in the entirety of the text - Complete Text of Norm 006 Delimitation of the public zone of a mangrove sector of Playa Coyote Complete Text of record: 12F41E NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC DEPARTMENT AND TERRITORY OBSERVATION NOTICE No. 2019-006 MARITIME TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE OF A MANGROVE SECTOR OF PLAYA COYOTE Based on the powers conferred by Article 140 and Article 240, subsection 1 of the General Public Administration Law No. 6227, and the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulation.

1. 1That by Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget, and sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, aimed at the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and at the studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical and similar nature related to said works, in order to support planning processes.
2. 2That the Law Creating the National Geographic Institute, No. 59, establishes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any kind originating from the work entrusted to it.
3. 3That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."
4. 4That in Executive Decree No. 36642-MP-MOPTMINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone," it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, in order to expedite delimitations and provide greater technical security to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public agency, person, or private national or foreign entity must be referenced."; while Article 7 indicates that "As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, by appropriate means, that information which has been made official."
6. 6That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), the approval of survey plans (planos de agrimensura), the granting of concessions in the Restricted Zone, and other aspects of coastal land-use planning (ordenamiento territorial costero).
7. 7That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
8. 8That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by:

• a)Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares the CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone."

1. 9That Article 16 of the Forest Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit the boundaries on the ground of the areas that make up the Natural Heritage of the State.

10.-The National Geographic Institute, together with the Tempisque Conservation Area (Área de Conservación Tempisque), used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Playa Coyote; located in district 06 Bejuco, canton 09 Nandayure; province 05 Guanacaste, in accordance with proceedings carried out by José Miguel Valverde Rodríguez, ID number 5-0199-0696 and Fabián Jesús Bonilla Salguero, ID number 1-1282-0908 before the National Geographic Institute.

11.-That the delimitation carried out has internal technical endorsement according to official letter No. DIG-TOT-0230-2019 of June 20, 2019, issued by the Official Limits Subprocess of the Topographic Department and Territory Observation of the National Geographic Institute.

12.-That the delimitation carried out had the accompaniment of the Tempisque Conservation Area, National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), for the demarcation of the public zone in the mangrove ecosystem sector, in accordance with official letter ACT-OR-DR-684-19 dated June 3, 2019.

13.-That Article 140 of the General Public Administration Law No. 6227 states that "the administrative act shall produce its effect after it has been communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted," a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating: "General acts shall be communicated by publication, and specific ones, by notification." HEREBY NOTIFIES:

First.-That on May 15, 2019, the "Georeferenced Digital Delimitation to the national coordinate system to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Playa Coyote; located in district 06 Bejuco, canton 09 Nandayure; province 05 Guanacaste" was carried out.

Second.-The work for determining the public zone of the Maritime Terrestrial Zone was carried out on May 15, 2019, with the accompaniment of the Tempisque Conservation Area; this delimitation corresponds to a mangrove sector whose coordinates of georeferenced points (vertices) surveyed (MAM), indicated below, are in the official CRTM05 cartographic projection system of Costa Rica, and on the IGNCR- 1/50,000 Map Sheet Puerto Coyote, namely:

Third.-The mangrove sectors located in Playa Coyote that currently have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

Fourth.-The official technical data of the delimitation of the mangrove sector of the public zone of the Maritime Terrestrial Zone of Playa Coyote have been recorded in the Digital Georeferenced Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.

en la totalidad del texto - Texto Completo Norma 006 Delimitación de zona pública de un sector de manglar de Playa Coyote Texto Completo acta: 12F41E INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO AVISO Nº 2019-006 ZONA MARÍTIMA TERRESTRE DELIMITACIÓN DE ZONA PÚBLICA DE UN SECTOR DE MANGLAR DE PLAYA COYOTE Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley Nº 6227 General de la Administración Pública, y en lo dispuesto en la Ley Nº 59 de creación del Instituto Geográfico Nacional, la Ley Nº 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su respetivo reglamento.

1. 1Que mediante Ley Nº 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº 59, en el artículo 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18º que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
7. 7Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
8. 8Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por:

• a)el Decreto Ejecutivo Nº 7841-P "Reglamento a la Ley Nº 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

1. 9Que el artículo 16º de la Ley Forestal, Ley Nº 7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

10.-El Instituto Geográfico Nacional junto con el Área de Conservación Tempisque, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en un sector de manglar en Playa Coyote; ubicada en distrito 06 Bejuco, cantón 09 Nandayure; provincia 05 Guanacaste, esto conforme diligencias realizadas por José Miguel Valverde Rodríguez, cédula Nº 5-0199-0696 y Fabián Jesús Bonilla Salguero, cédula Nº 1-1282-0908 ante el Instituto Geográfico Nacional.

11.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio Nº DIG-TOT-0230-2019 del 20 de junio de 2019, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

12.-Que la delimitación realizada contó con el acompañamiento del Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación, para la demarcación de la zona pública en el sector de ecosistema de manglar, de acuerdo con el oficio ACT-OR-DR-684-19 de fecha 03 de junio del 2019.

13.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

Primero.-Que el 15 de mayo del 2019 se realizó la "Delimitación Digital Georreferenciada al sistema nacional de coordenadas para delimitar la zona pública de la Zona Marítimo Terrestre en un sector de manglar en Playa Coyote; ubicada en distrito 06 Bejuco, cantón 09 Nandayure; provincia 05 Guanacaste.

Segundo.-Los trabajos para la determinación de la zona pública de la Zona Marítimo Terrestre fueron realizados en día 15 de mayo de 2019 en acompañamiento con el Área de Conservación Tempisque; esta delimitación corresponde a un sector de manglar cuyas coordenadas de puntos (vértices) georreferenciados levantados (MAM) que se indican a continuación, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, y en los Mapa IGNCR- 1/50.000 Hoja Puerto Coyote, a saber:

Tercero.-Los sectores de manglar ubicados en Playa Coyote, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

Cuarto.-Los datos técnicos oficiales de la delimitación del sector de manglar de la zona pública de la Zona Marítimo Terrestre de Playa Coyote, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN.
