I.Article 50 of the Political Constitution establishes that the State must procure the greatest well-being for all inhabitants of the country; and guarantee and preserve the right of individuals to a healthy and ecologically balanced environment, promoting greater development in harmony with it, which entails programmatic planning activity for the fulfillment of goals and purposes to which it is called.
II.That in accordance with the provisions of subsection f) of Article 11 of the Executive Decree N° 41187-MP-MIDEPLAN, and its amendments, the Stewardship of the Environment, Energy, and Seas sector is exercised by the Minister of Environment and Energy; likewise, subsection h) of Article 11 establishes that the Stewardship of the Infrastructure and Transport sector is exercised by the Minister of Public Works and Transport, therefore, they hold the power, together with the President of the Republic, to coordinate, articulate, and direct the activities of their sectors. Similarly, Article 2, b) in relation to 4, b) establishes the Presidential articulation areas of territorial planning, infrastructure, and mobility, which aim to generate conditions of urban planning, to achieve resilient, sustainable, and inclusive urban and rural spaces, integrated, among others, by MINAE and MOPT, whose Heads are the Steward Ministers of their Sectors and must coordinate whatever is necessary for the fulfillment of the proposed objectives, which include those contained in the PNTE. Among their functions is that of validating and endorsing public policies corresponding to their competencies, for which they must ensure these are complied with according to the guidelines of the National Development and Public Investment Plan.

III.The Stewardship of the Environment, Energy, and Seas sector has regulated the organization of the Energy Subsector through Executive Decree N° 35991- MINAET, Regulation for the Organization of the Energy Subsector, and its amendments.
This subsector is constituted, among others, by the Subsectoral Energy Council (Consejo Subsectorial de Energía, CSE) and the Energy Subsector Planning Secretariat (Secretaría de Planificación del Subsector Energía, SEPSE), according to Article 6, which provide support to the Steward Minister.
IV.The Steward Minister of the Infrastructure and Transport sector has the Sectoral Planning Secretariat as an advisory and technical support body, as established in Article 3 of Executive Decree Nº 39173-MOPT, Structural Reorganization of the sectoral and institutional planning process of the Ministry of Public Works and Transport, of the year 2015.
V.The Law of Incentives and Promotion for Electric Transportation N° 9518 establishes in Transitory Provision I that the Ministry of Environment and Energy (MINAE), in coordination with the Ministry of Public Works and Transport (MOPT), shall prepare the National Electric Transportation Plan within a maximum period of six months from the publication of the cited Law.
VI.Law N° 9518, Incentives and Promotion for Electric Transportation, of February 6, 2018, in Article 4 establishes that the Ministry of Environment and Energy (MINAE) is the steward for the application of this law with powers of direction, monitoring, evaluation, and control.
VII.The Law of Incentives and Promotion for Electric Transportation N° 9518 establishes in Article 19 that the public administration, public enterprises, and municipalities may make the necessary investment for those infrastructure works directed at strengthening and promoting electric transportation.
VIII.The National Electric Transportation Plan (Plan Nacional de Transporte Eléctrico, PNTE) aims to promote the transition towards a greater share of renewable energies in the national energy matrix, through the electrification of transport in all its modes, seeking to achieve impacts in the reduction of greenhouse gas (GHG) emissions and in the improvement of air quality in urban areas, which will be directly reflected in human health. For this purpose, it is necessary to integrate the efforts of different actors in the public sector, the private sector, and civil society.
IX.The development of electric transportation responds to the energy policies contained in the VII National Energy Plan (PNE), to the national commitment to advance towards the decarbonization of the economy established in the Action Plan of the National Climate Change Strategy (ENCC) and in Costa Rica's Nationally Determined Contribution (NDC).
X.The National Decarbonization Plan establishes, as axes to reverse the growth of greenhouse gases, the transformation of the vehicle fleet to zero emissions powered by renewable energies, not of fossil origin, and the development of a mobility system based on safe, efficient, and renewable public transport, and on active and shared mobility schemes.
XI.The National Planning Law, Nº 5525, establishes a National Planning System which has the objectives of intensifying the growth of the country's production and productivity, promoting better distribution of income and social services provided by the State, and fostering the participation of citizens in solving economic and social problems; for which the creation of sectors is established, composed of institutions that work in the same field of activity.
XII.The General Regulation of the National Planning System, Executive Decree Nº 37735-PLAN, aims to regulate the constitution, organization, functions, and relations of the National Planning System (SNP), as an articulated set of public institutions, subsystems, and regulations. Among the organs of the system are the Sectoral Councils, Sectoral Steward Ministers, and Sectoral Secretariats, among others, for which their respective functions are established, whereby the Public Administration shall be organized by sectors to facilitate the coordination of institutions with related activities.
XIII.The General Regulation of the National Planning System, Executive Decree No. 37735-PLAN, aims to regulate the constitution, organization, functions, and relations of the National Planning System (SNP), as an articulated set of public institutions, subsystems, and regulations. Among the organs of the system are the Sectoral Councils, Sectoral Steward Ministers, and Sectoral Secretariats, among others, for which their respective functions are established, whereby the Public Administration shall be organized by sectors to facilitate the coordination of institutions with related activities.
XIV.The General Regulation of the National Planning System, Executive Decree N° 37735-PLAN, establishes in its Article 8 that the planning instruments, such as plans, policies, programs, and projects, among others, shall be issued by executive decree.
XV.Given that the existing regulations contemplate Councils and Secretariats already existing and operating, it is necessary to create a coordination and steering mechanism for them to address the implementation of an intersectoral planning instrument such as the PNTE, which has been created by law and requires MINAE and MOPT to work jointly.

