Therefore, THEY DECREE:

“Promulgation of this Agreement in the form of an Exchange of Notes between the Republic of Costa Rica and the Federal Republic of Germany concerning the project ‘Climate Change and Transportation in Costa Rica.’”

Its literal text is as follows:

San José, 07 ele noviembre del 2018 DM-DGPE-0673-2018 Honorable Sir:

I have the honor to address Your Excellency to acknowledge receipt of your esteemed note 404-468.40 /2-1 CRI TZ 5 dated 24 ele setiembre ele 2018, which reads as follows:

“Your Excellency, Madam Minister:

Pursuant to the Agreement concerning Technical Cooperation entered into between our two Governments on 23 ele julio de 1965, as well as the Amending Protocols of 13 ele marzo de 1986 and 18 ele diciembre de 2006, I have the honor, on behalf of the Government of the Federal Republic of Germany, to propose to Your Excellency the following supplementary Agreement concerning the ‘Climate Change and Transportation in Costa Rica’ project, within the framework of the International Climate Initiative of the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety:

3. The Government of the Federal Republic of Germany shall provide additional human resources and additional material contributions and, where appropriate, additional financial contributions for the project in a total amount of up to 2 500 000 euros (in words: two million five hundred thousand euros).

It shall entrust implementation to Deutsche Gesellschaft fúr Internationale Zusammenarbeit (GIZ) GmbH.

4. On behalf of the Government of the Republic of Costa Rica, the Ministerio de Ambiente y Energía shall be responsible for implementing the project.

5. The details of the project and the respective contributions and obligations shall be established in an implementation agreement (contrato de ejecución) and, where appropriate, a financing agreement (contrato de financiación), to be entered into between GJZ and the institution commissioned by the Government of the Republic of Costa Rica to implement the project, and shall be subject to the legal provisions in force in the Federal Republic of Germany.

HONORABLE SIR ANDRÉ SCHOLZ CHARGÉ D’AFFAIRES AD INTERIM FEDERAL REPUBLIC OF GERMANY 6. The commitment of the Government of the Federal Republic of Germany to the project shall lapse if the implementation agreement and, where appropriate, the financing agreement referred to in paragraph 5 are not entered into within four years, calculated from the year in which this Agreement enters into force. For the amount in question, the period shall expire on 31 de diciembre de 2022.

7. The Government of the Republic of Costa Rica shall exempt the materials, vehicles, goods, and equipment imported for the project on behalf and at the expense of the Government of the Federal Republic of Germany, as well as the corresponding spare parts used for the project referred to in paragraph 1, from all import and export duties, licensing requirements, port fees, storage charges, and other public levies, and shall ensure their prompt customs clearance.

8. The Government of the Republic of Costa Rica shall exempt GJZ from all direct taxes accruing in the Republic of Costa Rica in connection with the conclusion and performance of the implementation agreement and, where appropriate, the financing agreement referred to in paragraph 5.

9. At GIZ’s request, the Government of the Republic of Costa Rica shall refund value-added tax or other similar indirect taxes imposed in the Republic of Costa Rica on items acquired and services used in connection with the conclusion and performance of the implementation agreement and, where appropriate, the financing agreement referred to in paragraph 5. Excise taxes imposed in this connection shall be borne by the Government of the Republic of Costa Rica upon request.

10. This Agreement shall apply both to the project referred to in paragraph 1 and to future follow-up measures bearing the same title, should our two Governments wish to continue supporting the project. Commitments by the Government of the Federal Republic of Germany concerning the provision of support for follow-up measures relating to the project referred to in paragraph 1 shall be conveyed through an official communication from the Government of the Federal Republic of Germany that 11. In all other respects, the provisions of the Agreement concerning Technical Cooperation of 23 de Julio de 1 965 and the Amending Protocols of 13 ele marzo de 1986 and 18 ele diciembre de 2006 mentioned at the outset shall also apply to this Agreement.

