throughout the text - Complete Text of Norm 272 Approves the closure proposal for the year 2019 Complete Text of record: 12D09F COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/272-2019.-San José, on the sixteenth day of the month of May of two thousand nineteen.

1. 1That it is the responsibility and competence of INCOPESCA to ensure the promotion of responsible fishing that guarantees the sustainable use and protection of fishery resources.
2. 2That in accordance with Law 8436, the Fisheries and Aquaculture Law, INCOPESCA may establish, based on technical, economic, and social criteria, the closure periods (periodos de veda) it deems necessary for the different fishing zones that, due to their condition, require them.
3. 3That having analyzed the content of the ruling (voto) of the Constitutional Chamber of the Supreme Court of Justice number 2019-004046, Exp: 18-010494-0007-CO, at nine thirty on the 8th of March of 2019, it is convenient and reasonable, in order to adjust the closure in the Gulf of Nicoya to the terms and conditions established by current regulations and the content of said ruling, to institute the closure within the months in which reproduction peaks of marine species occur, with the objective of giving a reasonable period to INCOPESCA to present the updated technical and scientific criteria, and to the Joint Institute for Social Aid, IMAS, the corresponding socioeconomic studies.
4. 4That the 2019 closure proposal was analyzed and discussed, in accordance with what was thus agreed by the National Closures Commission (Comisión Nacional de Vedas), at Extraordinary Meeting No. 3, held on the 21st day of March 2019, where the recommendations made by the INCOPESCA Department of Research and Development and the Technical-Scientific Coordination Commission (CCCT) and the conditions established in the aforementioned ruling of the Constitutional Chamber were also considered.
5. 5That by means of Constitutional Chamber ruling No. 2019-00406 at nine thirty on the eighth of March of two thousand nineteen, it was determined that for the establishment of closures, the social and environmental studies justifying them must be available.
6. 6That for the case of the Gulf of Nicoya, according to the ruling indicated in the preceding considering clause, any of the periods with higher reproduction peaks determined by the corresponding technical studies must be considered, specifically the months established for the 2019 closure, where there are reproduction peaks, reason for which,

THE BOARD OF DIRECTORS OF INCOPESCA THEREFORE;

1-To approve the closure proposal for the year 2019, under the following terms and conditions:

1.1 To establish a total closure for small-scale fishing (pesca en pequeña escala), in the area encompassed by an imaginary straight line running from Punta Torres, known as Peñón (09°53'31" North Latitude, 084°43'52" West Longitude), and from there to the East part of Punta Cuchillo on the Nicoya Peninsula, and from this line inshore to the mouth of the Tempisque River.

This fishing prohibition runs from August 1st to October 31st, 2019, both dates inclusive.

1.2 INCOPESCA may authorize sport fishing tournaments during the closure periods and zones, in the area encompassed by an imaginary straight line running from the Puntarenas Lighthouse to the Negritos Island Lighthouse (09°49'14" North Latitude, 084°49'35" West Longitude) and from this line seaward; catches made during the sport fishing tournament must be released in their entirety.

1.3 Owners of small-scale artisanal fleet vessels in the Gulf of Nicoya, with fishing licenses to operate in zones a and b, may opt out of the closure, provided they expressly request this from Incopesca. They may only fish using hand lines (cuerdas de mano en línea), regardless of the fishing gear (arte de pesca) they are authorized to use, outside the closed area indicated in article 1.1; they may carry out their fishing operations with the recognition of fuel at a competitive price, from August 1st to October 31st, 2019.

2-To establish a total closure starting in the year 2020, from May 1st to July 31st of each year, in the Gulf of Nicoya, in the area encompassed by an imaginary straight line running from Punta Torres, known as Peñón (09°53'31" North Latitude, 084°43'52" West Longitude), to the offshore Negritos Island Lighthouse (09°49'14" North Latitude, 084°49'35" West Longitude), and from there to the East part of Punta Cuchillo on the Nicoya Peninsula, and from this line inshore to the mouth of the Tempisque River. The above is until such time as a variation of the indicated dates is determined by means of Board of Directors agreements.

3-The map annexed in the following box is to be considered an integral part of this Agreement:

RESOLVES

en la totalidad del texto - Texto Completo Norma 272 Aprueba la propuesta de veda para el año 2019 Texto Completo acta: 12D09F INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/272-2019.-San José, a los dieciséis días del mes de mayo de dos mil diecinueve.

