2 SCOPE Applies to all interested parties who request from ECA the recognition of the equivalence of the accreditation certificate granted by an accreditation body (organismo de acreditación, OA) signatory to a Multilateral Recognition Agreement (IAF- MLA / ILAC - MRA).

3 DEFINITIONS - ECA: Ente Costarricense de Acreditación.

- Equivalence of the accreditation certificate: Acceptance of the similarity of the activities within the scope of accreditation issued by an OA with a Multilateral Recognition Agreement.

- IAAC: Interamerican Accreditation Cooperation.

- IAF: International Accreditation Forum.

- ILAC: International Laboratory Accreditation Cooperation.

- Interested party: User of the accreditation services of an accredited conformity assessment body (Organismo de Evaluación de la Conformidad, OEC) with a multilateral recognition agreement or an OEC accredited with a multilateral recognition agreement.

- Verifier (Verificador): Assistant for conformity assessment procedures.

- MLA: Multilateral Recognition Agreement - IAF.

- MRA: Multilateral Recognition Agreement - ILAC.

- OA: Accreditation Body (Organismo Acreditador).

- OEC: Conformity Assessment Bodies (Organismos de Evaluación de la Conformidad) (laboratories, inspection bodies, or certification bodies).

- SA: Accreditation Secretariat (Secretaría de Acreditación).

4 GENERAL INFORMATION 4.1.1 The recognition of the equivalence of the accreditation certificate is granted upon the express request of the interested party with a validity of:

− 3 calendar months.

− 12 calendar months.

ECA carries out periodic reviews of the recognitions granted for more than three months, to confirm that the status under which the OEC was recognized is maintained; the accreditation certificate.

In cases where the validity of the accreditation or in cases of system or product certifications, if the term is less than those indicated, the recognition will be granted for the term indicated in the accreditation documents.

4.1.2 Interested parties may request recognition of the equivalence of the accreditation certificate in the scopes with a Multilateral Recognition Agreement in ILAC or IAF.

4.1.3 Any interested party wishing to obtain the recognition of the equivalence of the accreditation certificate must comply with the provisions of this document and the requirements of the standards or accreditation guides in their current version. This includes adapting to changes that ECA publishes in subsequent versions.

4.1.4 All information provided to ECA is treated confidentially. ECA keeps all applications submitted securely safeguarded.

4.1.5 Only accreditations granted by an OA that is a signatory to the MLA or MRA with ILAC, IAF, or IAAC are recognized.

4.1.6 The submission of an application does not imply the obtainment of the recognition of the equivalence of the accreditation certificate.

4.1.7 Once the validity of the recognition of the equivalence of the accreditation certificate has expired, ECA does not guarantee that the OEC's accreditation issued by an OA remains valid.

4.1.8 In cases where it is not possible to issue the recognition of the equivalence of the accreditation certificate, whether due to non-compliance with the notifications made or because the verification of the information is negative, ECA will not reimburse the cost of submitting the application.

4.1.9 Once the validity of the recognition has ended and if the interested party needs to maintain its validity, they must initiate the process for a new recognition of the equivalence of the accreditation certificate, with the corresponding submission of the application and payment of the current fees.

5 REQUIREMENTS FOR THE RECOGNITION OF THE EQUIVALENCE OF THE ACCREDITATION CERTIFICATE.

5.1.1 The accreditation must be granted by an Accreditation Body (Organismo de Acreditación) that is a signatory to the MLA in the scope requested.

5.1.2 The accreditation issued by the OA in the country of origin must be valid at the time of requesting the recognition of the equivalence of the accreditation certificate and without any suspension of the accreditation.

5.1.3 Complete submission of the application for recognition of the equivalence of the accreditation certificate with all required documents.

5.1.4 When the document is issued by an OA in a language other than Spanish or English, an official translation into Spanish must be submitted.

6 GENERAL PROCESS FOR RECOGNITION OF THE EQUIVALENCE OF THE ACCREDITATION CERTIFICATE 6.1.1 The interested party must create a new user on the website: eco.eca.or.cr (only applies the first time), and subsequently must create a new application and complete the required information.

6.1.2 The verifier (Verificador) reviews the payment and the information submitted by the interested party, within a period of 7 business days, which may be extended for an equal period, when it is necessary to verify the content of the information directly with the responsible product certification body or the respective accreditation body, in which case the interested party will be notified.

