Resolución 092 — Official List of Endangered and Threatened Species with Reduced Populations

in the entirety of the text - Complete Text of Norm 092 Establishes the Official List of Species in danger of extinction and with reduced and threatened populations NATIONAL SYSTEM OF CONSERVATION AREAS R-SINAC-CONAC-092-2017 NATIONAL SYSTEM OF CONSERVATION AREAS, at twelve hours fourteen minutes on the twelfth of September, two thousand seventeen.

1That Article 50 of the Political Constitution recognizes the right to a healthy and ecologically balanced environment, this right including the conservation, use, and sustainable management of biodiversity and the just and equitable distribution of benefits derived from it, ensuring the broadest participation of all citizens. Wildlife being an element of biodiversity, which is a priority and substantive, its importance is unquestionable, for its intrinsic value and its contributions to achieving a healthy and ecologically balanced environment, as well as its fundamental role in the economy and the development of this country.
2That Costa Rica ratified the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) through Law Nº5605 of October 30, '1974.
3That Article 1 of the Wildlife Conservation Law (Ley de Conservación de Vida Silvestre, LCVS) Nº7317 of October 30, 1992, has the purpose of establishing regulations on wildlife. Wildlife is comprised of the set of organisms that live in natural conditions, temporarily or permanently within the national territory, both in the continental territory and insular territory, in the territorial sea, internal waters, the exclusive economic zone, and jurisdictional waters, and that do not require human care for their survival. Exotic organisms declared as wild by their country of origin, organisms cultivated or raised and born in captivity from wild specimens, their parts, products, and derivatives are considered wildlife and regulated by law. Wildlife may only be subject to private appropriation and trade, through the provisions contained in public treaties, international agreements, this law, and its regulations.
4That the Wildlife Conservation Law Nº7317 of October 30 of 1992 has the purpose of establishing regulations on wildlife, standardizing its conservation and management. Article 3 declares the public domain of wild fauna, and Article 4 declares the production, management, extraction, and commercialization, industrialization, and use of the genetic material of wild flora and fauna, their parts, products, and by-products of public interest and national patrimony, subject to state regulation. This represents a milestone that implies that all Costa Ricans have the duty to protect it and manage it adequately, ensuring its enjoyment for present and future generations.
5That Article 12 of the Wildlife Conservation Law Nº7317 of October 30, 1992 empowers the Executive Branch to establish, through the Regulations of this Law, the procedures and requirements necessary for the conservation of continental or insular, aquatic or terrestrial wildlife, throughout the national territory.

6- For the consultation on the mechanism for updating the lists of fauna and flora species in extinction danger and with threatened or reduced populations, specific consultations with experts, work workshops in 2013 and 2014 with the participation of academia, NGOs, the National Museum of Costa Rica (Museo Nacional de Costa Rica), among others, were conducted. Methodologies were developed by taxonomic group to generate the lists.

7- SINAC requested, in the month of June 2017, the final review of the lists resulting from the workshops and expert consultation from CONAGEBIO, the UCR School of Biology, the UNA School of Biological Sciences, ICOMVIS of UNA, and the National Museum.

8That in August 2017, the last recommendations and observations were received before the final publication of the fauna and flora lists in extinction danger and with reduced or threatened populations.
1That on August 9, 2017, Executive Decree Nº40548-MINAE was issued, titled "Reglamento a la Ley de Conservación de Vida Silvestre" (Regulations to the Wildlife Conservation Law).
2That Article 4 of Decree 40548-MINAE, Regulations to the Law of Wildlife Conservation defines:

" ... 16 Threatened species or with reduced populations (Especie amenazadas o con poblaciones reducidas): Species or subspecies of wild fauna or flora, or their populations, that have probabilities of becoming an endangered species in the foreseeable future, in all of their distribution areas or part of them, if the factors that cause their numerical decline or the degradation of their habitat continue to be present, or very disseminated in more extensive distribution areas, and is in real or potential possibilities of being subject to a decline and possible extinction danger ...