The management of the PNTE shall be led by the Minister of MINAE, in his capacity as Steward of the Environment, Energy, and Seas sector and as institutional head of the ministry. He shall be supported by the Energy Subsector Planning Secretariat (SEPSE), the Subsectoral Energy Council (CSE), and the institutions that make it up, as those responsible for and supervisors of managing the fulfillment and execution of the PNTE.
The Minister of MOPT, in his capacity as Steward of the Infrastructure and Transport sector and in his capacity as institutional head, shall coordinate the implementation of the PNTE with the Minister of MINAE. In this task, he shall be supported by the institutions that make up the Infrastructure and Transport sector and by the Sectoral Planning Secretariat (SPS), as those responsible for collaborating in the management of fulfillment and execution of the PNTE.
The bodies within MINAE shall lead the process of compliance and execution of the PNTE and shall coordinate directly with the bodies within MOPT.

The bodies shall have the following functions:
a. The CSE, in coordination with the Steward of the Infrastructure and Transport Sector and the institutions that make it up, shall be the policy guides and decision-makers for articulating the PNTE in accordance with current regulations, policies, plans, and instruments.
b. The Steward Minister of the Environment, Energy, and Seas Sector and the Steward Minister of the Infrastructure and Transport Sector shall convene the CSE and the institutions of the Infrastructure and Transport sector to hold working sessions on an ordinary basis, at least once a year, or, on an extraordinary basis, as many times as necessary, subject to the need to advance the Plan.
c. The Steward Minister of the Environment, Energy, and Seas Sector and the Steward Minister of the Infrastructure and Transport Sector may, on a consultative basis, convene Ministers, Heads of institutions, or representatives of public or private companies to participate in these working sessions.
d. The SEPSE and the SPS shall be the coordinators and liaisons for the implementation of the PNTE, and shall therefore guide the actions, monitor, and follow up on the fulfillment and execution of the PNTE. These bodies shall maintain constant and fluid communication and coordination.
e. The SEPSE and the SPS shall organize planning and follow-up meetings for the execution of the PNTE.

For the proper fulfillment of the PNTE, the bodies shall have under their responsibility:
1. The CSE and the Steward Minister of the Infrastructure and Transport Sector and the institutions that make it up shall have the following responsibilities:
a. To know and propose convenient adjustments for the PNTE.
b. To issue the general provisions for the articulation of the PNTE.
c. To promote the implementation of the policies, plans, programs, and projects of the PNTE.
d. To coordinate the plans, programs, and projects of the PNTE with the fundamental actors of the PNTE.
e. To make decisions inherent to the implementation of the PNTE.
f. To facilitate and/or manage financial-economic resources for the development of the PNTE.
g. To coordinate with the fundamental actors of the PNTE the linkage of the Plan with the strategic and institutional plans of the different organizations.
h. To evaluate and follow up on the PNTE.
i. To form advisory committees deemed necessary.
j. To convene actors as required, in order to receive recommendations and technical advice.
k. To inform the National Environmental Council (CNA) about the progress of the PNTE.
2. The SEPSE and the SPS shall have the following responsibilities:
a. To coordinate with the institutions, companies, and actors the implementation of the PNTE.
b. To coordinate the formation of advisory committees as required.
c. To periodically follow up and control the progress in the implementation of the PNTE, consolidating the inputs on progress.
d. To manage and systematize the information and report the progress and risks that arise in the fulfillment of the PNTE.
e. To prepare the progress reports of the PNTE, which shall be semi-annual.
f. To prepare technical reports at the request of the Steward Minister or by agreement of the CNA.
g. To manage the evaluations of the PNTE.
h. To support the efforts of the CSE and the institutions of the Infrastructure and Transport sector.
The progress reports prepared by the SEPSE and SPS shall be submitted to the Minister of MINAE in his capacity as steward, who shall determine the higher political-level bodies to which the results, findings, or recommendations are to be sent.

