in the entirety of the text - Full Text of Norm 366 Establishes a permanent closed season for the capture of sawfish with any type of fishing gear throughout the country COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/366-2017.-Puntarenas, on the thirteenth day of September, two thousand seventeen.
I.-That INCOPESCA is the Executing Authority for fishing and aquaculture activity in accordance with the provisions of Ley 8436 Ley de Pesca y Acuicultura, LPA.
II.-That the act of fishing must be carried out responsibly to ensure the conservation and effective management of living aquatic resources, in order to avoid overexploitation and prevent harmful effects on the environment and the ecological system.
III.-That in accordance with Ley 7384, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, it is the competence of INCOPESCA to authorize the fishing gear and fishing zones permitted for the use of aquatic fauna.
IV.-That it is prohibited to use or carry on board a vessel fishing gear not authorized by INCOPESCA.
V.-That it is prohibited to use unauthorized dimensions and materials for fishing nets and lines or any fishing gear in general.
VI.-That it is prohibited to use any fishing method that threatens the sustainability of the fishery resource.
VII.-That to carry out fishing activity, the corresponding fishing license must be held, which establishes the fishing gear and its specific dimensions and characteristics, as well as the authorized target species.
VIII.-That sawfish are cartilaginous fish species that have historically inhabited the rivers, wetlands, mangroves, and coastal waters of Costa Rica and that there is sufficient evidence that their populations have declined significantly at the global, regional, and national levels. These species are classified as critically endangered species, according to the International Union for Conservation of Nature (IUCN); furthermore, they are considered "Threatened Species" by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and the Convention on the Conservation of Migratory Species of Wild Animals (CMS).
IX.-That INCOPESCA is the Scientific Authority for those species of fisheries and aquaculture interest, and it is in its interest to ensure the conservation and management of these species.
X.-That it is of special importance that Costa Rica adopt conservation measures that allow the sustainability of sawfish in Costa Rica.
XI.-That it is in the national interest to know and update the population status of sawfish in Costa Rica, to promote measures for their protection and conservation.
XII.-The Objective of this agreement is to protect the populations of the two sawfish species present in our country and at the same time to have better technical-scientific information in order to strengthen the sustainability of these species through the adoption of conservation and management measures in Costa Rica.
XIII.-That it is the duty of INCOPESCA to strengthen the population sustainability of sawfish (Pristis pristis and P. pectinata) in Costa Rica, through this agreement; the Board of Directors, Therefore; AGREES:
1º-A permanent closed season (veda) is established for the capture of sawfish with any type of fishing gear throughout the country.
2º-During the closed season mentioned in the preceding article, fishing for sawfish (Pristis pristis and P. pectinata) conducted for scientific research purposes may be permitted.
3º-Whoever incidentally captures a sawfish must release it if it is found alive. All captures must be reported to INCOPESCA for the respective collection of scientific information.
For these purposes, a biological-fishery data table with the required scientific information is attached below. It is incorporated as Annex 1 (anexo 1) of this agreement.
4º-These provisions are of a technical nature and anyone who fails to comply with them shall have the procedures and sanctions applied in accordance with the provisions of the Ley de Pesca y Acuicultura (Ley 8436) and its Reglamento (Decreto N° 36782-MINAET-MAGMOPT- TUR-SP-S-MTSS).
5º-Firm Agreement.
6º-It takes effect upon its publication.
Considering:
en la totalidad del texto - Texto Completo Norma 366 Establece veda permanente para la captura del pez sierra con cualquier tipo de arte de pesca en todo el país INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/366-2017.-Puntarenas, a los trece días del mes de setiembre del dos mil diecisiete.
I.-Que el INCOPESCA es la Autoridad Ejecutora de la actividad pesquera y acuícola de conformidad con lo dispuesto en la Ley 8436 Ley de Pesca y Acuicultura, LPA.
II.-Que el acto de pescar deberá realizarse en forma responsable para asegurar la conservación y gestión efectiva de los recursos acuáticos vivos, con el fin de evitar la ecológico.
III.-Que de conformidad con la Ley 7384, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, es competencia del INCOPESCA, autorizar los artes y zonas de pesca permitidas para el aprovechamiento de la fauna acuática.
IV.-Que está prohibido utilizar o llevar a bordo de una embarcación artes de pesca no autorizados por el INCOPESCA.
V.-Que está prohibido utilizar dimensiones y materiales no autorizados para las redes y líneas de pesca o cualquier arte de pesca en general.
VI.-Que está prohibido utilizar todo método de pesca que atente contra la sustentabilidad del recurso pesquero.
VII.-Que para llevar a cabo la actividad pesquera se deberá contar con la correspondiente licencia de pesca, en la cual se establecen los artes de pesca y sus dimensiones y características específicas, así como las especies sujetos de pesca autorizados.
VIII.-Que los peces sierras son especies de peces cartilaginosos que históricamente han habitado los ríos, humedales, manglares, y aguas cosieras de Costa Rica y que hay suficiente evidencia de que sus poblaciones han declinado significativamente a nivel global, regional y nacional. Estas especies son catalogadas como especies en peligro crítico de extinción, según la Unión Internacional para la Naturaleza (UICN); además son consideradas "Especies Amenazadas" por la Convención Internacional sobre el Comercio de Especies Amenazadas de Flora y Fauna Silvestre (CITES) y la Convención sobre la Conservación de las Especies Migratorias de Animales Silvestres (CMS).
IX.-Que el INCOPESCA es la Autoridad Científica para aquellas especies de interés pesquero y acuícolas y es de su interés, el velar por la conservación y manejo de estas especies.
X.-Que es de especial importancia que Costa Rica adopte medidas de conservación que permitan la sostenibilidad de los peces sierra en Costa Rica.
XI.-Que es de interés nacional conocer y actualizar sobre el estado de la población de peces sierra de Costa Rica, para promover medidas para su protección y conservación.
XII.-El Objetivo de este acuerdo es proteger las poblaciones de las dos especies de peces sierra presentes en nuestro país y a la vez contar con mejor información técnica científica con el fin de fortalecer la sostenibilidad de estas especies mediante la adopción de medidas de conservación y ordenamiento en Costa Rica.
XIII.-Que es deber del INCOPESCA, fortalecer la sostenibilidad poblacional de los peces sierra (Pristis pristis y P. pectinata) en Costa Rica, mediante este acuerdo; la Junta Directiva, Por tanto; ACUERDA:
1º-Se establece veda permanente para la captura de pez sierra con cualquier tipo de arte de pesca en todo el país.
2º-Durante la veda mencionada en el artículo anterior, se podrá permitir la pesca de pez sierra (Pristis pristis y P. pectinata), que se realice con fines de investigación científica.
3º-Quien capture incidentalmente un pez sierra, debe liberarlo si se encuentra vivo. Todas las capturas deberán ser reportadas al INCOPESCA para la respectiva recolecta de información científica.
Para estos fines se adjunta a continuación tabla de datos biológico pesquero con información científica requerida. Se incorpora como anexo 1 de este acuerdo.
4º-Las presentes disposiciones son de carácter técnico y quien las incumpla le serán aplicados los procedimientos y sanciones de conformidad con lo establecido en la Ley de Pesca y Acuicultura (Ley 8436) y su Reglamento (Decreto N° 36782-MINAET-MAGMOPT- TUR-SP-S-MTSS).
