(ESPH, S.A.) AND THE SERVICIO NACIONAL DE AGUAS SUBTERRÁNEAS, RIEGO Y AVENAMIENTO (SENARA).

I- On July 27, 2012, through official letter DFOE-EC-0393, the Contraloría General de la República, indicated regarding the regulatory fee (canon) concept: "(.) This Contraloría General warns ARESEP of the obligation that, prior to collecting it, it must be effectively incorporated into the tariff charged by the companies providing the regulated service to their end users, considering that those entities authorized to provide the service are merely collectors of the regulatory fee (canon), and therefore it must be neutral with respect to their financial situation (.)." II- On November 28, 2019, through official letter OF-1066-IA-2019, the Water Intendency recommended to the Department of Document Management the opening of an administrative file, to apply ex officio an extraordinary adjustment in the amount of the regulatory fees (cánones de regulación) for the year 2020, to the Instituto Costarricense de Acueducto y Alcantarillado (AyA), to the Empresa de Servicios Públicos de Heredia, S.A. (ESPH, S.A) and to the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), corresponding to the public services of water supply (acueductos), sewerage (alcantarillados), hydrants, irrigation (riego), and fish farming (piscicultura). Likewise, it requested the Dirección General de Atención al Usuario (DGAU) to call for a public hearing to present the referenced ex officio extraordinary tariff study. (Folio 01).

III- The Regulatory Authority published the call for a public hearing in the following newspapers: La Extra and La Teja of December 6, 2019 and in Supplement (Alcance) No. 272 of La Gaceta No. 233 of December 6, 2019. (Folio 21).

IV- The public hearing concluded on December 11, 2019, at 12:00 hours. According to report No. IN-2257-DGAU-2019 of the Direccion General de Atención al Usuario, no oppositions or coadjuvancies were received. (The same is attached to the record).

V- On December 12, 2019, through official letter OF-1125-IA-2019, the Water Intendency issued the report titled "Extraordinary adjustment to the tariff due to the regulatory fees (cánones) for the public services of Water Supply (Acueducto), Sewerage (Alcantarillado), Hydrants, Irrigation (Riego) and Fish Farming (Piscicultura) for the year 2020. File ET-104-2019". (The same is attached to the record).

VI- The prescriptions of the Law have been complied with in terms of deadlines and procedures.

WHEREUPON I- From official letter OF-1125-IA-2019 of December 12, 2019, which serves as the basis for this resolution and will be notified to the parties, it is appropriate to extract the following conclusions and recommendations:

"(.) IV. Conclusions 1- The Contraloría General de la República, through official letter DFOE-ED-0564 of July 30, 2010, orders that ARESEP must adjust, in the same execution period of each regulatory activity, the corresponding regulatory fee (canon) for the regulated activities, as approved.

2- Upon reviewing the amount authorized by the Contraloría General de la República in the estimates of the regulatory fee (canon por regulación) for the year 2020, it was determined that AyA's revenues would require a tariff decrease for the water supply (acueductos) and sewerage (alcantarillado) services of 0.34% and 0.37%. With respect to ESPH, S.A., revenue needs would increase by 0.08% for both services, water supply (acueducto) and sewerage (alcantarillado).

3- In order to consider the adjustment, which are reductions in the regulatory fee (canon de regulación) of AyA for the water supply (acueducto) and sewerage (alcantarillado) services, these will be adjusted ordinarily in their tariff studies during the year 2020 or ex officio extraordinarily, given that the water resource protection tariff is in process under file ET-087-2019.

4- For the hydrant service provided by AyA, the tariff must be reduced in the month of January 2020. The hydrant tariff for the metered service changes from ₡26 to ₡24.1 per cubic meter and for the fixed service from ₡555 to ₡515.4 colones.

5- For the hydrant service provided by ESPH S.A., the tariff must be increased in the month of January 2020. The hydrant tariff for the metered service changes from ₡25.81 to ₡26.83 per cubic meter and for the fixed service from ₡617.83 to ₡642.29.

6- For the irrigation (riego) and fish farming (piscicultura) service, the tariff must be increased by 8.29% based on calculations made on the basis of the 2019 crop and will be in effect for the entire year of 2020.

