For the purposes of this Regulation, the following shall be understood as:
Subscriber (Abonado): Natural or legal person in whose name the service provided by the provider is registered. (Amended by the Board of Directors of ARESEP, according to resolution Nº RJD-053-2016, published in Supplement 55, La Gaceta Nº 69 of April 12, 2016) Collective supply (Abastecimiento colectivo): When from one connection, water is provided to more than one consumption unit.
Individual supply (Abastecimiento individual): When from one connection, water is provided to a single consumption unit.
Universal access (Acceso universal): Effective right of access to a public service provided by a provider within its territorial jurisdiction under optimal provision conditions.
Water connection (Acometida de agua): Length of pipe installed from the distribution network to the installation point of the service connection; it reaches the property line.
Sanitary sewerage connection (Acometida de alcantarillado sanitario): Length of pipe installed from the collection network to the outlet fitting of the siphon box.
Aqueduct (Acueducto): The set of sources, purification plants, storage tanks, transmission and distribution networks, and other elements necessary for the supply of water to a population.
Gauging (Aforo): Measurement of flow.
Pollutant agent (Agente contaminante): Any substance or element whose incorporation into water leads to the deterioration of its physical, chemical, or biological quality.
Drinking water (Agua potable): Treated water that meets the provisions of recommended or maximum permissible aesthetic, organoleptic, physical, chemical, biological, and microbiological values, established in the Drinking Water Quality Regulation.
Stormwater (Agua pluvial): Rainwater that, instead of being infiltrated, flows over the surface of the land finally reaching a body of water.
Wastewater (Agua residual): Water that has received a use and has been contaminated with organic matter, chemical substances, or suspended solids. To be received into the public sanitary sewerage system, it must comply with the environmental regulations issued by other competent authorities.
Special type wastewater (Agua residual de tipo especial): Wastewater of a type different from ordinary.
Ordinary type wastewater (Agua residual de tipo ordinario): Wastewater generated by domestic activities of humans (use of toilets, showers, sinks, dishwashers, laundry, etc.).
Billing adjustment (Ajuste a la facturación): Modification to the invoiced amounts when a high consumption occurs.
Storm sewer (Alcantarillado pluvial): Public network of pipes used to collect and transport rainwater to its discharge point.
Sanitary sewerage or sanitary sewerage system (Alcantarillado sanitario o sistema de alcantarillado sanitario): System whose objective is to collect, convey, and treat wastewater; as well as the sanitary disposal of the resulting water and sludge. It includes the receiving body and physical infrastructure works. It consists of the following stages:
a-. Collection; b.- Treatment (Environmental management, and final disposal of water and residual sludge); and c-. Commercialization (Measurement of consumption, billing, collection, and activities related to subscriber service).
Payment arrangement (Arreglo de pago): The commitment acquired by the liable party with the Municipality to pay the expired obligation owed to the Municipality within the time agreed by both, which may not exceed six months, with the exceptions provided in the Regulation for the Administrative, Extrajudicial, and Judicial Collection Procedure of the Municipality of Santo Domingo de Heredia.
Approval of works (Aprobación de obras): Action resulting from validating a water or sanitation work or infrastructure; constructed by a private party, once technical and legal compliance with the requested requirements has been verified.
Biosolids (Biosólidos). Sludge that has been subjected to treatment processes and that, due to its organic matter content, nutrients, and characteristics acquired after treatment, can be utilized.
Special biosolids (Biosólidos especiales). Treated special sludge.
Ordinary biosolids (Biosólidos ordinarios): Treated ordinary sludge.
Sanitary biosolids (Biosólidos sanitarios). Treated sanitary sludge.
Septic biosolids (Biosólidos sépticos). Treated septic sludge.
Fecal Coliforms (Coliformes Fecales). Bacteria present in the intestine of warm-blooded animals. Non-spore-forming gram-negative short bacilli, also known as thermotolerant coliforms. Correspond to the genera: Escherichia, Klebsiella, Enterobacter, and Citrobacter.
Quality (Calidad): Set of attributes held by public services that allows them to be provided continuously, timely, regularly, swiftly, effectively, and efficiently; which confers suitability to satisfy human needs.
Water quality (Calidad del agua): Set of physical, chemical, biological, and organoleptic attributes assigned to water based on its use and that are required for the protection of human health, both for human consumption and for recreational and productive uses.
Service quality (Calidad del servicio): Overall effect of the provision of a service that determines the degree of satisfaction of the subscriber's or user's needs.
