate.
Force majeure (Fuerza o causa mayor): An inevitable and unforeseeable event. The generation of such a circumstance, which generally involves events caused by the behavior of nature, implies alteration of the conditions of an obligation.
Leak (Fuga): Escape of water in the distribution networks or water installations.
Groups in a condition of vulnerability (Grupos en condición de vulnerabilidad): Groups or communities of persons whose economic situation, illness condition (physical or mental), age, disability, ethnicity, indigence condition, among others, do not have sufficient economic means to face the total payment of the debt. Such conditions must be verified by submitting, by the interested party, documentation such as the following: certificates, interviews, social referrals, and epicrisis reports and/or medical opinion, among others; issued by the competent state entities.
Water meter (Hidrómetro): Device or instrument designed to measure and record the volume of water.
Independization (Independización): The act through which AyA, at the request of the interested parties, separates an existing service, whether water, or water and sanitary sewerage, so that the filial plots (fincas filiales) of the same parent plot (finca matriz) have their own service; provided it is a condominium with primary infrastructure completed by the developer and approved by AyA through the corresponding Administrative Resolutions. The independization of services implies the transfer to AyA of the relevant system for its administration, operation, and maintenance.
In no case shall sanitary sewerage services be independized exclusively.
Individualization (Individualización): The act through which AyA, at the request of the interested party, separates an existing service, whether water, or water and sanitary sewerage, for each of the consumption units located within the same property, provided that there are no civil works pending completion by the developer and that these have therefore been approved by AyA through the Corresponding Administrative Resolutions. In no case shall sanitary sewerage services be individualized exclusively.
Existing AyA infrastructure (Infraestructura existente de AyA): Corresponds to infrastructure under the operation, administration, and maintenance of AyA, such as public networks for water distribution and wastewater collection and treatment, connection pipes (acometidas), water meters, hydrants, valves, pumping stations, tanks, sanitary manholes, and any other component necessary for the optimal provision of services.
Primary infrastructure or primary works (Infraestructura primaria u obras primarias): Corresponds to the infrastructure of potable water and sanitation systems, as well as complementary works, which is necessary and must be built with the objective of being able to grant the Service Availability Certificate (Constancia de Disponibilidad de los servicios) for Supply and/or Collection to an urban development project or properties. This infrastructure would be located on AyA-owned land, streets or public thoroughfares, and/or registered permanent pipe and access easement (servidumbre permanente de tubería y de paso).
Property (Inmueble): Land duly individualized, listing one or several owners, or possessors by any legitimate title.
Technical inspection (Inspección técnica): Specialized review conducted by AyA or the delegated operator regarding the operation and use of water, sanitation, and metering systems, located on public thoroughfares, on access easements (servidumbres de paso), or on private plots and buildings, as established in Article 5, subsection i) of the Constitutive Law of AyA (Law No. 2726).
Technical inspection for supply (Inspección técnica para abastecimiento): Review carried out by the operator, at the user's request or ex officio, to verify the use of the service and its basic data.
Connection installation (Instalación de conexión): Action materialized when the connection located on a private property is physically integrated into the operator's system.
Internal installations (Instalaciones internas): Mechanical installations for water supply and wastewater collection located within a property.
Interconnection (Interconexión): Connection of new systems, infrastructure, and urban developments that comply with current technical regulations to the distribution and collection systems operated by AyA or the delegated operator for the enabling of water and sanitation services.
Property boundary for water service (Límite de propiedad para el servicio de agua): Boundary of a real estate property that borders a public street or a registered pipe and access easement (servidumbre de tubería y de paso) in favor of AyA, in front of which the connection point for its water service is located.
Property boundary for sanitary sewerage service (Límite de propiedad para el servicio de alcantarillado sanitario): The final segment of the sanitary siphon pipe where the connection to the public network is made. If an inspection box (caja de registro) exists, it is understood that it is the property of the service holder, who is therefore responsible for its maintenance.
Calculation memorandum for service allocation and diameter change (Memoria de cálculo para dotación de Servicios y Cambio de Diámetro): Estimation of monthly water consumption to determine, according to the projected average allocation, the correct sizing (diameter) of the water meter to be assigned to the service, considering the use (domestic, commercial, industrial, or any other authorized purpose), the description of the consumption units, and the number of persons who will use the service. The calculation must be presented in cubic meters (m3) per month.
