Regulation for the Management and Recognition of Ecosystem Services No. 41124-MINAE

THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by articles 50, 89, 140, subsections 3) and 18), 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration No. 6227 of May 2, 1978; articles 2 paragraph a) and 48 of the Organic Law of the Environment No. 7554 of October 4, 1995; articles 13, 22, 35, 36, 53, 100, 101 and 102 of the Biodiversity Law No. 7788, of April 30, 1998; articles 4 and 6 of the National Parks Service Law No. 6084 of August 24, 1977; article 13 of the Forestry Law (Ley Forestal) No. 7575 of February 13, 1996 and article 17 of the Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre) No. 7317 of October 30, 1992 and their amendments.
Considering:
7575, the Natural Heritage of the State is in the public domain and its administration is assigned by law to the Ministry of Environment and Energy (MINAE). Likewise, it is through articles 13 and 22 of the Biodiversity Law No. 7788, that SINAC was delegated to integrate competencies in forestry matters, wildlife, protected areas, the protection and conservation of the use of hydrographic basins and water systems, in order to dictate policies, plan and execute processes aimed at achieving sustainability in the management of Costa Rica's natural resources. Therefore, SINAC shall exercise its functions and competencies as a single instance, through the administrative structure of the system, without prejudice to the objectives for which they were established. Therefore, due to its competencies, the Natural Heritage of the State is administered by MINAE through SINAC.
7788, the State must promote the adoption of incentives and the retribution of environmental services for the conservation and sustainable use of biodiversity.
7788, in its article 35, the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) must design financing mechanisms that allow it to exercise its mandates with agility and efficiency. Likewise, it authorizes in its article 36 SINAC to administer the funds that enter the System by any concept, through trusts (fideicomisos) or other instruments, whether these are for the entire system, or specific to each Conservation Area.
7788, in its chapter VIII on incentives, and more specifically in articles 101 and 102, MINAE must incentivize the participation of communities in the conservation and sustainable use of biodiversity.
7317 of October 30, 1992, the State may enter into contracts, grant use permits, licenses, concessions or any other legally established figure for the conservation and sustainable use of wildlife.
34433-MINAE of March 11, 2008, establishes that SINAC must define, develop and promote management actions to achieve the conservation, restoration, recovery and rehabilitation of ecosystems and their components, based on scientific studies, management plans or other planning instruments for protected wild areas, in accordance with the objectives of their declaration, including the management and/or eradication of invasive exotic species, recovery of soils and vegetation cover (cobertura vegetal), control and prevention of forest fires, mitigation of natural disasters and control of opportunistic native species populations and regulation of hydrobiological cycles.

General Provisions
Decree:
CHAPTER I
The purposes of this regulation are the following:
This regulation shall be applied by SINAC in the following terms:
MINAE, through SINAC, shall have the exclusive power to establish the necessary agreements to fulfill the stages of the value chain (cadena de valor) of the ecosystem services provided by the lands of the Natural Heritage of the State and the marine areas within the ASP.

Economic and Non-Economic Mechanisms
CHAPTER III
The economic and non-economic mechanisms to be developed may include, but not exclusively:
a. Trusts (Fideicomisos); b. Payment for ecosystem services (Pago por servicios ecosistémicos); c. Conservation credits; d. Fees (Cánones); e. Donations according to established institutional procedures; f. Debt swaps.
g. Alliances for development h. Technical assistance for community management.
i. Incentives j. Any other as established in article 85 of the Regulation to the Biodiversity Law No. 7788, Executive Decree No. 34433-MINAE, of March 11, 2008 or other current regulations, that meets the objectives and criteria established in this decree.
For the creation of economic and non-economic mechanisms, the following criteria must be taken into account:
a. The mechanisms must guarantee the management, sustainable use and conservation of biodiversity, as well as its restoration, rehabilitation and recovery.
b. The mechanisms may in no case include the authorization of access to elements of biodiversity in favor of third parties when the mechanism is generated in PNE and ASP areas, a matter that shall be governed by the provisions of the Biodiversity Law and the regulatory rules issued in this regard; c. The mechanisms must contribute to the financial sustainability of the ASP and PNE, as well as to the management of SINAC and the promotion of community participation.
d. The mechanisms must have a platform for their administration, which must include operating resources.
e. The mechanisms must be designed, managed and administered according to institutional policies, programs, strategies or plans.
f. The mechanisms must support the prioritization that the institution carries out according to the levels of intervention according to the instruments or mechanisms developed by the institution.
Management and Administration
CHAPTER IV
The Ecosystem Services Program is created as an inter-institutional program attached to the Department of Conservation and Sustainable Use of Biodiversity and Ecosystem Services of the Executive Secretariat of the National System of Conservation Areas (SINAC), as the entity responsible for developing processes that allow incentivizing the recognition of SE and their valuation, as well as designing, administering, promoting, implementing and monitoring the economic and non-economic mechanisms that contribute to the conservation and sustainable use of biodiversity.
The SINAC Ecosystem Services Program shall have the following functions:
According to its financial availability, SINAC shall give priority to forms of financing and technical or other support, for community biodiversity management projects, in order to promote and encourage the conservation and sustainable use of biodiversity.
SINAC must promote innovative processes, for which it must determine the type of projects and activities oriented to the conservation and sustainable use of biodiversity, considering actions for the recovery, rehabilitation and restoration of ecosystems.
For the selection of community projects, the following criteria must be considered:
SINAC must establish the mechanisms for the application, review and updating of such eligibility criteria.
The resources coming from the internalization of ecosystem services may be administered through the special funds created by Law available to SINAC or administered by the Environmental Bank Foundation (Fundación Banco Ambiental, FUNBAM) created by article 4 of Law No. 8640 published in La Gaceta No. 128 of July 3, 2008.
The resources coming from the internalization of ecosystem services shall be used by SINAC for the strengthening of institutional management in conservation and sustainable use of biodiversity in the Natural Heritage of the State and community biodiversity management projects.
For the implementation of economic and non-economic mechanisms to compensate third parties, SINAC may establish agreements with national, regional and local public or private organizations or entities, duly recognized and with experience in the administration of funds.
In case it is required to establish agreements with international public or private organizations or entities, the signing of these shall be the responsibility of the Minister of Environment and Energy with prior approval of CONAC.
It takes effect as of its publication in the Official Gazette La Gaceta.

EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AMBIENTE Y ENERGÍA En ejercicio de las facultades que les confieren los artículos 50, 89, 140, incisos 3) y 18), 146 de la Constitución Política; los artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la Administración Pública N° 6227 del 2 de mayo de 1978; artículos 2 inciso a) y 48 de la Ley Orgánica del Ambiente N° 7554 del 4 de octubre de 1995; artículos 13, 22, 35, 36, 53, 100, 101 y 102 de la Ley de Biodiversidad Nº 7788, del 30 de abril de 1998; artículos 4 y 6 de la Ley del Servicio de Parques Nacionales Nº 6084 del 24 de agosto de 1977; artículo 13 de la Ley Forestal Nº 7575 de 13 de febrero de 1996 y el artículo 17 de la Ley de Conservación de la Vida Silvestre Nº 7317 del 30 de octubre de 1992 y sus reformas.
Considerando:
Asimismo, es por medio de los artículos 13 y 22 de la Ley de Biodiversidad N° 7788, que se delegó al SINAC integrar las competencias en materia forestal, vida silvestre, áreas protegidas, la protección y conservación del uso de cuencas hidrográficas y sistemas hídricos, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica. Por lo anterior, el SINAC ejercerá sus funciones y competencias como una sola instancia, mediante la estructura administrativa del sistema, sin prejuicio de los objetivos para los cuales fueron establecidos. Por lo anterior, debido a sus competencias el Patrimonio Natural del Estado es administrado por el MINAE a través del SINAC.
Asimismo, autoriza en su artículo 36 al SINAC para administrar los fondos que ingresen al Sistema por cualquier concepto, por medio de fideicomisos u otros instrumentos, ya sean estos para todo el sistema, o específicos para cada Área de Conservación.
10.-Que es necesario para impulsar proyectos innovadores, que el SINAC defina el tipo de proyectos y actividades orientadas al uso sostenible y conservación de la biodiversidad, así como aquellos direccionados a su rehabilitación, restauración y recuperación.
11.-Por ser este un proceso propio del SINAC, y siendo el superior jerárquico del Sistema el CONAC, órgano colegiado presidido por el Ministro de Ambiente y Energía, dado esa condición, la suscripción de convenios con organizaciones o entes públicos o privados de carácter internacional, le corresponderá al Ministro de Ambiente y Energía. Decretan:
CAPÍTULO I
Disposiciones Generales
Los objetivos de este reglamento son los siguientes:
El presente reglamento será aplicado por el SINAC en los siguientes términos:
El MINAE, a través del SINAC tendrá la potestad exclusiva para establecer acuerdos necesarios para cumplir con las etapas de la cadena de valor de los servicios ecosistémicos que brinden las tierras del Patrimonio Natural del Estado y las áreas marinas comprendidas en las ASP.