12. This Agreement is concluded in German and Spanish, both texts being equally authentic.

Should the Government of the Republic of Costa Rica agree to the proposals contained in paragraphs 1 through 12, this Note and Your Excellency’s reply Note stating your Government’s agreement shall constitute an Agreement between our Governments, which shall enter into force on the date on which the Government of the Republic of Costa Rica has notified the Government of the Federal Republic of Germany, through diplomatic channels, that the domestic requirements necessary for the entry into force of this Exchange of Notes have been fulfilled.

I avail myself of this opportunity to renew to Your Excellency the assurances of my highest and most distinguished consideration.” In this regard, I have the honor to inform Your Excellency that the foregoing proposal is acceptable to the Government of the Republic of Costa Rica and that Your Excellency’s Note and this Note constitute an Agreement between our Governments, which shall enter into force on the date on which the Government of the Republic of Costa Rica has notified the Government of the Federal Republic of Germany, through diplomatic channels, that the domestic requirements necessary for the entry into force of this Exchange of Notes have been fulfilled.

10. This Agreement shall apply both to the project referred to in paragraph 1 and to future follow-up measures bearing the same title, should our two Governments wish to continue promoting the project. Commitments by the Government of the Federal Republic of Germany concerning the provision of support for follow-up measures relating to the project referred to in paragraph 1 shall be conveyed by means of an official communication from the Government of the Federal Republic of Germany expressly referring to this Agreement.

11. In all other respects, the provisions of the Agreement on Technical Cooperation of July 23, 1965, and the Protocols of Amendment of March 13, 1986, and December 18, 2006, referred to at the outset, shall also apply to this Agreement.

12. This Agreement is concluded in German and Spanish, both texts being equally authentic.

Should the Government of the Republic of Costa Rica agree to the proposals contained in paragraphs 1 through 12, this Note and Your Excellency’s Note in reply stating the agreement of your Government shall constitute an Agreement between our Governments, which shall enter into force on the date on which the Government of the Republic of Costa Rica has notified the Government of the Federal Republic of Germany, through diplomatic channels, that the internal requirements necessary for the entry into force of this Exchange of Notes have been fulfilled.

Tengo el honor de dirigirme a Vuestra Señoría, en ocasión ele acusar recibo ele su atenta nota 404-468.40 /2-1 CRI TZ 5 de fecha 24 ele setiembre ele 2018, que dice lo siguiente:

"Excelentísima Señora Ministra:

En cumplimiento del Convenio sobre Cooperación Técnica, concertado entre nuestros dos Gobiernos el 23 ele julio de 1965, así como de los Protocolos ele Enmienda del 13 ele marzo de 1986 y del 18 ele diciembre de 2006, tengo el honor de proponer a Vuestra Excelencia, en nombre del Gobierno de la República Federal de Alemania, el siguiente Acuerdo adicional sobre el proyecto "Cambio climático y transporte en Costa Rica", en el marco ele la Iniciativa Internacional de Protección del Clima del Ministerio Federal de Medio Ambiente, Protección ele la Naturaleza y Seguridad Nuclear:

1. El Gobierno ele la República Federal de Alemania y el Gobierno de la República de Costa Rica seguirán conjuntamente con el fomento del proyecto "Cambio climático y transporte en Costa Rica", si después ele examinado, sigue resultando susceptible de apoyo.

2. El objetivo del proyecto es contribuir a la protección del clima y al desarrollo sostenible en la República ele Costa Rica, a través del fomento ele medidas para la mitigación de gases ele efecto invernadero.

3. .El Gobierno ele la República Federal de Alemania facilitará recursos humanos adicionales y realizará prestaciones materiales adicionales y, si procede, aportaciones financieras adicionales para el proyecto por un monto total ele hasta 2 500 000 euros (en letras: dos millones quinientos mil euros).

Confiará la ejecución a la Deutsche Gesellschaft fúr Internationale Zusammenarbeit (GIZ) GmbH.

4. Por parte del Gobierno ele la República de Costa Rica será responsable ele la ejecución del proyecto el Ministerio ele Ambiente y Energía.

5. Los detalles del proyecto y de las prestaciones y obligaciones respectivas se fijarán en. un contrato ele ejecución y, si procede, de financiación. que habrá. ele ser concertado entre la GJZ y la institución. a la que el Gobierno ele la República de Costa Rica encargue la ejecución del proyecto y que estará sujeto a las disposiciones legales vigentes en la República Federal ele Alemania.