New water service (Nuevo servicio de agua): Corresponds to a new physical connection between the public network and the user's property through the water connection pipe (acometida de agua), whether foreseen or not, through which the supply service shall be provided, with its corresponding metering system and tariff use.
New sanitation service (Nuevo servicio de saneamiento): Corresponds to a new physical connection between the public network and the user's property through the sanitary sewer connection pipe (acometida de alcantarillado sanitario), whether foreseen or not, through which the collection service shall be provided, with its corresponding inspection box (caja de registro) and tariff use.
Operator (Operador): Legally constituted provider, or one whose administration has been delegated, of potable water and/or sanitary sewerage services.
Unauthorized alternate water path (bypass) (Paso alterno de agua no autorizado): Water connection mechanism used to falsify the consumption recorded by the water meter.
Wastewater discharge permit (Permiso de descarga de aguas residuales): Procedure that the interested party must carry out before the administrator of a sanitary sewerage system when the establishment or activity generates wastewater that discharges directly into the sanitary sewerage network.
Master plan (Plan maestro): Technical document describing the planning for constructing an urban development, reflecting the strategy to be followed with its action programs and validity. It includes aspects of location and spatial distribution; the chronology of actions for each stage, phase, or component; as well as the characteristics, the execution deadline, the development objective, and the water demand by stages.
Survey plan (Plano de agrimensura): The physical or electronic format plan that graphically and mathematically represents a property, complying with the standards established by the Regulation to the National Cadastre Law, Executive Decree No. 34331-J, and its reforms or the regulation that replaces it.
Cadastral plan (Plano catastrado): The survey plan, physical or electronic, that has been registered in the National Cadastre and whose effects are defined in the Regulation to the National Cadastre Law, Executive Decree No. 34331-J, and its reforms or the regulation that replaces it.
Possessor (Poseedor): A person who performs stable and effective acts of possession, peacefully, publicly, and uninterruptedly, as an owner for more than one year on properties not registered by the Public Registry.
Inspection manhole (Pozo de registro para inspección): Structure with access used for the inspection and maintenance of collection systems; used when there are changes in direction, slope, material, or diameter and the confluence of several pipes.
Water connection stub (Prevista de agua): Length of pipe installed from the distribution network to the point for the service connection; it reaches the property boundary and has not been connected to the property's internal installations.
Sanitary sewer connection stub (Prevista de alcantarillado sanitario): Pipe segment installed from the collection network to provide service to the property but that has not been connected to the sanitary siphon.
Succession proceeding: Legal process whose purpose is the liquidation and distribution (partición) of inheritance assets, prior to their determination and that of the persons among whom they are to be distributed.
Owner (Propietario): Natural or legal person who exercises dominion over real property through a public deed (escritura pública), duly registered in the Public Registry; also understood as the natural or legal person in whose name the service provided by the service provider is registered.
Urban development project: Subdivision (Fraccionamiento) of lots for urban purposes (housing developments (urbanizaciones), condominiums, shopping centers, residential or office towers, among other infrastructure), which involves a process of enabling access, communal facilities, and basic services for the use of the resulting lots.
Volumetric Test (Prueba Volumétrica): Inspection performed on the water meter (hidrómetro) to verify the correct recording of water volume. It corresponds to the technical procedure by which a water meter (hidrómetro) is subjected to different water flows, making a comparison between the recorded volume and a reference standard, in order to obtain the respective error percentages.
Works Acceptance (Recepción de Obras): Administrative act by which a water or sanitation work or infrastructure, built by a private individual and which becomes the property of AyA, is approved and transferred (traspasa), once technical and legal compliance with the requested requirements has been verified. Said act indicates the infrastructure that remains under the administration, operation, and maintenance by the users.
Networks (Redes): System of pipes for water distribution and the collection of wastewater (aguas residuales).
Public network (Red pública): System of water pipes or wastewater (aguas residuales) collection owned by AyA.
Operational Report (Reporte Operacional): Technical document presenting a summary of the characteristics of the wastewater (aguas residuales) discharged into the sanitary sewer system (alcantarillado sanitario) or a receiving body. It includes an analysis of the wastewater (aguas residuales) in which the physicochemical parameters requested in the Reglamento de Vertido y Reuso de Aguas Residuales are determined, and corrective measures are established in case of non-compliance with the maximum permissible discharge limits.
