in the entirety of the text - Full Text of Norm 41849 Repeal of Several Executive Decrees Concerning Phytosanitary Pest Control Full Text of Record: 12F7F9 No. 41849-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers established in Article 140, subsections 3), 8), 18), and 20) and Article 146 of the Political Constitution; Articles 25, 27, subsection 1), 28, subsection 2), paragraph b) of Law No. 6227 of May 2, 1978, General Law of Public Administration; Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production FODEA and Organic Law of the MAG; and Law No. 7664 of April 8, 1997, Phytosanitary Protection Law,
I.—That by legal mandate, the Executive Branch is responsible for the Declaration of a State of Phytosanitary Emergency, and because at the time the Phytosanitary Service recommended the promulgation of a series of executive decrees with the objective of addressing phytosanitary pest control in a timely and effective manner, and these states of emergency having now lost their currency, the repeal of these decrees becomes necessary.
II.—That it is necessary for the State Phytosanitary Service to request the repeal of decrees that currently cannot be applied because they have already fulfilled the objective for which they were promulgated.
III.—That some Sector regulations have been tacitly repealed by other, more general and recent regulations, making their express repeal necessary in order to avoid legal confusion in their application, by having two or more regulations for the same purpose.

II.-Que es necesario para el Servicio Fitosanitario del Estado solicitar la derogatoria de decretos que en la actualidad no pueden ser aplicados debido a que ya cumplieron el objetivo para el cual habían sido promulgados.
III.-Que alguna normativa del Sector ha sido tácitamente derogada por otras normativas más generales y recientes, por lo que es necesario realizar su derogación expresa a fin de evitar la confusión jurídica en su aplicación, al tener dos o más regulaciones para el mismo fin.
