in the entirety of the text - Complete Text of Regulation 41906 The Costa Rican Institute of Aqueducts and Sewers is hereby exempted from the application of article 1 of Executive Decree No. 41162-H on a one-time basis in order to carry out the process of establishing the "Executing Unit for the AyA / BCIE Portfolio of Investment Projects and Programs” Complete Text of record: 12F7F3 No. 41906-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by articles 130, 140 subsections 7), 8), 18), and 20), 146, 176, and 180 of the Political Constitution; articles 1, 4, 21, 25 subsection 1), 27 subsection 1), 28 subsection b), 113 subsections 2) and 3) of Law No. 6227, General Law of Public Administration of May 2, 1978, and its amendments; Law No. 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006, and its amendments; Executive Decree No. 32452-H of June 29, 2005, and its amendments; Executive Decree No. 37045-MP-MEIC of February 22, 2012, "Regulation to the Law for the Protection of Citizens against Excessive Administrative Requirements and Procedures" and its amendments; Executive Decree No. 41162-H of June 1, 2018; and
I.The Costa Rican State needs to enhance the optimal and sustainable use of water resources, in order to meet and satisfy the basic needs of its citizens, a task carried out through the Institute of Aqueducts and Sewers (hereinafter AyA), an autonomous institution of the State competent in the matter.
II.AyA has signed various loan contracts with the Central American Bank for Economic Integration (BCIE), in order to develop a Portfolio of AyA / BCIE Investment Projects and Programs, which includes the following: Loan Contract No. 1725, Supply Program for the San José Metropolitan Area, Urban Aqueducts and Sanitary Sewerage of Puerto Viejo de Limón; Loan Contract No. 2129, Non-Revenue Water Reduction and Energy Efficiency Optimization Project / Includes KfW/BCIE Complementary Measure; Loan Contract No. 2164, Supply Program for the San José Metropolitan Area, Urban Aqueducts II and Sanitary Sewerage of Juanito Mora, Puntarenas; Loan Contract No. 2188, Water and Sanitation Program for Coastal Zones, Service Quality and Efficiency Management; Loan Contract No. 2198, Expansion and Improvement Project of the Sanitary Sewerage of the City of Limón; and the loan contract under evaluation, called the Fifth Expansion Construction Works Project for the Metropolitan Aqueduct of San José.
III.Part of the responsibilities assumed by the Costa Rican Institute of Aqueducts and Sewers, within the execution schedule of the approved loans, is to have an Executing Unit.
IV.The integration of a single Executing Unit for the entire AyA / BCIE Portfolio of Investment Projects and Programs for the approved loans will allow a reduction in costs associated with human resources, rent, electricity, cleaning, and security, among others.
V.The Board of Directors of the Costa Rican Institute of Aqueducts and Sewers adopted Agreement No. 2018-422 of December 12, 2018, in which the Organization Proposal for the "Executing Unit for the AyA / BCIE Portfolio of Investment Projects and Programs" is endorsed; an organization, restructuring, and integration scheme whose purpose is to achieve the objectives of the signed loan contracts and the one under evaluation, endorsed by the Ministry of Finance, this being the organizational alternative best suited for the execution of the Portfolio to make the human, technical, and economic resources available at the institutional level more efficient. This is in accordance with the organization chart approved by the BCIE and the assignment of personnel who will be exclusively dedicated to these tasks.
VI.In order to achieve the objectives stated in the preceding Recital, the issuance of an Operational Regulation with the endorsement of the BCIE is required, as well as the appointment of personnel for the "Executing Unit for the AyA / BCIE Portfolio of Investment Projects and Programs," with the non-objection of the BCIE.
VII.The Executive Branch issued Executive Decree No. 41162-H, published in Supplement 115 of La Gaceta No. 100 of June 6, 2018, which provides in its article 1 that: "Only restructurings within ministries, deconcentrated bodies, and entities covered by the scope of the Budgetary Authority, whose purpose is to make State management more efficient, shall be approved, provided they do not entail the creation of additional positions, reassignments of posts, or new expenses."