Supply service: Corresponds to the supply of water for human consumption provided by AyA; also called water service.
Equivalent service: It is the consumption of one non-residential unit expressed in the average consumption of residential units (unidades habitacionales). It will be calculated according to the provisions of the Norma técnica for "Design and construction of potable water supply, sanitation, and stormwater systems" (Diseño y construcción de sistemas de abastecimiento de agua potable, de saneamiento y pluvial), approved through Board of Directors Agreement No. 2017-281 on June 27, 2017, and its eventual reforms.
Hydrant service: Operation, maintenance, and development of hydrant networks for firefighting, at the service of the Cuerpo de Bomberos.
Collection or sanitary sewer service (Servicio de recolección o alcantarillado sanitario): Public network (Red pública) of pipes and pumping stations whose objective is the transport of wastewater (aguas residuales) to its treatment point.
Sanitation service: Corresponds to the integration of the Collection Services (Sanitary Sewer) (Alcantarillado Sanitario), Treatment Service, and Final Disposal of wastewater (aguas residuales).
Temporary service: Service that, due to the temporary nature of the activity being supplied, is provided for a defined period of time.
Public access easement (Servidumbre de acceso público): Real right of entry and free transit for pedestrians and/or vehicles, established in favor of public entities over a property owned by another. It implies for its owner a limitation on the full exercise of the attributes of property rights, without the portion of land losing its status as private property.
De facto easement (Servidumbre de hecho): One established over a property by force of use and custom, tolerated by the owner of the property, without legal imposition or formal act of constitution by public deed (escritura pública).
Passage easement (Servidumbre de paso) registered in favor of third parties: Real right of entry and free transit for pedestrians and/or vehicles, constituted and registered in favor of a property whose owner is a natural or legal person other than AyA.
Private passage easement (Servidumbre de paso privada): Real right of entry and transit for pedestrians and/or vehicles for the benefit of one or several properties, over a property owned by another. It implies for its owner a limitation on the full exercise of the attributes of property rights, without the portion of land losing its status as private property.
Permanent pipeline and passage easement (Servidumbre permanente de tubería y de paso) of AyA: Real right to install water and/or sanitary sewer system (alcantarillado sanitario) pipelines over a property owned by another, for the operation, administration, and maintenance by AyA. It implies permanent and continuous use for the fulfillment of its public purpose, as well as a limit on the exercise of property rights by its owner.
Registered permanent pipeline and passage easement (Servidumbre permanente de tubería y de paso inscrita): Easement (Servidumbre) duly registered over one or several properties in the Property Registry (Registro de la Propiedad).
Sanitary siphon (Sifón sanitario): Underground conduit with three openings through which wastewater (aguas residuales) flows to the tertiary network in operation; the flow originates within the property to which the service will be provided. The section of the siphon (sifón) with two openings is located within the property's boundaries and serves the function of eliminating odors from the sewer system (alcantarillado) entering the interior of the property. The third opening, located in the sidewalk area, is used by the operator for clearing blockages and maintenance towards the connection and tertiary network.
Potable water system: Set of works encompassing the civil and electromechanical components for the abstraction (captación), treatment (potabilización), and distribution of the water service.
Metering system (Sistema de medición): System composed of the water meter (hidrómetro), the protection elements, the set of control mechanisms or valves necessary for operation, maintenance, and data transmission.
Treatment system (potabilización): Physical, chemical, or biological process, the purpose of which is to make water suitable for population use.
Sanitation system: Set of works encompassing at least the civil and electromechanical components necessary for the collection, treatment, and reuse of ordinary-type wastewater (aguas residuales). This concept does not include individual wastewater (aguas residuales) treatment and disposal systems (sistemas particulares).
Treatment system (Sistema de tratamiento): Civil works in which physical, chemical, and biological processes are carried out, the purpose of which is to improve the quality of the raw collected wastewater (aguas residuales crudas) before its disposal into a receiving body.
Internal property systems: Water and sanitation systems located within a property, necessary for the enjoyment of services, and which are under the responsibility of the user.
Private system: Water or sanitation system not administered by AyA or another delegated operator.
Public system: Water or sanitation system administered and operated by AyA or another delegated operator.
