…in the entirety of the text - Full Text of Norma 41497 Amendment to the Public Use Regulation of Corcovado National Park Full Text of acta: 12A356 N° 41497-MINAE THE PRESIDENT OF THE REPUBLIC AND THE ACTING MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by Articles 50, 140 subsections 3) and 18), and 146 of the Political Constitution, Article 22 and 39 of the Biodiversity Law No. 7788 of April 30, 1998, and Articles 6 subsection d), 27 subsection 1), and 28 subsection 2) paragraph b) of the General Law on Public Administration No. 6227 of May 2, 1978.

1. 1That Article 50 of the Political Constitution establishes that the State must guarantee the right of every person to a healthy and ecologically balanced environment.
2. 2That Article 1, subsections 2) and 3) of the Biodiversity Law No. 7788, has among its objectives to promote the active participation of social sectors in the conservation and ecologically sustainable use of biodiversity, and to promote education and public awareness on conservation.
3. 3That the Biodiversity Law No. 7788 provides in its Article 22 that the National System of Conservation Areas (SINAC) shall have its own legal personality and shall be a decentralized and participatory institutional management and coordination system, integrating the competencies in forestry, wildlife, and protected areas of the Ministry of Environment and Energy, in order to issue policies, plan, and execute processes aimed at achieving sustainability in the management of the country's natural resources.
4. 4That Corcovado National Park, within the Osa Conservation Area (ACOSA), was created by Executive Decree No. 5357 of October 24, 1975, its main creation objective being to conserve the marine and terrestrial ecosystems existing within it, in order to maintain the ecological value of one of the areas of greatest richness in flora and fauna in the country. Furthermore, to ensure that this important part of the Cultural Heritage provides permanent benefits in education, research, inspiration, and recreation for current and future generations of Costa Ricans.
5. 5That through Executive Decree No. 40700 of October 12, 2017, the Public Use Regulation of Corcovado National Park was issued, in a context different from the current one.

THEY DECREE:

"AMENDMENT OF ARTICLE 8 SUBSECTION C) OF THE PUBLIC USE REGULATION OF CORCOVADO NATIONAL PARK, EXECUTIVE DECREE NO. 40700-MINAE OF OCTOBER 12, 2017"

CONSIDERING:

Therefore,

en la totalidad del texto - Texto Completo Norma 41497 Reforma Reglamento de uso público del Parque Nacional Corcovado Texto Completo acta: 12A356 N° 41497-MINAE EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO A.I DE AMBIENTE Y ENERGÍA En el ejercicio de las facultades que les confieren los artículos 50, 140 incisos 3) y 18) y 146 de la Constitución Política, el artículo 22 y 39 de la Ley de Biodiversidad Nº 7788 del 30 de abril de 1998 y los artículos 6 inciso d), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la Administración Pública Nº 6227 del 2 de mayo de 1978.

1. 1Que el artículo 50 de la Constitución Política establece que el Estado debe garantizar el derecho de toda persona a un ambiente sano y ecológicarnente equilibrado.
2. 2Que el artículo 1 O incisos 2) y 3) de la Ley de Biodiversidad N º 7788, tiene entre sus objetivos promover la participación activa de los sectores sociales en la conservación y el uso ecológicamente sostenible de la biodiversidad y promover la educación y conciencia pública sobre la conservación.
3. 3Que la Ley de Biodiversidad Nº 7788 dispone en su artículo 22, que el Sistema Nacional de Áreas de Conservación (SINAC) tendrá personería jurídica propia y será un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integrará las competencias en materia forestal, vida silvestre y áreas protegidas del Ministerio de Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales del país.

4º-El Parque Nacional Corcovado del Área de Conservación Osa, fue creado mediante Decreto Ejecutivo Nº 5357 del 24 de octubre de 1975, siendo el objetivo principal de su creación, conservar los ecosistemas marinos y terrestres existentes en él, con el fin de mantener el valor ecológico de una de las áreas de mayor riqueza en flora y fauna del país. Además asegurar que esta importante parte del Patrimonio Cultural suministre beneficios permanentes en educación, investigación, inspiración y recreación para las actuales y futuras generaciones de costarricenses.

1. 5Que mediante Decreto Ejecutivo Nº 40700 del 12 de octubre de 2017 se emitió el Reglamento de Uso Público del Parque Nacional Corcovado, en un contexto distinto al actual.

"MODIFICACIÓN DEL ARTICULO 8 INCISO C) DEL REGLAMENTO DE USO PÚBLICO DEL PARQUE NACIONAL CORCOVADO, DECRETO EJECUTIVO Nº 40700- MINAE DEL 12 DE OCTUBRE DE 2017"
