in the entirety of the text - Complete Text of Norma 012 Delimitation of the public zone of a mangrove sector in Bahía Guabos Complete Text of record: 130794 NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT (Notice No. 2019-012) MARITIME TERRESTRIAL ZONE Delimitation of the public zone of a sector of mangrove in Bahía Guabos Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227 General Public Administration Act, and as provided in Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, dated March 2, 1977, and its respective regulations.

1. 1That through Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry will administer the Institute's budget, will sign the contracts and agreements necessary for the exercise of its functions; likewise, it is established that the National Geographic Institute shall be the scientific and technical entity governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or labors and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, with the purpose of supporting planning processes.
2. 2That the Law Creating the National Geographic Institute, No. 59, constitutes it permanently and representing the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature originating from the works entrusted to its charge.
3. 3That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."
4. 4That Executive Decree No. 36642-MP-MOPTMINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone", establishes according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite the delimitations and provide greater technical security to interested parties.
5. 5That Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05, shall constitute the only official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the National Territory by any public agency, person, or private national or foreign entity must be referenced."; while Article 7 indicates that "As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish by appropriate means that information which has been officialized."
6. 6That Executive Decree No. 40962-MJP "Update of the Official Horizontal Geodetic Reference System for Costa Rica" declares that: "The official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica.," while "The cartographic projection system CRTM05 shall continue to be the official system for the cartographic representation of the continental national territory." For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that ".all surveys and cartographic and geodetic activities developed in the national territory by any public agency, person or private entity, national or foreign, that undertake or contract geodetic and cartographic works, contributing to avoid public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information, of general utility and that supports decision-making at the different levels of the State."
7. 7That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, approving survey plans, granting concessions in the Restricted Zone and other aspects of coastal territorial planning.
8. 8That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN, is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
9. 9That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares CR05 and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica", c) Executive Decree No. 40962-MJP "Update of the Official Horizontal Geodetic Reference System for Costa Rica"; and d) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".

10.—That Article 16 of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy will delimit on the ground the boundaries of the areas that constitute the State's Natural Heritage.

11.—The National Geographic Institute together with the Tempisque Conservation Area, used the methodology of "Georeferenced Digital Delimitation" to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Bahía Guabos, located in district 03 Sierpe, canton 05 Osa, province 06 Puntarenas, this in accordance with proceedings carried out by Mrs. Sonia Carvajal González, identification number 5-0252-0351 before the National Geographic Institute.

12.—That the delimitation carried out has internal technical endorsement in accordance with official communication DIG-TOT-0241-2019 of July 09, 2019, issued by the Official Limits Sub-process of the Topographic and Territory Observation Department of the National Geographic Institute.

13.—That the delimitation carried out had the accompaniment of the Osa Conservation Area, System of Conservation Areas, for the demarcation of the public zone in the mangrove ecosystem sector, in accordance with official communication SINAC-ACOSA-D-077-2019, dated March 01, 2019.

14.—That Article 140 of Law No. 6227 General Public Administration Act states that "the administrative act shall produce its effect after it is communicated to the administered party, except if it only grants them rights, in which case it shall produce it from the moment it is adopted", a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and concrete acts by notification".

COMMUNICATES:

First.—That on the days of November 05 to 14, 2018, and December 04 and 05, 2018, the digital georeferencing delimitation and establishment of boundary markers (mojones) to the national coordinate system was carried out to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Bahía Guabos; located in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas. Second.—The works for the determination of the public zone of the Maritime Terrestrial Zone were carried out on December 04 and 05, 2018, accompanied by the Osa Conservation Area; this delimitation corresponds to a mangrove sector whose coordinates of georeferenced surveyed points (vertices) (GU), are indicated below, in the official cartographic projection system of Costa Rica CRTM05 and on Map MBCR- 1/50.000 Rincón, namely:

Third.—The official technical data of the delimitation of the mangrove sector of the public zone of the Maritime Terrestrial Zone of Bahía Guabos, have been registered in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.

en la totalidad del texto - Texto Completo Norma 012 Delimitación de zona pública de un sector de manglar en Bahía Guabos Texto Completo acta: 130794 INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO (Aviso Nº 2019-012) ZONA MARITIMA TERRESTRE Delimitación de zona pública de un sector de manglar en Bahía Guabos Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley Nº 6227 General de la Administración Pública, y en lo dispuesto en la Ley Nº 59 de creación del Instituto Geográfico Nacional, la Ley Nº 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su respectivo reglamento.

1. 1Que mediante Ley Nº 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones así mismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº 59, en el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que el Decreto Ejecutivo Nº 40962-MJP "Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica" declara que: "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica,.", mientras que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que ".todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado."
7. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
8. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
9. 9Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo Nº 7841-P "Reglamento a la Ley Nº 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", c) el Decreto Ejecutivo Nº 40962-MJP "Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica"; y d) el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

10.-Que el artículo 16° de la Ley Forestal, Ley Nº7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-El Instituto Geográfico Nacional junto con el Área de Conservación Tempisque, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en un sector de manglar en Bahía Guabos, ubicada en distrito 03 Sierpe, cantón 05 Osa, provincia 06 Puntarenas, esto conforme diligencias realizadas por la señora Sonia Carvajal González, cédula 5-0252-0351 ante el Instituto Geográfico Nacional.

12.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio DIG-TOT-0241-2019 del 09 de julio de 2019, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

13.-Que la delimitación realizada contó con el acompañamiento del Área de Conservación Osa, Sistema de Áreas de Conservación, para la demarcación de la zona pública en el sector de ecosistema de manglar, de acuerdo con el oficio SINACACOSA- D-077-2019, de fecha 01 de marzo de 2019.

14.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

Primero.-Que los días 05 al 14 de noviembre de 2018, 04 y 05 de diciembre de 2018, se realizó la delimitación digital georreferenciación y establecimiento de mojones al sistema nacional de coordenadas para delimitar la zona pública de la Zona Marítimo Terrestre en un sector de manglar en Bahía Guabos; ubicada en distrito 03 Sierpe, cantón 05 Osa; provincia 06 Puntarenas. Segundo.-Los trabajos para la determinación de la zona pública de la Zona Marítimo Terrestre fueron realizados los días 04 y 05 de diciembre de 2018 en acompañamiento con el Área de Conservación Osa; esta delimitación corresponde a un sector de manglar cuyas coordenadas de puntos (vértices) georreferenciados levantados (GU), se indican a continuación, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05 y en los Mapa MBCR- 1/50.000 Rincón, a saber:

Tercero.-Los datos técnicos oficiales de la delimitación del sector de manglar de la zona pública de la Zona Marítimo Terrestre de Bahía Guabos, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN.
