ADOPTION OF AMENDMENTS TO THE LIMITATION AMOUNTS SET OUT IN THE 1992 PROTOCOL TO AMEND THE INTERNATIONAL CONVENTION ON CIVIL LIABILITY FOR OIL POLLUTION DAMAGE, 1969 THE LEGAL COMMITTEE, meeting at its 82nd session:
RECALLING article 33(b) of the Convention on the International Maritime Organization (hereinafter referred to as "the IMO Convention"), which concerns the functions of the Committee, MINDFUL of the provisions of article 36 of the IMO Convention, concerning the rules governing the procedures to be followed when exercising functions conferred on it by or under any international convention or instrument, RECALLING FURTHER article 15 of the 1992 Protocol to amend the International Convention on Civil Liability for Oil Pollution Damage, 1969 (hereinafter referred to as "the 1992 Protocol to the Civil Liability Convention"), which concerns the procedures for amending the limitation amounts set out in article 6(1) of the 1992 Protocol to the Civil Liability Convention, HAVING EXAMINED the proposed amendments to the limitation amounts proposed and distributed in accordance with the provisions of articles 15(1) and 15(2) of the 1992 Protocol to the Civil Liability Convention, 1.
ADOPTS, in accordance with the provisions of article 15(4) of the 1992 Protocol to the Civil Liability Convention, the amendments to the limitation amounts set out in article 6(1) of the 1992 Protocol to the Civil Liability Convention, the text of which is set out in the annex to this resolution; 2. DECIDES, in accordance with the provisions of article 15(7) of the 1992 Protocol to the Civil Liability Convention, that these amendments shall be deemed to have been accepted on 1 May 2002, unless, before that date, no fewer than one-quarter of the States that were States Parties on the date of their adoption (i.e., 18 October 2000) have communicated to the Organization that they do not accept them; 3. DECIDES ALSO that, in accordance with the provisions of article 15(8) of the 1992 Protocol to the Civil Liability Convention, these amendments, which shall be deemed to have been accepted in accordance with paragraph 2 above, shall enter into force on 1 November 2003; 4.
REQUESTS the Secretary-General, in accordance with the provisions of articles 15(7) and 17(2)(v) of the 1992 Protocol to the Civil Liability Convention, to transmit certified copies of this resolution and the amendments set out in its annex to all States that have signed the 1992 Protocol to the Civil Liability Convention or have acceded to it; and 5. REQUESTS FURTHER the Secretary-General to transmit copies of this resolution and its annex to the Members of the Organization that have not signed the 1992 Protocol to the Civil Liability Convention nor acceded to it.
