throughout the entire text - Complete Text of Regulation 117 General Management Plan for Barbilla National Park NATIONAL SYSTEM OF CONSERVATION AREAS R-SINAC-CONAC-117-2017 National System of Conservation Areas.-Executive Secretariat.-San José, at ten o'clock on December sixth, two thousand seventeen.
APPROVAL OF THE GENERAL MANAGEMENT PLAN FOR BARBILLA NATIONAL PARK
1. That the General Management Plan (Plan General de Manejo, PGM) is the technical planning instrument that guides the management of a Protected Wilderness Area (Área Silvestre Protegida, ASP) towards the fulfillment of long-term conservation objectives.
2. That the General Management Plan (PGM) is the technical instrument that defines the guide or route that the ASP personnel and their allies must follow to maintain the ASP's values, therefore the conservation of biodiversity and ecosystem services.
3. That Barbilla National Park (Parque Nacional Barbilla, PNB) has not had a PGM to date.
4. That in 2010, a team of professionals from the Amistad Caribe Conservation Area prepared a General Management Plan for Barbilla National Park, with broad participation from community leaders, leaders of indigenous territories, local government, governmental and non-governmental organizations, academia, among other actors.
5. That the General Management Plan (PGM) was not published for its final officialization in due course in 2010.
6. That the General Management Plan (PGM) was updated during 2016.
FIRST: That the Magna Carta in its numeral 50 regarding the environment states: "..Every person has the right to a healthy and ecologically balanced environment. Therefore, they are entitled to report acts that infringe upon that right and to claim reparation for the damage caused. The State shall guarantee, defend, and preserve that right. The Law shall determine the corresponding responsibilities and sanctions." SECOND: That Article No. 13 of the Forestry Law (Ley Forestal) 7575 defines the State Natural Heritage as follows: "The State Natural Heritage (Patrimonio Natural del Estado, PNE) is constituted by the forests and forest lands of the national reserves, of the areas declared inalienable, of the farms registered in its name, and of those belonging to municipalities, autonomous institutions, and other organizations of the Public Administration." THIRD: That Law No. 6084 creates the National Parks Service, which shall have as its specific function the development and administration of national parks for the conservation of the country's natural heritage.
FOURTH: That through Law No. 7878, of May 27, 1998, the National System of Conservation Areas is created, which shall have its own legal personality; as a decentralized and participatory system of institutional management and coordination, which integrates competencies in forestry, wildlife, and protected areas, in order to dictate policies, plan, and execute processes aimed at achieving sustainability in the management of Costa Rica's natural resources.
FIFTH: That Executive Decree No. 13392-A of February 26, 1982, published in La Gaceta No. 52 of May 16, 1982, established the "Barbilla Biological Reserve," That by Executive Decree No. 13587-A, of May 4, 1982, published in La Gaceta No. 95 of Tuesday, May 18, 1982, the category of said absolute protection unit was modified, converting it into a "'Protective Zone," but with a special protection statute. That by Executive Decree No. 23235-MIRENEM of April 15, 1994, published in La Gaceta No. 96 of May 19, 1994, the category of said protection unit was modified, converting it into a "Biological Reserve." That due to its ecological characteristics, its richness in fauna and flora, and its geographic situation, this Protected Wilderness Area must be an Area of Absolute Protection, with the category of "National Park" and that through Executive Decree No. 26561-MINAE, published in La Gaceta No. 9 of January 14, 1998, which establishes Barbilla National Park.
SIXTH: That the Technical Committee (Comité Técnico, CCT) of the Amistad Caribe Conservation Area, in Ordinary Session Minutes No. 25-2009, Agreement No. 05, held on April 21, 2009, acknowledged and endorsed the update of the General Management Plan for Barbilla National Park and recommended proceeding with the approval process.
SEVENTH: That the Regional Council of the Amistad Caribe Conservation Area (Consejo Regional del Área de Conservación Amistad Caribe, CORAC-ACLAC) in Ordinary Session No. 25-2009, Agreement No. 5 of April 21, 2009, approved the General Management Plan for Barbilla National Park and recommended continuing the approval process before the National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación, CONAC).