I.Que el artículo 50 de la Constitución Política establece que el Estado debe procurar el mayor bienestar a todos los habitantes del país; y garantizar y preservar el derecho de las personas a un ambiente sano y ecológicamente equilibrado, promoviendo el mayor desarrollo en armonía con éste, lo que conlleva una actividad de planificación programática para el cumplimiento de metas y de fines a los que está llamado.
II.Que de conformidad con lo establecido en el inciso f) del artículo 11 del Decreto Ejecutivo N° 41187-MP-MIDEPLAN, y sus reformas, la Rectoría del sector Ambiente, Energía y Mares es ejercida por el Ministro de Ambiente y Energía, de igual forma, en el inciso h) del artículo 11 establece que la Rectoría del sector Infraestructura y Transporte es ejercida por el Ministro de Obras Públicas y Transportes, por tanto, les corresponde la potestad junto con el Presidente de la República, de coordinar, articular y conducir las actividades de sus sectores. De igual manera, el artículo 2, b) en relación con el 4, b) establecen las áreas de articulación Presidencial de ordenamiento territorial, infraestructura y movilidad, que tiene como objetivo generar condiciones de planificación urbana, para el logro de espacios urbanos y rurales resilientes, sostenibles e inclusivos, integrada entre otros, por el MINAE y el MOPT, cuyos Jerarcas son Ministros Rectores de sus Sectores y deben coordinar lo necesario para el cumplimento de los objetivos propuestos, que incluyen los contenidos en el PNTE. Entre sus funciones está la de validar y suscribir las políticas públicas correspondientes a sus competencias para lo cual deben asegurarse que éstas sean cumplidas conforme a las orientaciones del Plan Nacional de Desarrollo y de Inversión Pública.

