in the entirety of the text - Complete Text of Regulation 003 Delimitation of the public zone of various sectors Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno Complete Text of record: 12BB98 NATIONAL GEOGRAPHIC INSTITUTE NOTICE No. 2019-003 MARITIME TERRESTRIAL ZONE Delimitation of the public zone of various sectors Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, the General Law of Public Administration, and on the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulations.

1. 1That by means of Law No. 8905, the National Geographic Institute is established as a unit of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget and shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical unit governing national cartography, destined for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or tasks and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.
2. 2That the Law Creating the National Geographic Institute, No. 59, constitutes it on a permanent basis and in representation of the State, as the official authority on geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the works entrusted to it.
3. 3That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation indicates that: "The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."
4. 4That in Executive Decree No. 36642-MP-MOPTMINAET, "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone," it is established according to Article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically indicating in Article 11 that: "The National Geodetic Network of Horizontal Reference CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed in the National Territory by any public entity, person, or national or foreign private entity must be referenced."; while Article 7 indicates that "As cartographic data are produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish through appropriate means that information which has been officialized."
6. 6That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, the stamping (visado) of survey plans, the granting of concessions in the Restricted Zone, and other aspects of coastal land-use planning.
7. 7That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
8. 8That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P, "Regulation to Law No. 6043 on the Maritime Terrestrial Zone," b) Executive Decree No. 33797-MJ-MOPT, "Declares as official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05," and c) Executive Decree No. 36642-MP-MOPT-MINAET, "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone."
9. 9That Article 16° of the Forest Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State.

10.—The National Geographic Institute used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in various sectors of Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno; located in district 04 Santa Elena, canton 10 La Cruz; province 05 Guanacaste.

11.—That the inputs generated from the Cadastre and Registry Regularization Program, Loan Contract 1284/OC-CR" for the sector subject to this notice were used.

12.—That the delimitation carried out has internal technical endorsement according to official letter No. DIG-TOT-0033-2019 of February 4, 2019, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.

1. 13That Article 140 of Law No. 6227, the General Law of Public Administration, indicates that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the time it is adopted," a provision that must necessarily be related to numeral 204) of the same normative body, which defines the ideal instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and specific ones by notification."

COMMUNICATES:

1º—The National Geographic Institute used the "Georeferenced Digital Delimitation" and georeferencing of boundary markers to the national coordinate system to delimit the public zone of the Maritime Terrestrial Zone in various sectors of Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno; located in district 04 Santa Elena, canton 10 La Cruz; province 05 Guanacaste.

2º—The public zone of the Maritime Terrestrial Zone in various sectors of Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno, determined in the official cartographic projection system of Costa Rica CRTM05, of Map MBCR-1/50,000 Sheets Murciélago, namely:

Sector of georeferenced digital line and georeferenced boundary markers on the coast of Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno.

3º—The sectors located on the coast of Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno, which to date have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers and respective publication in the Official Gazette La Gaceta, maintain their official condition.

5º—The official technical data of the georeferenced digital delimitation and georeferencing of boundary markers of the public zone of the Maritime Terrestrial Zone of the coast of Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno, have been recorded in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN and in file 39 of the ZMT registry of the IGN.—Curridabat, February 25, 2019.

en la totalidad del texto - Texto Completo Norma 003 Delimitación de zona pública de varios sectores Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno Texto Completo acta: 12BB98 INSTITUTO GEOGRÁFICO NACIONAL AVISO Nº 2019-003 ZONA MARÍTIMA TERRESTRE Delimitación de zona pública de varios sectores Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley N° 6227 General de la Administración Pública, y en lo dispuesto en la Ley No. 59 de creación del Instituto Geográfico Nacional, la Ley N° 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, del 02 de marzo de 1977, y su respetivo reglamento.

1. 1Que mediante Ley N° 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), N° 59, en el artículo 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que. "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
4. 4Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
7. 7Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
8. 8Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo N° 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".
9. 9Que el artículo 16° de la Ley Forestal, Ley N° 7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

10.-El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en varios sectores de Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno; ubicada en distrito 04 Santa Elena, cantón 10 La Cruz; provincia 05 Guanacaste.

11.-Que se utilizó los insumos generados a partir del Programa de Regularización del Catastro y Registro Contrato Préstamo 1284/OC-CR" del sector objeto del presente aviso.

12.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio N° DIG-TOT-0033-2019 del 04 de febrero de 2019, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

1. 13Que el artículo 140 de la Ley N° 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1º-El Instituto Geográfico Nacional, utilizó la "Delimitación Digital Georreferenciada" y georreferenciación de mojones al sistema nacional de coordenadas para delimitar la zona pública de la Zona Marítimo Terrestre en varios sectores de Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno; ubicados en distrito 04 Santa Elena, cantón 10 La Cruz; provincia 05 Guanacaste.

2º-La zona pública de la Zona Marítimo Terrestre en varios sectores de Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno, determinada, en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, del Mapa MBCR-1/50.000 Hojas Murciélago, a saber:

Sector de línea digital georreferenciada y mojones georreferenciados en la costa de Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno.

Se completa la demarcación digital realizada según mojones oficializados vía Aviso N° 2012-09 publicado en el Diario Oficial La Gaceta N° 168 del 31 de octubre de 2012, a partir del punto final del sector 09 en Bahía Junquillal:

Finalmente, a partir del mojón M500 oficializado según Aviso No. 03-17 publicado en el Diario Oficial La Gaceta N° 132 del 10 de julio de 2003 se empata con el primer punto del Sector 10, Bahía Cuajiniquil-Bahía el Torno de la línea digital georreferenciada oficializada según Aviso N° 2012-09 publicado en el Diario Oficial La Gaceta N° 168 del 31 de agosto de 2012 como sigue:

3º-Los sectores ubicados en la costa de Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

5º-Los datos técnicos oficiales de la delimitación digital georreferenciada y georreferenciación de mojones de la zona pública de la Zona Marítimo Terrestre de la costa de Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN y en el expediente 39 del registro de la ZMT del IGN.-Curridabat, 25 de febrero de 2019.
