8905, the Instituto Geográfico Nacional is established as a dependency of the Registro Nacional and that the Junta Administrativa of the Registro Nacional will administer the Institute's budget, and will sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the Instituto Geográfico Nacional will be the scientific and technical dependency governing national cartography, destined for the execution of the Official Basic Map and the Basic Geographic Description of the Republic of Costa Rica, and for the studies, research or labors, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.

59, constitutes it permanently and in representation of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the works entrusted to its charge.

59, and Article 62 of the Regulations to Law No. 6043, the competence of the Instituto Geográfico Nacional is recognized for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulations states that "The Instituto Geográfico Nacional must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."

36642-MP-MOPT-MINAET, "Regulations of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone," it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, in order to expedite delimitations and provide greater technical security to interested parties.

7575 of February 13, 1996, establishes that the Ministry of Environment and Energy will delimit on the ground the boundaries of the areas that make up the State's Natural Heritage (Patrimonio Natural del Estado).

6227, the General Public Administration Law, states that "the administrative act will produce its effect after being communicated to the administered party, except if it grants only rights, in which case it will produce it from the moment it is adopted," a provision that must necessarily be related to section 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts will be communicated by publication, and specific acts by notification." COMMUNICATES:

First. -The Instituto Geográfico Nacional used the "Georeferenced Digital Delimitation" methodology to delimit the public zone of the Maritime Terrestrial Zone in specific coastal sectors of different islands, where to date, no delimitation of the public zone exists through the placement of boundary markers officialized via their respective publication in the Official Gazette La Gaceta.

Second.- The public zone of the Maritime Terrestrial Zone of maritime islands, determined by the Instituto Geográfico Nacional with georeferenced digital delimitation, was carried out in the year 2017 and corresponds to the coastal sectors whose extreme point coordinates are indicated below, both in the official cartographic projection system of Costa Rica CRTM05, and by reference, in Map MBCR- 1/50.000 Golfo, Tambor, Carrillo Norte, Murciélago, Bahía Salinas, Berrugate, Punta Gorda, and Venado, as follows:

Third. -The coastal sectors of the maritime islands that currently have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers and respective publication in the Official Gazette La Gaceta maintain their official status.

Fourth. - With this demarcation, boundary markers 33, 34, and 136 established in September 1993 and officialized via publication in La Gaceta No. 201 of October 24, 1994, page 14, corresponding to Isla Caballo, are removed from the Maritime Terrestrial Zone Registry (Registro de Zona Marítimo Terrestre).

Fifth. -The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone, corresponding to maritime islands, have been registered in the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT), in a file with vector shape format, under the coding: RN/IGN_GDG-IGN-ZMT_CRIslasOP/Geolínea_Versión_islas_06/11/2017.

8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.

59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

59, en el artículos 62 del Reglamento a la Ley No. 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".

36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."

6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

Primero. -El Instituto Geográfico Nacional, utilizó la metodología de "Delimitación Digital Georreferenciada" para delimitar la zona pública de la Zona Marítimo Terrestre en sectores costeros específicos de distintas islas, donde no existe a la fecha, delimitación de la zona pública a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.

Segundo.- La zona pública de la Zona Marítimo Terrestre de islas marítimas, determinada por el Instituto Geográfico Nacional con delimitación digital georreferenciada, fue realizada en el año 2017 y corresponde a los sectores costeros cuyas coordenadas de puntos extremos se indican a continuación, tanto en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, así como por referencia, en los Mapa MBCR- 1/50.000 Golfo, Tambor, Carrillo Norte, Murciélago, Bahía Salinas, Berrugate, Punta Gorda y Venado a saber:

Tercero. -Los sectores costeros las islas marítimas que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

Cuarto. - Con esta demarcación quedan eliminados del Registro de Zona Marítimo Terrestre los mojones 33, 34 y 136 establecidos en setiembre de 1993 y oficializados vía publicación en La Gaceta No. 201 del 24 de octubre de 1994, página 14, correspondiente a isla Caballo.

Quinto. -Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre, correspondiente a islas marítimas, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_CRIslasOP/Geolínea_Versión_islas_06/11/2017.
