in the entirety of the text - Complete Text of Norm 42 Establishes for the Central Pacific Conservation Area, the new Territorial Subunit of Orotina, which shall exercise the functions that the Forestry Law and its regulations establish for the State Forestry Administration Complete Text of record: 12F5C2 NATIONAL SYSTEM OF CONSERVATION AREAS CENTRAL PACIFIC CONSERVATION AREA SINAC-ACOPAC-D-RES-42-2019.-Ministry of Environment, Energy and Telecommunications. National System of Conservation Areas. Central Pacific Conservation Area. At eight hours ten minutes on the fourth of June, two thousand nineteen.
I.-That in a staff meeting of ACOPAC on the 26th of March, 2019, and according to the minutes prepared for said meeting, in point 5. "Transfer of the Regional Headquarters to Orotina", the agreement was adopted to form a commission to work on the legal and technical inputs to formally establish another subregional office, to assume responsibility for the cantons of Orotina, San Mateo and Garabito, due to the institutional need derived from the workload reflected by the Esparza-Orotina Subregional Office, in the service and operations that territorially cover six cantons.
II.-That according to official communication SINAC-ACOPAC-D-145-2019, the director of ACOPAC officially appoints the commission and details the tasks to be performed.
III.-That on the 10th of April, 2019, the commission met, as recorded in the minutes prepared for that purpose, where the institutional need for the creation of the new office was analyzed and the content of the proposal was defined.
IV.-That on the 6th of May, 2019, the Scientific Technical Committee of ACOPAC met, in order to review the technical proposal for the creation of the new subregional office, issuing the following recommendations:
"Recommendation 01-01-2019: having reviewed the proposal prepared by the commission appointed via official communication SINAC-ACOPAC-D-145-2019 and which technically substantiates the creation of a new territorial sub-unit in the Central Pacific Conservation Area (ACOPAC), which will be responsible for the fulfillment of the obligations conferred to this conservation area by the current legislation, in the cantons of Garabito, Orotina and San Mateo, and under the protection of the provisions of article 26 of the Regulation to the Biodiversity Law 7788, Decreto Ejecutivo N° 34433, the Scientific Technical Committee of ACOPAC recommends to the Regional Directorate the creation of the new territorial sub-unit described. To this end, it must proceed with the publication of the respective creation resolution in the Official Gazette La Gaceta and submit a draft executive decree to the Ministry of Environment and Energy, for the purpose of amending the decree creating the subregional offices, in what corresponds to the current Esparza Orotina Subregional Office, and also, amending the name of the Aguirre Parrita Subregional Office to Quepos Parrita Subregional Office." "Recommendation 02-01-2019: once the territorial sub-unit indicated in Recommendation 01-01-2019 is created, the Regional Directorate of the Central Pacific Conservation Area (ACOPAC) must provide the new work center with the material, financial, and human resources adequate for proper functioning, a process in which it may consider the existing vacant positions in the conservation area and carry out personnel transfers from other work centers of ACOPAC, deemed suitable." V.-That through official communication SINAC-ACOPAC-D-265-2019, the area director informs the Executive Secretary of the National System of Conservation Areas of the recommendations of the Scientific Technical Committee of ACOPAC, as well as a timeline with the actions, responsible parties, and deadline for their fulfillment.
VI.-That at the request of the Executive Directorate of SINAC, official communication SINAC-ACOPAC-D-284-2019 was submitted, containing the justification for the proposal to constitute the new territorial sub-unit in the Central Pacific Conservation Area (ACOPAC).
VII.-That both the technical proposal justifying the creation of this new subregional office and the other documents generated are contained in the administrative file (expediente administrativo) called "Expediente de creación nueva Sub-Unidad Territorial" N° SINAC-ACOPACD-EXP-14-2019.
The Subregions of the Conservation Areas will be governed by the same development and administration strategy as the Conservation Areas and will have an office.
4º-Likewise, that article 25 of this regulation indicates that the functions of the Director of the Conservation Area will be all those indicated in the legal and technical framework binding on their duties as hierarchical superior in the geographical scope under their charge; furthermore, they will ensure the establishment of the administrative structure of the Conservation Area, must consider those programs proposed by the CORAC as mandatory compliance and approved by CONAC.
