throughout the entire text - Full Text of Norm 07 Delimitation of the public zone of the Estero/Manglar Ventanas, Playa Ventanas, and Playa Grande (Up to the mouth of the Estero Tamarindo): Parque Nacional Marino Las Baulas INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO DE TOPOGRAFÍA Y OBSERVACIÓN DEL TERRITORIO NOTICE No. 2017-07 ZONA MARÍTIMA TERRESTRE Delimitation of the public zone of the Estero/Manglar Ventanas, Playa Ventanas, and Playa Grande (Up to the mouth of the Estero Tamarindo): Parque Nacional Marino Las Baulas Based on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, General Law of Public Administration, and on the provisions of Law No. 59 creating the Instituto Geográfico Nacional, Law No. 8905 transferring the Instituto Geográfico Nacional to the Registro Nacional, and Law No. 6043 on the Zona Marítimo Terrestre and its Regulation.

1. 1That through Law No. 8905, the Instituto Geográfico Nacional is established as a dependency of the Registro Nacional and that the Junta Administrativa of the Registro Nacional will administer the Institute's budget, and will sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the Instituto Geográfico Nacional shall be the scientific and technical dependency governing national cartography, responsible for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica, and for the studies, investigations, or tasks and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.
2. 2That the Law Creating the Instituto Geográfico Nacional, No. 59, establishes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any kind originating from the works entrusted to its charge.
3. 3That Loan Agreement No. 1284/OC-CR "Programa de Regularización de Catastro y Registro", signed with the Inter-American Development Bank, under the mixed Financing modality, between the cited Bank and the State of the Republic of Costa Rica, whose Executing Unit is a decentralized body of the Ministry of Finance, has the objective of: forming the cadastre of all existing properties in the country, duly georeferenced, and making this information compatible with the Registro de la Propiedad Inmueble.
4. 4That in accordance with the Law Creating the Instituto Geográfico Nacional (IGN), No. 59, in Article 62 of the Regulation to Law No. 6043, the authority of the Instituto Geográfico Nacional for the delimitation of the public zone of the Zona Marítimo Terrestre is recognized, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that "The Instituto Geográfico Nacional must publish a notice in the Official Gazette, for each portion of the Zona Marítimo Terrestre in which it has demarcated the public zone."
5. 5That Executive Decree No. 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", establishes according to Article 18° that for the delimitation of the public zone of the Zona Marítimo Terrestre, the IGN may use two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Zona Marítimo Terrestre through the placement of boundary markers (mojones) and/or digital georeferenced delimitation, this in order to expedite delimitations and provide greater technical certainty to interested parties.
6. 6That Executive Decree No. 33797-MJ-MOPT, which among other aspects determines, the Red Geodésica Nacional de Referencia Horizontal CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: "The Red Geodésica Nacional de Referencia Horizontal CR05 and the cartographic projection system CRTM05, shall constitute the only official coordinate system for the Republic of Costa Rica from which all cartographic and geodetic surveys and activities developed in the National Territory by any public entity, person, or private national or foreign entity must be referenced." ; while Article 7 indicates that "As cartographic data are produced in the new cartographic projection system CRTM05, the Instituto Geográfico Nacional will publish, through appropriate means, that information which has been officialized."
7. 7That the Ministry of Public Works and Transport and the Programa de Regularización del Catastro y Registro (Law No. 8154, published in "La Gaceta", number 237 of December 10, 2001, Loan Agreement No. 1284/OC-CR), signed an Agreement with an effective date of December 18, 2009, whose main objective was to formalize the support provided by the Executing Unit (UE) of the Programa de Regularización del Catastro y Registro (PRCR) to the Instituto Geográfico Nacional to determine and georeference to the national coordinate system the position of: a) the ordinary high-water line (línea de pleamar ordinaria) and consequently the line delimiting the Public Zone, and b) the boundary markers (mojones) that demarcate the public zone of the Zona Marítimo Terrestre on the Pacific coast of our country.
8. 8That the current boundary marker (mojones) placements in the sector of Estero/Manglar Ventanas, Playa Ventanas, and Playa Grande (up to the mouth of the Estero Tamarindo), current official placements that have been subject to georeferencing, were officialized in their time via publication in the Official Gazette La Gaceta as follows: La Gaceta No. 22 of February 02, 2009: Notice No. 2009-01, page 5 (boundary markers up to 20); La Gaceta No. 142 of July 26, 1996: Notice No. 96-27, page 23 (boundary markers from 300 to 324); La Gaceta No. 155 of August 14, 1980: Notice without number, page 27 (boundary markers from 0 to 9); La Gaceta No. 164 of August 23, 2004: Notice No. 04-32, page 4 (boundary markers from 285 to 293 and from 302 to 306); La Gaceta No. 157 of August 19, 1980: Notice without number, page 25 (boundary markers from 13 to 16); and La Gaceta No. 65 of April 03, 1981: Notice without number, page 18 (Boundary markers from 1 to 12).