VIII.Through official communication PRE-2019-00766 of June 14, 2019, AyA requested that the reorganization to create the Executing Unit for the programs and projects that make up this AyA / BCIE Portfolio be authorized, by way of exemption, which would make institutional management and project execution more efficient. Additionally, in official communication PRE-2019-00879 of July 18, 2019, AyA indicated that the creation of the Executing Unit for this Portfolio "allows, through economies of scale, a significant reduction of the personnel required for the execution of the loans (around 30% in the peak execution semester), and better articulation of the projects and smoother coordination with the BCIE."
IX.The restructuring process for the Executing Unit in question does not harm the national budget, given that according to the Organization Proposal for the Executing Unit for the AyA / BCIE Portfolio of Investment Projects and Programs, each of the developments has approved financing from both an external source (BCIE) and an internal source, already provided for. In this regard, official communication PRE-2019-00879 states that: "(...) new positions for Special Services are needed, some reassignments of posts are required to leverage the knowledge and experience developed in the already existing Executing Units that are being integrated into the new Executing Unit, and new expenses for its operation will be incurred (remunerations, services, rent, materials, assets, etc.), all of which was considered in our programming at the time, during the management and approval of all the loans." It is also stated that all of the Executing Unit's operating expenses related to remunerations, materials, assets, among others, are already provided for in the loans and counterpart contributions.
X.In accordance with article 12 bis of Executive Decree No. 37045-MP-MEIC, published in Supplement 36 of La Gaceta No. 60 of March 23, 2012, "Regulation to the Law for the Protection of Citizens against Excessive Administrative Requirements and Procedures" and its amendments, due to the nature of this executive decree, it is considered that it is not necessary to complete Section I, called Prior Control of Regulatory Improvement, which makes up the Cost-Benefit Evaluation form, given that it does not establish new procedures or requirements for the citizen.

I.Que el Estado costarricense requiere potenciar el aprovechamiento óptimo y sostenible de los recursos hídricos, con el fin de atender y satisfacer las necesidades básicas de los ciudadanos, labor realizada a través del Instituto de Acueductos y Alcantarillados (en adelante AyA), institución autónoma del Estado competente en la materia.
II.Que el AyA ha suscrito diversos contratos de préstamo con el Banco Centroamericano de Integración Económica (BCIE), con el fin de desarrollar un Portafolio de Proyectos y Programas de Inversión AyA / BCIE, el cual contempla los siguientes: contrato de préstamo N°1725, Programa de abastecimiento del Área Metropolitana de San José, Acueductos urbanos y Alcantarillado Sanitario de Puerto Viejo de Limón; contrato de préstamo N°2129, Proyecto de Reducción del Agua No Contabilizada y Optimización de la Eficiencia Energética / Incluye Medida Complementaria KfW/BCIE; contrato de préstamo N°2164, Programa Abastecimiento del Área Metropolitana de San José, Acueductos Urbanos II y Alcantarillado Sanitario Juanito Mora, Puntarenas; contrato de préstamo N°2188, Programa de Agua y Saneamiento de Zonas Costeras, Gestión de la Calidad y Eficiencia del Servicio; contrato de préstamo N°2198, Proyecto Ampliación y Mejoramiento del Alcantarillado Sanitario de la Ciudad de Limón; y contrato de préstamo en evaluación, denominado Proyecto Construcción de las Obras de Quinta Ampliación del Acueducto Metropolitano de San José.
III.Que parte de las responsabilidades que asume el Instituto Costarricense de Acueductos y Alcantarillados, dentro del cronograma de ejecución de los créditos aprobados, es contar con una Unidad Ejecutora.
IV.Que la integración de una sola Unidad Ejecutora para todo el Portafolio de Proyectos y Programas de Inversión AyA / BCIE de los créditos aprobados permitirá una disminución de costos asociados al recurso humano, alquiler, electricidad, limpieza y seguridad, entre otros.