6.1.3 If the application is NOT complete, the verifier (Verificador) must send the application back for correction through the digital platform. The interested party must correct the deficiencies found to continue with the process of recognition of the equivalence of the accreditation certificate, and the review of the application restarts.

6.1.5 If the application for recognition of the equivalence of the accreditation certificate is complete, the Verifier (Verificador) confirms the validity of the information within 7 business days, verifying if the accreditation is valid and if it was granted by an OA that is a signatory to the MLA in IAAC, ILAC, or IAF, as applicable.

6.1.6 If during the information verification process the Verifier (Verificador) deems clarifications from the interested party necessary, these are forwarded to the applicant. If the necessary clarifications are not made, the application will be permanently archived.

6.1.7 If the verification performed is positive, within the 7 business days established above, the Verifier (Verificador) completes the form ECA-MC-MA-P05-F03 Recognition of the equivalence of the accreditation certificate and processes the respective signatures.

Note. The recognition of the equivalence of the accreditation certificate must be accompanied by a certified copy of the certificate or report supporting the conformity assessment results, the scope of accreditation of the accreditation body of origin, and the accreditation certificate whenever possible.

6.1.8 Once the information is confirmed, the Verifier (Verificador) forwards the results of the investigation to the Approver, who must proceed with the review within a period of 3 business days.

6.1.9 The Verifier (Verificador) notifies the interested party of the recognition granted and requests payment of the corresponding granting fee.

6.1.10 After the payment of the respective fees, the Approver uploads to the platform eco.eca.or.cr, the recognition of the equivalence of the accreditation certificate.

6.1.11 Periodic reviews are carried out for which the Verifier (Verificador) confirms that the conditions under which the OEC was recognized remain unchanged. The information from these reviews is recorded in ECA-MC-MA-P05-F02 list of recognition of the equivalence of the accreditation certificate.

6.1.12 If during the periodic reviews it is detected that the recognized OEC is suspended, withdrawn, or with its accreditation expired, the recognition granted is immediately cancelled and the interested party is informed.

6.1.13 ECA will make this information public knowledge and will not refund any amount for the remaining term of the recognition granted.

7 LIST OF RECOGNITIONS OF THE EQUIVALENCE OF THE ACCREDITATION CERTIFICATE 7.1.1 ECA maintains the ECA-MC-MA-P05-F02 list of recognition of the equivalence of the accreditation certificate with the following information:

- Recognition Number - Name of the OEC that obtained the accreditation certificate - Scope of the Recognized Accreditation - Date of issuance of the recognition - Validity - (for three months or for twelve months) - Accreditation body issuing the accreditation - Name of the interested party.

- Email address - Dates of review of the maintenance of the recognition 7.1.2 ECA will keep any government entity informed, upon request, of the status of the recognitions of equivalences of the accreditation certificate granted, their validity, and the name of the applicant.

7.1.3 To provide additional information on the recognitions of the equivalences of the accreditation certificate, the interested party must contact the email address [email protected] 8 FEES 8.1 Consult the current fees at the email address [email protected] Note 1: The same fees approved for the evaluation and accreditation process apply.

These are updated automatically every six months, so the fee current at the time of the application will apply.

8.2 The interested party may request the revalidation of the recognition granted by ECA; for this, they must complete the application process again on the website: eco.eca.or.cr and make the corresponding payment for the granting of the recognition under items II or III of table 1, as applicable. Revalidation will be granted provided that the conditions of the initial application are maintained and the accreditations remain valid; therefore, it is not required to pay the application fee again. In the event that the original conditions under which the recognition was granted change, the interested party must pay the application fee.

8.3 ECA may apply discounts on the fees for the recognitions of the accreditation certificate, provided the following conditions are met:

2 ALCANCE Aplica a todos los interesados que soliciten al ECA el reconocimiento de la equivalencia del certificado de acreditación otorgado por un organismo de acreditación signatario de un Acuerdo de Reconocimiento Multilateral (IAF- MLA / ILAC - MRA).

3 DEFINICIONES - ECA: Ente Costarricense de Acreditación.

- Equivalencia del certificado de acreditación: Aceptación de la semejanza de las actividades dentro del alcance de acreditación emitido por un OA con Acuerdo de Reconocimiento Multilateral.

- IAAC: Cooperación Interamericana de Acreditación.

- IAF: Foro Internacional de Acreditación.

- ILAC: Cooperación Internacional de Laboratorios.

- Interesado: Usuario de los servicios de acreditación de un OEC acreditado con acuerdo de reconocimiento multilateral o un OEC acreditado con acuerdo de reconocimiento multilateral.

- Verificador: Asistente para trámites de evaluación de la conformidad.

- MLA: Acuerdo de Reconocimiento Multilateral - IAF.

- MRA: Acuerdo de Reconocimiento Multilateral - ILAC.

- OA: Organismo Acreditador.

- OEC: Organismos de Evaluación de la Conformidad (laboratorios, organismos de inspección u organismos de certificación).

- SA: Secretaría de Acreditación.

4 GENERALIDADES 4.1.1 El reconocimiento de la equivalencia del certificado de acreditación se otorga a solicitud − 3 meses calendario.

− 12 meses calendario.

El ECA realiza revisiones periódicas de los reconocimientos otorgados por más de tres meses, para confirmar que se mantiene el estado bajo el cual el OEC fue reconocido; el certificado de acreditación.

En los casos en que la vigencia de la acreditación o en los casos de certificaciones de sistemas o productos, si el plazo es menor a los indicados, el reconocimiento se otorgará por el plazo indicado en los documentos de acreditación.

4.1.2 Los interesados pueden solicitar reconocimiento de la equivalencia del certificado de acreditación en los alcances con Acuerdo de Reconocimiento Multilateral en ILAC o IAF.

4.1.3 Todo interesado que desee obtener el reconocimiento de la equivalencia del certificado de acreditación debe cumplir lo establecido en este documento y los requisitos de las normas o guías de acreditación en su versión vigente. Esto incluye adaptarse a los cambios que ECA publique con versiones posteriores.

4.1.4 Toda la información suministrada al ECA es tratada de manera confidencial. ECA mantiene todas las solicitudes que se presenten resguardadas de forma segura.

4.1.5 Solamente se reconocen las acreditaciones otorgadas por un OA signatario del MLA o MRA con ILAC, IAF o IAAC.

4.1.6 La presentación de un trámite no implica la obtención del reconocimiento de la equivalencia del certificado de acreditación.

4.1.7 Una vez vencida la vigencia del reconocimiento de la equivalencia del certificado de acreditación, el ECA no garantiza que la acreditación del OEC emitida por un OA se mantenga vigente.

4.1.8 En los casos en que no sea posible emitir el reconocimiento de la equivalencia del certificado de acreditación, sea por incumplimiento de las prevenciones realizadas o porque la verificación de la información resulta negativa, el ECA no reembolsará el costo de la presentación de la solicitud.

4.1.9 Finalizada la vigencia del reconocimiento y si el interesado requiere mantener su vigencia, debe iniciar el proceso para un nuevo reconocimiento de la equivalencia del certificado de acreditación, con la correspondiente presentación de la solicitud y cancelar las tarifas vigentes.

5 REQUISITOS PARA EL RECONOCIMIENTO DE LA EQUIVALENCIA DEL CERTIFICADO DE ACREDITACIÓN.

5.1.1 La acreditación debe ser otorgada por un Organismo de Acreditación firmante de MLA en el alcance que solicita.

5.1.2 La acreditación emitida por el OA en el país de origen debe estar vigente al momento de solicitar el reconocimiento de la equivalencia del certificado de acreditación y sin ninguna suspensión de la acreditación.

5.1.3 Presentación completa del trámite de reconocimiento de la equivalencia del certificado de acreditación con todos los documentos requeridos.

5.1.4 Cuando el documento es emitido por un OA en un idioma diferente al español o inglés, se debe presentar una traducción oficial al idioma español.

6 PROCESO GENERAL DE RECONOCIMIENTO DE LA EQUIVALENCIA DEL CERTIFICADO DE ACREDITACIÓN 6.1.1 El interesado debe crear un nuevo usuario en el sitio web: eco.eca.or.cr (solo aplica para la primera vez), posteriormente debe crear un nuevo trámite y completar la información requerida.

6.1.2 El verificador revisa el pago y la información presentada por parte del interesado, en un plazo de 7 días hábiles, el cual se puede extender hasta un período igual, cuando se requiera verificar el contenido de la información directamente con el organismo de certificación de producto responsable o el organismo de acreditación respectivo, en cuyo caso se le notificará al interesado.

6.1.3 Si la solicitud, NO se encuentra completa el verificador debe enviar el trámite a subsanar mediante la plataforma digital. El interesado debe subsanar las deficiencias encontradas para continuar con el proceso de reconocimiento de la equivalencia del certificado de acreditación y se vuelve a iniciar la revisión del trámite.

