4 -000-04 21 46), is authorized to enter into a land administration agreement with the Costa Rican Institute of Aqueducts and Sewers (AyA), legal entity identification number four - zero zero zero - zero four two one three eight (No. 4-000-042138), for the property registered in the Public Property Registry of the district of Alajuela, under the folio real system, registration number five one two six zero five - zero zero zero (No. 512605-000); nature: pastureland and building site, located in district 8, San Rafael; canton of Alajuela, province of Alajuela; boundaries: to the north with Quebrada Seca and the Costa Rican Football Federation (Fedefútbol); to the south with Inversiones llerda S.A.; to the east with Calle Pública Radial San Antonio and the Costa Rican Football Federation, and to the west with Inversiones llerda S.A. and the Costa Rican Football Federation. It measures thirty-three thousand two hundred fifty-four square meters (33,254 m²). Cadastral map number A-one six eight two six two four-two thousand thirteen (A-1682624-2013), for the purpose of building a wellfield to meet the flow needs for the San José metropolitan aqueduct, in accordance with the following technical specifications: The wells must be located in the zone where the lower Colima aquifer has the greatest thickness, which places the possible well construction points on the boundary between the CNP land and the land called Proyecto Gol, according to the following table:

For the construction phase of the wells and civil works, it is necessary to have an area larger than the final area that will be used for the location of the extraction infrastructure and the operational phase; therefore, a larger area must be available during the construction phase, both for the stage in which the wells are built and for the stage in which the civil, electrical, and mechanical works will be built.
The construction phase will be developed in two parts: the first, which will consist of the construction of the wells, through drilling with rotary-percussion machines, which use different tools and foaming agent to extract the drilled material, which implies the location of tool storage areas and sedimentation pits to deposit the drilling residue.
In addition to the above, at the work zone, a guard shack and a sanitary shack must be located.
Thus, the required work area for each of the sites where the wells are built must be sufficient to accommodate the following components:
- 1)Drilling equipment.
- 2)Drill rods.
- 3)Various tools (drill bits, welding machines, casing pipes, etc.).
- 4)Tanks with water and foaming agent.
- 5)Sedimentation pit.
- 6)Sanitary shack.
- 7)Guard shack.
The required area at each of the points where each well will be built is defined as six hundred square meters (600 m²) (a lot of 30m x 20m), the same area that will be required during the construction phase of the civil, electrical, and mechanical works.
Once the well construction phase is completed, the construction of the civil, electrical, and mechanical works must be contracted, for which the same area as for the well construction phase will initially be required, since materials and equipment must be stored to develop this phase, as well as some temporary infrastructure, such as warehouses, sanitary shacks, and guard shacks.
The works to be built basically consist of two concrete slabs around the well curbs, two motor control houses (one house per well); in addition, next to both houses a Pad Mounted type transformer will be located (two in total), required for the electrical supply of each well; on both properties, an area of two hundred square meters (200 m²) is required, with the following dimensions: 20m x 10m.
The permanent infrastructure to be placed on each of the properties where the two wells will be built is as follows:
Lands for Well 1 (Pp1) and Well (Pp2) A 4x6m concrete slab around the well curb and the discharge head.
A control house for each well of 5x3m and next to it a ground-mounted transformer of 3x3m. Required area for each well of approximately two hundred square meters (200 m²).
Likewise, there must be an easement (servidumbre) of eight meters (8m) in width along the route that connects each of the two wells to the main road of the Radial Lindera. In this easement (servidumbre), the discharge pipe with diameters between three hundred mm (300mm) and five hundred mm (500mm), in ductile iron pipe, the stormwater pipes for each well, and, furthermore, the overhead/underground medium-voltage electrification will be located. In addition, it will serve as a right-of-way easement (servidumbre de paso) for the maintenance and operation of the electromechanical systems installed at the wells.
Given the characteristics of the works and the service they will provide, the agreement may be entered into for up to fifty years, automatically renewable for equal periods, unless otherwise agreed between the parties, for a duly justified reason, which must be indicated within a period within the month prior to its expiration.
The specific design aspects of the wells will be defined subsequently; therefore, some geometric or size modification may eventually be required, based on project-specific assessments, authorizing variations within the conceptualization already set forth.
This law takes effect upon its publication.