III.Que la Rectoría del sector de Ambiente, Energía y Mares tiene reglamentada la organización del Subsector Energía mediante el Decreto Ejecutivo N° 35991- MINAET Reglamento de Organización del Subsector Energía y sus reformas.
Este subsector está constituido entre otras, por el Consejo Subsectorial de Energía (CSE) y la Secretaría de Planificación del Subsector Energía (SEPSE), según el artículo 6, los cuales brindan apoyo al Ministro (a) Rector.
IV.Que el Ministro (a) Rector del sector Infraestructura y Transporte cuenta con la Secretaría de Planificación Sectorial como órgano de asesoría y apoyo técnico, según se establece en el artículo 3 del Decreto Ejecutivo Nº39173-MOPT Reorganización estructural del proceso de planificación sectorial e institucional del Ministerio de Obras Públicas y Transportes del año 2015.
V.Que la Ley de Incentivos y Promoción para el Transporte Eléctrico N° 9518, establece en el Transitorio I, que el Ministerio de Ambiente y Energía (MINAE), en coordinación con el Ministerio de Obras Públicas y Transportes (MOPT), elaborarán el Plan Nacional de Transporte Eléctrico en un plazo máximo de seis meses a partir de la publicación de la citada Ley.
VI.Que la Ley N°9518 Incentivos y promoción para el transporte eléctrico del 06 de febrero del 2018, en el artículo 4 establece que el Ministerio de Ambiente y Energía (MINAE) es el rector para la aplicación de esta ley con potestades de dirección, monitoreo, evaluación y control.
VII.Que la Ley de Incentivos y Promoción para el Transporte Eléctrico N° 9518, establece en el artículo 19, que la administración pública, las empresas públicas y las municipalidades, pueden realizar la inversión necesaria para aquellas obras de infraestructura dirigidas al fortalecimiento y a la promoción del transporte eléctrico.
VIII.Que el Plan Nacional de Transporte Eléctrico (PNTE) tiene como objetivo promover la transición hacia una mayor participación de las energías renovables en la matriz energética nacional, mediante la electrificación del transporte en todos sus modos, en busca de lograr impactos en la reducción de las emisiones de gases de efecto invernadero (GEI) y en la mejora de la calidad del aire en zonas urbanas que se verá reflejado directamente en la salud humana. Para este propósito es necesario integrar los esfuerzos de diferentes actores en el sector público, en el sector privado y la sociedad civil.
IX.Que el desarrollo del transporte eléctrico responde a las políticas energéticas contenidas en el VII Plan Nacional de Energía (PNE), al compromiso país de avanzar hacia la descarbonización de la economía establecido en el Plan de Acción de la Estrategia Nacional de Cambio Climático (ENCC) y en la Contribución Nacionalmente Determinada de Costa Rica (NDC, por sus siglas en inglés).
X.Que el Plan Nacional de Descarbonización establece como ejes para revertir el crecimiento de gases de efecto invernadero la transformación de la flota de vehículos a cero emisiones nutridos de energías renovables, no de origen fósil y el desarrollo de un sistema de movilidad basado en transporte público seguro, eficiente y renovable, y en esquemas de movilidad activa y compartida.
XI.Que la Ley de Planificación Nacional, Nº 5525 establece un Sistema de Planificación Nacional que tiene como objetivos, intensificar el crecimiento de la producción y de la productividad del país, promover la mejor distribución del ingreso y de los servicios sociales que presta el Estado y propiciar la participación de los ciudadanos en la solución de los problemas económicos y sociales; para los cuales se establece la creación de sectores integrado por instituciones que trabajen en un mismo campo de actividad.
XII.Que el Reglamento General del Sistema Nacional de Planificación, Decreto Ejecutivo Nº37735-PLAN, tiene por objeto, regular la constitución, organización, funciones y relaciones del Sistema Nacional de Planificación (SNP), como conjunto articulado de instituciones públicas, subsistemas y normativa. Entre los órganos del sistema, encontramos a los Consejos Sectoriales, Ministros Rectores Sectoriales y Secretarías Sectoriales entre otros, para los que se establecen sus funciones respectivas, siendo que la Administración Pública se organizara por sectores para facilitar la coordinación de instituciones con actividades afines.
XIII.Que el Reglamento General del Sistema Nacional de Planificación, Decreto Ejecutivo No. 37735-PLAN, tiene por objeto regular la constitución, organización, funciones y relaciones del Sistema Nacional de Planificación (SNP), como conjunto articulado de instituciones públicas, subsistemas y normativa. Entre los órganos del sistema encontramos a los Consejos Sectoriales, Ministros Rectores Sectoriales y Secretarías Sectoriales entre otros, para los que se establecen sus funciones respectivas, siendo que la Administración Pública se organizara por sectores para facilitar la coordinación de instituciones con actividades afines.
XIV.Que el Reglamento General del Sistema Nacional de Planificación, Decreto Ejecutivo N°37735-PLAN, establece en su artículo 8, que los instrumentos de planificación, tales como los planes, políticas, programas y proyectos, entre otros, serán emitidos por decreto ejecutivo.
XV.Que siendo que la normativa existente contempla a Consejos y Secretarias ya existentes y funcionando, se hace necesario crear un mecanismo de coordinación y dirección para que atiendan la implementación de un instrumento de planificación intersectorial como el PNTE, que ha sido creado por ley y que obliga a MINAE y al MOPT a trabajar de manera conjunta.
OFICIALIZACIÓN DEL PLAN NACIONAL DE TRANSPORTE ELÉCTRICO

Decretan:

Se oficializa el "Plan Nacional de Transporte Eléctrico (PNTE)", en cumplimiento a lo dispuesto en la Ley de Incentivos y Promoción del Transporte Eléctrico", Ley número 9518 del 06 de febrero de 2018.
Este Plan estará disponible en el sitio web de la Secretaría de Planificación del Subsector Energía (SEPSE), en la dirección electrónica https://sepse.go.cr/. Así como en el sitio web de la Secretaría de Planificación Sectorial del Ministerio de Obras Públicas y Transporte (MOPT) http://repositorio.mopt.go.cr:8080/xmlui/.
La versión impresa del documento se custodiará en la Secretaría de Planificación del Subsector Energía (SEPSE), en el quinto piso del Ministerio de Ambiente y Energía (MINAE) y en la Secretaría de Planificación Sectorial-MOPT.