Additionally, boundary markers (mojones) were georeferenced that were pending publication according to the demarcation carried out by this Institute in the 1990s, which resulted in the partial officialization according to La Gaceta No. 142 of July 26, 1996. Finally, boundary markers were georeferenced for which No publication was found in La Gaceta, but they are supported by survey plans (planos de agrimensura) duly registered in the Registro Inmobiliario of the Registro Nacional, valid and current as of today. These registered plans do Not have the approval (visado) of the Instituto Geográfico Nacional, because they are plans describing private properties in the Registro Inmobiliario of the Registro Nacional.

1. 9That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Zona Marítimo Terrestre, enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, approving survey plans (planos de agrimensura), the granting of concessions in the Restricted Zone, and other aspects of coastal land-use planning.
2. 10That the georeferenced digital information on the delimitation of the public zone of the Zona Marítimo Terrestre held by the IGN, is called the Geodatabase Digital Georreferenciada (GDG) of the Instituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT).
3. 11That the Geodatabase Digital Georreferenciada (GDG) of the Instituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) Executive Decree No. 33797-MJ-MOPT "Declares as the official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".
4. 12That via official communication No. 09-1090 of October 23, 2009, the Directorate of the Instituto Geográfico Nacional, submitted to the Constitutional Chamber, the Executive Directorate of the Sistema Nacional de Áreas de Conservación (SINAC) and the Director of the Área de Conservación Tempisque, these last two dependencies of the Ministry of Environment and Energy, and to the General Secretariat of the Secretaria Técnica Ambiental (SETENA) the Report: "Actions carried out by the Instituto Geográfico Nacional (IGN) in relation to vote number 2009-000949 of 14 hours 15 minutes on January 23, 2009, of the Constitutional Chamber, and preliminary report according to official communication No. 09-0712 of July 17, 2009, from the General Directorate of the Instituto Geográfico Nacional".
5. 13That in the report according to official communication No. 09-1090 of October 23, 2009 presented by the Directorate of the Instituto Geográfico Nacional, it identifies a series of actions necessary to carry out in order to improve and complete the delimitation of the coastal and estuary/mangrove (esteros/manglar) sectors of the Parque Nacional Marino Las Baulas (PNMLB).
6. 14That the Instituto Geográfico Nacional has addressed, followed up on, and complied with what is stated in the previous Considering clauses 7°, 10°, and 11°, through the execution of topographic survey work carried out from December 2009 to June 2010, with a subsequent process of debugging, adjustment, and detailed review of data during the period 2011-2015, and to date a final validation process for the georeferencing of the current and valid boundary marker placements (amojonamientos), contrasting it both with the surveyed topographic information and with the georeferenced digital database, for consistency verification.
7. 15That Article 140 of Law No. 6227 General Law of Public Administration states that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted," a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and specific acts by notification."

COMMUNICATES:

1º-In accordance with the provisions of Article 63 of the Regulation to Law No. 6043 on the Zona Marítimo Terrestre, of March 2, 1977, the Instituto Geográfico Nacional carried out the positioning in the national coordinate system CR05 of the boundary markers (mojones) that define the public zone of the sector of Estero/Manglar Ventanas, Playa Ventanas, and Playa Grande (up to the mouth of the Estero Tamarindo): Parque Nacional Marino Las Baulas, located in district 01 Cabo Velas, canton 10 Santa Cruz, province of 05 Guanacaste.

2º-The coordinates of the boundary markers (mojones) are indicated in the official cartographic projection system of Costa Rica CRTM05 of the MBCR-1/50,000 Map Sheets Matapalo and Villarreal.

3º-The sectors of Estero/Manglar Ventanas, Playa Ventanas, Playa Grande (up to the mouth of Estero Tamarindo): Parque Nacional Marino Las Baulas, with boundary markers (mojones) installed by the Instituto Geográfico Nacional in the periods described in the previous Considering clauses, and duly georeferenced in CRTM05 projection, are as follows:

en la totalidad del texto - Texto Completo Norma 07 Delimitación de zona pública de estero/manglar ventanas, playa ventanas y playa grande (Hasta la desembocadura del Estero Tamarindo: Parque Nacional Marino Las Baulas INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO DE TOPOGRAFÍA Y OBSERVACIÓN DEL TERRITORIO AVISO N º 2017-07 ZONA MARÍTIMA TERRESTRE Delimitación de zona pública de estero/manglar ventanas, playa ventanas y playa grande (Hasta la desembocadura del Estero Tamarindo: Parque Nacional Marino Las Baulas Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley N° 6227 General de la Administración Pública, y en lo dispuesto en la Ley N° 59 de creación del Instituto Geográfico Nacional, la Ley N° 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, y la Ley N° 6043 sobre la Zona Marítimo Terrestre y su Reglamento.

1. 1Que mediante Ley N° 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Así mismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que el Convenio de Préstamo N° 1284/OC-CR "Programa de Regularización de Catastro y Registro", suscrito con el Banco Interamericano de Desarrollo, bajo la modalidad de Financiamiento mixto, entre el citado Banco y El Estado de la República de Costa Rica, cuya Unidad Ejecutora es un órgano desconcentrado del Ministerio de Hacienda, tiene como objetivo: formar el catastro de la totalidad de los predios existentes en el país, debidamente georreferenciados, y compatibilizar esta información con el Registro de la Propiedad Inmueble.
4. 4Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), N° 59, en el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
5. 5Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
6. 6Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
7. 7Que el Ministerio de Obras Públicas y Transportes y el Programa de Regularización del Catastro y Registro (Ley N° 8154, publicada en "La Gaceta", número 237 del 10 de diciembre de 2001, Contrato de Préstamo N° 1284/OC-CR), suscribieron un Convenio con fecha de rige 18 de diciembre de 2009, cuyo objetivo principal fue formalizar el apoyo que brindo la Unidad Ejecutora (UE) del Programa de Regularización del Catastro y Registro (PRCR) al Instituto Geográfico Nacional para determinar y georreferenciar al sistema nacional de coordenadas la posición de: a) línea de pleamar ordinaria y consecuentemente la línea que delimita la Zona Pública, y b) los mojones que demarcan la zona pública de la Zona Marítimo Terrestre en el litoral Pacífico de nuestro país.
8. 8Que los amojonamientos vigentes en el sector de Estero/Manglar Ventanas, Playa Ventanas y Playa Grande (hasta de desembocadura del Estero Tamarindo), oficiales vigentes que han sido objeto de georreferenciación, fueron oficializados en su oportunidad vía publicación en el Diario Oficial La Gaceta como sigue: La Gaceta N° 22 del 02 de febrero de 2009: Aviso N° 2009-01, página 5 (mojones a la 20); La Gaceta N° 142 del 26 de julio de 1996: Aviso N° 96-27, página 23 (mojones del 300 al 324); La Gaceta N° 155 del 14 de agosto de 1980: Aviso sin número, página 27 (mojones del 0 al 9); La Gaceta N° 164 del 23 de agosto de 2004: Aviso N° 04-32, página 4 (mojones del 285 al 293 y del 302 al 306); La Gaceta N° 157 del 19 de agosto de 1980: Aviso sin número, página 25 (mojones del 13 al 16); y La Gaceta N° 65 de 03 de abril de 1981: Aviso sin número, página 18 (Mojones del 1 al 12).

Adicionalmente, se georreferenciaron mojones que se encontraban pendientes de publicar según demarcación realizada por este Instituto en los años 1990´s, la cual derivó en la oficialización parcial según La Gaceta N° 142 del 26 de julio de 1996. Finalmente, se georreferenció mojones de los cuales N° se encontró publicación en La Gaceta, pero los mismos tienen un respaldo de planos de agrimensura debidamente inscritos en el Registro Inmobiliario del Registro Nacional, válidos y vigentes para el día de hoy. Estos planos inscritos N° cuentan con visado del Instituto Geográfico Nacional, por ser planos que describen propiedades privadas en el Registro Inmobiliario del Registro Nacional.

1. 9Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
2. 10Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
3. 11Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P "Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo N° 33797-MJ-MOPT "Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".
4. 12Que vía oficio N° 09-1090 del 23 de octubre de 2009, la Dirección del Instituto Geográfico Nacional, presentó ante la Sala Constitucional, a la Dirección Ejecutiva del Sistema Nacional de Áreas de Conservación (SINAC) y Director del Área de Conservación Tempisque, estas dos últimas dependencias de Ministerio de Ambiente y Energía, y a la Secretaria General de la Secretaria Técnica Ambiental (SETENA) el Informe: "Acciones realizadas por el Instituto Geográfico Nacional (IGN) en relación con el voto número 2009-000949 de las 14 horas 15 minutos del 23 de enero de 2009 de la Sala Constitucional, e informe preliminar según oficio N° 09-0712 del 17 de julio de 2009 de Dirección General del Instituto Geográfico Nacional".
5. 13Que en el informe según oficio N° 09-1090 del 23 de octubre de 2009 presentado por la Dirección del Instituto Geográfico Nacional, se identifica una serie de acciones necesarias de realizarse a efecto de mejorar y completar la delimitación de los sectores costeros y esteros/manglar del Parque Nacional Marino Las Baulas (PNMLB).
6. 14Que el Instituto Geográfico Nacional ha dado atención, seguimiento y cumplimiento de lo señalado en los Considerandos 7°, 10° y 11° anteriores, a través de la ejecución de trabajos de levantamiento topográfico llevados a cabo desde diciembre de 2009 hasta junio del año 2010, con posterior proceso de depuración, ajuste y revisión detallada de datos durante el periodo 2011-2015, y a la fecha un proceso final de validación de georreferenciación de los amojonamientos vigentes y validos, contraponiéndola tanto con la información topográfica levantada, como con la base de datos digital georreferenciada, para su comprobación de consistencia.
7. 15Que el artículo 140 de la Ley N° 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1º-De conformidad con lo dispuesto en el artículo 63 del Reglamento de la Ley N° 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, el Instituto Geográfico Nacional realizó el posicionamiento en el sistema de coordenadas nacional CR05 de los mojones que definen la zona publica de sector de Estero/Manglar Ventanas, Playa Ventanas y Playa Grande (hasta la desembocadura del Estero Tamarindo): Parque Nacional Marino Las Baulas, ubicado en distrito 01 Cabo Velas, cantón 10 Santa Cruz, provincia de 05 Guanacaste.

2º-Las coordenadas de los mojones se indican en el sistema de proyección cartográfico oficial de Costa Rica CRTM05 del Mapa MBCR-1/50.000 Hojas Matapalo y Villarreal.

3º-Los sectores de Estero/Manglar Ventanas, Playa Ventanas, Playa Grande (hasta la desembocadura de Estero Tamarindo): Parque Nacional Marino Las Baulas, con mojones instalados por el Instituto Geográfico Nacional en las épocas descritas en los Considerandos anteriores, y debidamente georreferenciados en proyección CRTM05 es como sigue:

Los datos técnicos oficiales del trabajo han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN y en el Curridabat, 31 de octubre del 2017.

Considerando:
