I- The Contraloría General de la República, in its official communication DFOE-EC-0393 of July 27, 2012, indicated regarding the regulatory fee (canon) mechanism: "(.) This Contraloría General warns ARESEP of the obligation that, prior to charging it, it must be effectively incorporated into the tariff that the companies providing the regulated service charge their end users, considering that these entities authorized to provide the service are merely collectors of the regulatory fee (canon), and therefore it must be neutral with respect to their financial situation (.)".

II- By official communication OF-0666-IA-2018 of September 25, 2018, the Water Superintendency (Intendencia de Agua) recommended the opening of an administrative file for the ex officio application of an adjustment to the amount of the regulatory fees (cánones de regulación) for the year 2018, to the Empresa de Servicios Públicos de Heredia, S.A. (ESPH, S.A.) and the Instituto Costarricense de Acueductos y Alcantarillados (AyA) and corresponding to the aqueduct, sewerage, and hydrant services. (Page 01).

III- By official communication OF-0667-IA-2018 of September 25, 2018, the Water Superintendency (Intendencia de Agua) requested the Dirección General de Atención al Usuario (DGAU) to convene a public hearing to present the referenced ex officio tariff study. (Page 03).

IV- The Regulatory Authority published the notice of public hearing in the following newspapers: La Extra and La Teja of October 11, 2018 (page 21) and the Diario Oficial La Gaceta No. 188 of October 11, 2018. (Page 21).

V- The public hearing was held on November 13, 2018, at 17:30 hours, in the Auditorium of the Autoridad Reguladora de los Servicios Públicos, located in Guachipelín de Escazú, Oficentro Multipark, Turrubares building; by means of a videoconference system interconnected with the Courts of Justice located in the centers of Limón, Heredia, Alajuela, Liberia, Puntarenas, Pérez Zeledón, and Cartago, and also in person in the Salón de la Cruz Roja of San Ignacio de Acosta, located 25 meters south of the west side of Monseñor Sanabria Park, San Ignacio, Acosta, San José, to hear the proposal for an "Ex officio tariff study to apply adjustment of regulatory fees (cánones) for the 2018 period in the aqueduct, sewerage, and hydrant services of the Instituto Costarricense de Acueductos y Alcantarillados (AyA) and of the aqueduct and sewerage services of the Empresa de Servicios Públicos de Heredia S.A. (ESPH S.A.)", processed in file ET-051-2018. According to report No. IN-0072-DGAU-2018, no oppositions or joinders were received.

VI- By official communication OF-0861-IA-2018 of December 4, 2018, the Water Superintendency (Intendencia de Agua) issued the report entitled "Adjustment by reduction in the regulatory fees (cánones) for the year 2018 for the aqueduct, sewerage, hydrant, and irrigation services. File ET-051-2018". (Which is attached to the proceedings).

VII- The prescriptions of the Law have been complied with regarding the deadlines and procedures.

I- From official communication OF-0861-IA-2018 of December 4, 2018, which serves as the basis for this resolution, it is appropriate to extract the following:

"(.)

I. Aqueduct, Sanitary Sewerage, and Hydrant Services

• a)Introduction This study arises from the need to make adjustments to the tariffs upon updating the amount of the regulatory fee (canon de regulación) approved by the Contraloría General de la República for the year 2018, in order to comply with that entity's recommendation that the regulatory fee (canon) "must be neutral to their financial situation"; which must be followed by the Regulatory Authority.

To comply with the aforementioned directive and considering that the regulatory fee (canon de regulación) is part of the service tariff paid by subscribers, the Regulatory Authority must adjust this charge in the proportion that corresponds.

The mechanism by which the Regulatory Authority can ensure the adjustment of the regulatory fee (canon) reaches the subscribers is by modifying the tariffs and through the ordinary procedure; except in irrigation and drainage (riego y avenamiento) tariffs, since the tariff model established by resolution RIA-009-2015 of September 8, 2015, indicates that the adjustment must be made through the extraordinary procedure (.).

• c)Calculation of the Impact of the Regulatory Fee (Canon) on Estimated Revenues The impact on revenues of the difference between the regulatory fee (canon) incorporated by the Regulatory Authority in the tariff studies prepared for the aqueduct, sewerage, and hydrant services for the Instituto Costarricense de Acueductos y Alcantarillados (AyA); the aqueduct, sewerage, and hydrant service of the Empresa de Servicios Públicos de Heredia (ESPH, S.A.); and the irrigation service for the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (Senara) for the year 2018, with respect to the regulatory fee (canon) approved by the Contraloría General de la República for each service, was calculated. As a result of the Evaluation conducted, the following was determined:

For the hydrant service of ESPH, S.A. and the Irrigation and Fish Farming (Riego y Piscicultura) service of SENARA, the amounts to adjust proved insignificant in the fixed tariffs, and are therefore not considered in the tariff change (.).

