Creation of the Environmental Recognition System (SIREA)Creación del Sistema de Reconocimientos Ambientales (SIREA)

The Environmental Recognition System (hereinafter SIREA) is created, whose objective is to integrate the environmental recognitions existing in the country, in accordance with the requirements defined in this Regulation, so that they have the endorsement of the State.

The specific objectives of SIREA are the following:

• a)To become the State recognition system in environmental matters.
• b)To promote the continuous improvement of the recognitions that form part of the system, in aspects such as evaluation procedures, communication, dissemination, and transparency.
• c)To contribute to improving environmental quality through the adoption of good practices in the public and private sectors.
• d)To publicize and promote innovative experiences with a positive impact on the environment.

The general management principles that frame and guide the operation of SIREA are the following:

• a)Accountability: responsibility of an Organization or Organizer to offer answers to governing bodies, state authorities, and other interested parties, regarding its decisions and actions.
• b)Ethical behavior: behavior that is consistent with the generally accepted principles of good conduct in the context of a specific situation and that is concordant with national and international regulations related to the matter.
• c)Continuous improvement: quality strategy or methodology based on the continuous search for and application of improvement opportunities.
• d)Transparency: openness regarding decisions and activities that affect society and the environment, and willingness to communicate these in a clear, accurate, and complete manner.

For the purposes of this Regulation, the following definitions shall apply:

• a)Scope: refers to the areas of the organization that are to be evaluated, as well as the processes included in the evaluation to obtain a recognition.
• b)Evaluation criteria: verifiable parameters corresponding to attributes or variables of a quantitative nature, used in an evaluation process.
• c)Evaluator: competent person designated by the Organizer of a recognition to carry out the evaluation of an Organization applying for a recognition.
• d)Organization: for the purposes of this Regulation, Organization shall be understood as all public and private physical and legal persons that opt for a recognition.
• e)Organizer: a public or private entity responsible for managing the technical and logistical processes of a SIREA recognition.
• f)Recognition: award given to one or more organizations that demonstrate specific, systematic, and successful achievements in pursuit of sustainable development. It is granted to an Organization that, having undergone an evaluation process, meets the criteria that make it deserving of said award.
• g)SIREA: State Environmental Recognition System that integrates the country's environmental recognitions.

The Technical Advisory Committee of SIREA (hereinafter CTC-SIREA) is created, which will ensure the implementation of this Regulation, and will be composed of a representative and an alternate from the following MINAE bodies:

• a)Directorate of Environmental Quality Management (Dirección de Gestión de Calidad Ambiental, DIGECA, which will coordinate).
• b)Directorate of Climate Change (Dirección de Cambio Climático, DCC).
• c)Directorate of Energy (Dirección de Energía, DE).
• d)the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC).

The foregoing, without prejudice that any other public or private body or technical experts may be convened for specific cases, for advice on required matters, and even to constitute ad hoc commissions.

For its internal organization, working procedures, convening, and agreements, the CTC-SIREA shall be governed by the provisions of Book I, Title II, Chapter III of the General Law of Public Administration No. 6227, regarding collegiate bodies.

The powers and responsibilities of the CTC-SIREA are the following:

• a)To carry out the evaluations of the recognitions that wish to be incorporated into SIREA.
• b)To submit for the knowledge of the MINAE minister:

b.1. The normative and procedural instruments required for the effective implementation of this Regulation.

b.2. The recommendations for the incorporation of recognitions into SIREA.

• c)To create and maintain an updated registry of recognitions incorporated into SIREA, with their respective organizers. This registry will be available on the website www.digeca.go.cr.
• d)To inform the organizers of the results of the evaluations carried out for the admission of their recognitions into SIREA.
• e)To support the organizers with:

e.1. The continuous improvement of their applied procedures.

e.2. The public dissemination of successful cases.

• f)To verify that the recognitions that form part of SIREA meet the requirements established in this Regulation.
• g)To recommend to the Minister of Environment and Energy the withdrawal of the use of the SIREA seal (distintivo) from those organizers of recognitions that fail to comply with the provisions of this Regulation, in accordance with what is indicated in Articles 17 and 18.
• h)To make public knowledge the withdrawal of the use of the SIREA seal (distintivo).
• i)Any other action necessary for the proper implementation of this regulation.