CAPÍTULO II
Para efectos del presente Reglamento se utilizarán los siguientes acrónimos:

A)Alianzas para el desarrollo: Interacción corresponsable de las instituciones públicas y las organizaciones privadas, en la cual, las partes comparten recursos, competencias y riesgos para el logro de objetivos comunes que contribuyan al desarrollo sostenible.
Mecanismos económicos y no económicos
CAPÍTULO III
Los mecanismos económicos y no económicos a desarrollar podrán incluir, pero no en forma exclusiva:
a. Fideicomisos; b. Pago por servicios ecosistémicos; c. Créditos de conservación; d. Cánones; e. Donaciones según procedimientos institucionales establecidos; f. Canjes de deuda.
g. Alianzas para el desarrollo h. Asistencia técnica para gestión comunitaria.
i. Incentivos j. Cualquier otro según lo establecido en el artículo 85 del Reglamento a la Ley de Biodiversidad N° 7788, Decreto Ejecutivo N° 34433-MINAE, del 11 de marzo del 2008 u otra normativa vigente, que cumpla con los objetivos y criterios establecidos en el presente decreto.
Para la creación de mecanismos económicos y no económicos se deberá tomar en cuenta los siguientes criterios:
a. Los mecanismos deben garantizar el manejo, uso sostenible y conservación de la biodiversidad, así como su restauración, rehabilitación y recuperación.
b. Los mecanismos en ningún caso podrán comprender la autorización del acceso a elementos de la biodiversidad a favor de terceros cuando el mecanismo se genere en áreas del PNE y ASP, materia que se regirá por lo dispuesto en la Ley de Biodiversidad y las normas reglamentarias emitidas al respecto; c. Los mecanismos deberán contribuir a la sostenibilidad financiera de las ASP y PNE, así como a la gestión del SINAC y el fomento de la participación comunitaria.
d. Los mecanismos deberán contar con una plataforma para su administración, la cual deberá contemplar los recursos de operación.
e. Los mecanismos deberán estar diseñados, gestionados y administrados de acuerdo a las políticas, programas, estrategias o planes institucionales.
f. Los mecanismos deberán apoyar la priorización que la institución realice de acuerdo a los niveles de intervención según los instrumentos o mecanismos que se desarrollen por la institución.
Gestión y Administración
CAPÍTULO IV
Créase el Programa de Servicios Ecosistémicos como un programa interinstitucional adscrito al Departamento de Conservación y Uso Sostenible de la Biodiversidad y Servicios Ecosistémicos de la Secretaría Ejecutiva del Sistema Nacional de Áreas de Conservación (SINAC), como el responsable de desarrollar procesos que permitan incentivar el reconocimiento de los SE y su valoración, así como diseñar, administrar, promover, implementar y monitorear los mecanismos económicos y no económicos, que contribuyan a la conservación y uso sostenible de la biodiversidad.
El Programa de Servicios Ecosistémicos del SINAC tendrá las siguientes funciones:
De acuerdo a su disponibilidad financiera, el SINAC dará prioridad a formas de financiamiento y apoyo técnico o de otra índole, para proyectos de manejo comunitario de la biodiversidad, con el fin de promover y fomentar la conservación y uso sostenible de la biodiversidad.
El SINAC deberá impulsar procesos innovadores, para lo cual deberá determinar el tipo de proyectos y actividades orientadas a la conservación y uso sostenible de la biodiversidad, considerando acciones de recuperación, rehabilitación y restauración de ecosistemas.
Para la selección de proyectos comunitarios se deberán considerar los siguientes criterios:
1. Fortalecimiento organizacional o comunal.
2. Proyectos comunitarios de manejo de la biodiversidad y desarrollo rural sostenible.
3. Restauración, rehabilitación o recuperación de ecosistemas.
4. Fomento a la creación y manejo de reservas privadas y comunitarias.
5. Concientización y Educación Ambiental.
6. Que proponga acciones innovadoras para la conservación y uso sostenible de la biodiversidad y los recursos naturales.
7. Conservación y restauración de áreas de recarga acuífera.
8. Implementación de Planes Generales de Manejo de las ASP, permisos de uso en el PNE y otros vinculantes.
9. Desarrollo de investigaciones y transferencia de tecnologías para la conservación y uso sostenible de la biodiversidad.
El SINAC deberá establecer los mecanismos para la aplicación, la revisión y actualización de tales criterios de elegibilidad.
Los recursos provenientes de la internalización de los servicios ecosistémicos podrán ser administrados por medio de los fondos especiales creados por Ley con que cuenta el SINAC o administrados por la Fundación Banco Ambiental (FUNBAM) creada mediante el artículo 4 de la Ley N° 8640 publicada en La Gaceta Nº 128 del 3 de julio del 2008.
Los recursos provenientes de la internalización de los servicios ecosistémicos serán utilizados por el SINAC para el fortalecimiento de la gestión institucional en conservación y uso sostenible de la biodiversidad en el Patrimonio Natural del Estado y proyectos de manejo comunitario de la biodiversidad.
Para la implementación de los mecanismos económicos y no económicos para compensar a terceros, el SINAC podrá establecer convenios con organizaciones o entes públicos o privados de carácter nacional, regional y local, debidamente reconocidos y con En caso de requerirse establecer convenios con organizaciones o entes públicos o privados de carácter internacional, la suscripción de estos le corresponderá al Ministro de Ambiente y Energía previa aprobación del CONAC.