REPÚBLICA FEDERAL DE ALEMANIA 6. El compromiso del Gobierno de la República Federal ele Alemania para el proyecto quedará sin efecto si el contrato ele ejecución y, si procede, de financiación mencionado en el párrafo 5 no se concierta dentro de un plazo de cuatro años contado a partir del año de la entrada en vigor del presente Acuerdo. Para el monto en cuestión el plazo concluirá el 31 de diciembre de 2022.

7. El Gobierno ele la República ele Costa Rica eximirá a los materiales, vehículos, bienes y equipos importados para el proyecto por encargo y a expensas del. Gobierno ele la República Federal de Alemania) así como a los respectivos repuestos que se utilicen para el proyecto mencionado en el párrafo 1, ele todos los derechos ele importación y exportación, así como de licencias, tasas portuarias, derechos de almacenaje y demás gravámenes públicos, y asegurará que pasen aduana sin demora.

8. El Gobierno de la República de Costa Rica eximirá a la GJZ ele todos los impuestos directos que se devenguen en la República ele Costa Rica en relación con la concertación y ejecución del contrato ele ejecución y, si procede, ele financiación mencionado en el párrafo 5.

9. El Gobierno ele la República de Costa Rica reembolsará a solicitud de la. GIZ el impuesto sobre el valor añadido u otros impuestos indirectos similares que hayan sido aplicados en la República de Costa Rica sobre objetos adquiridos y servicios utilizados en relación con la concertación y ejecución del contrato de ejecución y, si procede, de financiación mencionado en el párrafo 5. Los impuestos especiales al consumo que se hayan aplicado en este contexto serán asumidos por el Gobierno de la República ele Costa Rica siguiendo una solicitud.

10. El presente Acuerdo se aplicará tanto al proyecto mencionado en el párrafo 1 como a futuras medidas de seguimiento con el mismo título en caso de que nuestros dos Gobiernos deseen continuar el fomento del proyecto. Los compromisos del Gobierno ele la República Federal de Alemania relativos a la concesión de fomento respecto a medidas de seguimiento del proyecto mencionado en el _párrafo 1 se transmitirán mediante comunicado oficial del Gobierno de la República Federal ele Alemania en. el que se hará referencia explícita al _presente Acuerdo.

11. Por lo demás se aplicarán también al presente Acuerdo las disposiciones del Convenio sobre Cooperación Técnica del 23 de Julio de 1 965 y ele los Protocolos ele Enmienda del 13 ele marzo de 1986 y del 18 ele diciembre de 2006 mencionados al inicio .

12. El presente Acuerdo se concierta en alemán y español, siendo ambos textos igualmente auténticos.

En caso de que el Gobierno ele la República de Costa Rica se declare conforme con las propuestas contenidas en los párrafos 1 a 12, esta Nota y la Nota de respuesta de Vuestra. Excelencia en la que conste la conformidad de su Gobierno constituirán un Acuerdo entre nuestros Gobiernos que entrará en vigor el día en que el Gobierno de la República ele Costa Rica haya comunicado al Gobierno ele la República Federal de Alemania, por la vía diplomática, el cumplimiento ele los requisitos internos necesarios para la entrada en vigor del presente Canje de Notas.

Aprovecho la ocasión para reiterar a Vuestra Excelencia, el testimonio de mi más alta y distinguida consideración".

Sobre el particular, tengo el honor de informar a Vuestra Señoría que la propuesta anterior es aceptable al Gobierno de la República de Costa Rica y que la Nota ele Vuestra Señoría y la presente constituyen un Acuerdo entre nuestros Gobiernos, que entrará en vigencia el día en que el Gobierno de la República de Costa Rica haya comunicado al Gobierno ele la República Federal de Alemania, por la vía diplomática, el cumplimiento de los requisitos internos necesarios para la entrada en vigor del presente Canje ele Notas.

12. El presente Acuerdo se concierta en alemán y español, siendo ambos textos igualmente auténticos.
