8905, the Instituto Geográfico Nacional is established as a dependency of the Registro Nacional and that the Junta Administrativa of the Registro Nacional will administer the Institute's budget, and will sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the Instituto Geográfico Nacional will be the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, research, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical nature and of a similar nature related to said works, in order to support planning processes.

59, establishes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the work entrusted to its charge.

59, in Article 62 of the Regulation to Law No. 6043, the competence of the Instituto Geográfico Nacional is recognized for the delimitation of the public zone of the Zona Marítimo Terrestre, and its officialization through publication in the Diario Oficial La Gaceta, while Article 63 of the same Regulation states that "The Instituto Geográfico Nacional must publish a notice in the Diario Oficial, for each portion of the Zona Marítimo Terrestre in which it has demarcated the public zone."

36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre," it is established according to Article 18° that for the delimitation of the public zone of the Zona Marítimo Terrestre, the IGN may resort to two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Zona Marítimo Terrestre through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite the delimitations and provide greater technical security to the interested parties.

33797-MJ-MOPT, which among other aspects determines the Red Geodésica Nacional de Referencia Horizontal CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The Red Geodésica Nacional de Referencia Horizontal CR05 and the cartographic projection system CRTM05 will constitute the sole official coordinate system for the Republic of Costa Rica from which all cartographic and geodetic surveys and activities developed in the National Territory by any public dependency, person, or private national or foreign entity must be referenced." ; while Article 7 indicates that "As cartographic data are produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional will publish through appropriate means that information which has been made official."

7575 of February 13, 1996, establishes that the Ministry of Environment and Energy will delimit on the ground the boundaries of the areas that constitute the National Natural Heritage (Patrimonio Natural del Estado).

10.-The Instituto Geográfico Nacional, together with the Tempisque Conservation Area (Área de Conservación Tempisque), used the "Delimitación Digital Georreferenciada" methodology to delimit the public zone of the Zona Marítimo Terrestre in two estuary/mangrove sectors in Playa Camaronal; located in district 03 Zapotal, canton 09 Nandayure; province 05 Guanacaste.

11.-That the inputs generated from the "Programa de Regularización del Catastro y Registro Contrato Préstamo 1284/OC-CR" of the sector subject to this notice were used.

1. 12That the delimitation carried out has internal technical endorsement according to officio No. DIG-TOT-0084-2019 of March 21, 2019, issued by the Subprocess of Official Limits of the Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional.

13-.That the delimitation carried out was accompanied by the Tempisque Conservation Area (Área de Conservación Tempisque), Sistema de Áreas de Conservación, for the demarcation of the public zone in the two sectors of mangrove ecosystems, according to officios ACT-OR-DR-306-19, dated March 12, 2019, and ACTOR-DR-177-19, dated February 14, 2019.

14.-That Article 140 of Law No. 6227 General Law of Public Administration states that "the administrative act will produce its effect after being communicated to the administered party, except if it grants only rights, in which case it will produce it from when it is adopted," a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument to communicate acts of a generic nature by stating that: "General acts will be communicated by publication and concrete ones by notification." Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

10.-El Instituto Geográfico Nacional junto con el Área de Conservación Tempisque, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en dos sectores de estero/manglar en Playa Camaronal; ubicada en distrito 03 Zapotal, cantón 09 Nandayure; provincia 05 Guanacaste.

11.-Que se utilizó los insumos generados a partir del "Programa de Regularización del Catastro y Registro Contrato Préstamo 1284/OC-CR" del sector objeto del presente aviso.

1. 12Que la delimitación realizada cuenta con aval técnico interno conforme al oficio N° DIG-TOT-0084-2019 del 21 de marzo de 2019, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

13-.Que la delimitación realizada contó con el acompañamiento del Área de Conservación Tempisque, Sistema de Áreas de Conservación, para la demarcación de la zona pública en los dos sectores de ecosistemas de manglar, de acuerdo con los oficios ACT-OR-DR-306-19, de fecha 12 de marzo de 2019 y ACTOR-DR-177-19, de fecha 14 de febrero de 2019.

14.-Que el artículo 140 de la Ley No. 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".
