in the entirety of the text - Full Text of Regulation 41907 Extends the deadline established in Article 1 of Executive Decree No. 41669 of 04/05/2019 "Extends the deadline established in the Sole Transitory Provision of Executive Decree No. 41479-MAG "Repeal of the Regulation for the use of fishing capacity" No. 41907-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers and authorities conferred upon them by numerals 140, subsections 3), 8) and 20), 50 and 146 of the Political Constitution; the United Nations Convention on the Law of the Sea, Law No. 7291 of July 15, 199; the United Nations Agreement on Straddling Fish Stocks and Highly Migratory Fish Stocks, Law No. 8059 of February 2, 2001; the Convention for the Strengthening of the Inter-American Tropical Tuna Commission, Law No. 8712 of April 1, 2009; Articles 25.1 and 27.1 of the General Law of Public Administration, No. 6227 of May 2, 1978; the Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, No. 7064 of April 29, 1987; the Law Creating the Costa Rican Institute of Fisheries and Aquaculture, No. 7384 of March 16, 1994; the Fisheries and Aquaculture Law, No. 8436 of March 1, 2005; and

I.-That Article 50 of the Political Constitution provides that it is the State's obligation to procure the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. Likewise, it incorporates every person's right to a healthy and ecologically balanced environment.

II.-That through Executive Decree No. 41669-MAG of April 5, 2019, the deadline established in the Sole Transitory Provision of Executive Decree No. 41479-MAG of December 11, 2018, was extended to issue a new regulation on the use of the purse-seine tuna fishing capacity quota recognized to Costa Rica within the Inter-American Tropical Tuna Commission (IATTC); however, to date it has not been possible to complete the studies and procedures that would allow the issuance of the new regulation.

III.-That despite the efforts made by the Executive Branch, the technical, legal, economic, and social studies continue to be developed to regulate the exploitation of the fishing capacity of the tuna resource that the Inter-American Tropical Tuna Commission (IATTC) recognized to the Costa Rican State, making it necessary to extend the deadline initially granted to issue the new regulation.

IV.-That the Cost-Benefit Evaluation Form, Section I, denominated Prior Control of Regulatory Improvement, was completed, and it yielded a negative result, and the proposal contains no procedures or requirements. Therefore, Enact:

EXTENSION OF THE DEADLINE ESTABLISHED IN ARTICLE 1 OF EXECUTIVE DECREE No. 41669-MAG OF APRIL 5, 2019

Considering:

en la totalidad del texto - Texto Completo Norma 41907 Amplía el plazo establecido en el artículo 1° del decreto ejecutivo N° 41669 del 05/04/2019 "Amplía el plazo establecido en el Transitorio Único del Decreto Ejecutivo N° 41479-MAG "Derogatoria del Reglamento para la utilización de la capacidad de pesca" N° 41907-MAG EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En uso de las facultades y atribuciones que les confiere los numerales 140, incisos 3), 8) y 20), 50 y 146 de la Constitución Política; la Convención de las Naciones Unidas sobre el Derecho del Mar, Ley N° 7291 del 15 de julio de 199; el Acuerdo de las Naciones Unidas sobre Poblaciones de Peces Transzonales y Altamente Migratorios, Ley N° 8059 del 02 de febrero del 2001; la Convención para el Fortalecimiento de la Comisión Interamericana del Atún Tropical, Ley N° 8712 del 01 de abril del 2009; los artículos 25.1 y 27.1 de la Ley General de la Administración Pública, N° 6227 del 02 de mayo de 1978; la Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, N° 7064 del 29 de abril de 1987; la Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, N° 7384 del 16 de marzo de 1994; la Ley de Pesca y Acuicultura, N° 8436 del 01 de marzo del 2005; y

I.-Que el artículo 50 de la Constitución Política dispone que es obligación del Estado procurar el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Asimismo, incorpora el derecho de toda persona a un ambiente sano y ecológicamente equilibrado.

II.-Que mediante el Decreto Ejecutivo Nº 41669-MAG de 05 de abril del 2019 se prorrogó el plazo establecido en el Transitorio Único del Decreto Ejecutivo N° 41479-MAG de 11 de diciembre del 2018, para emitir una nueva regulación sobre la utilización de la cuota de capacidad de pesca de Atún de Cerco reconocida a Costa Rica en el seno de la Comisión Interamericana del Atún Tropical (CIAT), no obstante a la fecha no ha sido posible terminar los estudios y procedimientos que permitan emitir la nueva regulación.

III.-Que pese a los esfuerzos realizados por el Poder Ejecutivo, se continúa desarrollando los estudios técnicos, jurídicos, económicos y sociales que permita regular la explotación de la capacidad de pesca del recurso atunero, que la Comisión Interamericana del Atún Tropical (CIAT) le reconoció al Estado costarricense, lo que hace necesario ampliar el plazo otorgado inicialmente para emitir la nueva reglamentación.

IV.-Que se procedió a llenar el Formulario de Evaluación Costo Beneficio, Sección I, denominada Control Previo de Mejora Regulatoria, siendo que el mismo dio un resultado negativo y la propuesta no contiene trámites ni requisitos. Por tanto,