1. 1Que es responsabilidad y competencia del INCOPESCA, velar por el fomento de la pesca responsable que garantice el aprovechamiento sostenible y protección de los recursos pesqueros.
2. 2Que de conformidad con la Ley 8436, Ley de Pesca y Acuicultura, el INCOPESCA podrá establecer con base en criterios técnicos, económicos y sociales, los periodos de veda que considere necesarios para las diferentes zonas de pesca que por su condición lo requieran.
3. 3Que analizado el contenido del voto de la Sala Constitucional de la Corte Suprema de Justicia número 2019-004046, Exp: 18-010494-0007-CO, de las nueve horas con treinta minutos del 08 de marzo del año 2019, resulta conveniente y razonable en aras de ajustar la veda en el Golfo de Nicoya a los términos y condiciones establecidos por de la normativa vigente y el contenido de dicho voto, instaurar la veda dentro de los meses en que se producen picos de reproducción de las especies marinas con el objetivo de dar un plazo razonable al INCOPESCA, para que presente la actualización de criterios técnicos y científicos y al Instituto Mixto de Ayuda Social, IMAS, los estudios socioeconómicos correspondientes.
4. 4Que analizada y discutida propuesta de veda 2019, de conformidad con lo así acordado por la Comisión Nacional de Vedas, en la Reunión Extraordinaria N° 3, celebrada el día 21 de marzo 2019, donde se consideraron, además, las recomendaciones vertidas por el Departamento de Investigación y Desarrollo del INCOPESCA y de la Comisión de Coordinación Científico Técnica (CCCT) las condiciones establecidas en el voto de la Sala Constitucional ya citado.
5. 5Que por medio del voto de la Sala Constitucional N°2019- 00406 de las nueve horas con treinta minutos del ocho de marzo del dos mil diecinueve, se determinó que para el establecimiento de las vedas se debe contar con los estudios sociales y ambientales que justifiquen la misma.
6. 6Que para el caso del Golfo de Nicoya según en el voto indicado en el considerando anterior, se debe considerar cualquiera de las épocas con picos de reproducción mayores que hayan determinado los estudios técnicos correspondientes, caso específico de los meses establecidos de veda 2019, donde se tienen picos de reproducción, razón por la cual,

LA JUNTA DIRECTIVA DE INCOPESCA POR TANTO; ACUERDA 1-Aprobar la propuesta de veda para el año 2019, en los siguientes términos y condiciones:

1.1 Establecer una veda total para la pesca en pequeña escala, en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53 '31"Latitud Norte, 084°43'52" Longitud Oeste) y de ahí a la parte Este de Punta Cuchillo en la Península de Nicoya y de esa línea aguas adentro hasta la desembocadura del río Tempisque.

Esta prohibición de pesca va desde el 01 de agosto hasta el 31 de octubre del 2019, ambas fechas incluidas.

1.2 INCOPESCA podrá autorizar torneos de pesca deportiva durante los plazos y zonas de veda, en el área comprendida por una línea recta imaginaria que va desde el Faro de Puntarenas hasta el Faro de la Isla Negritos (09°49´14") Latitud Norte, 084°49´35" Longitud Oeste) y de esa línea aguas afuera, las capturas realizadas en el torneo de pesca deportiva, deberán ser liberadas en su totalidad.

1.3 Los propietarios de embarcaciones de la flota artesanal en pequeña escala del Golfo de Nicoya, con licencias de pesca para faenar en las zonas a y b, podrán no acogerse a la veda, siempre y cuando lo soliciten de manera expresa al Incopesca. Únicamente podrán pescar utilizando cuerdas de mano en línea, independientemente del arte de pesca que tengan autorizado, fuera del área vedada indicada en el artículo 1.1; pudiendo realizar sus faenas de pesca con el reconocimiento del combustible a precio competitivo, del 01 de agosto al 31 de octubre del 2019.

2- Establecer la veda total a partir del año 2020 del 01 de mayo al 31 de julio de cada año, en el Golfo de Nicoya, en el área comprendida por una línea recta imaginaria que va desde Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afizera (09°49´14" Latitud Norte, 084| 49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillo en la Península de Nicoya y de esa línea aguas adentro hasta la desembocadura del río Tempisque. Lo anterior hasta el momento en que por medio de acuerdos de Junta Directiva se determine la variación de las fechas indicadas.

3- Téngase como parte integral del presente Acuerdo, el mapa que se anexa en el cuadro siguiente:
