the entire text - Full Text of Regulation 108 Comprehensive attention for the northern border zone in the districts of Pocosol, Cutris and Pital, of the Canton of San Carlos Full Text of record: 121586 DIRECTIVE No. 108-MP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY In accordance with the provisions of Articles 50, 140, subsections 3) and 20) and 146 of the Political Constitution, Articles 25 subsection 1), 27 subsection 1), 28 subsection 2) subparagraph b) and 121 of the General Law of Public Administration No. 6227; the Law for the Transformation of the Institute of Agrarian Development (IDA) into the Institute of Rural Development (Inder) No. 9036 and its Regulation; the Land and Colonization Law (ITCO) No. 2825, the Forest Law (Ley Forestal) No. 7575, the Law on Segregation of Lands Belonging to the Northern Border Wildlife Refuge No. 7774, the General Roads Law No. 5060, the Constitutive Law of the Costa Rican Institute of Aqueducts and Sewers No. 2726, the Water Law No. 276, the Law on the Maritime-Terrestrial Zone No. 6043, the Law for the Promotion of Agricultural Production, No. 7064, the Mining Code No. 6797, the Municipal Code No. 7794, the Law for the Protection of Citizens from Excess Requirements and Administrative Procedures No. 8220, the General Law of Migration and Foreigners No. 8764, and the Law on Judicial Notifications No. 8687.
I.That it is necessary to have a legal instrument that allows for the generation of articulated and coordinated responses in the short, medium, and long term for the comprehensive development of the northern border zone, specifically the districts of Pocosol, Cutris and Pital, under the protection of the Central American Strategy for Rural Territorial Development, 2010-2030 (ECADERT), which establishes that the management of rural territories is fundamental for promoting sustainable and balanced development of said territories, through the creation of spaces for proactive and articulated participation of all public and private actors, a strategy that has legal basis in Costa Rica with Law 9036 on the creation of the Institute of Rural Development (Inder).
II.That the Government Council, in a session on October 31, 2017, proposes to find economic, social, environmental, security, and infrastructure solutions, under the logic of inter-institutional articulation for the northern border zone of the country; hence, it entrusted the Ministry of the Presidency together with the Inder, with the support of the Local Government of San Carlos, to lead the search for solutions hand-in-hand with the inter-institutional sector.
III.That said Commission defined the objective of generating articulated and coordinated responses in the short, medium, and long term for the sustainable development of the border zones of the districts of Pocosol, Cutris and Pital, of San Carlos, through coordinated work between the Costa Rican Institute of Aqueducts and Sewers (AyA), the Costa Rican Social Security Fund (CCSS), the National Directorate of Community Development (DINADECO), the Joint Institute of Social Assistance (IMAS), the National Learning Institute (INA), the National Institute of Women (INAMU), the Ministry of Agriculture and Livestock (MAG), the Ministry of Public Education (MEP), the National Directorate of Migration and Foreigners, the Ministry of Foreign Trade (COMEX), the Ministry of Environment and Energy (MINAE), the Ministry of Health, the Ministry of Public Security, the Ministry of Housing and Human Settlements (MIVAH), the Ministry of Public Works and Transport (MOPT), the Ministry of Culture, the National Animal Health Service (SENASA), the National Technical University (UTN), the Technological Institute of Costa Rica (ITCR), the Comprehensive Development Associations of the zone, among other public, academic, civil society, and private sector organizations.
IV.That as a result of the articulation led by the institutions indicated in Considering II and thanks to various meetings facilitated for civil society in the zone, approximately 120 diverse actions were identified in dimensions of development such as the economic, social, infrastructure, and environmental, during the period from November 2017 to March 2018, which supports the proposal for the Northern Border Development of the Districts of Pital, Pocosol and Cutris.
Therefore, the following is issued, DIRECTIVE ADDRESSED TO THE PUBLIC SECTOR "ON THE COMPREHENSIVE ATTENTION FOR THE NORTHERN BORDER ZONE, IN THE DISTRICTS OF POCOSOL, CUTRIS AND PITAL OF THE CANTON OF SAN CARLOS"
CONSIDERING
The organs of the Central and Decentralized Administration are instructed to collaborate, to the extent of their possibilities and without prejudice to the fulfillment of their own objectives, in the implementation and execution of the short, medium, and long-term measures of the Comprehensive Development Plan for Northern Border Development, specifically, for the districts of Pocosol, Cutris and Pital, of the Canton of San Carlos.
The general coordination of the diverse activities shall be led by the Ministry of the Presidency, Inder, the Ministry of Public Security, and the Ministry of Environment and Energy.
The Plan shall be developed in four dimensions, divided into the following actions.
Similarly, each quarterly evaluation shall be reported to organized civil society so that they can follow up on the actions executed in the short, medium, and long term.

l. Que es menester contar con un instrumento jurídico que permita generar respuestas articuladas y coordinadas al corto, mediano y largo plazo para el desarrollo integral de la zona fronteriza norte, en específico los distritos Pocosol, Cutris y Pital, al amparo de la Estrategia Centroamericana de Desarrollo Rural Territorial, 2010-2030 {ECADERT), la cual establece que la gestión de territorios rurales, es fundamental para fomentar el desarrollo sostenible y equilibrado de dichos territorios, a través de la creación de espacios de participación proactiva y articulada de todos los actores públicos y privados, estrategia que tiene asidero legal en Costa Rica con la Ley 9036 de creación del Instituto de Desarrollo Rural (lnder).
II.Que el Consejo de Gobierno en sesión del 31 de octubre de 2017, propone encontrar soluciones económicas, sociales, ambientales, de seguridad y de infraestructura, bajo la lógica de articulación interinstitucional para la zona fronteriza norte del país, de ahí que, encomendara al Ministerio de la Presidencia junto al lnder, con el apoyo del Gobierno Local de San Carlos, liderar la búsqueda de soluciones de la mano con la interinstitucional.
III.Que dicha Comisión definió como objetivo generar respuestas articuladas y coordinadas al corto, mediano y largo plazo para el desarrollo sostenible de las zonas fronterizas de los distritos de Pocosol, Cutris y Pita!, de San Carlos, mediante el trabajo coordinador entre el Instituto Costarricense de Acueductos y Alcantarillados (AyA), Caja Costarricense del Seguro Social (CCSS), Direcc ón Nacional de Desarrollo Comunal (DINADECO), Instituto Mixto de Ayuda Social (IMAS), Instituto Nacional de Aprendizaje (INA), Instituto Nacional de las Mujeres (INAMU), Ministerio de Agricultura y Ganadería (MAG), Ministerio de Educación Pública (MEP), Dirección Nacional de Migración y Extranjería, Ministerio de Comercio Exterior (COMEX),Ministerio de Ambiente y Energía (MINAE), Ministerio de Salud, Ministerio de Seguridad Pública, Ministerio de Vivienda y Asentamientos Humanos (MIVAH), Ministerio de Obras Públicas y Transportes (MOPT), Ministerio de Cultura, Servicio Nacional de . Salud Animal (SENASA), Universidad Tecnológica Nacional (UTN) Instituto Tecnológico de Costa Rica (ITCR), Asociaciones de Desarrollo Integral de la zona, entre otras organizaciones públicas, académicas, de la sociedad civil y del sector privado.
IV.Que fruto de la articulación liderada por las instituciones indicadas en el Considerando II y gracias a diversos encuentros facilitados para la sociedad civil de la zona, se identificaron cerca de 120 acciones diversas en dimensiones del desarrollo como la económica, la social, de infraestructura y ambiental, durante el periodo de noviembre 2017 a marzo 2018, que sustenta la propuesta para el Desarrollo Fronterizo Norte de los Distritos de Pital, Pocosol y Cutris.
Por tanto, se emite la siguiente, DIRECTRIZ DIRIGIDA AL SECTOR PÚBLICO "SOBRE LA ATENCIÓN INTEGRAL DE LA ZONA FRONTERIZA NORTE, EN LOS DISTRITOS DE POCOSOL, CUTRIS Y PITAL DEL CANTÓN DE SAN CARLOS"
CONSIDERANDO
Se instruye a los órganos de la Administración Central y Descentralizada, a colaborar en la medida de sus posibilidades y sin perjuicio del cumplimiento de sus propios objetivos, en la implementación y ejecución de las medidas a corto, mediano y largo plazo del Plan de Desarrollo Integral para el Desarrollo Fronterizo Norte, en específico, de los distritos de Pocosol, Cutris y Pital, del Cantón de San Carlos.
La coordinación general de las diversas actividades las liderará el Ministerio de la Presidencia, Inder, Ministerio de Seguridad Pública y Ministerio de Ambiente y Energía.
El Plan deberá desarrollarse en cuatro dimensiones, divididas en las siguientes acciones.
Del mismo modo, cada evaluación trimestral será informada a la sociedad civil organizada para que puedan dar seguimiento a las acciones ejecutadas en el corto, mediano y largo plazo .