La gestión del PNTE estará liderada por el Ministro del MINAE en su calidad de Rector del sector de Ambiente, Energía y Mares y de jerarca institucional del ministerio. Se apoyará en la Secretaría de Planificación del Subsector Energía (SEPSE), en el Consejo Subsectorial de Energía (CSE) y en las instituciones que lo conforman, como los encargados y supervisores de gestionar el cumplimiento y la ejecución del PNTE.
El Ministro del MOPT en su calidad de Rector del sector de Infraestructura y Transporte y en su calidad de jerarca institucional, coordinará con el Ministro del MINAE la implementación del PNTE. En esta labor, se apoyará en las instituciones que conforman al sector Infraestructura y Transporte y en la Secretaría de Planificación Sectorial (SPS) como encargados para colaborar en la gestión de cumplimiento y de ejecución del PNTE.
Las instancias en el MINAE liderarán el proceso de cumplimiento y ejecución del PNTE y coordinarán directamente con las instancias en el MOPT.

Las instancias tendrán las siguientes funciones:
a. El CSE en coordinación con el Rector del Sector de Infraestructura y Transporte y las instituciones que lo integran, serán los orientadores políticos y los tomadores de decisiones para articular el PNTE de conformidad con normativas, políticas, planes e instrumentos vigentes.
b. El Ministro Rector del Sector Ambiente, Energía y Mares y el Ministro Rector del Sector de Infraestructura y Transporte, convocarán al CSE y las instituciones del sector de Infraestructura y Transporte para realizar sesiones de trabajo en forma ordinaria, al menos una vez al año, o bien, en forma extraordinaria las veces que sean necesarias, quedando sujeto a la necesidad de avanzar con el Plan.
c. El Ministro Rector del Sector Ambiente, Energía y Mares y el Ministro Rector del Sector de Infraestructura y Transporte podrán convocar de manera consultiva a Ministros o Ministras, Jerarcas de instituciones o representantes de empresas públicas o privadas a participar de estas sesiones de trabajo.
d. La SEPSE y la SPS serán los coordinadores y los enlaces para la implementación del PNTE, por lo que orientarán las acciones, monitorearán y darán seguimiento al cumplimiento y a la ejecución del PNTE. Estas instancias mantendrán una comunicación y una coordinación constante y fluida.
e. La SEPSE y la SPS deberán organizar reuniones de planificación y seguimiento para la ejecución del PNTE.

Para el adecuado cumplimiento del PNTE, las instancias tendrán bajo su responsabilidad:
1. El CSE y el Ministro Rector del Sector de Infraestructura y Transporte y las instituciones que lo integran tendrán las siguientes responsabilidades:
a. Conocer y proponer los ajustes convenientes para el PNTE.
b. Emitir las disposiciones generales para la articulación del PNTE.
c. Promover la puesta en práctica de las políticas, los planes, los programas y proyectos del PNTE.
d. Coordinar los planes, programas y proyectos del PNTE con los actores fundamentales del PNTE.
e. Tomar decisiones inherentes a la implementación del PNTE.
f. Facilitar y/o gestionar recursos financieros-económicos para el desarrollo del PNTE.
g. Coordinar con los actores fundamentales del PNTE la vinculación del Plan con los planes estratégicos e institucionales de las diferentes organizaciones.
h. Evaluar y dar seguimiento del PNTE.
i. Conformar los comités consultivos que se consideren necesarios.
j. Convocar a actores que se precisen, a fin de recibir recomendaciones y asesorías técnicas.
k. Informar al Consejo Nacional Ambiental (CNA) sobre el avance del PNTE.
2. La SEPSE y la SPS tendrán las siguientes responsabilidades:
a. Coordinar con las instituciones, empresas y actores la implementación del PNTE.
b. Coordinar la conformación de comités consultivos que se requieran.
c. Dar seguimiento periódico y controlar el avance en la implementación del PNTE, consolidando los insumos del avance.
d. Gestionar y sistematizar la información y reportar los avances y riesgos que se presenten en el cumplimiento del PNTE.
e. Elaborar los informes de avance del PNTE que tendrán una periodicidad semestral.
f. Elaborar los informes técnicos por solicitud del Ministro Rector o por acuerdo del CNA.
g. Gestionar las evaluaciones del PNTE.
h. Apoyar las gestiones del CSE y las instituciones del sector Infraestructura y Transporte.
Los informes de avance que prepare la SEPSE y SPS serán elevados al Ministro MINAE en su calidad de rector, quien determinará las instancias de nivel político superior a las cuales remitir los resultados, hallazgos o recomendaciones.