Environmental recognitions existing in the country at the time of publication of this Regulation, as well as those created in the future, whose organizer is a public sector institution, must be incorporated into SIREA, and for this they must comply with the requirements indicated in this Regulation.

Likewise, organizers of private sector environmental recognitions may form part of SIREA, provided they comply with all the provisions indicated in this Regulation.

Throughout the year, the CTC of SIREA will receive applications from organizers for the incorporation of their environmental recognitions into the system by means of the form indicated in Article 9, subsection a) of this Regulation.

Organizers aspiring to incorporate into SIREA the recognition under their charge must:

• a)Complete the official registration form available on the website www.digeca.go.cr and present it to this body.
• b)Undergo an evaluation process by the CTC-SIREA, in which compliance with the basic requirements established in Articles 10 and 11 will be verified.

Each recognition that forms part of SIREA must:

• a)Address the environmental theme.
• b)Have an Organizer with the capacity to fulfill the functions described in this Regulation.
• c)Have a transparent and objective evaluation system in which there are clear, verifiable, and quantifiable criteria.
• d)Have a group of evaluators trained in the subject matter they evaluate and who meet the profile generated for that purpose.

For the incorporation of a recognition into SIREA, the Organizer must undergo an evaluation process by the CTC-SIREA in which the following general criteria are considered at a minimum, without prejudice to the existence of other specific criteria:

• a)Experience of the Organizer in the subject matter of its recognition.
• b)Availability of records (registration applications, evaluators, evaluated organizations, recognized organizations, and validity of the recognitions given to the organizations).
• c)Implementation of procedures that ensure at least the following stages of the process: registration, evaluation (including technical evaluation criteria with on-site verification), award and withdrawal of the recognition when applicable, and handling of appeals (acciones recursivas).
• d)Profile of the evaluators that are pertinent to the subject matter of the recognition.

The evaluation instrument that contains the general and specific criteria with their respective qualification weights will be published on the website www.digeca.go.cr.

In the case of recognitions whose evaluation process is carried out through the National Quality System (Sistema Nacional de la Calidad), where there is a specific standard issued by the National Standardization Body, for the purposes of incorporation into SIREA, the Organizer must only comply with the provisions of Article 9, subsection a), Article 10, and Article 15, subsections a), b), c), f), g), and h) of this Regulation.

The Minister of MINAE, within a period of 60 business days from the submission of the requirements set forth in Articles 9, 10, 11, and 12 of this Regulation, shall issue a response to the applications for incorporation of a recognition into SIREA, upon prior recommendation issued by the CTC-SIREA.

Organizers in disagreement with the evaluation results may file administrative appeals or claims with the Minister of Environment and Energy, in accordance with the provisions of the General Law of Public Administration No. 6227.

In addition to complying with what is indicated in Article 9 of this Regulation, the responsibilities of the organizers of the recognitions incorporated into SIREA are the following:

• a)To provide the information required at the request of the CTC-SIREA on matters related to the implementation of this Regulation.
• b)To maintain an updated registry on their website of the recognized organizations, as well as of Evaluators. This registry must be kept updated.

Additionally, said website must have an updated schedule indicating the periods for registration, evaluation, and awarding of recognitions.

• c)To inform MINAE of the holding of the ceremonial act for awarding recognitions.
• d)To have mechanisms for control, registry, custody, and safeguarding of the confidentiality of all documentation related to the evaluation processes of the organizations, for purposes of transparency and follow-up by the CTC-SIREA.
• e)To address consultations, appeals, or claims, as applicable, that may arise from the organizations during the evaluation process, evaluation results, and the validity of the recognition under their charge.
• f)To comply with the frequency of awarding the recognition they organize.
• g)To indicate on the seal (distintivo) given to the Organizations the scope and validity of the recognition.
• h)To comply with all applicable provisions of this Regulation in their function as organizer.

Those recognitions incorporated into SIREA will have the following benefits:

1. A seal (distintivo) for advertising use that highlights the Organization as part of SIREA.

2. Being part of the National Registry of Environmental Recognitions.

3. Promotion and information provided by the Ministry of Environment and Energy through official channels.

4. Those derived from State contracting procedures, duly endorsed by the competent body in public procurement.

Once the recognition has been incorporated into SIREA, the term of its permanence within the system will be five years, provided it complies with the provisions of this Regulation and the evaluation instruments. For these purposes, the CTC-SIREA will be authorized to carry out periodic evaluations after its incorporation in order to verify said compliance.

In case of non-compliance, the recognition will be excluded from the system, following prior due process.

Within the SIREA framework, the Minister of Environment and Energy will grant a seal (distintivo) that identifies those recognitions that have been incorporated into SIREA.

The right to and use of the SIREA seal (distintivo) and its scope will be established via an administrative resolution issued by the Minister of MINAE.

Organizations that have been awarded a recognition that forms part of SIREA may use the seal (distintivo) of the recognition for advertising, provided it is valid, the type of recognition obtained, the physical scope, and the processes evaluated for the recognition are specified, as well as its validity.

The organizer of the recognition must ensure compliance with the foregoing provisions by the recognized organizations; in the event that any organization incurs a violation of the provisions of this article, the organizer must take the necessary measures for the immediate withdrawal of the seal (distintivo).

The following instruments are repealed:

a. Articles 2 and 4 of Executive Decree No. 34204 "Repeal of Executive Decree No. 27485-MINAE, and of subsections A) and B) of Article 10 of Executive Decree No. 30077-MINAE, and Modification of Article 20 of Executive Decree No. 33525-MINAE, published in La Gaceta No. 31 of February 13, 2007" of November 23, 2007, published in La Gaceta No. 08 of January 11, 2008.

b. Executive Decree No. 37109 "Regulation of the Environmental Recognition System (SIREA) and repeal of Executive Decree No. 33525-MINAE, Regulation for granting the Ecological Flag certificate, of November 27, 2006" of February 13, 2012, published in Supplement No. 67 to La Gaceta No. 99 of May 23, 2012.

c. Executive Decree No. 37707-MINAE "Regulation for establishing the registration and evaluation costs within the framework of the Environmental Recognition System" of April 19, 2013, published in Supplement No. 106 to La Gaceta No. 111 of June 11, 2013.

d. Administrative resolution R-425-2013-MINAE which approves the Procedure for call, admissibility, evaluation methodology, and awarding of the recognitions created in Article 10 of Executive Decree No. 37109.

Transitory Provision I. MINAE, through DIGECA, within a period of three months from the publication of this Regulation in the Official Gazette La Gaceta, will make available to the public on its website www.digeca.go.cr, the administrative resolution that officializes the qualification instrument with its respective values, as indicated in Article 11 of this Regulation, and the official registration form indicated in Article 9, subsection a) of this Regulation.

Transitory Provision II. MINAE will have a maximum period of six months from the publication of this Regulation in the Official Gazette La Gaceta to issue the administrative resolution mentioned in Article 18 of this Regulation regarding the right to and use of the SIREA seal (distintivo) and its scope.

Transitory Provision III. All those recognitions incorporated into SIREA under Executive Decree No. 37109 "Regulation of the environmental recognition system (SIREA) and repeal of Executive Decree No. 33525-MINAE, Regulation for granting the Ecological Flag certificate, of November 27, 2006", will continue forming part of SIREA, according to the validity period established in Article 17, which will come into effect upon the publication of this Regulation in the Official Gazette La Gaceta.

Transitory Provision IV. The MINAE bodies that make up the CTC-SIREA will have a period of fifteen days from the publication of this Regulation in the Official Gazette La Gaceta to appoint their representatives (principal and alternate).

It shall become effective upon its publication in the Official Gazette La Gaceta.

Done at the Presidency of the Republic.- San José, on the fifteenth of January of the year two thousand nineteen.

Créase el Sistema de Reconocimientos Ambientales (en adelante SIREA), que tiene como objetivo integrar los reconocimientos de carácter ambiental que existan en el país, de acuerdo con los requerimientos definidos en el presente Reglamento, para que cuenten con el aval del Estado.

Artículos 2° -Objetivos específicos. Los objetivos específicos del SIREA son los siguientes:

• a)Constituirse en el sistema de reconocimiento Estatal en materia ambiental.
• b)Promover la mejora continua de los reconocimientos que formen parte del sistema, esto en aspectos como procedimientos de evaluación, comunicación, divulgación y transparencia.
• c)Contribuir a mejorar la calidad ambiental mediante la adopción de buenas prácticas, en los sectores público y privado.
• d)Dar a conocer e impulsar las experiencias novedosas y de impacto positivo en el ambiente.

Los principios generales de gestión que enmarcan y orientan la operación del SIREA son los siguientes:

• a)Rendición de cuentas: responsabilidad de una Organización u Organizador de ofrecer respuestas a los órganos de gobierno, autoridades estatales y a otras partes interesad as, respecto a sus decisiones y acciones.
• b)Comportamiento ético: comportamiento que es coherente con los principios de buena conducta generalmente aceptados en el contexto de una situación determinada y que es concordante con la normativa nacional e internacional relacionada con el tema.
• c)Mejora continua: estrategia o metodología de la calidad basada en la búsqueda y aplicación continúa de oportunidades de mejora.
• d)Transparencia: apertura en cuanto a las decisiones y actividades que afectan a la sociedad y al medioambiente y voluntad de comunicar éstas de manera clara, exacta y completa.

Para efectos de este Reglamento se entenderá por:

• a)Alcance: se refiere a las áreas de la organización que van a ser evaluadas, así como a los procesos incluidos en la evaluación para obtener un reconocimiento.
• b)Criterios de evaluación: parámetros verificables correspondientes a atributos o variables de carácter cuantitativo, empleados en un proceso de evaluación.
• c)Evaluador: persona competente designada por el Organizador de un reconocimiento, para realizar la evaluación de una Organización que aplica a un reconocimiento.
• d)Organización: para efectos del presente Reglamento se entenderá por Organización a todas las personas fisicas y jurídicas, públicas y. privadas que opten por un reconocimiento.
• e)Organizador: es un ente público o privado encargado de gestionar los procesos técnicos y logísticos de algún reconocimiento del SIREA.' f) Reconocimiento: galardón entregado a una o más organizaciones que evidencien logros específicos, sistemáticos y exitosos en procura del desarrollo sostenible. Se otorga a una Organización que, habiéndose sometido a un proceso de evaluación, cumple con los criterios que la hace merecedora de dicho galardón.
• g)SIREA: Sistema de Reconocimientos Ambientales de carácter Estatal que integra los reconocimientos ambientales del país.

Crease el Comité Técnico Consultivo del SIREA (en adelante CTC-SIREA), el cual velará por la implementación del presente Reglamento, y estará conformado por un represente y un suplente de las siguientes instancias del MINAE:

• a)Dirección de Gestión de Calidad Ambiental (DIGECA, quien coordinará).
• b)Dirección de Cambio Climático (DCC).
• c)Dirección de Energía (DE).
• d)el Sistema Nacional de Áreas de Conservación (SINAC).

Lo anterior, sm detrimento que se pueda convocar para casos específicos, a cualquier otra instancia pública o privada o a expertos técnicos para el asesoramiento en las materias que se requieran e inclusive constituir comisiones ad hoc.

La CTC-SIREA para su organización interna, procedimientos de trabajo, convocatoria y acuerdos, se regirá por lo dispuesto en Libro I, Título II, Capítulo III de la Ley General de la Administración Pública Nº 6227, en lo referente a órganos colegiados.

Son potestades y responsabilidades del CTC-SIREA, las siguientes:

• a)Realizar las evaluaciones de los reconocimientos que deseen incorporarse al SIREA.
• b)Someter a conocimiento del ministro del MINAE:

b.1. Los instrumentos normativos y procedimentales que se requieran para la efectiva implementación del presente Reglamento.

b.2. Las recomendaciones de incorporación de reconocimientos al SIREA.

• e)Crear y mantener actualizado el registro de reconocimientos incorporados al SIREA, con sus respectivos organizadores. Este registro estará disponible en el sitio web www.digeca.go.cr.
• d)Informar a los organizadores, el resultado de las evaluaciones realizadas para el ingreso de sus reconocimientos al SIREA.
• e)Apoyar a los organizadores con:

e.1. El mejoramiento continuo de sus procedimientos aplicados.

e.2. La divulgación ante la ciudadanía de casos exitosos.

• f)Verificar que los reconocimientos que formen parte del SIREA cumplan los requisitos establecidos en este Reglamento.
• g)Recomendar al Ministro de Ambiente y Energía el retiro del uso del distintivo del SIREA a aquellos organizadores de reconocimientos que incumplan con lo establecido en este Reglamento, de conformidad con lo que se señala en los artículos 17º y 18 °.
• h)Hacer de conocimiento público el retiro del uso del distintivo del SIREA.
• i)Cualquier otra que sea necesaria para la debida implementación de este reglamento.

Los reconocimientos de carácter ambiental existentes en el país al momento de publicación del presente Reglamento, así como los que se creen a futuro, cuyo organizador sea una institución del sector público, deberán incorporarse al SIREA, para ello deberán cumplir con los requisitos señalados en este Reglamento.

Asimismo, los organizadores de reconocimientos ambientales del sector privado, podrán formar parte del SIREA, siempre que cumplan con todas las disposiciones señaladas en el presente Reglamento.

Durante todo el año la CTC del SIREA, recibirá solicitudes de aquellos organizadores para la incorporación de sus reconocimientos ambientales al sistema por medio del formulario indicado en el artículo 9° inciso a) de este Reglamento.

Los organizadores que aspiren a incorporar al SIREA el reconocimiento a su cargo deberán:

• a)Llenar el formulario oficial de inscripción disponible en el sitio web www.digeca.go.cr y presentarlo ante esta instancia.
• b)Someterse a un proceso de evaluación por parte CTC-SIREA, en el que se verificará el cumplimiento de los requisitos básicos establecidos en los artículos 10°· y 11 º.

Cada reconocimiento que forme parte del SIREA deberá de:

• a)Tratar sobre la temática ambiental.
• b)Contar con un Organizador con capacidad para cumplir las funciones descritas en el presente Reglamento.
• c)Tener un sistema de evaluación transparente y objetivo en el cual existan criterios claros, verificables y cuantificables.
• d)Disponer de un grupo de evaluadores capacitados en la temática que evalúan y que cumplan con el perfil generado para tal fin.

Para la incorporación de un reconocimiento al SIREA, el Organizador deberá de someterse a un proceso de evaluación por parte de la CTC-SIREA en donde se consideren los siguientes criterios generales como mínimo, sin detrimento de que existan otros criterios específicos:

• a)Experiencia del Organizador en la temática de su reconocimiento.
• b)Disponibilidad de registros (solicitudes de inscripción, evaluadores, organizaciones evaluadas, organizaciones reconocidas y vigencia de los reconocimientos dados a las organizaciones).
• c)Implementación de procedimientos que aseguren como mínimo las siguientes etapas del proceso: inscripción, evaluación (incluyendo criterios técnicos de evaluación con verificación en sitio), entrega y retiro del reconocimiento cuando esto proceda y la atención de acciones recursivas.
• d)Perfil de los evaluadores que sean atinentes a la temática del reconocimiento.

El instrumento de evaluación que consigna los criterios generales y específicos con sus respectivos pesos de calificación se publicará en el sitio web www.digeca.go.cr.

Para el caso de los reconocimientos cuyo proceso de evaluación se realiza por medio del Sistema Nacional de la Calidad, en donde exista una norma específica emitida por el Ente Nacional de Normalización, para efectos de incorporación al SIREA, únicamente el Organizador deberá de cumplir con lo establecido en el artículo 9 inciso a), 1 O y 15 inciso a), b ), c ), f), g) y h) de este Reglamento.

El Ministro del MINAE, en un plazo de 60 días hábiles a partir de la presentación de los requisitos consignados en los artículos 9 °, 10° , 11 º y 12º de este Reglamento, otorgará respuesta a las solicitudes de incorporación de reconocimiento al SIREA, previa recomendación emitida por la CTC-SIREA.

Los organizadores en desacuerdo con los resultados de la evaluación, podrán presentar los recursos o reclamos administrativos al Ministro de Ambiente y Energía, de conformidad con lo establecido en la Ley General de la Administración Pública Nº 6227.

Además de cumplir con lo indicado en el artículo 9° de este Reglamento, son responsabilidades de los organizadores de los reconocimientos incorporados al SIREA, las siguientes:

• a)Suministrar la información requerida a solicitud de la CTC-SIREA en los temas vinculados con la implementación de este Reglamento.
• b)Mantener un registro actualizado en su sitio web de las organizaciones reconocidas, así como de Evaluadores. Este registro deberá de mantenerse actualizado.

Adicionalmente en dicho sitio deberá de existir un cronograma actualizado donde se indiquen los períodos de inscripción, evaluación y entrega de reconocimientos.

• e)Informar al MINAE la realización del acto protocolario de entrega de reconocimientos.
• d)Contar con mecanismos de control, registro, custodia y resguardo de confidencialidad de toda la documentación vinculada con los procesos de evaluación de las organizaciones, para efectos de transparencia y seguimiento por parte de la CTC-SIREA.
• e)Atender las cornmltas, recursos o reclamos según correspondan, que puedan surgir por parte de las organizaciones durante el proceso de evaluación, resultados de evaluación y vigencia del reconocimiento a su cargo.
• f)Cumplir con la frecuencia de entrega del reconocimiento que organiza.
• g)lndicar en el distintivo que se le entrega a las Organizaciones el alcance y la vigencia del reconocimiento.
• h)Cumplir con todas las disposiciones que le sean aplicables de este Reglamento en su función de organizador.

Aquellos reconocimientos incorporados al SIREA contarán con los siguientes beneficios:

1. Un distintivo para uso publicitario que destaca a la Organización como parte del SIREA.

2. Ser parte del Registro Nacional de Reconocimientos Ambientales.

3. La promoción e información que realice el Ministerio de Ambiente y Energía por medios oficiales.

4. Aquellos que se deriven de los procedimientos de contratación del Estado debidamente avalados por el ente competente en compra pública.

Una vez que el reconocimiento se haya incorporado al SIREA, el plazo de permanencia de éste dentro del sistema, será de cinco años, siempre y cuando cumpla con lo establecido en el presente Reglamento y en los instrumentos de evaluación. Para estos efectos la CTC-SIREA estará facultada para realizar evaluaciones periódicas posteriores a su incorporación en aras de verificar dicho cumplimiento.

En caso de incumplimiento se excluirá el reconocimiento del sistema, previo seguimiento del debido proceso.

En el marco del SIREA, el Ministro de Ambiente y Energía otorgará un distintivo que identifique a aquellos reconocimientos que han sido incorporados en el SIREA.

El derecho y uso del distintivo del SIREA y su alcance se establecerán vía resolución administrativa emitida por el Ministro del MINAE.

Las organizaciones que hayan sido galardonas con algún reconocimiento que forme parte del SIREA, podrán hacer uso del distintivo del reconocimiento para hacer publicidad, siempre y cuando éste se encuentre vigente, se especifique el tipo de reconocimiento obtenido, el alcance físico y los procesos evaluados para el reconocimiento, así como su vigencia.

El organizador del reconocimiento deberá de velar por el cumplimiento de las anteriores disposiciones por parte de las organizaciones reconocidas, en el caso de que alguna incurra en la violación de lo dispuesto en este artículo deberá de tomar las medidas necesarias para el retiro inmediato del distintivo.

Deróguese los siguientes instrumentos:

a. Los artículos 2 y 4 del Decreto Ejecutivo Nº 34204 "Derogación del Decreto Ejecutivo Nº 27485-MINAE, y de los incisos· A) y B) del artículo 10 del Decreto Ejecutivo Nº 30077- MINAE, y Modificación del artículo 20 del Decreto Ejecutivo Nº 33525-MINAE, publicado en la Gaceta N º 31 del 13 de febrero de 2007" del 23 de noviembre de 2007 publicado en La Gaceta N º08 del 11 de enero de 2008.

b. El Decreto Ejecutivo N º 37109 "Reglamento del Sistema de reconocimientos ambientales (SIREA) y derogatoria del decreto ejecutivo Nº 33525-MINAE, Reglamento para otorgar el certificado Bandera Ecológica, del 27 de noviembre de 2006" del 13 de febrero de 2012, publicado en el Alcance Nº67 de La Gaceta Nº99 del 23 de mayo de 2012.

c. El Decreto Ejecutivo N º 37707-MINAE "Reglamento para el establecimiento de los costos de inscripción y evaluación en el marco del Sistema de Reconocimientos Ambientales" del 19 de abril de 2013, publicado en el Alcance Nº 106 de La Gaceta Nº 111 del 11 de junio de 2013.