V. Recommendations

1. Do not adjust the water supply (acueducto) and sewerage (alcantarillado) tariffs of AyA; rather, this will be done during the year 2020.

2. Set an increase of 1.10% for the water supply (acueducto) service and 0.94% for the sewerage (alcantarillado) service in all categories—on this occasion it was made generic and not only for high consumption—provided by ESPH, S.A., starting from the month of January 2020.

3. These tariffs are in effect from January 1, 2020, until January 31, 2020. Starting from February 1, 2020, the tariffs set by resolution RIA-006-2015 of July 9, 2015, published in La Gaceta No. 135 of July 14, 2015, and resolution RIA-003-2015 of March 19, 2015, published in La Gaceta No. 61 of March 27, 2015, will apply again.

4. Set the following tariffs for the hydrant service supplied by AyA and ESPH S.A. For AyA, for the metered service, ₡24.1 colones per cubic meter, and for the fixed service, ₡515.40. For ESPH, S.A., for the metered service, ₡26.83 per cubic meter, and for the fixed service, ₡642.29.

5. For the hydrant service supplied by AyA and ESPH, S.A., the indicated tariffs will be for the month of January 2020. Starting from February 1, 2020, the tariffs established in resolution RIA-002-2016 of February 3, 2016, published in La Gaceta No. 28 of February 10, 2016, will apply again for AyA; and for ESPH, resolution RIA-005-2015 of April 24, 2015, published in La Gaceta No. 82 of April 29, 2015, in Supplement (Alcance) No. 28, will apply.

6. Set for the irrigation (riego) and fish farming (piscicultura) services of SENARA a tariff of ₡2.61 per cubic meter for all its users; it will apply during the months of January to December 2020. On January 1, 2021, the tariffs set by resolution RIA-009-2015 of September 8, 2015, published in La Gaceta No. 180 of September 16, 2015, or the one in effect at that date, will apply again (.)." II- Also, in official letter OF-1125-IA of December 12, 2019, which serves as the basis for this resolution, no oppositions or coadjuvancies were received.

III- In accordance with the preceding whereas and whereupon clauses and with the merit of the record, it is appropriate to make the ex officio extraordinary tariff adjustment due to the calculation of the regulatory fees (cánones de regulación) for the year 2020, for the public services of water supply (acueducto), sewerage (alcantarillado), hydrants, irrigation (riego) and fish farming (piscicultura) provided by AyA, ESPH S.A. and SENARA, as ordered.

Based on the powers conferred by Law No. 7593 and its reforms, by the General Public Administration Law No. 6227, by Executive Decree 29732-MP, which is the Regulation to Law No. 7593, and by the Internal Regulation of Organization and Functions of the Autoridad Reguladora de los Servicios Públicos and its Deconcentrated Bodies, THE WATER INTENDANT

I.Set the following tariffs for the water supply (acueducto) and sewerage (alcantarillado) services provided by the Empresa de Servicios Públicos de Heredia, S.A.:

These tariffs are in effect from January 1, 2020, until January 31, 2020. Starting from February 1, 2020, the tariffs set by resolution RIA-006-2015 of July 9, 2015, published in La Gaceta No. 135 of July 14, 2015, and resolution RIA-003-2015 of March 19, 2015, published in La Gaceta No. 61 of March 27, 2015, will apply again.

II. Set the following tariffs for the hydrant service supplied by AyA and ESPH S.A

-For AyA, for the metered service, the tariff will be ₡24.1 per cubic meter, and for the fixed service, it will be ₡515.40.

-For ESPH, S.A., for the metered service, the tariff will be ₡26.83 per cubic meter, and for the fixed service, it will be ₡642.29.

The indicated tariffs will be in effect for the month of January 2020. Starting from February 1, 2020, the tariffs established in resolution RIA-002-2016 of February 3, 2016, published in La Gaceta No. 28 of February 10, 2016, will apply again for AyA; and for ESPH, resolution RIA-005-2015 of April 24, 2015, published in La Gaceta No. 82 of April 29, 2015, in Supplement (Alcance) No. 28, will apply.