It was determined that for AyA, the adjustment for the year 2018 must be made; therefore, a decrease in cost is appropriate, which is related to the estimated revenues, determining the reduction percentages to be applied to the aqueduct, sewerage, and hydrant services, which is detailed in Table 2, and regarding ESPH, S.A., it was determined that a decrease in revenues is required for the aqueduct and sewerage services for the year 2018 as shown in Table 2.

As observed, the adjustments that must be made to the revenues for the year 2018 for AyA correspond to a decrease for aqueduct of 0.48%, for sewerage of 0.90%; for ESPH, a decrease of 0.35% for aqueduct and 0.35% for sewerage also results.

II. Tariff Impact

• a)Adjustments to Current Tariffs: In order to consider the reductions in the regulatory fee (canon de regulación) for AyA, it is recommended to decrease the aqueduct and sewerage tariffs over a two-month period. Given the reasons for the reduction, it will be applied only to those tariff blocks and categories that are not subsidized. The tariffs to be adjusted are those corresponding to the business, government, and residential categories starting from the consumption blocks of 61 m³. For the preferential category and the blocks under 60 m³ of the residential category, no decrease was estimated given that these already have a subsidy for social reasons. For ESPH, it is recommended to decrease the aqueduct and sewerage tariff over a two-month period in the same categories.

Regarding costs and the market, the data remains constant as estimated in the last tariff study for each service. Thus, the market and revenue projections are taken as valid, and only the amount representing the adjustment of the new regulatory fees (cánones) over the revenues needed by the Institution to cover the costs already estimated in tariff studies in which the currently applicable tariffs were determined for AyA as well as ESPH, in the aqueduct and sewerage services, is measured.

According to the above, for AyA, a reduction of 6.36% applies to the aqueduct tariffs and 7.96% to the sewerage tariffs; for ESPH, a decrease of 4.60% applies to the aqueduct service and 3.45% to the sewerage service.

• b)Hydrants: It is necessary to indicate that the amount to be refunded in the hydrant tariff for AyA requested is 20,017,477 colones, which will be reduced in the month of January for all services and categories. The hydrant tariffs for metered service go from 24 to 22 colones per cubic meter and for fixed service from 510 to 478 (.).

IV. Conclusions

(.)

2- Upon reviewing the amount authorized by the Contraloría General de la República in the estimates of the regulatory fee (canon) for regulation for the year 2018, it was determined that AyA's revenues would require a decrease for the aqueduct service of 0.48% and for the sewerage service of 0.90%; with respect to ESPH, the revenue requirements would decrease by 0.35% for the aqueduct service and 0.35% for the sewerage service.

3- Given the reduction in the revenue requirement, it is necessary to apply a decrease in the tariffs for the aqueduct and sewerage services of AyA and ESPH; it is convenient that said variations be in effect for 2 months, corresponding to January and February 2019.

4- For the Hydrant service of AyA, a reduction must be made in the month of January 2019. The hydrant tariff for metered service goes from 24 to 22 colones per cubic meter and for fixed service from 510 to 478.

5- For the Hydrant service of ESPH, no adjustment is recommended due to the small amount.

6- For the Irrigation and Drainage (Riego y Avenamiento) service, no adjustment is recommended due to the resulting small amount (.)".

II- In accordance with the preceding Whereas clauses and Considerations, and in accordance with the merits of the proceedings, it is appropriate to:

1. Reduce by 6.36% the current tariff of the aqueduct service and by 7.96% the current tariff of the sewerage service for the business and government categories and for the blocks starting from 61 m³ of the residential category of AyA.

For the aqueduct service, the tariffs are in effect from January 1, 2019, to February 28, 2019. As of March 1, 2019, the tariffs set according to resolution RIA-008-2017 of September 14, 2017, published in La Gaceta No. 179 of September 21, 2017, for AyA shall apply.

For the sewerage service, the tariffs are in effect from January 1, 2019, until February 28, 2019. As of March 1, 2019, the tariffs set according to resolution RIA-009-2017 of September 14, 2017, published in La Gaceta No. 179 of September 21, 2017, for AyA shall apply.

2. Reduce by 4.60% the current tariff of the aqueduct service and by 3.35% the current tariff of the sewerage service for the business and government categories and for the blocks starting from 61 m³ of the residential category of ESPH.

For the aqueduct service, the tariffs are in effect from January 1 to February 28, 2019; as of March 1, 2019, the tariffs set according to resolution RIA-006-2015 of July 9, 2015, published in La Gaceta No. 135, of July 14, 2015, for ESPH shall apply.

For the sewerage service, the tariffs are in effect from January 1 to February 28, 2019; as of March 1, 2019, the tariffs set according to resolution RIA-003-2015 of March 19, 2015, published in La Gaceta No. 61, of March 27, 2015, for ESPH shall apply.

3. For the Hydrant service provided by AyA, the tariff for the metered service goes from 24 to 22 colones per cubic meter and for the fixed service from 510 to 478, reductions applicable for the month of January 2019. As of February 1, 2019, the tariffs set according to resolution RIA-002-2016 of February 3, 2016, published in La Gaceta No. 28 of February 10, 2016, shall apply.

4. For the Hydrant services in ESPH, and the Irrigation and Fish Farming (Riego y Piscicultura) service of SENARA, no adjustment is recommended as the resulting tariff differences are of small amount.

Based on the powers conferred in Law No. 7593 and its amendments, in the General Public Administration Law No. 6227, in the Executive Decree 29732-MP, which is the Regulation to Law No. 7593, and in the Internal Regulation of Organization and Functions of the Autoridad Reguladora de los Servicios Públicos and its Deconcentrated Bodies, THE WATER SUPERINTENDENT (INTENDENTE DE AGUA)

I.To set for the aqueduct and sewerage services provided by the Instituto Costarricense de Acueductos y Alcantarillados (AyA), the following tariffs:

AyA Aqueduct Service January-February 2019 in colones

AyA Sewerage Service January-February 2019 in colones

These tariffs are in effect from January 1, 2019, to February 28, 2019. As of March 1, 2019, the tariffs set according to resolutions RIA-008-2017 and RIA-009-2017 of September 14, 2017, published in La Gaceta No. 179 of September 21, 2017, for AyA shall apply.

II.To set for the aqueduct and sewerage services provided by the Empresa de Servicios Públicos de Heredia, S.A., the following tariffs:

ESPH Aqueduct Service January-February 2019 in colones

ESPH Sewerage Service January-February 2019 in colones

These tariffs are in effect from January 1, 2019, to February 28, 2019. As of March 1, 2019, the tariffs set according to resolution RIA-006-2015 of July 9, 2015, published in the official newspaper La Gaceta No. 135 of July 14, 2015, and RIA-003-2015 of March 19, 2015, published in La Gaceta No. 61 of March 27, 2015, for ESPH shall apply.

In compliance with the provisions of Article 245 in relation to Article 345 of the General Public Administration Law, it is hereby informed that against this resolution, the ordinary remedies of revocation and appeal, and the extraordinary remedy of review are available.

The revocation remedy may be filed before the Water Superintendent (Intendente de Agua), who is responsible for resolving it; the appeal and review remedies may be filed before the Board of Directors, which is responsible for resolving them.

In accordance with Article 346 of the General Public Administration Law, the revocation and appeal remedies must be filed within a period of three days counted from the business day following notification, and the extraordinary review remedy, within the deadlines indicated in Article 354 of the cited Law.

(ESPH, S.A.)

I- La Contraloría General de la República, en su oficio DFOE-EC-0393 del 27 de julio del 2012 indicó en cuanto a la figura del canon: "(.) Esta Contraloría General advierte a la ARESEP, la obligación de que, previo a realizar el cobro, éste se encuentre incorporado efectivamente en la tarifa que cobran las empresas que brindan el servicio regulado a sus usuarios finales, considerando que esas entidades autorizadas para prestar el servicio no son más que recaudadores del canon, por lo que este debe ser neutro respecto de su situación financiera (.)".

II- Mediante el oficio OF-0666-IA-2018 del 25 de septiembre del 2018, la Intendencia de Agua recomendó la apertura de un expediente administrativo para la aplicar de oficio, un ajuste en el monto de los cánones de regulación para el año 2018, a la Empresa de Servicios Públicos de Heredia, S.A. (ESPH,S.A) y al Instituto Costarricense de Acueducto y Alcantarillado (AyA) y correspondiente a los servicios de acueductos, alcantarillados e hidrantes. (Folio 01).

