throughout the entire text - Complete Text of Norm 008 Delimitation of the Public Zone of Coastal Sectors of the Sierpe District, Osa Canton, Province of Puntarenas Complete Text of record: 12F347 NATIONAL GEOGRAPHIC INSTITUTE NOTICE No. 2019-008 MARITIME TERRESTRIAL ZONE Delimitation of the Public Zone of Coastal Sectors of the Sierpe District, Osa Canton, Province of Puntarenas Based on the powers conferred by Article 140 and Article 240, subsection 1, of Law No. 6227, the General Public Administration Act, and on the provisions of Law No. 59 creating the Instituto Geográfico Nacional, Law No. 8905 transferring the Instituto Geográfico Nacional to the Registro Nacional, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulations.

1. 1That by means of Law No. 8905, the Instituto Geográfico Nacional is established as a dependency of the Registro Nacional and that the Junta Administrativa of the Registro Nacional will administer the Institute's budget, and will sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the Instituto Geográfico Nacional will be the scientific and technical dependency governing national cartography, responsible for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and for the studies, research, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.
2. 2That the Law Creating the Instituto Geográfico Nacional, No. 59, establishes it on a permanent basis and in representation of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic, its authority extending to activities of any nature that have their origin in the work entrusted to it.
3. 3That in accordance with the Law Creating the Instituto Geográfico Nacional (IGN), No. 59, Article 62 of the Regulations to Law No. 6043, recognizes the competence of the Instituto Geográfico Nacional for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulations states that "The Instituto Geográfico Nacional must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone where it has demarcated the public zone."
4. 4That Executive Decree No. 36642-MP-MOPTMINAET "Regulations on Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone," establishes under Article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or the georeferenced digital delimitation, in order to expedite the delimitations and provide greater technical certainty to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines, the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public agency, private national or foreign person or entity must be referenced."; while Article 7 indicates that "As cartographic data is produced in the new cartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish by appropriate means that information that has been made official."
6. 6That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone, enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), the approval of survey plans (planos de agrimensura), the granting of concessions in the Restricted Zone, and other aspects of coastal land-use planning (ordenamiento territorial costero).
7. 7That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN, is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT).
8. 8That the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P "Regulations to Law No. 6043 on the Maritime Terrestrial Zone",

• b)Executive Decree No. 33797-MJ-MOPT "Declares as the official horizontal datum for Costa Rica, CR05, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulations on Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".

1. 9That Article 16° of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy will demarcate on the ground the boundaries of the areas that make up the Natural Heritage of the State.

10.-The Instituto Geográfico Nacional used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in nine coastal sectors in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas.

11.-That the delimitation carried out has internal technical endorsement according to official letter No. DIG-TOT-0210-2019 of May 28, 2019, issued by the Official Limits Sub-process of the Topographic and Territory Observation Department of the Instituto Geográfico Nacional.

12.-That Article 140 of Law No. 6227, the General Public Administration Act, states that "the administrative act shall produce its effect after it has been communicated to the administered party, except if it grants only rights, in which case it shall produce it from the time it is adopted", a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument for communicating acts of a general nature by stating that: "Acts of a general nature shall be communicated by publication and specific acts, by notification." COMMUNICATES:

1. 1That in the months of April to June 2019, the Instituto Geográfico Nacional used the "Georeferenced Digital Delimitation" to the national coordinate system, to delimit nine sectors of the public zone of the Maritime Terrestrial Zone in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas.

2º-The work for the determination of the public zone of the Maritime Terrestrial Zone was carried out between the months of April to June 2019; this delimitation corresponds to nine coastal sectors where, as of the date of signing this Notice, no delimitation of the public zone of the Maritime Terrestrial Zone exists, and whose extreme point coordinates are indicated below, in the official cartographic projection system of Costa Rica CRTM05, namely:

3º-The sectors located in district 03 Sierpe, which to date have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

4º-The official technical data for the delimitation of the nine sectors of the public zone of the Maritime Terrestrial Zone of the Sierpe district, have been recorded in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.-Curridabat, June 21, 2019.

Considering:

en la totalidad del texto - Texto Completo Norma 008 Delimitación de zona pública de sectores costeros del Distrito Sierpe, cantón Osa, Provincia de Puntarenas Texto Completo acta: 12F347 INSTITUTO GEOGRÁFICO NACIONAL AVISO Nº 2019-008 ZONA MARITIMA TERRESTRE Delimitación de Zona Pública de Sectores Costeros del Distrito Sierpe, Cantón Osa, Provincia Puntarenas Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley Nº 6227 General de la Administración Pública, y en lo dispuesto en la Ley Nº 59 de creación del Instituto Geográfico Nacional, la Ley Nº 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su respetivo reglamento.

1. 1Que mediante Ley Nº 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº 59, en el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
7. 7Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
8. 8Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo Nº 7841-P "Reglamento a la Ley Nº 6043 sobre la Zona Marítimo Terrestre",

• b)el Decreto Ejecutivo Nº 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

1. 9Que el artículo 16° de la Ley Forestal, Ley Nº7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

10.-El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en nueve sectores de costa en el distrito 03 Sierpe, cantón 05 Osa; provincia 06 Puntarenas.

11.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio N° DIG-TOT-0210-2019 del 28 de mayo de 2019, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

12.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1. 1Que en los meses de abril a junio de 2019 el Instituto Geográfico Nacional utilizó la "Delimitación Digital Georreferenciada" al sistema nacional de coordenadas, para delimitar nueve sectores de la zona pública de la Zona Marítimo Terrestre del distrito 03 Sierpe, cantón 05 Osa; provincia 06 Puntarenas.

2º-Los trabajos para la determinación de la zona pública de la Zona Marítimo Terrestre fueron realizados entre los meses abril a junio de 2019; esta delimitación corresponde a nueve sectores de costa donde no existe a la fecha de firma del presente Aviso delimitación zona pública de la Zona Marítimo Terrestre, y cuyas coordenadas de puntos extremos se indican a continuación, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, a saber:

3º-Los sectores ubicados en el distrito 03 Sierpe, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

4º-Los datos técnicos oficiales de la delimitación de los nueve sectores de la zona pública de la Zona Marítimo Terrestre del distrito Sierpe, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN.-Curridabat, 21 de junio de 2019.