EIGHTH: That the National Council of the Amistad Caribe Conservation Area (CONAC) in Extraordinary Session No. 10-2010, Agreement No. 4 of November 29, 2010, approved the General Management Plan for Barbilla National Park and recommended continuing the publication process in the Official Gazette La Gaceta.
NINTH: That through Official Communication SINAC-DE-418-2016, Mr. Julio Jurado Fernández, at the time Director of the National System of Conservation Areas, officialized the procedure related to the approval of General Management Plans for ASPs.
TENTH: That the Management of Protected Wilderness Areas of ACLAC requests that it be updated in accordance with the new Guide for the elaboration of General Management Plans in ASPs of SINAC, an activity that was carried out at the end of 2015 and 2016.
ELEVENTH: That the Technical Committee (CCT) of the Amistad Caribe Conservation Area, in ordinary session Minutes No. 003-2017, Agreement No. 8, held on March 21, 2017, acknowledged and endorsed the update of the General Management Plan for Barbilla National Park and recommended proceeding with the approval process.
TWELFTH: That the Regional Council of the Amistad Caribe Conservation Area (CORAC-ACLAC) in ordinary session No. 001-2017, Agreement No. 8 of March 24, 2017, approved the update of the General Management Plan for Barbilla National Park and recommended continuing the approval process before the National Council of Conservation Areas (CONAC). Therefore, THE NATIONAL COUNCIL OF CONSERVATION AREAS RESOLVES:
FIRST: To validate and approve the update of the General Management Plan for Barbilla National Park (2016-2026).
SECOND: To send this resolution to the Executive Director of the National System of Conservation Areas to continue with the officialization process in accordance with official communication SINAC-DE-418-2016 of March 17, 2016.

APROBACIÓN DEL PLAN GENERAL DE MANEJO DEL PARQUE NACIONAL BARBILLA
1. Que el Plan General de Manejo (PGM) es el instrumento técnico de planificación que permite orientar la gestión de una Área Silvestre Protegida (ASP) hacia el cumplimiento de los objetivos de conservación a largo plazo.
2. Que Plan General de Manejo (PGM) es el instrumento técnico que define la guía o ruta que debe seguir el personal del ASP y sus aliados para mantener los valores del ASP, por tanto la conservación de la biodiversidad y los servicios ecosistémicos.
3. Que el Parque Nacional Barbilla (PNB) no ha contado hasta la fecha con un PGM.
4. Que en el 2010 un equipo de profesionales del Área de Conservación Amistad Caribe, elaboró un Plan General de Manejo para el Parque Nacional Barbilla, con una amplia participación de líderes comunales, lideres territorios indígenas, gobierno local, organizaciones gubernamentales y no gubernamentales, academia entre otros actores.
5. Que Plan General de Manejo (PGM), no fue publicado para su oficialización final en su oportunidad en el año 2010.
6. Que Plan General de Manejo (PGM), fue actualizado durante el año 2016.
PRIMERO: Que la Carta Magna en su numeral 50 en lo que respecta al ambiente dice:"..Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La Ley determinará las responsabilidades y las sanciones correspondientes." SEGUNDO: Que el artículo N° 13 de la Ley Forestal 7575, define el Patrimonio Natural del Estado de la siguiente manera: "El Patrimonio Natural del Estado (PNE), está constituido por los bosques y terrenos forestales de la reserva nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a las municipalidades, instituciones autónomas y demás organizaciones de la Administración Pública." TERCERO: Que la Ley N° 6084, crea el Servicio de Parque Nacionales, que tendrá como función específica el desarrollo y administración de los parque nacionales para la conservación de patrimonio natural del país.
CUARTO: Que mediante la Ley N° 7878, del 27 de mayo del 1998, se crea el Sistema Nacional de Áreas de Conservación, que tendrá personería jurídica propia; como un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integra las competencias en materia forestal, vida silvestre, áreas protegidas, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.
QUINTO: Que el Decreto Ejecutivo N° 13392-A del 26 de febrero de 1982, publicado en La Gaceta N° 52 del 16 de mayo de 1982, se estableció la "Reserva Biológica Barbilla", Que por Decreto Ejecutivo N° 13587-A, del 4 de mayo de 1982, publicado en La Gaceta N° 95 del martes 18 de mayo de 1982, se modificó la categoría de dicha unidad de protección absoluta, convirtiéndola en una "'Zona Protectora", pero con estatuto especial de protección. Que por Decreto Ejecutivo N° 23235-MIRENEM del 15 de abril de 1994, publicado en La Gaceta N° 96 del 19 de mayo de 1994, se modificó la categoría de dicha unidad de protección convirtiéndola en "Reserva Biológica". Que por sus características ecológicas, su riqueza en fauna y flora y su situación geográfica, esta Área Silvestre protegida debe ser una Área de Protección Absoluta, con categoría de "Parque Nacional" y que mediante el Decreto Ejecutivo N° 26561-MINAE, publicado en La Gaceta Nº 9 del 14 de enero de 1998, en que establece Parque Nacional Barbilla.
SEXTO: Que el Comité Técnico (CCT), del Área de Conservación Amistad Caribe, en Sesión Ordinaria Acta N° 25-2009, Acuerdo N° 05 efectuada el 21 de abril del 2009, conoció y avaló la actualización del Plan General de Manejo del Parque Nacional Barbilla y recomendó el seguir el procedimiento de aprobación.
SETIMO: Que el Consejo Regional del Área de Conservación Amistad Caribe (CORAC-ACLAC) en Sesión Ordinaria N°25-2009, Acuerdo N° 5 del 21 de Abril del 2009, aprobó el Plan General de Manejo Parque Nacional Barbilla y recomendó continuar el procedimiento de aprobación ante el Consejo Nacional de Áreas de Conservación (CONAC).
OCTAVO: Que el Consejo Nacional del Área de Conservación Amistad Caribe (CONAC) en Sesión Extraordinaria N°10-2010, Acuerdo N° 4 del 29 de Noviembre del 2010, aprobó el Plan General de Manejo Parque Nacional Barbilla y recomendó continuar el procedimiento de publicación en el Diario Oficial La Gaceta.
NOVENO: Que mediante el Oficio SINAC-DE-418-2016, el señor Julio Jurado Fernández, en su momento Director del Sistema Nacional de Áreas de Conservación, oficializó el procedimiento relacionado con la aprobación de los Planes Generales de manejo de ASP.
DECIMO: Que la Gerencia de Áreas Silvestres Protegidas del ACLAC, solicita que se actualice de conformidad a la nueva Guía para la elaboración de Planes Generales de Manejo en ASP del SINAC, actividad que se realizó a finales de los años 2015 y 2016.
UNDECIMO: Que el Comité Técnico (CCT), del Área de Conservación Amistad Caribe, en sesión ordinaria Acta N° 003-2017, Acuerdo N° 8 efectuada el 21 de marzo del 2017, conoció y avaló la actualización del Plan General de Manejo del Parque Nacional Barbilla y recomendó el seguir el procedimiento de aprobación DUODÉCIMO: Que el Consejo Regional del Área de Conservación Amistad Caribe (CORAC-ACLAC) en sesión ordinaria N° 001-2017, Acuerdo N° 8 del 24 de marzo del 2017, aprobó la actualización del Plan General de Manejo Parque Nacional Barbilla y recomendó continuar el procedimiento de aprobación ante el Consejo Nacional de Áreas de Conservación (CONAC). Por tanto, EL CONSEJO NACIONAL DE ÁREAS DE CONSERVACIÓN, RESUELVE:
PRIMERO: Validar y aprobar la actualización el Plan General de Manejo del Parque Nacional Barbilla (2016-2026).
SEGUNDO: Enviar la presente resolución al Director Ejecutivo del Sistema Nacional de Áreas de Conservación para que prosiga con el trámite de oficialización de conformidad con el oficio SINAC-DE-418-2016 del 17 de marzo del 2016.