V.Que la Junta Directiva del Instituto Costarricense de Acueductos y Alcantarillados adoptó el acuerdo N° 2018-422 del 12 de diciembre de2018, en el que se avala la Propuesta de Organización de la "Unidad Ejecutora para el Portafolio de Proyectos y Programas de Inversión AyA / BCIE"; esquema de organización, reestructuración e integración que tiene el fin de alcanzar los objetivos de los contratos de préstamo suscritos y en evaluación, avalados por el Ministerio de Hacienda, siendo la alternativa de organización que mejor se ajusta para la ejecución del Portafolio para eficientizar los recursos humanos, técnicos y económicos disponibles a nivel institucional. Lo anterior, atendiendo al organigrama aprobado por el BCIE y la asignación de personal que en forma exclusiva se dedicará a estas labores.
VI.Que para alcanzar los objetivos indicados en el considerando anterior, se requiere la emisión de un Reglamento Operativo con el aval del BCIE, así como del nombramiento de personal para la "Unidad Ejecutora para el Portafolio de Proyectos y Programas de Inversión AyA / BCIE", con la no objeción del BCIE.
VII.Que el Poder Ejecutivo emitió el Decreto Ejecutivo N° 41162-H, publicado en Alcance 115 de la Gaceta N°100 del 6 de junio de 2018, el cual dispone en su artículo 1º que: "Únicamente serán aprobadas las reestructuraciones dentro de ministerios, órganos desconcentrados y entidades cubiertas por el ámbito de la Autoridad Presupuestaria, cuyo propósito sea hacer más eficiente la gestión del Estado, siempre que no impliquen la creación de plazas adicionales, reasignaciones de puestos, así como nuevos gastos."
VIII.Que mediante oficio PRE-2019-00766 del 14 de junio de 2019, el AyA solicita que se autorice, por la vía de excepción, la reorganización para crear la Unidad Ejecutora de los programas y proyectos que integren este Portafolio AyA / BCIE, la cual permitiría hacer más eficiente la gestión institucional y la ejecución de los proyectos. Adicionalmente, en oficio PRE-2019-00879 del 18 de julio de 2019, el AyA señala que la creación de la Unidad Ejecutora para este Portafolio "permite, por escala, una reducción significativa del personal requerido para la ejecución de los créditos (alrededor de un 30 % en el semestre pico de ejecución), y una mejor articulación de los proyectos y una coordinación más fluida con el BCIE."
IX.Que el proceso de reestructuración para la Unidad Ejecutora en cuestión no perjudica el presupuesto nacional, toda vez que de acuerdo con la Propuesta de Organización de la Unidad Ejecutora para el Portafolio de Proyectos y Programas de Inversión AyA / BCIE, cada uno de los desarrollos cuenta con financiamiento aprobado tanto de fuente externa del BCIE, como de fuente interna, ya contemplados. En este sentido, en oficio PRE-2019-00879, se indica que: "(...) se necesitan nuevas plazas por Servicios Especiales, se requieren algunas reasignaciones de puestos para aprovechar el conocimiento y la experiencia desarrollada en las Unidades Ejecutoras ya existentes que se integran a la nueva Unidad Ejecutora, y se presentarán nuevos gastos por el funcionamiento de la misma (remuneraciones, servicios, alquiler, materiales, activos, etc.), todo lo cual fue considerado en nuestra programación, en su momento, durante la gestión y aprobación de todos los créditos." Asimismo, se manifiesta que todos los gastos de operación de la Unidad Ejecutora relativos a remuneraciones, materiales, activos, entre otros, ya se encuentran contemplados en los créditos y las contrapartidas.
X.Que de conformidad con el artículo 12 bis del Decreto Ejecutivo N° 37045-MP-MEIC, publicado en Alcance 36 de la Gaceta N°60 del 23 de marzo de 2012, "Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos" y sus reformas, por la naturaleza del presente decreto ejecutivo, se considera que no es necesario completar la Sección I denominada Control Previo de Mejora Regulatoria, que conforma el formulario de Evaluación Costo Beneficio, toda vez que el mismo no establece nuevos trámites ni requerimientos para el administrado.