III- Mediante el oficio OF-0667-IA-2018 del 25 de septiembre del 2018, la Intendencia de Agua solicitó a la Dirección General de Atención al Usuario (DGAU), la convocatoria a audiencia pública para exponer el estudio tarifario de oficio de referencia. (Folio 03).

IV- La Autoridad Reguladora publicó la convocatoria a audiencia pública en los siguientes periódicos: La Extra y La Teja del 11 de octubre del 2018 (folio 21) y el Diario Oficial La Gaceta Nº188 del 11 de octubre del 2018. (Folio 21).

V- La audiencia pública se realizó el día 13 de noviembre del 2018 a las 17:30 horas, en el Auditorio de la Autoridad Reguladora de los Servicios Públicos, ubicado en Guachipelín de Escazú, Oficentro Multipark, edificio Turrubares; por medio del sistema de videoconferencia interconectado con los Tribunales de Justicia ubicados en los centros de Limón, Heredia, Alajuela, Liberia, Puntarenas, Pérez Zeledón y Cartago, y también en forma presencial en el Salón de la Cruz Roja de San Ignacio de Acosta, ubicado 25 metros al sur del costado oeste del parque Monseñor Sanabria, San Ignacio, Acosta, San José. para conocer la propuesta de "Estudio tarifario de oficio para aplicar ajuste de cánones para el periodo 2018 en los servicios de acueducto, alcantarillado e hidrantes del Instituto Costarricense de Acueductos y Alcantarillados (AyA) y de los servicios de acueducto y alcantarillado de la Empresa de Servicios Públicos de Heredia S.A. (ESPH S.A.)", tramitada en el expediente ET-051- 2018. Según el informe N° IN-0072-DGAU-2018 no se recibieron oposiciones ni coadyuvancias.

VI- Mediante el oficio OF-0861-IA-2018 del 04 de diciembre de 2018, la Intendencia de Agua emitió el informe denominado "Ajuste por rebaja en los cánones para el año 2018 para los servicios de acueducto, alcantarillado, hidrantes y riego. Expediente ET-051-2018". (Mismo que corre agregado a los autos).

VII- En los plazos y procedimientos se han cumplido las prescripciones de Ley.

I- Del oficio OF-0861-IA-2018 del 04 de diciembre de 2018, que sirve de base a esta resolución, conviene extraer lo siguiente:

"(.)

I. Servicios de Acueductos, Alcantarillado Sanitario, Hidrantes

• a)Introducción El presente estudio surge ante la necesidad de efectuar ajustes en las tarifas al actualizarse el monto del canon de regulación aprobado por la Contraloría General de la República para el año 2018, con el fin de cumplir con la recomendación de esa entidad en el sentido de que el canon "debe ser neutro a su situación financiera"; la cual debe ser acatada por la Autoridad Reguladora.

Para cumplir con la directriz anteriormente mencionada y en vista de que el canon de regulación es parte de la tarifa del servicio que pagan los abonados, la Autoridad Reguladora debe ajustar este cargo en la proporción que corresponda.

El mecanismo con el cual la Autoridad Reguladora puede lograr que el ajuste del canon llegue a los abonados, es mediante la modificación de las tarifas y por la vía ordinaria; excepto en las tarifas de riego y avenamiento ya que el modelo tarifario establecido mediante resolución RIA-009-2015 del 08 de septiembre del 2015 indica que se debe realizar el ajuste por la vía extraordinaria (.).

• c)Cálculo del Impacto del Canon en los ingresos estimados Se calculó el impacto sobre los ingresos de la diferencia entre el canon incorporado por la Autoridad Reguladora en los estudios tarifarios elaborados para los servicios de acueducto, alcantarillado e hidrantes para el Instituto Costarricense de Acueductos y Alcantarillados (AyA); servicio de acueducto, alcantarillado e hidrantes de la Empresa de Servicios Públicos de Heredia (ESPH, S.A.) y en el servicio de riego para el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (Senara) para el año 2018, con respecto al canon aprobado por la Contraloría General de la República para cada servicio. Producto de la Evaluación realizada se determinó lo siguiente:

Para el servicio de hidrantes de la ESPH, S.A. y Riego y Piscicultura de SENARA los montos a ajustar resultaron insignificantes en las tarifas fijadas, por lo que no se consideran en el cambio tarifario (.).