III.Set for the irrigation (riego) and fish farming (piscicultura) services supplied by SENARA a tariff of ₡2.61 per cubic meter for all its users; it will be in effect for the months of January to December 2020. On January 1, 2021, the tariffs set in resolution RIA-009-2015 of September 8, 2015, published in La Gaceta No. 180 of September 16, 2015, or the one in effect at that date, will apply again.

In compliance with what is ordered by Article 245 in relation to Article 345 of the General Public Administration Law, it is reported that against this resolution the ordinary remedies of revocation and appeal, and the extraordinary remedy of review, are applicable.

The revocation remedy may be filed before the Water Intendant, who is responsible for resolving it; the appeal and review remedies may be filed before the Board of Directors, which is responsible for resolving them.

In accordance with Article 346 of the General Public Administration Law, the remedies of revocation and appeal must be filed within a period of three days counted from the business day following that of notification, and the extraordinary remedy of review, within the deadlines set forth in Article 354 of the aforementioned Law.

IV. Notify together with this resolution the report OF-1125-IA-2019 of December 12, 2019

en la totalidad del texto - Texto Completo Norma 0004 Ajuste extraordinaria tarifario por efecto del cálculo de los cánones de regulación para el año 2020, para los servicios de acueducto, alcantarillado, hidrante, riego y piscicultura prestados por el AyA, la ESPH, y SENARA Texto Completo acta: 1330F1 INTENDENCIA DE AGUA RESOLUCIÓN RE-0004-IA-2019 del 12 de diciembre de 2019 CONOCE EL INTENDENTE DE AGUA LA SOLICITUD DE AJUSTE EXTRAORDINARIO TARIFARIO POR EFECTO DEL CÁLCULO DE LOS CÁNONES DE REGULACIÓN PARA EL AÑO 2020, PARA LOS SERVICIOS PUBLICOS DE ACUEDUCTO, ALCANTARILLADO, HIDRANTES, RIEGO Y PISCICULTURA PRESTADOS POR EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO (AyA), LA EMPRESA DE SERVICIOS PÚBLICOS DE HEREDIA, S.A. (ESPH, S.A.) Y EL SERVICIO NACIONAL DE AGUAS SUBTERRÁNEAS, RIEGO Y AVENAMIENTO (SENARA).

I- El 27 de julio de 2012, mediante el oficio DFOE-EC-0393, la Contraloría General de la República, indicó en cuanto a la figura del canon: "(.) Esta Contraloría General advierte a la ARESEP, la obligación de que, previo a realizar el cobro, éste se encuentre incorporado efectivamente en la tarifa que cobran las empresas que brindan el servicio regulado a sus usuarios finales, considerando que esas entidades autorizadas para prestar el servicio no son más que recaudadores del canon, por lo que este debe ser neutro respecto de su situación financiera (.)".

II- El 28 de noviembre de 2019, mediante el oficio OF-1066-IA-2019, la Intendencia de Agua recomendó al Departamento de Gestión Documental la apertura de un expediente administrativo, para la aplicar de oficio un ajuste extraordinario en el monto de los cánones de regulación para el año 2020, al Instituto Costarricense de Acueducto y Alcantarillado (AyA), a la Empresa de Servicios Públicos de Heredia, S.A. (ESPH, S.A) y al Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), correspondiente a los servicios públicos de acueductos, alcantarillados, hidrantes riego y piscicultura. Asimismo, solicitó a la Dirección General de Atención al Usuario (DGAU), la convocatoria a consulta pública para exponer el estudio extraordinario tarifario de oficio de referencia. (Folio 01).

III- La Autoridad Reguladora publicó la convocatoria a consulta pública en los siguientes periódicos: La Extra y La Teja del 06 de diciembre del 2019 y en el Alcance N°272 de La Gaceta Nº233 del 06 de diciembre del 2019. (Folio 21).

IV- La consulta pública finalizó el 11 de diciembre del 2019 a las 12:00 horas. Según el informe de la Direccion General de Atención al Usuario N°IN-2257- DGAU-2019, no se recibieron oposiciones ni coadyuvancias. (Mismo que corre agregado a los autos).

V- El 12 de diciembre de 2019, mediante el oficio OF-1125-IA-2019, la Intendencia de Agua emitió el informe denominado "Ajuste extraordinario en la tarifa por efecto de los cánones de los servicios públicos de Acueducto, Alcantarillado, Hidrantes, Riego y Piscicultura para el año 2020. Expediente ET-104-2019". (Mismo que corre agregado a los autos).

VI- En los plazos y procedimientos se han cumplido las prescripciones de Ley.

I- Del oficio OF-1125-IA-2019 del 12 de diciembre de 2019, que sirve de base a esta resolución y que será notificado a las partes, conviene extraer las siguientes conclusiones y recomendaciones:

"(.) IV. Conclusiones 1- La Contraloría General de la República mediante el oficio DFOE-ED-0564 del 30 de julio del 2010, dispone que la ARESEP deberá ajustar en el periodo mismo de ejecución en cada actividad de regulación el canon correspondiente a las actividades reguladas, según lo aprobado.

2- Al revisar el monto autorizado por la Contraloría General de la República en las estimaciones del canon por regulación para el año 2020, se determinó que los ingresos del AyA requerirían una disminución tarifaria para los servicios de acueductos y de alcantarillado de un 0,34% y 0,37%. Con respecto a la ESPH, S.A. las necesidades de ingresos aumentarían en un 0,08% para ambos servicios, de acueducto y para el servicio de alcantarillado.

3- Con el fin de considerar el ajuste que son rebajas en el canon de regulación del AyA para los servicios de acueducto y alcantarillado estas serán ajustadas en el año 2020 de forma ordinaria en sus estudios tarifarios o de oficio extraordinariamente, esto por estar en trámite la tarifa de protección del recurso hídrico ET-087-2019.

4- Para el servicio de hidrantes brindado por el AyA, se debe rebajar la tarifa en el mes de enero de 2020. La tarifa de hidrantes para el servicio medido pasa de ₡26 a ₡24,1 por metro cúbico y en servicio fijo de ₡555 a ₡515,4 colones.

5- Para el servicio el servicio de Hidrantes brindado por la ESPH S.A, se debe aumentar la tarifa en el mes de enero de 2020.La tarifa de hidrantes para el servicio medido pasa de ₡25,81 a ₡26,83 por metro cúbico y para el servicio fijo de ₡617,83 a ₡642,29.

6- Para el servicio de riego y piscicultura la tarifa debe aumentarse en un 8,29% con fundamento en los cálculos realizados con base al cultivo del 2019 y estará vigente para todo el año de 2020.

V. Recomendaciones

1. No ajustar las tarifas de acueducto y alcantarillado del AyA, sino que se hará durante el año 2020.

2. Fijar un aumento del 1,10% para el servicio de acueducto y del 0,94% para el servicio de alcantarillado en todas las categorías, en esta ocasión se hizo genérico ya no en los consumos altos; brindado por la ESPH, S.A, a partir del mes de enero 2020.

3. Estas tarifas rigen a partir del 1 de enero de 2020 hasta el 31 de enero de 2020. A partir del 01 de febrero de 2020, se volverán a aplicar las tarifas fijadas según la resolución RIA-006-2015 del 09 de julio del 2015, publicada en La Gaceta Nº135, del 14 de julio del 2015 y la resolución RIA-003-2015 del 19 de marzo del 2015, publicada en La Gaceta Nº61, del 27 de marzo del 2015.

4. Fijar las siguientes tarifas para el servicio de hidrantes suministrado por el AyA y la ESPH S.A. Para el AyA en el servicio medido, ₡24,1 colones por metro cúbico y para el servicio fijo ₡515,40. Para la ESPH, S.A, en el servicio medido ₡26,83 por metro cúbico y para el servicio fijo ₡642,29.

5. Para el servicio de hidrantes suministrado por el AyA y la ESPH, S.A. las tarifas indicadas serán para el mes de enero 2020. A partir del 01 de febrero de 2020 se volverán a aplicar las tarifas establecidas en la resolución RIA-002-2016 del 03 de febrero del 2016, publicada en la Gaceta N°28 del 10 de febrero del 2016 para AyA; y para la ESPH aplicará la resolución RIA-005-2015 del 24 de abril de 2015, publicada en la Gaceta N°82 del 29 de abril de 2015 en el alcance N°28.

6. Fijar para los servicios de riego y piscicultura del SENARA una tarifa de ₡2,61 por metro cubico para todos sus usuarios, aplicara en los meses de enero a diciembre 2020. El 01 de enero 2021 se volverán a aplicar las tarifas fijadas según la resolución RIA-009-2015 del 8 de setiembre de 2015, publicada en La Gaceta N°180 del 16 de septiembre del 2015, o la que esté vigente a esa fecha(.)".

II- También, en el en el oficio OF-1125-IA del 12 de diciembre de 2019, que sirve de base a esta resolución, no se recibieron oposiciones ni coadyuvancias.

III- De conformidad con los resultandos y considerandos que preceden y de acuerdo con el mérito de los autos, lo procedente es realizar el ajuste extraordinario tarifario de oficio por efecto del cálculo de los cánones de regulación para el año 2020, para los servicios públicos de acueducto, alcantarillado, hidrantes, riego y piscicultura que prestan el AyA, la ESPH S.A. y SENARA, tal y como se dispone.

Con fundamento en las facultades conferidas en la Ley N° 7593 y sus reformas, en la Ley General de la Administración Pública N° 6227, en el Decreto Ejecutivo 29732-MP, que es el Reglamento a la Ley N° 7593, y en el Reglamento Interno de Organización y Funciones de la Autoridad Reguladora de los Servicios Públicos y sus Órganos Desconcentrados, El INTENDENTE DE AGUA

I.Fijar para los servicios de acueducto y de alcantarillado que brinda la Empresa de Servicios Públicos de Heredia, S.A., las siguientes tarifas:

Estas tarifas rigen a partir del 1 de enero de 2020 hasta el 31 de enero de 2020. A partir del 01 de febrero de 2020, se volverán a aplicar las tarifas fijadas según la resolución RIA-006-2015 del 09 de julio del 2015, publicada en La Gaceta Nº135, del 14 de julio del 2015 y la resolución RIA-003-2015 del 19 de marzo del 2015, publicada en La Gaceta Nº61, del 27 de marzo del 2015.

II. Fijar las siguientes tarifas para el servicio de hidrantes suministrado por el AyA y la ESPH S.A

-Para AyA en el servicio medido la tarifa será de ₡24,1 por metro cúbico y para el servicio fijo será de ₡515,40.

-Para la ESPH, S.A en el servicio medido la tarifa será de ₡26,83 por metro cúbico y para el servicio fijo será de ₡642,29.

Las tarifas indicadas regirán para el mes de enero 2020. A partir del 01 de febrero de 2020, se volverán a aplicar las tarifas establecidas en la resolución RIA-002-2016 del 03 de febrero del 2016, publicada en la Gaceta N°28 del 10 de febrero del 2016 para AyA; y para la ESPH aplicará la resolución RIA-005-2015 del 24 de abril de 2015, publicada en la Gaceta N°82 del 29 de abril de 2015 en el alcance N°28.

III.Fijar para los servicios de riego y piscicultura suministrados por el SENARA una tarifa de ₡2,61 por metro cúbico para todos sus usuarios; regirán en los meses de enero a diciembre 2020. El 01 de enero 2021 se volverán a aplicar las tarifas fijadas en la resolución RIA-009-2015 del 8 de setiembre de 2015, publicada en La Gaceta N°180 del 16 de septiembre del 2015, o la que esté vigente a esa fecha.

En cumplimiento de lo que ordena el artículo 245 en relación con el 345 de la Ley General de la Administración Pública, se informa que contra esta resolución caben los recursos ordinarios de revocatoria y de apelación y el extraordinario de revisión.

El de revocatoria podrá interponerse ante el Intendente de Agua, a quien corresponde resolverlo; el de apelación y el de revisión podrán interponerse ante la Junta Directiva, a la que corresponde resolverlos.

De conformidad con el artículo 346 de la Ley General de Administración Pública, los recursos de revocatoria y el de apelación deberán interponerse en el plazo de tres días contados a partir del día hábil siguiente al de notificación, y el extraordinario de revisión, dentro de los plazos señalados en el artículo 354 de la citada Ley.

IV. Notificar junto con esta resolución el informe OF-1125-IA-2019 del 12 de diciembre de 2019