Service applicant: Any natural or legal person who has the right to enjoy and dispose of a real property without further limitations than those contained by law, be it a registered property, an unregistered property, as well as properties under concessions, assignments, and leases given under the modality of special lands administered by the State through its institutions with a Special Legal Regime (Régimen Jurídico Especial).
Connection requests: Formalism, petition, or procedure carried out by the interested party to obtain a service for their enjoyment.
Service suspension: Action allowing the interruption of the continuity of the water supply service, due to non-payment, at the request of the user, or for reasons inherent to the operation of the service.
Tariff: List or catalog of prices to be paid for the provision of a service, approved by ARESEP.
Technically feasible for the granting of a service: A service is considered technically feasible when it meets the following conditions:
1. The distribution and collection networks pass in front of the property boundaries (linderos) or have direct access via a public road or passage easement (servidumbre de paso) of the property for which the service is requested.
2. The systems have sufficient water, hydraulic, treatment (potabilización), and treatment capacity to grant new services.
3. The system meets the established quality attributes.
4. It is legally and environmentally possible.
5. The applicants meet the established administrative requirements.
Consumption unit: Each of the residential, commercial, industrial, or other units that have their own water and sanitary sewer system (alcantarillado sanitario) installations and receive the services provided by the service provider.
Housing development (Urbanización): The subdivision (fraccionamiento) and enabling (habilitación) of land for urban purposes, through the opening of streets and provision of services.
Water use: Destination that the user gives to the water service.
User: Natural and/or legal person who legitimately uses the services provided by AyA or by the operators of the delegated systems.
Sale of water by volume for mobile means: Modality of water sale in a determined volume, through mobile means; for example, tanker trucks (camiones cisterna), boats, and aircraft.
Deficit zone (Zona deficitaria): Corresponds to the territorial area delimited by the coverage zone of a legally constituted operating entity (ente operador), empowered to operate and administer aqueduct and sanitary sewer system (alcantarillado sanitario) services, where the water or hydraulic conditions of the existing systems prevent meeting the demand and the optimal provision of services for existing users, and where the issuance of positive availability certificates (constancias de disponibilidades positivas) or the incorporation of new services for urban developments would negatively impact or increase the deficit or the quality of service to the detriment of the served community or potential new users. This type of zone will have a temporary condition, defined by a technical study detailing the technical and operational insolvency of the real and current capacity of one, the other, or both administered systems. This temporality will be subject to the execution of works that resolve the needs of the zone. In this type of zone, only services for individual housing units (vivienda individual) and individual commerce (comercio individual) resulting from the application of the concept of "maximum development of growth" (desarrollo máximo de crecimiento) will be approved.
Maritime-terrestrial zone (Zona marítimo terrestre): A strip two hundred meters wide along the entire length of the Atlantic and Pacific coasts of the Republic, whatever their nature, measured horizontally from the ordinary high tide line (línea de la pleamar ordinaria) and the lands and rocks left uncovered by the sea at low tide, according to Ley Sobre la Zona Marítimo Terrestre, No. 6043 and its eventual reforms.
For all legal purposes, the maritime-terrestrial zone (zona marítimo terrestre) includes the maritime islands, islets, and rocks, as well as any land or natural formation that protrudes above the ocean level within the territorial sea of the Republic. Excepted is Isla del Coco, which will be under the direct domain and possession of the State, and those other islands whose domain or administration is determined in this law or in special laws, in accordance with Law No. 6043 and its eventual reforms.
Restriction zone (Zona de restricción): Corresponds to the territorial area delimited by the water or hydraulic conditions of the existing systems that prevent meeting the demand and the optimal provision of services, geomorphological conditions or risk zones, protection zones, protected areas, or State heritage reserves where, by legal or territorial planning provisions at the local, regional, or national level, the provision of aqueduct or sanitary sewer system (alcantarillado sanitario) services, or both, cannot be enabled by a legally constituted operating entity (ente operador) empowered to operate and administer these services. Likewise, this zone classification will integrate those areas or coverages that present deficient systems upon which potable water and/or sanitary sewer system (alcantarillado sanitario) services should no longer be approved, due to the lack of water and hydraulic capacity. An express declaration of this type of zone by the Board of Directors (Junta Directiva) of AyA through a Board of Directors Agreement (Acuerdo de Junta Directiva) will be required, which must be published in the Official Gazette La Gaceta (Diario Oficial La Gaceta).