Siphon Box (Caja Sifón): Underground container generally built on the sidewalk and used to interconnect the wastewater coming from the property with the operating sanitary collection network. It also fulfills the function of eliminating odors towards the interior of the property, as well as facilitating unblocking tasks.
Street or public way (Calle o vía pública): Any access in the domain of the collectivity for the free transit of people and/or vehicles.
Hydraulic capacity (Capacidad hidráulica): Corresponds to the condition of the installed infrastructure of the supply and sewerage systems to convey the flows for the provision of services.
Water resource capacity (Capacidad hídrica): Existing condition of technical and administrative feasibility for the production and exploitation of drinking water for supply by the Municipality of Santo Domingo.
Collection capacity (Capacidad de recolección): Existing condition of technical and administrative feasibility for the collection, treatment, and disposal of wastewater for sanitation by AMSDH.
Certificate of service availability (Constancia de disponibilidad de servicios): Document issued by the operating entity with the purpose of certifying to the interested party the actual existence on a property of the water resource capacity, hydraulic capacity, as well as collection and treatment capacity, that allows the eventual request for drinking water supply, collection, and treatment of wastewater services; without causing detriment to the rights of existing users.
Certificate of water availability (Constancia de disponibilidad de agua): Document issued by the operating entity in the event of a denial of service availability, which certifies that the aqueduct has real water resource capacity and the potential availability of the water supply service to the property; subject to the construction by the interested party of the infrastructure indicated in this document.
Certificate of sewerage capacity (Constancia de capacidad de saneamiento): Document issued by the operating entity in the event of a denial of service availability, which certifies that the sanitary sewerage system has the capacity for the availability of the collection, treatment, and disposal service to the property; subject to the construction by the interested party of the infrastructure indicated in this document.
Connection (Conexión): Union of the public drinking water supply or sanitary sewerage system with the private system.
Cross connections (Conexiones cruzadas): Interconnection of systems (water, wastewater, storm drainage water, non-potable industrial water, or others) that put the water system, the integrity of the sewerage system, and the stormwater system at risk of contamination.
Fraudulent connection (Conexión fraudulenta): A connection that, having been suspended, is connected to the water and/or sewerage system without the authorization of the system operator; or that, being active, is detected using a means to falsify the actual consumption of the service.
Unauthorized or illegal connection (Conexión no autorizada o ilícita): Connection made by third parties to the water and/or sewerage system, without the proper authorization of AMSDH.
Consumption (Consumo): The recorded monthly consumption of drinking water, where there is no evidence of illegal connections.
Average consumption (Consumo promedio): The average of the normal consumptions recorded in the last 6 months.
Service continuity (Continuidad del servicio): A quality of the service indicating the time of uninterrupted service during a specific period.
Receiving body (Cuerpo receptor): Any spring, recharge zones, river, creek, permanent or non-permanent stream, lake, lagoon, marsh, natural or artificial reservoir, artificial channel, estuary, mangrove, peatland, swamp, freshwater, brackish, or saltwater, where wastewater is discharged.
Wastewater spill (Derrame de aguas residuales): Outflow of wastewater from the sewerage system.
Availability of water service (Disponibilidad de servicio de agua): Real and current, not future or potential, existence of the necessary overall works and infrastructure and water resource capacity of supply to meet the service needs of a specific population.
Final disposal (Disposición final): Last stage of the sludge management and final disposal process where biosolids are disposed of sanitarily in accordance with what is established in this regulation.
Land application (Disposición en Suelos): Process of incorporating biosolids into the soil for disposal purposes.
Suitable document (Documento idóneo): Reference sketch and location of the property, deed, document proving, confirming, or justifying some information, which must be adjusted to the specific case, in accordance with the application of the principle of reasonableness and logic.
Branch extension (Extensión de ramal): Increase in length of a segment of the aqueduct network and/or the wastewater collection system up to a determined point.
Technical feasibility (Factibilidad técnica): Study to verify that a certain action is possible to carry out under adequate conditions.
Invoice/Bill (Factura): Printed or digital document issued periodically by the operator, showing the concepts, consumption, due date, amounts to be charged for the services rendered, and, among others, information of interest to the user. It may also present information on overdue accounts receivable.
Billing (Facturación): Process by which the concepts, volumes, and amounts to be paid by the user are determined.
Subdivision (Fraccionamiento): The division of any property for the purpose of selling, transferring, negotiating, distributing, exploiting, or using separately, the resulting parcels; it includes both partitions by judicial or extrajudicial adjudication, locations of undivided rights, and mere segregations in the name of the same owner, as well as those located in urbanizations or new constructions that are of interest for the control of the formation and urban use of real estate.
