in the entirety of the text - Full Text of Standard 09 Delimitation of the public zone corresponding to the system of principal channels connecting the ports of Moín and Barra del Colorado, the Tortuguero channel fluvial system, and continental islands located in the province of Limón Full Text of act: 11D481 NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT NOTICE No. 2017-09 MARITIME TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE CORRESPONDING TO THE SYSTEM OF PRINCIPAL CHANNELS CONNECTING THE PORTS OF MOÍN AND BARRA DEL COLORADO: THE TORTUGUERO CHANNEL FLUVIAL SYSTEM AND THE CONTINENTAL ISLANDS: PALMA, SAMAY, PENITENCIA, TORTUGUERO, PARISMINA, PACUARE, MADRE DE DIOS NORTE, MADRE DE DIOS SUR, MATINA AND MOÍN; LOCATED IN THE PROVINCE OF LIMÓN Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227 General Law of Public Administration, and on the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, and the provisions of Article 75 of Law No. 6043 on the Maritime Terrestrial Zone regarding the system of principal channels connecting the ports of Moín and Barra del Colorado, and Articles 62 and 63 of the Regulation to Law No. 6043 on the competence of the National Geographic Institute for the delimitation of the Maritime Terrestrial Zone and its officialization through publication in the Official Gazette La Gaceta.

I.-That through Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry will administer the Institute's budget, and sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute will be the scientific and technical dependency governing national cartography, intended for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or tasks and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, with the purpose of supporting planning processes.

II.-That the Creation Law of the National Geographic Institute, No. 59, establishes it permanently and in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the works entrusted to its charge.

III.-That in accordance with the Creation Law of the National Geographic Institute (IGN), No. 59, in Articles 62 of the Regulation to Law No. 6043, the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone is recognized, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone." IV.-That in Executive Decree No. 36642-MP-MOPTMINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone", it is established according to Article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite the delimitations and provide greater technical security to interested parties.

V.-That in Executive Decree No. 33797-MJ-MOPT, which among other aspects designates the National Geodetic Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed within the National Territory by any public dependency, person, or national or foreign private entity must be referenced."; while Article 7 indicates that "As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, by appropriate means, that information which has been officialized." VI.-That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, approving survey plans (visado de planos de agrimensura), granting concessions in the Restricted Zone, and other aspects of coastal territorial planning (ordenamiento territorial costero).

VII.-That Article 75 of Law No. 6043 on the Maritime Terrestrial Zone states: "The Atlantic Port and Economic Development Administration Board (JAPDEVA) shall continue with domain over the lands transferred to it under Article 41, subsection b) of Law No. 5337 of August 27, 1973, except in the maritime terrestrial zone corresponding to both sides of the system of principal channels connecting the ports of Moín and Barra del Colorado. In that zone, the stipulations of this law shall be in full force." VIII.-That the National Geographic Institute, through its Directorate, issued official communication IGN/DG-98065 dated April 2, 1998, called Ruling on the Tortuguero Channel Fluvial System, Limón, which indicates:

"Based on Pronouncement C-191-96 dated November 27, 1996, from the Attorney General's Office, on the legal regime of the Caribbean coastal territory along the Tortuguero channels and the territorial administrative competence of JAPDEVA, MINAE, or the Municipal Councils of the region; where it is indicated that:

.'Regarding the determination of which channels between the ports of Moín and Barra del Colorado should be understood as principal for the application of this new regulation, the National Geographic Institute must be consulted, .', and at the request of the Municipal Council of Pococí, through Agreement No. 17, Article VII of Ordinary Session No. 04 of January 8, 1998, concerning the geographic condition of the Tortuguero zone regarding Law No. 6043 on the Maritime Terrestrial Zone and its regulation, the National Geographic Institute determines, according to its competence and the study conducted with registered official data and available technical field information that:

1. The Tortuguero channel fluvial system is constituted by the hydrographic network of artificial channels and natural riverbeds of primary or secondary order, extending from Puerto Moín in the city of Limón to the town of Barra del Colorado in Pococí, along the Caribbean coast of Costa Rica.