Se determinó que para el AyA se debe hacer el ajuste del año 2018; por lo que procede hacer una disminución en el costo, el cual se relaciona con los ingresos estimados, determinándose los porcentajes de rebaja que se aplicarían a los servicios de acueducto, alcantarillado e hidrantes, lo cual se detalla en el cuadro 2 y con respecto a ESPH, S.A, se determinó que se requiere de una disminución en los ingresos para los servicios de acueducto y alcantarillado para el año 2018 como se muestra en el cuadro 2.

Como se observa, los ajustes que deben realizarse en los ingresos del año 2018 para el AyA corresponden a una disminución para acueducto de 0,48%, para alcantarillado de 0,90%; en ESPH también resulta una disminución de 0,35% para acueducto y 0,35% para alcantarillado.

II. Impacto Tarifario

• a)Ajustes en las tarifas vigentes: Con el fin de considerar las rebajas en el canon de regulación en AyA, se recomienda disminuir las tarifas de acueducto y alcantarillado en un periodo de dos meses. Dadas las razones que llevan a la rebaja, esta se aplicará sólo a aquellos bloques y categorías tarifarias que no se encuentran subsidiadas. Las tarifas que se ajustarán son las que corresponden a las categorías empresarial, gubernamental y domiciliaria a partir de los bloques de consumo de 61 m3. Para la categoría preferencial y los bloques menores de 60 m3 de la categoría domiciliar, no se estimó disminución dado que estos ya cuentan con un subsidio por razones de tipo social. En ESPH se recomienda disminuir la tarifa de acueducto y alcantarillado por un periodo de dos meses en las mismas categorías.

En cuanto a los costos y al mercado, se mantienen los datos constantes según lo estimado en el último estudio tarifario para cada servicio. De manera que se toman como válidas las proyecciones de mercado y de ingresos, y solamente se mide cuánto representa el ajuste de los nuevos cánones sobre los ingresos que necesita la Institución para sufragar los costos que ya fueron estimados en estudios tarifarios en que se determinaron las tarifas que aplican actualmente para AyA como ESPH, en los servicios de acueducto y alcantarillado.

Según lo anterior, para AyA aplica una rebaja de 6,36% en las tarifas de acueducto y de un 7,96% en las de alcantarillado, mientras en ESPH aplica una disminución de 4,60% en el servicio de acueducto y de un 3,45% en el servicio de alcantarillado.

• b)Hidrantes: Es necesario indicar que el monto a devolver en la tarifa de hidrantes para AyA solicitado es de 20.017.477 colones, los cuales se van a rebajar en el mes de enero, para todos los servicios y categorías. Las tarifas de hidrantes para el servicio medido pasan de 24 a 22 colones por metro cúbico y en servicio fijo de 510 a 478 (.).

IV. Conclusiones

(.)

2- Al revisar el monto autorizado por la Contraloría General de la República en las estimaciones del canon por regulación para el año 2018, se determinó que los ingresos del AyA requerirían una disminución para el servicio de acueducto de un 0,48% y para el servicio de alcantarillado un 0,90%; con respecto a ESPH las necesidades de ingresos disminuirían en un 0,35% para el servicio de acueducto y un 0.35% para el servicio de alcantarillado.

3- Ante la rebaja en la necesidad del ingreso, es necesario aplicar una disminución en las tarifas de los servicios de acueducto y alcantarillado del AyA y de la ESPH, es conveniente que dichas variaciones rijan durante 2meses, que corresponden de enero y febrero de 2019.

4- Para el servicio de Hidrantes del AyA se debe rebajar en el mes de enero 2019. La tarifa de hidrantes para el servicio medido pasa de 24 a 22 colones por metro cúbico y en servicio fijo de 510 a 478.

5- Para el servicio de Hidrantes de la ESPH no se recomienda hacer ningún ajuste por poca cuantía.

6- Para el servicio de Riego y Avenamiento no se recomienda hacer ningún ajuste por resultar de poca cuantía (.)".

II- De conformidad con los resultandos y considerandos que preceden y de acuerdo con el mérito de los autos, lo procedente es:

1. Rebajar un 6,36% en la tarifa vigente del servicio de acueducto y un 7,96% en la tarifa vigente del servicio de alcantarillado para las categorías empresarial, de gobierno y para los bloques a partir de 61 m3 de la categoría domiciliar del AyA.

Para el servicio de acueducto, las tarifas rigen a partir del 01 de enero de 2019 al 28 de febrero 2019. A partir del 1º de marzo 2019, aplicarán las tarifas fijadas según resolución RIA-008-2017 del 14 de septiembre del 2017, publicada en la Gaceta N°179 del 21 de septiembre de 2017 para AyA.