Leak (Fuga): Escape of water in the distribution networks or water installations.
Visible leak (Fuga visible). Leak in the domestic aqueduct, which can be easily determined with the naked eye.....
Invisible leak (Fuga invisible). Leak in the domestic aqueduct, which cannot be easily determined with the naked eye, generally requiring equipment for its detection.
Water meter (Hidrómetro): Device or instrument intended to measure and record the volume of water consumed.
Independence (Independización): The act by which AMSDH, at the request of the interested parties, separates the water or sanitary sewerage services for the properties.
Individualization (Individualización): The act by which AMSDH, at the request of the interested party, separates the water or sanitary sewerage services for each of the consumption units within a single property.
Property (Inmueble): Duly individualized land that consigns one or several owners. Technical inspections for supplies (Inspecciones técnicas por abastecimientos): Review that the operator performs, at the user's request or ex officio, to verify the use of the service and its basic data.
Connection installation (Instalación de conexión): Action that materializes when the connection located on a private property is physically integrated into the sanitary sewerage system of the operator.
Internal installations (Instalaciones internas): Mechanical water supply and sewerage installations located within the property.
Technical inspection (Inspección técnica): Specialized review carried out by AMSDH or the operator regarding the operation and use of the water, sewerage, and metering systems, located on public roads, in easements (servidumbres) of way, or on private properties and buildings (internal systems). Upon prior notification to the owners, possessors, users, administrators, or their representatives.
Interconnection (Interconexión): Connection of new systems, infrastructure, and urban developments that comply with current technical regulations, to the distribution and collection systems operated by MSDH or the operator for the enabling of water and sewerage services.
Property line for water service (Límite de propiedad para el servicio de agua): Corresponds to the part of the boundary of the property or of the access easement to this property, in front of the point where the water meter providing the water service is located. In the case of properties located facing a public road or an easement of way and pipeline, constituted in favor of MSDH, it corresponds to the boundary of the property or the subsidiary property. In the case of properties located facing access easements, it corresponds to the front of this easement with the public road.
Property line for sanitary sewerage service (Límite de propiedad para el servicio de alcantarillado Sanitario): Corresponds to the limit of the public sanitary sewerage service provided by MSDH. It is established at the pipe segment where the manhole with a siphon located on the sidewalk begins; it is understood that the manhole is the property of the service holder, therefore, the maintenance thereof corresponds to the holder.
Sludge (Lodos). Mixture of solids and water by-product of water treatment processes.
Special sludge (Lodos especiales). Sludge generated by the treatment of special type wastewater and that from water purification plants, as well as from the treatment of wastewater and sludge with chemical products such as coagulants, polymers, and flocculants.
Ordinary sludge (Lodos ordinarios). Includes sanitary and septic sludge.
Sanitary sludge (Lodos sanitarios). Sludge generated in an ordinary type wastewater treatment plant.
Septic sludge (Lodos sépticos). Sludge generated in septic tanks.
Sludge management and final disposal (Manejo y disposición final de lodos). Set of operations to which sludge from wastewater treatment plants is subjected, to avoid risks to the health of the population. It includes, among other stages: storage, transport, treatment, and final disposal.
Municipality of Santo Domingo de Heredia (Municipalidad de Santo Domingo de Heredia): The Municipality is a legal person, with a specific territorial jurisdiction of the canton of Santo Domingo, which, for the purposes of this regulation, is responsible for the administration and provision of the public service of sanitary sewerage and wastewater treatment of Los Zamora Urbanization.
Unauthorized water bypass (Paso alterno de agua no autorizado (bypass)): Unauthorized water connection mechanism, used to falsify the consumption recorded by the water meter.
Wastewater Treatment Plant (PTAR) or Sewerage system (Planta de tratamiento de Aguas Residuales (PTAR) o Sistema de saneamiento): Set of works that include at least the civil and electromechanical components necessary to carry out physical, chemical, and biological processes to improve the quality of the wastewater.
Manhole or inspection chamber (Pozo de registro o inspección): Structure with access and cover used for inspection and maintenance of the collection systems. Used when there are changes in direction, slope, or diameter, and at the confluence of several pipes.
Possessor (Poseedor): Person who performs stable and effective acts of possession, peacefully, publicly, and uninterruptedly, as owner for more than one year on properties not registered in the Registro Público.
Stubbed water (Prevista agua): Length of pipe installed from the distribution network to the point for the service connection; reaches the property line, which has not been connected to the internal installations of the property.
Stubbed sanitary sewerage (Previsto alcantarillado sanitario): Length of pipe that is installed from the collection network to serve the property but has not been connected to the siphon box.