The Director of the CA may establish the necessary territorial sub-units for the proper performance of the Conservation Area, based on the respective technical studies and with the recommendation of the corresponding Scientific-Technical Committee.
Each Director must implement, evaluate, and systematize, in the CA, the policies, guidelines, methodologies, norms, and strategies, and will also execute the directives issued by the respective CORAC, by CONAC, and by the Executive Secretariat.
They will also ensure the integration and proper functioning of the Scientific-Technical Committee and the Financial Administration Body, as well as the training, supervision, and well-being of the conservation area's personnel. Therefore, THE DIRECTOR OF THE CENTRAL PACIFIC CONSERVATION AREA
I.-To establish for the Central Pacific Conservation Area, the new Territorial Subunit of Orotina, which shall exercise the functions that the Forestry Law (Ley Forestal) and its regulations establish for the State Forestry Administration. In Wildlife matters, the provisions of the Wildlife Law and its Regulation shall continue to be observed, as shall all provisions and internal regulations issued by the Administration. Subregional Office is understood to mean the same entity established herein.
II.-The boundaries of the Esparza Subregional Office are modified, segregating from it the cantons of Orotina, San Mateo and Garabito, in their entirety.
III.-The new Territorial Subunit shall be domiciled in the canton of Orotina and for the purposes of nomenclature and taking into account article 25 of the Regulation to the Biodiversity Law, it shall continue to be called the Orotina Subregional Office, in order not to cause confusion to the citizens (administrados).
IV.-The corresponding administrative departments are instructed to carry out the pertinent processes to provide the new work center with the material, financial, and human resources adequate for proper functioning, a process in which existing vacant positions in the conservation area may be considered and personnel transfers from other work centers of ACOPAC deemed pertinent may be carried out.

Sistema Nacional de Áreas de Conservación. Área de Conservación Pacífico Central. A las ocho horas con diez minutos del cuatro de junio del dos mil diecinueve.
I.-Que en reunión de personal del ACOPAC del día 26 de marzo del 2019, y según minuta levantada de dicha reunión, en el punto 5. "Traslado de la Sede Regional a Orotina", se toma el acuerdo de conformar una comisión que trabaje en los insumos legales y técnicos para establecer formalmente otra oficina subregional, que asuma la atención de los cantones Orotina, San Mateo y Garabito, lo anterior debido a la necesidad institucional que se cuenta con el manejo que se refleja por parte de la Oficina Subregional Esparza- Orotina, en la atención y operaciones que abarca territorialmente de seis cantones.
II.-Que según oficio SINAC-ACOPAC-D-145-2019, el director de ACOPAC nombra oficialmente la comisión y les detalla las tareas a realizar.
III.-Que el 10 de abril del 2019, se reúne la comisión, según consta en la minuta levantada para tal efecto, donde se analiza la necesidad institucional de creación de la nueva oficina y se define el contenido de la propuesta.
IV.-Que el día 06 de mayo del 2019 se reúne el Comité Científico Técnico del ACOPAC, con el fin de conocer la propuesta técnica para la creación de la nueva oficina subregional, emitiendo las siguientes recomendaciones:
"Recomendación 01-01-2019: conocida la propuesta elaborada por la comisión nombrada mediante oficio SINAC-ACOPAC-D-145-2019 y en la cual se fundamenta técnicamente la creación de una nueva sub-unidad territorial en Área de Conservación Pacífico Central (ACOPAC) la cual tendrá a cargo el cumplimiento de las obligaciones conferidas a esta área de conservación por la legislación vigente, en los cantones de Garabito, Orotina y San Mateo y al amparo de lo estipulado por el artículo 26 del Reglamento a la Ley de Biodiversidad 7788, Decreto Ejecutivo N° 34433, el Comité Científico Técnico del ACOPAC recomienda a la Dirección Regional la creación de la nueva sub-unidad territorial descrita. Para ello, deberá realizar la publicación de la resolución de creación respectiva en el Diario Oficial La Gaceta y remitir borrador de decreto ejecutivo ante el Ministerio de Ambiente y Energía, a efectos de modificar el decreto de creación de las oficinas subregionales en lo correspondiente a la actual Oficina Subregional de Esparza Orotina y además, modificar el nombre de la Oficina Subregional Aguirre Parrita a Oficina Subregional Quepos Parrita".