2. For the purposes of applying Law No. 6043 and its Regulation, the principal channels correspond to the watercourses that connect both geographic sites indicated in the previous point by fluvial route in a direct route; which are used for all types of navigation and transport in general. In this condition are found several channels with no particular official name and the following fluvial routes: Moín River, Las Vueltas River, Matina River Mouth (boca río Matina) (one sector), Madre de Dios Estuary (estero Madre de Dios), Pacuare River Mouth (boca río Pacuare) (one sector), Pacuare Estuary (estero Pacuare), Parismina River Mouth (boca rio Parismina), Parismina Estuary (estero Parismina), caño Negro, Tortuguero Lagoon (laguna Tortuguero) (up to Cuatro Esquinas Island), Penitencia Lagoon (laguna Penitencia), caño Palacio, caño Penitencia, Samay Lagoon (laguna Samay) (one sector) and Colorado River Mouth (boca rio Colorado)." IX.-That the National Geographic Institute, through its Directorate, issued official communication IGN/DG-98066 dated April 2, 1998, called Ruling on Coastal Islands of the Caribbean Coast of Costa Rica, Limón, which indicates:

"Based on Pronouncement C-191-96 dated November 27, 1996, from the Attorney General's Office, on the legal regime of the Caribbean coastal territory along the Tortuguero channels and the territorial administrative competence of JAPDEVA, MINAE, or the Municipal Councils of the region; where it is indicated that:

.' Regarding the determination of which channels between the ports of Moín and Barra del Colorado should be understood as principal for the application of this new regulation, the National Geographic Institute must be consulted, .', and at the request of the Municipal Council of Pococí, through Agreement No. 17, Article VII of Ordinary Session No. 04 of January 8, 1998, concerning the geographic condition of the Tortuguero zone regarding Law No. 6043 on the Maritime Terrestrial Zone and its regulation, the National Geographic Institute determines, according to its competence and the study conducted with registered official data and available technical field information that:

1. The existing geographic units along the Caribbean coast in the province of Limón, between the sites of Puerto Moín and the town of Barra del Colorado, located between the principal channels of the Tortuguero channel fluvial system and the coast facing the Caribbean Sea, are islands according to the studies executed, taking into account the official criterion of Pronouncement C-038-97 dated March 12, 1997, from the Attorney General's Office.

2. The Inalienable Public Zone (Zona Publica Inalienable) must be demarcated along the entire extent of those insular coastlines, considering the ocean front and the existing channels, estuaries, rías, or coastal lagoons, in accordance with the established legal system and according to the administrative regime under which the respective insular territory is found.

3. In relation to their geographic position, these islands are located towards the interior of the continent from the coastline. Therefore, they all have the condition of "continental islands", derived from separation from the mainland upon constructing the Tortuguero channelization system. The majority of the islands partially present some characteristics of "oceanic islands", relating to the permanent influence of waves and marine currents along the entire marine coastal extent.

4. These Caribbean coastal islands do not have official names in the national cartography. The National Geographic Institute will present the following names to the National Nomenclature Commission (Comisión Nacional de Nomenclatura) for their approval and respective registration:

• a)Isla Moín (between Puerto Moín and Matina Mouth).
• b)Isla Matina (between Matina Mouth and channel northwest of Urivano Lagoon).
• c)Isla Madre de Dios (between channel and Parismina Mouth).
• d)Isla Pacuare (between Pacuare Mouth and Parismina Mouth).
• e)Isla Parismina (between Parismina Mouth and Jolova Lagoon).
• f)Isla Tortuguero (between Jolova Mouth and Tortuguero Mouth).
• g)Isla Palma (between Tortuguero Mouth and Samay Lagoon).
• h)Isla Penitencia (between caño Palma and caño Penitencia).
• i)Isla Samay (between Samay and Colorado Mouth)." X.-That the National Nomenclature Commission (Comisión Nacional de Nomenclatura), in ordinary session No. 234, held on September 3, 1998, in its Article Fifteen, heard a request submitted by the National Geographic Institute, based on official communication IGN/DG-98066 dated April 2, 1998, approving the following names of geographical features:

1. Isla Moín (between Puerto Moín and Matina Mouth).

2. Isla Matina (between Matina Mouth and channel northwest of Urivano Lagoon).

3. Isla Madre de Dios (between channel and Parismina Mouth).

4. Isla Pacuare (between Pacuare Mouth and Parismina Mouth).

5. Isla Parismina (between Parismina Mouth and Jolova Lagoon).

6. Isla Tortuguero (between Jolova Mouth and Tortuguero Mouth).

8. Isla Penitencia (between caño Palma and caño Penitencia).

9. Isla Samay (between Samay and Colorado Mouth).

XI.-That the National Geographic Institute used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the maritime terrestrial zone of the system of principal channels connecting the ports of Moín and Barra del Colorado: the Tortuguero channel fluvial system and the Continental Islands Palma, Samay, Penitencia, Tortuguero, Parismina, Pacuare, Madre de Dios Norte, Madre de Dios Sur, Matina and Moín; located in the cantons of Limón, Matina, Siquirres, Pococí of the province of Limón.

XII.-That the georeferenced digital information on delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (Geodata base Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).

XIII.-That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P "Regulation to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares CR05 and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".

XIV.-That the official documents issued by the National Geographic Institute where the technical criteria supporting what is stated in Considering 11 above are founded are the official communications DIG-TOT-484-2017 of September 11, 2017, from the Topographic Modeling Sub-process (Subproceso de Modelado Topográfico) and DIG-TOT-0506-.2017 of September 27, 2017, from the Official Limits Sub-process (Subproceso de Limites Oficiales), both sub-processes of the Topographic and Territory Observation Department.

XV.-That Article 140 of Law No. 6227 General Law of Public Administration states that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from its adoption," a provision that must necessarily be related to numeral 204) of the same normative body, which defines the ideal instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and concrete acts by notification." COMMUNICATES:

1. 1That the National Geographic Institute used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in the system of principal channels connecting the ports of Moín and Barra del Colorado: the Tortuguero channel fluvial system and the Continental Islands Palma, Samay, Penitencia, Tortuguero, Parismina, Pacuare, Madre de Dios Norte, Madre de Dios Sur, Matina and Moín; located in the cantons of Limón, Matina, Siquirres, Pococí of the province of Limón, given that in the system of principal channels and continental islands in the sector between the ports of Moín and Barra del Colorado, there does not exist, as of the signing date of this Notice, a delimitation of the public zone officialized via respective publication in the Official Gazette La Gaceta.

2º-The public zone of the Maritime Terrestrial Zone in the system of principal channels connecting the ports of Moín and Barra del Colorado: the Tortuguero channel fluvial system and the Continental Islands Palma, Samay, Penitencia, Tortuguero, Parismina, Pacuare, Madre de Dios Norte, Madre de Dios Sur, Matina and Moín; located in the cantons of Limón, Matina, Siquirres, Pococí of the province of Limón, determined by the National Geographic Institute with georeferenced digital delimitation, was carried out in the year 2017 and in the official cartographic projection system of Costa Rica CRTM05. For reference purposes, the system of principal channels and continental islands in the sector between the ports of Moín and Barra del Colorado are represented on Map MBCR-1/50,000 Colorado, Tortuguero, California, Parismina, Moín, Rio Banano.

1. 3That the sectors in the vicinity of the system of principal channels and continental islands in the sector between the ports of Moín and Barra del Colorado, which are delimited with the placement of boundary markers (mojones) officialized via respective publication in the Official Gazette La Gaceta, maintain their invariable condition.

4º-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, system of principal channels connecting the ports of Moín and Barra del Colorado: the Tortuguero channel fluvial system and the Continental Islands Palma, Samay, Penitencia, Tortuguero, Parismina, Pacuare, Madre de Dios Norte, Madre de Dios Sur, Matina and Moín; located in the cantons of Limón, Matina, Siquirres, Pococí of the province of Limón, have been registered in the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in a file with vector shape format, under the coding:

RN/IGN_GDG-IGN-ZMT_CRCanales/Geolínea_Versión_Canales_09/11/2017.

I.-Que mediante Ley Nº 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

II.-Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

III.-Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº 59, en el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".

IV.-Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

V.-Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado." VI.-Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

VII.-Que el artículo 75 de la Ley Nº 6043 sobre la Zona Marítimo Terrestre, señala: "La Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica continuará con el dominio sobre los terrenos que le fueron traspasados en virtud del artículo 41, inciso b) de la ley Nº 5337 de 27 de agosto de 1973, excepto en la zona marítimo terrestre correspondiente a ambos lados del sistema de canales principales que unen los puertos de Moín y Barra del Colorado. En esa zona regirán con pleno vigor las estipulaciones de esta ley." VIII.-Que el Instituto Geográfico Nacional, a través de su Dirección, emitió el oficio IGN/DG-98065 de fecha 02 de abril de 1998 denominado Dictamen sobre Sistema Fluvial de Canales de Tortuguero, Limón, el cual indica:

"En base al Pronunciamiento C-191-96 con fecha del 27 de noviembre de 1996 de la Procuraduría General de la Republica, sobre el régimen jurídico del territorio del litoral Caribe a lo largo de los canales de Tortuguero y la competencia territorial administrativa de JAPDEVA, MINAE o los Concejos Municipales de la región; donde se indica que:

."En lo que toca a la determinación de cuales canales entre los puertos de Moin y Barra del Colorado deben entenderse como principales para aplicación de esta nueva normativa, debe recurrirse al Instituto Geográfico Nacional, .", y a solicitud del Concejo Municipal de Pococí, por el Acuerdo N° 17, Articulo VII de la Sesión Ordinaria N° 04 del 08 de enero de 1998, relativo a la condición geográfica de la zona de Tortuguero respecto a la Ley N° 6043 de la Zona Marítimo Terrestre y a su reglamento, el Instituto Geográfico Nacional determina, de acuerdo a su competencia y al estudio realizado con datos oficiales registrados e información técnica de campo disponible que:

1. El sistema fluvial de canales de Tortuguero está constituido por la red hidrográfica de canales artificiales y cauces naturales de orden primario o de orden secundario, que se extiende desde puerto Moin en la ciudad de Limón, hasta el poblado de Barra del Colorado en Pococí, a lo largo del litoral Caribe de Costa Rica.

