MARITIME TERRESTRIAL ZONE Delimitation of the public zone of a sector of mangrove in Bahía Guabos Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, the General Public Administration Act, and on the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulations.

1. 1That through Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget, sign the contracts and agreements necessary for the exercise of its functions; likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, responsible for the execution of the official Basic Map and the basic geographic description of the Republic of Costa Rica, and for studies, research, or tasks and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.
2. 2That the Law Creating the National Geographic Institute, No. 59, establishes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature originating from the tasks entrusted to it.
3. 3That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."
4. 4That in Executive Decree No. 36642-MP-MOPTMINAET, "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone," it is established, according to Article 18°, that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through digital georeferenced delimitation, in order to streamline delimitations and provide greater technical certainty to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which, among other aspects, designates the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, to which all cartographic and geodetic surveys and activities carried out in the National Territory by any public agency, person, or private entity, national or foreign, must be referenced."; while Article 7 indicates that "As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, through appropriate means, that information which has been officialized."
6. 6That Executive Decree No. 40962-MJP "Update of the Official Horizontal Geodetic Reference System for Costa Rica" declares that: "The official horizontal geodetic reference system for Costa Rica, named CR05, and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica...", while "The CRTM05 cartographic projection system shall remain the official one for the cartographic representation of the continental national territory." For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that "...all cartographic and geodetic surveys and activities carried out in the national territory by any public agency, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic work, thereby contributing to avoiding public expenditure and obtaining, in turn, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at different levels of the State."
7. 7That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), approving cadastral survey plans (visado de planos de agrimensura), granting concessions in the restricted zone (Zona Restringida), and other aspects of coastal land-use planning (ordenamiento territorial costero).
8. 8That the georeferenced digital information on delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
9. 9That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone," b) Executive Decree No. 33797-MJ-MOPT "Declares CR05 and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica," c) Executive Decree No. 40962-MJP "Update of the Official Horizontal Geodetic Reference System for Costa Rica"; and d) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone."

10.—That Article 16° of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that make up the Natural Heritage of the State (Patrimonio Natural del Estado).

11.—The National Geographic Institute, together with the Tempisque Conservation Area (Área de Conservación Tempisque), used the "Digital Georeferenced Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Bahía Guabos, located in district 03 Sierpe, canton 05 Osa, province 06 Puntarenas, this pursuant to proceedings carried out by Mrs. Sonia Carvajal González, ID 5-0252-0351, before the National Geographic Institute.

12.—That the delimitation performed has internal technical endorsement according to official communication DIG-TOT-0241-2019 of July 09, 2019, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.

13.—That the delimitation performed was accompanied by the Osa Conservation Area (Área de Conservación Osa), of the System of Conservation Areas (Sistema de Áreas de Conservación), for the demarcation of the public zone in the mangrove ecosystem sector, according to official communication SINACACOSA- D-077-2019, dated March 01, 2019.

14.—That Article 140 of Law No. 6227, the General Public Administration Act, states that "the administrative act shall produce its effect after being communicated to the administered party, except if it only grants rights, in which case it shall produce them from the moment it is adopted," a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating: "General acts shall be communicated by publication, and specific acts by notification." COMMUNICATES:

First.—That on November 05 to 14, 2018, and December 04 and 05, 2018, the digital georeferenced delimitation and establishment of boundary markers (mojones) to the national coordinate system were carried out to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Bahía Guabos; located in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas. Second.—The work for determining the public zone of the Maritime Terrestrial Zone was carried out on December 04 and 05, 2018, accompanied by the Osa Conservation Area; this delimitation corresponds to a mangrove sector whose coordinates of georeferenced surveyed points (vertices) (GU), are indicated below, in the official cartographic projection system of Costa Rica, CRTM05, and on the Map MBCR- 1/50,000 Rincón, namely:

Third.—The official technical data of the delimitation of the mangrove sector of the public zone of the Maritime Terrestrial Zone of Bahía Guabos have been recorded in the Digital Georeferenced Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.

ZONA MARITIMA TERRESTRE Delimitación de zona pública de un sector de manglar en Bahía Guabos Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley Nº 6227 General de la Administración Pública, y en lo dispuesto en la Ley Nº 59 de creación del Instituto Geográfico Nacional, la Ley Nº 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su respectivo reglamento.

1. 1Que mediante Ley Nº 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones así mismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº 59, en el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que el Decreto Ejecutivo Nº 40962-MJP "Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica" declara que: "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica,.", mientras que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que ".todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado."
7. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
8. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
9. 9Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo Nº 7841-P "Reglamento a la Ley Nº 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", c) el Decreto Ejecutivo Nº 40962-MJP "Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica"; y d) el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

10.-Que el artículo 16° de la Ley Forestal, Ley Nº7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-El Instituto Geográfico Nacional junto con el Área de Conservación Tempisque, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en un sector de manglar en Bahía Guabos, ubicada en distrito 03 Sierpe, cantón 05 Osa, provincia 06 Puntarenas, esto conforme diligencias realizadas por la señora Sonia Carvajal González, cédula 5-0252-0351 ante el Instituto Geográfico Nacional.

12.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio DIG-TOT-0241-2019 del 09 de julio de 2019, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

13.-Que la delimitación realizada contó con el acompañamiento del Área de Conservación Osa, Sistema de Áreas de Conservación, para la demarcación de la zona pública en el sector de ecosistema de manglar, de acuerdo con el oficio SINACACOSA- D-077-2019, de fecha 01 de marzo de 2019.

14.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

Primero.-Que los días 05 al 14 de noviembre de 2018, 04 y 05 de diciembre de 2018, se realizó la delimitación digital georreferenciación y establecimiento de mojones al sistema nacional de coordenadas para delimitar la zona pública de la Zona Marítimo Terrestre en un sector de manglar en Bahía Guabos; ubicada en distrito 03 Sierpe, cantón 05 Osa; provincia 06 Puntarenas. Segundo.-Los trabajos para la determinación de la zona pública de la Zona Marítimo Terrestre fueron realizados los días 04 y 05 de diciembre de 2018 en acompañamiento con el Área de Conservación Osa; esta delimitación corresponde a un sector de manglar cuyas coordenadas de puntos (vértices) georreferenciados levantados (GU), se indican a continuación, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05 y en los Mapa MBCR- 1/50.000 Rincón, a saber:

Tercero.-Los datos técnicos oficiales de la delimitación del sector de manglar de la zona pública de la Zona Marítimo Terrestre de Bahía Guabos, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN.
