Directors, Central Level Regional Directors of Health Governance Directors of Health Governance Areas Officials Ministry of Health Subject: MODIFICATION OF DIRECTIVE No. DM-CB-1327-2019 ON THE "PROCEDURE FOR THE MEASUREMENT OF BACKGROUND NOISE AND IMPACT OR IMPULSE NOISE." Dear Sirs/Madams:
This Office, through Directive No. DM-1213-1327-2019, dated January 24, 2019, established the procedure to be followed for the measurement of background noise and impact or impulse noise; however, in order to achieve greater viability, it is necessary to modify and clarify it, for a better application of the given instrument.
Therefore, points 7 and 8 are hereby modified, and the antepenultimate paragraph is rendered null and void, with the understanding that as of the notification of this modification, the indicated points must be read as follows:
"7- A measurement of background noise must be performed, at the same site where the source is measured, inside the complainant's buildings, for which the source being evaluated must remain inactive, or the LN90 must be determined simultaneously with the measurement using the sound level meter.
8- The measurement of the source must be performed inside the complainant's buildings, avoiding sound-emitting sources extraneous to the measurement. The measurement must be performed with the windows open and must indicate the site(s) of the property where they were performed, and must continue for at least 15 minutes, during the operating time of the impact noise source. If the source operates for less than 15 minutes, the measurement must cover the time the source operates. Subsequently, the Leq(Z), Leq(C), and Leq(A) measurements must be recorded for the noise source, as reported by the integrating sound level meter, and the reading of the sound intensities from the one-third octave bands must be recorded." Communicate this to the different management levels, so that this modification of Directive DM-CB-1327-2019 is of mandatory and immediate compliance, with the understanding that failure to comply with the provisions herein will generate administrative liability as of the notification thereof.

DM-CB-1610-2019 San José, 22 de febrero del 2019 Señores (as) Directores (as) Nivel Central Directores (as) Regionales de Rectoría de la Salud Directores (as) de Areas Rectoras de Salud Funcionarios y funcionarias Ministerio de Salud Asunto: MODIFICACIÓN DE DIRECTRIZ No. DM-CB-1327-2019 SOBRE "PROCEDIMIENTO PARA LA MEDICIÓN DE RUIDO DE FONDO Y RUIDO DE IMPACTO O IMPULSO." Estimados señores:
Este Despacho por medio de Directriz N° DM-1213-1327-2019, de fecha 24 de enero del 2019, dispuso el procedimiento a seguir para la medición de ruido de fondo y ruido de impacto o impulso; sin embargo, con el fin de lograr una mayor viabilidad, es necesario modificarla y aclararla, para una mejor aplicación del instrumento dado.
Por lo tanto, se procede a modificar los puntos 7, 8 y se deja sin efecto el párrafo antepenúltimo, siendo que a partir de la notificación de la presente modificación los puntos señalados deberán de leerse de la siguiente forma:
"7- Se debe realizar, en el mismo sitio donde se mide la fuente, una medición de ruido de fondo dentro de las edificaciones del denunciante, para lo cual la fuente que se evalúa debe permanecer inactiva o bien determinarse de manera simultánea a la medición el LN90 con el sonómetro.
8- La medición de la fuente debe realizarse dentro de las ec4flcaciones del denunciante, evitando fuentes emisoras de sonido ajenas a la medición. La medición debe efectuarse con las ventanas abiertas y señalar el (los) sitio (s) del inmueble en que se realizaron y debe prolongarse por al menos por 15 minutos, durante el tiempo de operación de la fuente de ruido de impacto. Si la fuente opera por menos de 15 minutos la medición deberá cubrir el tiempo que opere la fuente. Posteriormente, deben registrarse las mediciones Leq(Z), Leq(C) y Leq(Á), para la fuente de ruido, según las reporta el sonómetro integrador y registrarse la lectura de las intensidades de sonido de tercios de octavas de banda." Comuníquese a los diferentes niveles de gestión, para que la presente modificación de la Directriz DM-CB- 1327-2019, sea de obligado e inmediato acatamiento, en el entendido de que el incumplimiento de lo aquí dispuesto, generará responsabilidad administrativa a partir de la notificación de la misma.
