Regulation for Fisheries and Aquaculture Scientific Research Outside Marine Protected AreasReglamento para Investigación Científica Pesquera y Acuícola fuera de Áreas Marinas Protegidas

Research by scientists, technicians, and public, state, or private institutions, national or foreign, will be governed under the rules of this regulation, which will apply to any application for a research or development permit, fisheries or aquaculture, on living marine, continental aquatic, or aquaculture resources outside Marine Protected Areas under the jurisdiction of MINAE. In addition, all research must comply with the provisions of the LPA and its Regulation.

For the purposes of applying this Regulation, the following is understood as:

Scientific aquaculture: activity for the purposes of scientific research, repopulation, conservation, exploitation, sustainable management, and development of aquatic species.

Development aquaculture: activity whose purpose is to promote the development of the cultivation of aquatic species and the use of equipment and methodologies consistent with cultivation systems.

Scientific capture: temporary capture of the individual under study in which a rigorous method is applied that ensures its use will not temporarily or permanently harm the population of the species, and the individual is subsequently released in the conditions and places where it was captured or in another previously authorized place.

Technical File: Form containing all the information relating to the Researcher in those authorized investigations, which will be kept in a database for the respective administrative and technical monitoring (seguimiento).

Application Form: document establishing the information that the person or institution must provide in relation to the investigation subject to the application.

Scientific fishing: fishing activity for scientific research purposes, protection of aquatic species, experimentation, exploration, prospecting, development, sustainable exploitation, and management.

Development fishing (pesca de fomento): fishing whose purpose is the study, scientific research, experimentation, exploration, prospecting, development, the capture of live specimens for research, the repopulation, or conservation of fishery aquatic resources, and for the experimentation of equipment and methods intended for said activity.

Fishing permits for scientific research or fisheries development (fomento): Special administrative act, authorizing individuals or legal entities, public or private, to carry out development (fomento) fishing activities or fishing activities for research purposes, under the terms indicated in the Fisheries and Aquaculture Law and its Regulation. Included within these permits is the execution of research by universities, university colleges, and the National Apprenticeship Institute (INA), for a dissertation or thesis for a bachelor's, master's, doctorate, or post-doctorate degree, on fisheries topics.

Fishing permits for scientific research or aquaculture development (fomento): Special administrative act, authorizing individuals or legal entities, public or private, to carry out development (fomento) aquaculture activities or activities for research purposes, under the terms indicated in the Fisheries and Aquaculture Law and its Regulation. Included within these permits is the execution of research by universities, university colleges, and INA, for a dissertation or thesis for a bachelor's, master's, doctorate, or post-doctorate degree, on aquaculture topics.

Scientific collection: scientific activity that applies a rigorous scientific method, undertaking a permanent collection of a determined quantity of individuals in the study process, which will be transferred to research laboratories; prior authorization for collection and Administrative monitoring (Seguimiento administrativo): activities in which INCOPESCA personnel monitor the authorized studies, to ensure, among other things, the delivery of progress reports and the final research report.

Administrative supervision: activity in which Incopesca personnel verify that the work carried out by the researcher is within the license, authorization, or research permit and the resolution issued in this regard. It also verifies that the researcher is being provided with the services requested and authorized during the time they conduct the field work.

Technical supervision: activity in which professional Incopesca personnel verify that the researcher is performing the technical work described in the research project and that was authorized, as well as ensuring that the strategy for communicating research results is carried out and implemented, for which purpose it may rely on consultations with specialists.

Requirements for obtaining fishing permits for scientific or development research, fisheries or aquaculture.

• 1)The Technical General Director, who will act in turn as coordinator of the Committee.
• 2)The General Director of Fisheries and Aquaculture Organization or their representative.
• 3)The Head of the Research and Development Department or their representative.
• 4)The Head of the Aquaculture Department or their representative.
• 5)The Head of the Statistics Department or their representative.

