…in the entirety of the text - Full Text of Standard 002 Delimitation of the public zone of various coastal sectors of Punta Guapinol Full Text of record: 12BBE7 NATIONAL GEOGRAPHIC INSTITUTE NOTICE No. 2019-002 MARITIME TERRESTRIAL ZONE Delimitation of the public zone of various coastal sectors of Punta Guapinol Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, the General Public Administration Law, and on the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulation.

I.That by means of Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget and shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or tasks, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.

II.That the Law Creating the National Geographic Institute, No. 59, permanently constitutes it and, in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the tasks entrusted to its charge.

III.That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation indicates that "The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."

IV.That in Executive Decree No. 36642-MP-MOPTMINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone", Article 18 establishes that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or digital georeferenced delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.

V.That Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically pointing out in Article 11 that: "The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the National Territory by any public agency, person, or national or foreign private entity must be referenced."; while Article 7 indicates that "As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, through appropriate means, that information which has been officialized."

VI.That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of developing regulatory plans (planes reguladores), the approval of surveying plans (planos de agrimensura), the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning (ordenamiento territorial costero).

VII.That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).

VIII.That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares as the official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".

IX.That Article 16 of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy (MINAE) shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).

X.The National Geographic Institute used the "Digital Georeferenced Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in various sectors of Punta Guapinol, located in district 01 Jacó, canton 11 Garabito, province 06 Puntarenas.

XI.That the inputs generated from the Regularization Program of Cadastre and Registry (Programa de Regularización del Catastro y Registro), Loan Contract 1284/OC-CR, for the sector subject to this notice, were used.

XII.That the delimitation carried out has internal technical endorsement in accordance with official communication No. DIG-TOT-0466-2018 of November 15, 2018, issued by the Official Limits Subprocess of the Topographic and Territorial Observation Department of the National Geographic Institute.

XIII.That Article 140 of Law No. 6227, the General Public Administration Law, indicates that "the administrative act shall produce its effect after being communicated to the administered party, except if it solely grants rights, in which case it shall produce it from the moment it is adopted," a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and concrete acts by notification."

COMMUNICATES:

1°— The National Geographic Institute used the "Digital Georeferenced Delimitation" and georeferencing of boundary markers (mojones) to the national coordinate system to delimit the public zone of the Maritime Terrestrial Zone in various sectors of Punta Guapinol, located in district 01 Jacó, canton 11 Garabito, province 06 Puntarenas.

2°— The public zone of the Maritime Terrestrial Zone in various sectors of Punta Guapinol, located in district 01 Jacó, canton 11 Garabito, province 06 Puntarenas, determined in the official cartographic projection system of Costa Rica CRTM05, from Map MBCR-1/50,000 Sheets Herradura, correspond to:

3°— The sectors located in Punta Guapinol, located in district 01 Jacó, canton 11 Garabito, province 06 Puntarenas, which to date have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

5°— The official technical data of the "Digital Georeferenced Delimitation" and georeferenced boundary markers (mojones) of the public zone of the Maritime Terrestrial Zone of Punta Guapinol, located in district 01 Jacó, canton 11 Garabito, province 06 Puntarenas, have been recorded in the Digital Georeferenced Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN, and in file 38 of the ZMT registry of the IGN.— Curridabat, February 25, 2019.

Considering:

en la totalidad del texto - Texto Completo Norma 002 Delimitación de zona pública de varios sectores costeros de Punta Guapinol Texto Completo acta: 12BB7E INSTITUTO GEOGRÁFICO NACIONAL AVISO N° 2019-002 ZONA MARÍTIMA TERRESTRE Delimitación de zona pública de varios sectores costeros de Punta Guapinol Con fundamento en las facultades que confiere el artículo 140 y artículo 240, inciso 1° de la Ley N° 6227 General de la Administración Pública, y en lo dispuesto en la Ley N° 59 de creación del Instituto Geográfico Nacional, la Ley N° 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley N° 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su respetivo reglamento.

I.Que mediante Ley N° 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

II.Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

III.Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), N° 59, en el artículo 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".

IV.Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

V.Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado.".

VI.Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

VII.Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

VIII.Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo N° 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

IX.Que el artículo 16° de la Ley Forestal, Ley N° 7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

X.El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en varios sectores de Punta Guapinol ubicada en distrito 01 Jacó, cantón 11 Garabito, provincia 06 Puntarenas.

XI.Que se utilizó los insumos generados a partir del Programa de Regularización del Catastro Y Registro Contrato Préstamo 1284/OC-CR" del sector objeto del presente aviso.

XII.Que la delimitación realizada cuenta con aval técnico interno conforme al oficio N° DIG- TOT-0466-2018 del 15 de noviembre de 2018, emitido por el Subproceso de Limites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.

XIII.Que el artículo 140 de la Ley N° 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1°-El Instituto Geográfico Nacional, utilizó la "Delimitación Digital Georreferenciada" y georreferenciación de mojones al sistema nacional de coordenadas para delimitar la zona pública de la Zona Marítimo Terrestre en varios sectores de Punta Guapinol ubicada en distrito 01 Jacó, cantón 11 Garabito, provincia 06 Puntarenas.

2°-La zona pública de la Zona Marítimo Terrestre en varios sectores de Punta Guapinol, ubicada en distrito 01 Jacó, cantón 11 Garabito, provincia 06 Puntarenas. determinada en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, del Mapa MBCR-1/50.000 Hojas Herradura, corresponden a:

3°-Los sectores ubicados en Punta Guapinol ubicada en distrito 01 Jacó, cantón 11 Garabito, provincia 06 Puntarenas, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

5°-Los datos técnicos oficiales de la "Delimitación Digital Georreferenciada" y mojones georreferenciados de la zona pública de la Zona Marítimo Terrestre de Punta Guapinol ubicada en distrito 01 Jacó, cantón 11 Garabito, provincia 06 Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN, y en el expediente 38 del registro de la ZMT del IGN.-Curridabat, 25 de febrero de 2019.