2. Para efectos de aplicación de la Ley N° 6043 y su Reglamento, los canales principales corresponden a los cursos de agua que unen por vía fluvial en ruta directa ambos sitios geográficos indicados en el punto anterior; los cuales son utilizados para todo tipo de navegación y el transporte en general. En esta condición se encuentran varios canales sin nombre oficial particular y las siguientes vías fluviales: río Moín, río Las Vueltas, boca río Matina (un sector), estero Madre de Dios, boca río Pacuare (un sector), estero Pacuare, boca rio Parismina, estero Parismina, caño Negro, laguna Tortuguero (hasta isla Cuatro Esquinas), laguna Penitencia, caño Palacio, caño Penitencia, laguna Samay (un sector) y boca rio Colorado." IX.-Que el Instituto Geográfico Nacional, a través de su Dirección, emitió el oficio IGN/DG-98066 de fecha 02 de abril de 1998 denominado Dictamen sobre Islas Costeras del Litoral Caribe de Costa Rica, Limón, el cual indica:

"En base al Pronunciamiento C-191-96 con fecha del 27 de noviembre de 1996 de la Procuraduría General de la Republica, sobre el régimen jurídico del territorio del litoral Caribe a lo largo de los canales de Tortuguero y la competencia territorial administrativa de JAPDEVA, MINAE o los Concejos Municipales de la región; donde se indica que:

." En lo que toca a la determinación de cuales canales entre los puertos de Moín y Barra del Colorado deben entenderse como principales para aplicación de esta nueva normativa, debe recurrirse al Instituto Geográfico Nacional, .", y a solicitud del Concejo Municipal de Pococí, por el Acuerdo N° 17, Articulo VII de la Sesión Ordinaria N° 04 del 08 de enero de 1998, relativo a la condición geográfica de la zona de Tortuguero respecto a la Ley N° 6043 de la Zona Marítimo Terrestre y a su reglamento, el Instituto Geográfico Nacional determina, de acuerdo a su competencia y al estudio realizado con datos oficiales registrados e información técnica de campo disponible que:

1. Las unidades geográficas existentes a lo largo del litoral Caribe en la provincia de Limón, entre los sitios de Puerto Moín y el poblado de Barra del Colorado, ubicadas entre los canales principales del sistema fluvial de canales de Tortuguero y la costa frente al Mar Caribe, son islas según los estudios ejecutados, tomando en cuenta el criterio oficial de Pronunciamiento C- 038-97 con fecha 12 de marzo de 1997 de la Procuraduría General de la Republica.

2. La Zona Publica Inalienable debe demarcarse en toda la extensión de esos litorales insulares, considerando el frente oceánico y los canales, esteros, rías o lagunas costeras existentes, de acuerdo con el ordenamiento jurídico establecido y según el régimen administrativo bajo el que se encuentre el territorio insular respectivo.

3. En relación con su posición geográfica, estas islas se encuentran ubicadas hacia el interior del continente a partir de la línea de costa. Por lo tanto, todas tienen la condición de "islas continentales", con origen derivado por separación de la tierra firme al construir el sistema de canalización de Tortuguero. La mayoría de islas presentan de manera parcial algunas características de "islas oceánicas", relativas a la influencia permanente del oleaje y las corrientes marinas en toda la extensión litoral marino.