• 1)Submit the Research Permit Application Form (FSPI) that COTICIF will provide for this purpose, duly completed, to the coordinator of said Commission.
• 2)Provide an Activity Plan, according to the requirements established in Article 22 of Decree No. 36782- MINAET-MAG-MOPT-TUR-SP-S-MTSS (Regulation to the LPA), which must be in the Spanish language.
• 3)The objectives of the study or project must be framed within the objectives of conservation, protection, exploitation, and sustainable use of marine and aquaculture resources.
• 4)Curriculum vitae of the principal investigator, containing personal data, highest academic degree, work and scientific experience; publications, among others.
• 5)Institutional Endorsement Letter: Copy of the Agreement of the academic institution, certifying that the research or development permit they are requesting is an official investigation of the academic center, indicating therein the position (function), telephone, fax, email, or other, of the signing person.
• 6)In the case of a university degree thesis, a certified copy of the agreement of the Thesis Committee, along with a copy of the approved research preliminary project, will suffice to request the respective permit.
• 7)In those cases where the researchers and/or participants have a professional degree, they must provide a Certification stating that they are incorporated and active with the respective Professional Association.
• 8)National applicants, individuals, must provide 2 passport-size photographs, recent and taken from the front.
• 9)Provide a photocopy and original for verification, of the Identity Card or valid Identification Document.
• 10)In the case of Legal Entities, a Certification of Legal Status issued no more than 3 months prior must be provided, and present a photocopy and original of the valid Legal ID.
• 11)When the conduct of the research involves the use of vessel(s), they must provide their valid registration and Seaworthiness Certificate in original and provide photocopies of both documents.
• 12)In the case of research to be conducted by universities that are not national and state, they must present a receipt or certification that they provided the economic guarantee corresponding to 10% of the total cost of project execution (this according to Article 26 of the Regulation to the LPA).
• 13)In the event that the researcher or the institution requesting a research permit has not submitted the Final Report to COTICIF for any previous investigation within one calendar month following the completion of the project, no further research permits will be granted until this requirement is met.
• 14)In the case of research on aquaculture projects, the authorization for aquaculture project operation must be submitted to Incopesca, according to the requirements of the LPA.

Processing of applications for scientific research or fisheries or aquaculture development research permits on living marine, continental aquatic, or aquaculture resources outside Marine Protected Areas under the jurisdiction of MINAE.

The coordinator of this commission will inform the interested party of the agreement, so that they may begin the investigation or request corrections, if so decided by that Board of Directors.

Once said period has expired, if the additional information has not been submitted, COTICIF will proceed to archive the application.

Rights and duties of researchers

Consent to conduct research

• 1)That they are declared in danger of extinction.
• 2)That they are declared as reduced populations.
• 3)That they are declared or cataloged as endangered species by some related scientific or academic organization (OSPESCA, CIAT, UICN, CITES, or other).
• 4)That they are within the group of species that are little studied or with little information on their population status.
• 5)That they are found within ecosystems that are poorly represented or unique to the country.
• 6)That they are recognized as endemic species for the study area.
• 7)That they will be captured with authorized methods that have a low impact for that species, for others, or for the ecosystem of which they form a part.
• 8)That they will be transported in an adequate manner.
• 9)That the person who will carry out the collection demonstrates sufficient

Research monitoring (seguimiento)

For such work, when it deems it necessary, it will coordinate with the interested party.

This commission may appoint an official from the Development and Research Department or the Aquaculture Department to monitor (seguimiento) and supervise the research projects.

Suspension or cancellation, revocation, and appeal of the marine, continental aquatic, or aquaculture research or development permit

• 1)It is verified that information has been concealed, biological material has been used for purposes other than those authorized, or unauthorized collections have been made.
• 2)It is verified that the indications and calls for attention sent in writing have not been complied with.
• 3)It is verified that unauthorized species reintroduction activities have been conducted without due authorization.
• 4)It is verified that unauthorized research activities have been conducted, or that the established regulations have not been complied with.
• 5)It is verified that false information has been submitted in the application or in any of the requirements submitted.
• 6)It is verified that the offense has been repeated or that the progress or final reports of the research have not been delivered within the established deadlines.
• 7)It is verified that the research activities are not being conducted in accordance with the information indicated in the project.

Based on this, the Board of Directors will issue an agreement, where the permit is canceled or the pertinent corrections are requested from the researcher.

Miscellaneous Provisions

• 1)The activities carried out by its officials and associated researchers within the context of the research project.
• 2)Giving Incopesca access, if so requested, to all data and samples obtained through the project, as well as providing it with the database entered in Excel and the research results.
• 3)Allowing Incopesca to use the research results to dictate management measures, if it deems it necessary.
• 4)Immediately informing Incopesca of any important change in the research program.
• 5)Removing the scientific research installations or equipment once the research is completed, unless an extension has been agreed upon.
• 6)Individuals or legal entities, foreign researchers, or students will be responsible for the damage caused to the marine environment resulting from scientific research conducted by them or on their behalf.
• 7)Scientists, technicians, and competent national and international organizations will be responsible for non-compliance with the protection and conservation measures for living resources and preservation of the environment indicated by the institution, in which case they will be liable to compensate for the damages resulting from the non-compliance.

• 1)Standing on live coral or clinging to it during the execution of scientific or development research.
• 2)Throwing chlorine, oil, garbage, or ordinary waste, such as plastic bags, cans, bottles, and any type of special or ordinary pollutant into the sea.
• 3)Walking on coral ecosystems.
• 4)Extracting coral, live or dead, without the respective research permit.
• 5)Dropping anchor directly onto coral ecosystems.
• 6)The use of fishing gear harmful to these ecosystems, which includes the use of any type of net, line, speargun, or trammel net.