19 Species on the way to or in danger of extinction (Especie en vías o peligro de extinción): Species of wild fauna or flora with populations reduced to a critical level or whose habitat has been reduced to such a point that it affects its long-term genetic viability, which has been included in the list officialized by MINAE or through a resolution based on technical criteria, in international red lists, or in international agreements ... "

3That through Article 6 of the Regulations to the Wildlife Conservation Law, it is defined: "Wildlife species on the way to or in danger of extinction and with reduced or threatened populations under a ban (veda). For the purposes of Article 14 of the LCVS and of these Regulations, wildlife species in extinction danger, with reduced or threatened populations are considered to be those included in the taxa that shall be officialized via an administrative resolution, which will be reviewed by SINAC every four years. Likewise, SINAC, with the support of the National Wildlife Commission (Comisión Nacional de Vida Silvestre), shall establish the Protocol with the mechanisms and procedures for the review of the lists."
4That individuals of those species found within the limits of the Costa Rican State and that are included in the appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora CITES, the Convention on Migratory Species (CMS), and the Red List of the International Union for Conservation of Nature (UICN) are considered part of these lists.
5That Article 22 of the Biodiversity Law Nº7788 of April 30 of 1998, creates the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) (hereinafter SINAC) as a deconcentrated and participatory body that integrates the competencies in forestry matters, wildlife, protected wild areas, and conservation of the use of hydrographic basins and water systems, with the aim of dictating policies, planning, and executing processes directed at achieving the sustainability of natural resources.
6That the obligations derived from the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), ratified through Law Nº5605 of October 30, 1974, are exercised by SINAC as the administrative authority, in accordance with Article 71 of the Wildlife Conservation Law.

7- By Agreement number Nº08 taken at the Ordinary Session Nº 08-2017 of the National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación), held on August 28, May 2017, this resolution is issued.

All species that are found in CITES Appendix II shall form part of the list of species with a reduced population.

These lists shall be used for all legal, technical, and scientific processes that require such an assessment, furthermore, SINAC may include new species in these lists using substantiated technical criteria, as established in Article 6 of the Regulations to the Wildlife Law (Reglamento a la Ley de Vida Silvestre, RLCVS).

This administrative resolution shall be in effect from its publication in the Official Gazette La Gaceta.

1Que el artículo 50 de la Constitución Política reconoce el derecho a un ambiente sano y ecológicamente equilibrado, siendo que este derecho incluye la conservación, uso y manejo sostenible de la biodiversidad y la justa y equitativa distribución de beneficios derivados de esta, asegurando la mayor participación de todos los ciudadanos. Siendo la vida silvestre un elemento de la biodiversidad, el cual es prioritario y sustantivo, su importancia es incuestionable, por su valor intrínseco y sus aportes para lograr un ambiente sano y ecológicamente equilibrado, así como su rol fundamental en la economía y el desarrollo de este país.
2Que Costa Rica ratificó la Convención sobre el Comercio Internacional de Especies Amenazadas de Fauna y Flora Silvestres (CITES) mediante la Ley Nº5605 del 30 de octubre de '1974.
3Que el artículo 1 de la Ley de Conservación de Vida Silvestre (LCVS) Nº7317 del 30 de octubre de 1992 tiene como finalidad establecer las regulaciones sobre la vida silvestre. La vida silvestre está conformada por el conjunto de organismos que viven en condiciones naturales, temporales o permanentes en el territorio nacional, tanto en el territorio continental como insular, en el mar territorial, las aguas interiores, la zona económica exclusiva y las aguas jurisdiccionales y que no requieren el cuidado del ser humano para su supervivencia. Los organismos exóticos declarados como silvestres por el país de origen, los organismos cultivados o criados y nacidos en cautiverio provenientes de especímenes silvestres, sus partes, productos y derivados son considerados vidas silvestres y reguladas por ley. La vida silvestre únicamente puede ser objeto de apropiación particular y de comercio, mediante las disposiciones contenidas en los tratados públicos, los convenios internacionales, esta ley y su reglamento.
4Que la Ley de Conservación de Vida Silvestre Nº7317 del 30 de octubre de 1992 tiene como finalidad establecer las regulaciones sobre la vida silvestre, normando su conservación y manejo. El articulo 3 declara el dominio público de la fauna silvestre, y el artículo 4 declara la producción, manejo, extracción y comercialización, industrialización y uso del material genético de la flora y fauna silvestres sus partes, productos y subproductos de interés público y patrimonio nacional, sujetos a regulación estatal. Esto representa un hito que implica que todos los costarricenses tienen el deber de protegerla y manejarla adecuadamente, asegurando el disfrute para las presentes y las futuras generaciones.
5Que el artículo 12 de la Ley de Conservación de Vida Silvestre Nº7317 del 30 de octubre de 1992 faculta al Poder Ejecutivo para establecer, por medio del Reglamento de esta Ley, los procedimientos y requisitos necesarios para la conservación de la vida silvestre continental o insular, acuática o terrestre, en todo el territorio nacional.

6- Para la consulta sobre el mecanismo de actualización de las listas de especies de fauna y flora en peligro de extinción y con poblaciones amenazadas o reducidas se realizaron consultas puntuales a expertos, talleres de trabajo en el 2013 y 2014 con participación de la academia, ONGs, Museo Nacional de Costa Rica, entre otros. Se desarrollaron metodologías por grupo taxonómico para generar los listados.

7- El SINAC solicitó en el mes de junio de 2017, la revisión final de los listados producto de los talleres y consulta a expertos de CONAGEBIO, de la Escuela de Biología de la UCR, de la Escuela de Ciencias Biológicas de la UNA, al ICOMVIS de la UNA y al Museo Nacional.

8Que en agosto del 2017, se reciben las últimas recomendaciones y observaciones antes de la publicación final de las listas de fauna y flora en peligro de extinción y con poblaciones reducidas o amenazadas
1Que el 09 de agosto de 2017, se emite el Decreto Ejecutivo Nº40548-MINAE denominado "Reglamento a la Ley de Conservación de Vida Silvestren.
2Que el artículo 4 del Decreto 40548-MINAE, Reglamento a la Ley de Conservación de Vida Silvestre define:

" ... 16 Especie amenazadas o con poblaciones reducidas: Especie o subespecie de fauna o flora silvestres, o sus poblaciones, que tiene probabilidades de convertirse en una especie en peligro de extinción en el futuro previsible, en todas sus áreas de distribución o parte de ellas, si los factores que causan su disminución numérica o la degradación de su hábitat continúan presentándose, o muy diseminada en áreas de distribución más extensas, y está en posibilidades reales o potenciales de verse sujeta a una disminución y posible peligro de extinción ...

19 Especie en vías o peligro de extinción: Especie de fauna o flora silvestre con poblaciones reducidas a un nivel crítico o que su hábitat ha sido reducido a tal punto que afecta su viabilidad genética en el largo plazo, la cual ha sido incluida en la lista oficializada por el MINAE o mediante resolución fundamentada en criterios técnicos, en listas rojas internacionales o en los convenios internacionales ... "

3Que mediante el artículo 6 del Reglamento a la Ley de Conservación de Vida Silvestre se define: "Especies de vida silvestre en vías o peligro de extinción y con poblaciones reducidas o amenazadas en veda. Para los efectos del artículo 14 de la LCVS y de este Reglamento, se consideran especies de vida silvestre en peligro de extinción, con poblaciones reducidas o amenazadas, las incluidas en los taxones que se oficializarán vi a resolución administrativa, el cual será revisado por el SINAC cada cuatro años. Asimismo el SINAC, con apoyo de la Com1s1ón Nacional de Vida Silvestre, establecerá el Protocolo con los mecanismos y procedimientos para la revisión de las listas."
4Que se consideran parte de estas listas, los individuos de aquellas especies que se encuentren dentro de los límites del Estado costarricense y que están incluidas en los apéndices de Convención para el Comercio Internacional de Especies de Fauna y Flora en peligro de extinción CITES, la Convención de Especies Migratorias (CMS) y la Lista Roja de la Unión Mundial para la Naturaleza (UICN).
5Que el artículo 22 de la Ley de Biodiversidad Nº7788 del 30 de abril de 1998, crea el Sistema Nacional de Áreas de Conservación (en adelante SINAC) como un órgano desconcentrado y participativo que integra las competencias en materia forestal, vida silvestre, áreas silvestres protegidas y conservación del uso de cuencas hidrográficas y sistemas hídricos, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad de los recursos naturales.
6Que las obligaciones derivadas de la Convención sobre el Comercio Internacional de Especies Amenazadas de Fauna y Flora Silvestre (CITES), ratificada mediante Ley Nº5605 del 30 de octubre de 1974, son ejercidas por el SINAC como autoridad administrativa, de conformidad con el artículo 71 de la Ley de Conservación de Vida Silvestre.

7- Por Acuerdo número N º08 tomado en Sesión Ordinaria Nº 08-2017 del Consejo Nacional de Áreas de Conservación, celebrada el día 28 de agosto mayo de 2017, se emite la presente resolución.

Todas las especies que se encuentran en el Apéndice II de CITES formaran parte del listado de especie con población reducida.

Estas listas serán usadas para todos los procesos legales, técnicos y científicos que requieran dicha valoración, además el SINAC podrá incluir nuevas especies en estas listas usando criterios técnicos fundamentados, según lo establecido el artículo 6 del Reglamento a la Ley de Vida Silvestre (RLCVS).

La presente resolución administrativa rige a partir de su publicación en el Diario Oficial La Gaceta.