Para el servicio de alcantarillado, las tarifas rigen a partir del 01 de enero de 2019, hasta el 28 de febrero de 2019. A partir del 1º de marzo 2019, aplicarán las tarifas fijadas según resolución RIA-009-2017 del 14 de septiembre del2017, publicada en la Gaceta N°179 del 21 de septiembre del 2017 para AyA.

2. Rebajar un 4,60% en la tarifa vigente del servicio de acueducto y un 3,35% en la tarifa vigente del servicio de alcantarillado para las categorías empresarial, de gobierno y para los bloques a partir de 61 m3 de la categoría domiciliar de la ESPH.

Para el servicio de acueducto, las tarifas rigen a partir del 01 de enero hasta el 28 de febrero del 2019; a partir del al 01 de marzo de 2019 se aplicarán a las tarifas fijadas, según la resolución RIA-006-2015 del 09 de julio del 2015,publicada en La Gaceta Nº135, del 14 de julio del 2015 para ESPH.

Para el servicio de alcantarillado, las tarifas rigen a partir del 01 de enero hasta el 28 de febrero del 2019; a partir del 01 de marzo de 2019 se aplicarán a las tarifas fijadas, según la y la resolución RIA-003-2015 del 19 de marzo del 2015,publicada en La Gaceta Nº 61, del 27 de marzo del 2015 para ESPH.

3. Para el servicio de Hidrantes que suministra el AyA, la tarifa del servicio medido pasa de 24 a 22 colones por metro cúbico y del servicio fijo de 510 a 478,rebajas aplicables para el mes de enero 2019. Al 01 de febrero de 2019 se aplicarán a las tarifas fijadas, según la resolución RIA-002-2016 del 03 de febrero del 2016, publicada en la Gaceta N°28 del 10 de febrero del 2016.

4. Para los servicios de Hidrantes en ESPH, Riego y Piscicultura de SENARA no se recomienda hacer ningún ajuste por resultar las diferencias tarifarias de poca cuantía.

Con fundamento en las facultades conferidas en la Ley N° 7593 y sus reformas, en la Ley General de la Administración Pública N° 6227, en el Decreto Ejecutivo 29732- MP, que es el Reglamento a la Ley N° 7593, y en el Reglamento Interno de Organización y Funciones de la Autoridad Reguladora de los Servicios Públicos y sus Órganos Desconcentrados, El INTENDENTE DE AGUA

I.Fijar para los servicios de acueducto y de alcantarillado que brinda el Instituto Costarricense de Acueductos y Alcantarillados (AyA), las siguientes tarifas:

Servicio Acueducto AyA Enero-Febrero 2019 en colones Estas tarifas rigen a partir del 01 de enero de 2019, hasta el 28 de febrero de 2019. A partir del 01 de marzo 2019, aplicarán las tarifas fijadas según resolución RIA-008-2017 y RIA-009-2017 del 14 de septiembre del 2017, publicada en la Gaceta N°179 del 21 de septiembre del 2017 para AyA.

II.Fijar para los servicios de acueducto y de alcantarillado que brinda la Empresa de Servicios Públicos de Heredia, S.A., las siguientes tarifas:

Estas tarifas rigen a partir del 01 de enero de 2019, hasta el 28 de febrero de 2019. A partir del 01 de marzo 2019, aplicarán las tarifas fijadas según resolución RIA-006-2015 del 9 de julio del 2015, publicada en el diario oficial La Gaceta N°135 del 14 de julio de 2015 y RIA-003-2015 del 19 de marzo del 2015, publicada en la Gaceta N°61 del 27 de marzo del 2015 para ESPH.

En cumplimiento de lo que ordena el artículo 245 en relación con el 345 de la Ley General de la Administración Pública, se informa que contra esta resolución caben los recursos ordinarios de revocatoria y de apelación y el extraordinario de revisión.

El de revocatoria podrá interponerse ante el Intendente de Agua, a quien corresponde resolverlo; el de apelación y el de revisión podrán interponerse ante la Junta Directiva, a la que corresponde resolverlos.

De conformidad con el artículo 346 de la Ley General de Administración Pública, los recursos de revocatoria y el de apelación deberán interponerse en el plazo de tres días contados a partir del día hábil siguiente al de notificación, y el extraordinario de revisión, dentro de los plazos señalados en el artículo 354 de la citada Ley.