6.1.5 Si el trámite de reconocimiento de la equivalencia del certificado de acreditación, se encuentra completo; el Verificador confirma la validez de la información en 7 días hábiles, comprobando si la acreditación se encuentra vigente y si fue otorgada por un OA firmante del MLA en IAAC, ILAC o IAF, según aplique.

6.1.6 Si durante el proceso de la verificación de la información el Verificador considera necesarias aclaraciones por parte del interesado, ésta las traslada al solicitante. De no realizar las aclaraciones necesarias, se procede al archivo definitivo del trámite.

6.1.7 Si la verificación realizada resulta positiva, dentro de los 7 días hábiles establecidos anteriormente el Verificador completa el formulario ECA-MC-MA-P05-F03 Reconocimiento de la equivalencia del certificado de acreditación y gestiona las firmas respectivas.

Nota. El reconocimiento de la equivalencia del certificado de acreditación debe estar acompañado con la copia fiel del certificado o informe que respalde los resultados de evaluación de conformidad, el alcance de acreditación del organismo de acreditación de origen y el certificado de acreditación cuando sea posible.

6.1.8 Confirmada la información el Verificador traslada los resultados de la investigación al Aprobador, quien debe proceder a la revisión en un plazo de 3 días hábiles, 6.1.9 El Verificador notifica al interesado, el reconocimiento otorgado y solicita el pago del otorgamiento correspondiente.

6.1.10 Posterior al pago de las tarifas respectivas, el Aprobador sube a la plataforma eco.eca.or.cr, el reconocimiento de la equivalencia del certificado de acreditación.

6.1.11 Se realizan revisiones periódicas para lo cual, el Verificador, confirma que las condiciones bajo las cuales el OEC fue reconocido se mantiene invariable. La información de estas revisiones se registra en el ECA-MC-MA-P05-F02 listado de reconocimiento de la equivalencia del certificado de acreditación.

6.1.12 Si durante las revisiones periódicas se detecta que el OEC reconocido está suspendido, retirado o con su acreditación vencida, de manera inmediata se cancela el reconocimiento otorgado y se informa al interesado.

6.1.13 El ECA hará esta información de conocimiento público y no reintegrará ningún monto por el plazo restante del reconocimiento otorgado.

7 LISTADO DE RECONOCIMIENTOS DE LA EQUIVALENCIA DEL CERTIFICADO DE ACREDITACION 7.1.1 El ECA mantiene el ECA-MC-MA-P05-F02 listado de reconocimiento de la equivalencia del certificado de acreditación con la siguiente información:

- Número de Reconocimiento - Nombre del OEC que obtuvo el certificado de acreditación - Alcance de la Acreditación Reconocida - Fecha de emisión del reconocimiento - Vigencia - (por tres meses o por doce meses) - Organismo de acreditación emisor de la acreditación - Nombre del interesado.

- Correo electrónico - Fechas de revisión del mantenimiento del reconocimiento 7.1.2 El ECA mantendrá informado a solicitud de cualquier entidad del gobierno, el estado de los reconocimientos de equivalencias del certificado de acreditación otorgados, su vigencia y nombre del solicitante.

7.1.3 Para suministrar información adicional sobre los reconocimientos de las equivalencias del certificado de acreditación, el interesado debe comunicarse al correo [email protected] 8 TARIFAS 8.1 Consultar las tarifas vigentes al correo [email protected] Nota 1: Se aplican las mismas tarifas aprobadas para el proceso de evaluación y acreditación.

Las cuales se actualizan de manera automática semestralmente, por lo que regirá la tarifa vigente al momento del trámite.

8.2 El interesado puede solicitar la revalidación del reconocimiento otorgado por el ECA, para esto debe hacer el trámite de nuevo en el sitio web: eco.eca.or.cr y realizar el pago correspondiente al otorgamiento del reconocimiento a los rubros II o III del cuadro 1 según aplique. La revalidación se otorgará siempre que se mantengan las condiciones de la solicitud inicial y las acreditaciones se mantengan vigentes, por lo que no se requiere pagar nuevamente la solicitud. En caso de que las condiciones originales bajo las cuales se otorgó el reconocimiento cambien, el interesado debe realizar el pago de la solicitud.

8.3 El ECA podrá realizar descuentos en las tarifas para los reconocimientos del certificado de acreditación, siempre que se cumplan las siguientes condiciones:
