8905 establishes the Instituto Geográfico Nacional as a dependency of the Registro Nacional and that the Junta Administrativa of the Registro Nacional shall administer the Institute's budget and execute the contracts and agreements necessary for the exercise of its functions. Likewise, it establishes that the Instituto Geográfico Nacional shall be the scientific and technical dependency governing national cartography, intended for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and for studies, investigations, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, for the purpose of supporting planning processes.

59, establishes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature originating from the work entrusted to its charge.

59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the Instituto Geográfico Nacional for the delimitation of the public zone of the Zona Marítimo Terrestre, and its officialization through publication in the Diario Oficial La Gaceta, while Article 63 of the same Regulation indicates that "The Instituto Geográfico Nacional must publish a notice in the Diario Oficial for each portion of the maritime-terrestrial zone where it has demarcated the public zone."

36642-MP-MOPTMINAET, "Regulation of Specifications for the Delimitation of the public zone of the Zona Marítimo Terrestre," establishes, according to Article 18°, that for the delimitation of the public zone of the Zona Marítimo Terrestre, the IGN may employ two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Zona Marítimo Terrestre through the placement of markers (mojones) and/or through georeferenced digital delimitation, this for the purpose of expediting delimitations and providing greater technical certainty to interested parties.

33797-MJ-MOPT, which, among other aspects, determines the Red Geodésica Nacional de Referencia Horizontal CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically states in Article 11 that: "The Red Geodésica Nacional de Referencia Horizontal CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out within the National Territory by any public agency, person, or national or foreign private entity must be referenced."; while Article 7 indicates that "As cartographic data are produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish, by appropriate means, that information which has been officially established."

7841-P "Regulation to Law No. 6043 on the Zona Marítimo Terrestre," b) Executive Decree No. 33797-MJ-MOPT "Declares CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05," and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Zona Marítimo Terrestre."

7575 of February 13, 1996, establishes that the Ministerio del Ambiente y Energía shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State.

10.-The Instituto Geográfico Nacional used the methodology of "Georeferenced Digital Delimitation as well as the installation of markers (mojones) on site" to delimit the public zone of the Zona Marítimo Terrestre in the coastal sector of Playa San Martin, located in district 04 Bahía Ballena, canton 05 Osa, province of 06 Puntarenas, this according to proceedings carried out by Lic. Diego Arias Morales, Licda. Isabel Chaves Bonilla of the Depto. Zona Marítimo Terrestre and Mayor Lic. Alberto Cole León of the Municipalidad de Osa; based on official letters No. AZM-047-2017 of February 22, 2017, and No. SZM-851-2017 of October 31, 2017.

11.-That through official letter No. DTO-IGN-RN-0588-2017 of November 17, 2017, issued by the Subproceso de Límites Oficiales of the Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional, addressed to Lic. Diego Arias Morales, Licda. Isabel Chaves Bonilla of the Depto. Zona Marítimo Terrestre and Mayor Lic. Alberto Cole Leon of the Municipalidad de Osa; in addition to Arq. Antonio Farah Matarrita, Leader of the Departamento de Planeamiento Turístico of the Instituto Costarricense de Turismo; regarding the final definition of the Zona Marítimo Terrestre in the sector of Playa San Martín, canton of Osa, province of Puntarenas, which is the object of this notice.

DTO-IGN-RN-0588-2017 of November 17, 2017, and official letter No. DIG-TOT-0254-18 of June 14, 2018, both issued by the Subproceso de Limites Oficiales of the Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional.

6227, General Law of Public Administration, indicates that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the time it is adopted," a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication, and specific acts, by notification." (06 markers numbered M4 to M9) It continues with the markers numbered M110 to M113, officially established by Notice No. 99-30, published in Diario Oficial La Gaceta No. 192 of October 4, 1999, with the following coordinates:

Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

10.-El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada así como la instalación de mojones en el sitio" para delimitar la zona pública de la Zona Marítimo Terrestre en el sector costero de playa San Martin, ubicada en distrito 04 Bahía Ballena, cantón 05 Osa, provincia de 06 Puntarenas, esto conforme a diligencias realizadas por el Lic. Diego Arias Morales, la Licda. Isabel Chaves Bonilla del Depto. Zona Marítimo Terrestre y el Alcalde Lic. Alberto Cole León de la Municipalidad de Osa; con base en los oficios Nº AZM-047-2017 del 22 de febrero de 2017 y el Nº SZM-851-2017 del 31 de octubre de 2017.

11.-Que mediante el oficio Nº DTO-IGN-RN-0588-2017 del 17 de noviembre de 2017 emitido por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional, dirigido a los señores Lic. Diego Arias Morales, la Licda. Isabel Chaves Bonilla del Depto. Zona Marítimo Terrestre y el Alcalde Lic. Alberto Cole Leon de la Municipalidad de Osa; además del señor Arq. Antonio Farah Matarrita Líder del Departamento de Planeamiento Turístico del Instituto Costarricense de Turismo; referente a la definición final de la Zona Marítimo Terrestre en el sector de playa San Martín, cantón de Osa, provincia de Puntarenas objeto del presente aviso.