4. Estas islas costeras del Caribe no poseen nombres oficiales en la cartografía nacional. El Instituto Geográfico Nacional presentará a la Comisión Nacional de Nomenclatura los siguientes nombres para su aprobación y registro respectivo:

• a)Isla Moín (entre puerto Moín y boca Matina).
• b)Isla Matina (entre boca Matina y canal al noroeste de laguna Urivano).
• c)Isla Madre de Dios (entre canal y boca Parismina).
• d)Isla Pacuare (entre boca Pacuare y boca Parismina).
• e)Isla Parismina (entre boca Parismina y laguna Jolova).
• f)Isla Tortuguero (entre boca Jolova y boca Tortuguero).
• g)Isla Palma (entre boca Tortuguero y laguna Samay).
• h)Isla Penitencia (entre caño Palma y caño Penitencia).
• i)Isla Samay (entre Samay y boca Colorado)." X.-Que la Comisión Nacional de Nomenclatura, en la sesión ordinaria Nº 234, celebrada el día 03 de setiembre de 1998, en suartículo décimo quinto, conoció solicitud presentada por el InstitutoGeográfico Nacional, con fundamento en el oficio IGN/DG-98066de fecha 02 de abril de 1998, aprobando los siguientes nombres de accidentes geográficos:

1. Isla Moín (entre puerto Moín y boca Matina).

2. Isla Matina (entre boca Matina y canal al noroeste de laguna Urivano).

3. Isla Madre de Dios (entre canal y boca Parismina).

4. Isla Pacuare (entre boca Pacuare y boca Parismina).

5. Isla Parismina (entre boca Parismina y laguna Jolova).

6. Isla Tortuguero (entre boca Jolova y boca Tortuguero).

8. Isla Penitencia (entre caño Palma y caño Penitencia).

9. Isla Samay (entre Samay y boca Colorado).

XI.-Que el Instituto Geográfico Nacional utilizó la metodología de "Delimitación Digital georreferenciada" para delimitar la zona pública de la zona marítimo terrestre del sistema de canales principales que unen los puertos de Moín y Barra del Colorado: sistema fluvial de canales de Tortuguero y las Islas Continentales Palma, Samay, Penitencia, Tortuguero, Parismina, Pacuare, Madre de Dios Norte, Madre de Dios Sur,Matina y Moín; ubicadas en los cantones Limón, Matina, Siquirres, Pococí de la provincia de Limón.

XII.-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodata base Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

XIII.-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo Nº 7841-P "Reglamento a la Ley Nº 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

XIV.-Que los documentos oficiales emitidos por el Instituto Geográfico Nacional donde fundamenta los criterios técnicos que dan sustento a lo expuesto en el Considerando 11 anterior, son los oficios DIG-TOT-484-2017 del 11 de setiembre de 2017 delSubproceso de Modelado Topográfico y DIG- TOT-0506-.2017 del 27 de setiembre de 2017 del Subproceso de Limites Oficiales, ambos subprocesos del Departamento Topográfico y Observación del Territorio.

XV.-Que el artículo 140 de la Ley Nº 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1. 1Que el Instituto Geográfico Nacional utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en el sistema de canales principales que unen los puertos de Moín y Barra del Colorado: sistema fluvial de canales de Tortuguero y las Islas Continentales Palma, Samay, Penitencia, Tortuguero, Parismina, Pacuare, Madre de Dios Norte, Madre de Dios Sur, Matina y Moín; ubicadas en los cantones Limón, Matina, Siquirres, Pococí de la provincia de Limón, dado que en el sistema de canales principales e islas continentales en el sector entre los puertos de Moín y Barra del Colorado, no existe a la fecha de firma del presente Aviso, delimitación de la zona pública oficializada vía respectiva publicación en el Diario Oficial La Gaceta.

2º-La zona pública de la Zona Marítimo Terrestre en sistema de canales principales que unen los puertos de Mohín y Barra del Colorado: sistema fluvial de canales de Tortuguero y las Islas Continentales Palma, Samay, Penitencia, Tortuguero, Parismina, Pacuare, Madre de Dios Norte, Madre de Dios Sur, Matina yMoín; ubicadas en los cantones Limón, Matina, Siquirres, Pococí de la provincia de Limón, determinada por el Instituto Geográfico Nacional con delimitación digital georreferenciada, fue realizada en el año 2017 y en el sistema de proyección cartográfico oficial de Costa Rica CRTM05. Para efectos de referencia el sistema de canales principales e islas continentales en el sector entre los puertos de Moín y Barra del Colorado, están representados en el Mapa MBCR- 1/50.000 Colorado, Tortuguero, California, Parismina, Moín, Rio Banano.

1. 3Que los sectores en las cercanías del sistema de canales principales e islas continentales en el sector entre los puertos de Moín y Barra del Colorado, que se encuentran delimitados con colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición invariable.

4º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre,sistema de canales principales que unen los puertos de Moín yBarra del Colorado: sistema fluvial de canales de Tortuguero ylas Islas Continentales Palma, Samay, Penitencia, Tortuguero, Parismina, Pacuare, Madre de Dios Norte, Madre de Dios Sur, Matina y Moín; ubicadas en los cantones Limón, Matina, Siquirres, Pococí de la provincia de Limón, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación:
