AUTHORIZATION FOR THE COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (AyA) TO SEGREGATE A PLOT OF LAND FROM ITS PROPERTY, WHICH IS RELEASED FROM PUBLIC USE, IS ASSIGNED TO A NEW PUBLIC USE AS A PARK, SO THAT IT MAY BE DONATED TO THE MUNICIPALITY OF SAN JOSÉ

DECREES:

4-000-042138), is authorized to segregate and donate a lot from the property registered in its name, recorded in the National Registry under the San José split folio real system, registration number four nine eight two one four-zero zero zero (No. 498214-000), which is land designated for a treatment plant, located in district 07 Uruca, canton 01 San José, province of San José, which has the following boundaries: to the north with the public road to Electriona and a small portion with Tajo Viejo S.A.; to the south with the Torres River; to the east partially with CCSS and a small portion with Tajo Viejo S.A.; to the west with CCSS. It measures one hundred forty-three thousand eight hundred seventeen and ninety-four square meters (143,817.94 m2), in accordance with cadastral plans number SJ-zero one eight eight seven five one-one nine nine nine four (No. SJ-0188751-1994) and number SJ zero one eight eight seven five two-one nine nine nine four (No. SJ-0188752-1994). Said property bears a transferred easement (servidumbre trasladada) for electric lines and right of way of the Costa Rican Electricity Institute (ICE), and an easement (servidumbre) for wastewater and stormwater.

Boundaries: to the north with a public road with a frontage of fifty-two point forty-eight square meters (52.48 m2); to the south with the reserved remainder; to the east with the reserved remainder and to the west with the reserved remainder. It measures eight hundred fifteen square meters (815 m2) and has cadastral plan number SJ-one eight three nine zero nine zero-two zero one five (No. SJ-1839090-2015).

The segregated lot to be donated shall retain and bear the encumbrances: transferred easement (servidumbre trasladada) for electric lines and right of way of the Costa Rican Electricity Institute (ICE), at entries number two nine eight-zero eight zero two nine-zero one-zero nine zero one-zero zero two (No. 298-08029-01-0901-002) and servient easement (servidumbre sirviente) at entries number three nine four-zero three five zero eight-zero one-zero zero zero three-zero zero one (No. 394-03508-01-0003-001). Furthermore, a stormwater easement (servidumbre pluvial) and a sanitary sewer easement (servidumbre de alcantarillado sanitario) must be established in the same donation deed over the segregated and donated lot, according to the corresponding plans prepared by the JBIC-AYA Executing Unit.

The Costa Rican Institute of Aqueducts and Sewers (AyA) reserves the remainder of the parent property for itself.

It takes effect upon its publication.

Issued at the Presidency of the Republic, San José, on the sixth day of the month of September of the year two thousand seventeen.

AUTORIZACIÓN AL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA) PARA QUE SEGREGUE UN TERRERO DE SU PROPIEDAD, EL CUAL SE DESAFECTA DEL USO PÚBLICO, SE AFECTA A UN NUEVO USO PÚBLICO DE PARQUE, PARA QUE LO DONE A LA MUNICIPALIDAD DE SAN JOSÉ

DECRETA:

Linderos: al norte con calle pública con un frente de cincuenta y dos coma cuarenta y ocho metros cuadrados (52,48 m2); al sur con resto reservado; al este con resto reservado y al oeste con resto reservado. Mide ochocientos quince metros cuadrados (815 m2) y cuenta con el plano catastrado número SJ-uno ocho tres nueve cero nueve cero-dos cero uno cinco (N.° SJ-1839090-2015).

El lote segregado a donar conservará y soportará los gravámenes: servidumbre trasladada de líneas eléctricas y de paso del Instituto Costarricense de Electricidad (ICE), a las citas número dos nueve ocho-cero ocho cero dos nueve - cero uno - cero nueve cero uno- cero cero dos (N.° 298-08029-01-0901-002) y servidumbre sirviente a las citas número tres nueve cuatro - cero tres cinco cero ocho- cero uno- cero cero cero tres - cero cero uno (NY 394-03508-01-0003-001). Además, se deberá constituir en la misma escritura de donación sobre el lote segregado y donado servidumbre pluvial y la servidumbre de alcantarillado sanitario, según los planos correspondientes elaborados por la Unidad Ejecutora JBIC-AYA.

El resto de la finca madre se lo reserva el Instituto Costarricense de Acueductos y Alcantarillados (AyA).