Inheritance proceeding (Proceso sucesorio): Legal process whose purpose is the liquidation and partition of the hereditary assets, prior to their determination and that of the persons among whom they are to be distributed.
Owner (Propietario): Natural or legal person who exercises dominion over real estate by public deed, duly registered in the Registro Público.
Urban development project (Proyecto de desarrollo urbanístico): Infrastructure project for urban purposes, built on open spaces (urbanizations, condominiums, shopping centers, residential or office towers, among other infrastructures), intended to meet the needs of the population where water and sewerage services will exist.
Volumetric test (Prueba Volumétrica): Review performed on the water meter to verify the correct recording of the volume of water. Corresponds to the technical procedure by which a water meter is subjected to different water flows, making a comparison between the recorded volume and a reference standard, to obtain the respective error percentages.
Networks (Redes): System of pipes for the distribution of water and the collection of wastewater.
Public network (Red pública): System of water or wastewater collection pipes owned by MSDH.
Supply service (Servicio de abastecimiento): Corresponds to the supply of water for human consumption provided by AMSDH; also called water service.
Sanitation service (Servicio de saneamiento): Corresponds to the collection, treatment, and disposal of wastewater.
Equivalent service (Servicio equivalente): Corresponds to the water consumption or wastewater contribution of a single-family dwelling. The water consumption or wastewater contribution, that is not for a single-family dwelling, shall be determined by the equivalence table defined in the procedures manual.
Hydrant service (Servicio de hidrantes): Maintenance, operation, and development of hydrant networks for firefighting, at the service of the Fire Department.
Provisional service (Servicio provisional): Service that, due to the nature of the activity, is provided for a specific period and will later become a permanent service.
Temporary service (Servicio temporal): Service that, due to the nature of the activity, is provided for a specific period.
Public servant (Servidor público): That individual who provides services to the Public Administration or on behalf and on account of it, as part of its organization, by virtue of a valid and effective act of investiture.
Public access easement (Servidumbre de acceso público): Real right of entry or transit of pedestrians and/or vehicles in favor of public entities and on a property owned by another. It implies for its owner a limitation on the full exercise of the attributes of the property right, without the portion of land losing its private property status.
De facto easement (Servidumbre de hecho): That established on a property by force of use and custom, tolerated by the owner of the asset, without legal imposition or a formal act of constitution by public deed.
Private way easement (Servidumbre de paso privada): Real right of entry and transit of pedestrians and/or vehicles for the benefit of one or several properties, and on a property owned by another. It implies for its owner a limitation on the full exercise of the attributes of the property right, without the portion of land losing its private property status.
Pipeline and way easement (Servidumbre de paso y tubería): Real right to install water and/or sanitary sewerage pipe on a property owned by another, for the operation, administration, and maintenance by MSDH. It implies a permanent and continuous utility of access for the fulfillment of its public purpose, as well as a limit on the exercise of the property right by its owner.
Registered pipeline and way easement (Servidumbre de paso y tubería inscrita): An easement that is duly registered over one or several properties in the Property Registry.
Treatment system (Sistema de tratamiento): Set of physical, chemical, or biological processes, whose purpose is to improve the quality of raw wastewater before its disposal.
Internal property systems or domestic sanitary system (Sistemas internos de la propiedad o sistema sanitario domiciliar): The internal network and installations, both of water and sanitary sewerage, that are within a property.
Private system (Sistema privado): Set of water and sanitary sewerage installations that is not administered by MSDH.
Public system (Sistema público): Set of water and sanitary sewerage installations administered and operated by MSDH.
Connection applications (Solicitudes de conexión): Formalities, petitions, or procedures made by the interested party to obtain a service for their enjoyment.
Service suspension (Suspensión del servicio): Action that allows for the interruption of the provision of water supply services, due to improper use, lack of payment, or for reasons inherent to the operation of the service.
Rate (Tarifa): List or catalog of prices that must be paid for the provision of a service.
Consumption unit (Unidad de consumo): Each of the buildings (dwelling and commerce that generates ordinary type water), which has its own water and sanitary sewerage installations and receives the services provided by the service provider.
Urbanization (Urbanización): Subdivision and enabling of land for urban purposes, through the opening of streets and provision of services.
Water use (Uso de agua): Destination that the user gives to the water service.
User (Usuario): Natural and/or legal person who legitimately uses the services provided by MSDH or the operator of the delegated systems.
Discharge (Vertido): The final discharge of an effluent into a receiving body or sanitary sewerage system.