"Recomendación 02-01-2019: una vez creada la subunidad territorial indicada en la Recomendación 01-01- 2019, la Dirección Regional del Área de Conservación Pacífico Central (ACOPAC) deberá dotar al nuevo centro de trabajo los recursos materiales, financieros y humanos adecuados para un buen funcionamiento, proceso en el cual podrá considerar las plazas vacantes existentes en el área de conservación y realizar traslados de personal de otros centros de trabajo del ACOPAC, que se considere idóneo".
V.-Que mediante oficio SINAC-ACOPAC-D-265-2019, el director del área, le informa a la Secretaria Ejecutiva del Sistema Nacional de Áreas de Conservación, las recomendaciones del Comité Científico Técnico del ACOPAC, así como un cronograma con las acciones, responsable y plazo para su cumplimiento.
VI.-Que ha solicitud a la Dirección Ejecutiva del SINAC, se remite el oficio SINAC- ACOPAC-D-284-2019, que contiene la justificación de la propuesta de constitución de la nueva subunidad territorial en el Área de Conservación Pacífico Central (ACOPAC).
VII.-Que tanto la propuesta técnica que justifica la creación de esta nueva oficina subregional y los demás documentos generados constan en el Territorial" N° SINAC-ACOPACD- EXP-14-2019.
Las Subregiones de las Áreas de Conservación serán regidas por la misma estrategia de desarrollo y administración de las Áreas de Conservación y tendrán una oficina.
4º-Así mismo que el artículo 25 de este reglamento indica que serán funciones del Director/a de Área de Conservación, todas las indicadas en el ordenamiento jurídico y técnico vinculante con sus deberes como superior jerárquico en el ámbito geográfico a su cargo; además, velará por el establecimiento de la estructura administrativa del Área de Conservación, debiendo considerar aquellos programas que sean propuestos por los CORAC como de acatamiento obligatorio y aprobados por el CONAC.
El Director(a) del AC podrá establecer las subunidades territoriales necesarias para el buen desempeño del Área de Conservación, con fundamento en los estudios técnicos respectivos y con la recomendación del Comité Científico-Técnico correspondiente.
Cada Director/a deberá implementar, evaluar y sistematizar, en el AC, las políticas, lineamientos, metodologías, normas y estrategias, asimismo ejecutará las directrices emitidas por el CORAC respectivo, por el CONAC y por la Secretaría Ejecutiva.
También, velará por la integración y el buen funcionamiento del Comité Científico-Técnico y el Órgano de Administración Financiera, así como por la capacitación, supervisión y bienestar del personal del área de conservación. Por lo tanto, EL DIRECTOR DEL ÁREA DE CONSERVACIÓN PACÍFICO CENTRAL
I.-Establecer para el Área de Conservación Pacífico Central, la nueva Subunidad Territorial de Orotina, la cual ejercerá las funciones que la Ley Forestal y su reglamento establece para la Administración Forestal del Estado. En materia de Vida Silvestre se seguirá acatando lo dispuesto por la Ley de Vida Silvestre y su Reglamento, así como todas las disposiciones y normativa interna emitida por la Administración. Se entiende por Oficina Subregional el mismo ente aquí establecido.
II.-Se modifican los límites de la Oficina Subregional de Esparza, segregándole los cantones de Orotina, San Mateo y Garabito, en su totalidad.
III.-La nueva Subunidad Territorial, se encontrará domiciliada en el cantón de Orotina y para efectos de nomenclatura y tomando en cuenta el artículo 25 del Reglamento a la Ley de Biodiversidad, se le seguirá llamando Oficina Subregional de Orotina, con el fin de no causar confusiones a los administrados.
IV.-Se instruye a los departamentos administrativos correspondientes para que realicen los procesos pertinentes para dotar al nuevo centro de trabajo de los recursos materiales, financieros y humanos adecuados para un buen funcionamiento, proceso en el cual podrá considerar las plazas vacantes existentes en el área de conservación y realizar traslados de personal de otros centros de trabajo del ACOPAC, que se consideren pertinentes.