It will likewise promote the strengthening of marine, continental, and aquaculture scientific research capacity, through programs to provide adequate education and training to its technical and scientific personnel.

Excluded from the foregoing is the monitoring of national fisheries, which is an obligation to be carried out by Incopesca.

This list will be submitted to the Board of Directors every June of each year, before the preparation of the institutional POIs, so that it may declare the research projects it so considers to be of institutional interest, which will be approved through an agreement of the Board of Directors and published on the Incopesca website.

The researcher will have two months to submit the requirements to obtain the research permit; otherwise, the research topic will be made available again on the Incopesca website.

Any person who wishes to be an onboard observer and who meets the professional level and experience that qualifies them to fulfill this function must submit their curriculum vitae and credentials to said coordinator, which will be analyzed within the said Commission, which will approve or disapprove them as an onboard observer for research.

La investigación por parte de científicos, técnicos e instituciones públicas, estatales o privadas, nacionales o extranjeras, estarán regidas bajo la normativa del presente reglamento, el cual será de aplicación a toda solicitud de permiso de investigación o de fomento pesquera o acuícola sobre los recursos vivos marinos, acuáticos continentales o acuícolas fuera de las Áreas Marinas Protegidas bajo jurisdicción del MINAE. Además, toda investigación debe cumplir con lo establecido en la LPA y en su Reglamento.

A efectos de la aplicación del presente Reglamento se entiende por:

Acuicultura científica: actividad con propósitos de investigación científica, repoblación, conservación, aprovechamiento, manejo sostenible y desarrollo de especies acuáticas.

Acuicultura de fomento: actividad cuyo propósito es fomentar el desarrollo del cultivo de especies acuáticas y el uso de equipos y metodologías acordes con los sistemas de cultivo.

Captura científica: captura temporal del individuo en estudio en la que se aplica un método riguroso que asegura que su uso no dañará ni temporal ni permanentemente la población de la especie y luego el individuo se libera en las condiciones y lugares en que fuera capturado o en otro lugar previamente autorizado.

Ficha Técnica: Formulario donde aparecerá toda la información relativa al Investigador (a) en aquellas investigaciones autorizadas y que se llevará en una base de datos para el seguimiento administrativo y técnico respectivo.

Formulario de solicitud: documento mediante el cual se establece la información que debe aportar la persona o institución en relación a la investigación objeto de la solicitud.

Pesca científica: actividad de pesca con propósitos de investigación científica, protección de especies acuáticas, experimentación, exploración, prospección, desarrollo, aprovechamiento y manejo sostenible.

Pesca de fomento: pesca cuyo propósito es el estudio, la investigación científica, la experimentación, la exploración, la prospección, el desarrollo, la captura de ejemplares vivos para la investigación, la repoblación o conservación de los recursos acuáticos pesqueros y para la experimentación de equipos y métodos destinados a dicha actividad.

Permisos de pesca para investigación científica o de fomento pesquero: Acto administrativo especial, mediante el cual se autoriza a personas físicas o jurídicas, públicas o privadas, para que ejerzan actividades pesqueras de fomento o con fines investigativos, en los términos indicados en la Ley de Pesca y Acuicultura y su Reglamento. Se incluye dentro de estos permisos, la ejecución de la investigación por parte de las universidades, colegios universitarios y el Instituto Nacional de Aprendizaje (INA), para una tesina o tesis de licenciatura, maestría, doctorado o postdoctorado, en temas pesqueros.

Permisos de pesca para investigación científica o de fomento acuícola: Acto administrativo especial, mediante el cual se autoriza a personas físicas o jurídicas, públicas o privadas, para que ejerzan actividades acuícolas de fomento y con fines investigativos, en los términos indicados en la Ley de Pesca y Acuicultura y su Reglamento. Se incluye dentro de estos permisos, la ejecución de la investigación por parte de las universidades, colegios universitarios y el INA, para una tesina o tesis de licenciatura, maestría, doctorado o postdoctorado, en temas acuícolas.

Recolecta científica: actividad científica que aplica un método científico riguroso, que realiza una recolecta permanente de una cantidad determinada de individuos en proceso de estudio, que serán trasladados a laboratorios de investigación; previa autorización para la recolecta y la Seguimiento administrativo: actividades en las que el personal del INCOPESCA, da seguimiento a los estudios autorizados, para asegurar entre otras cosas la entrega de los informes de avance y del informe final de la investigación.

Supervisión administrativa: actividad en la que el personal del Incopesca, verifica que las labores que realiza el investigador se encuentran dentro de la licencia, autorización o permiso de investigación y la resolución emitida al respecto. Asimismo, verifica que se esté brindando al investigador los servicios solicitados y autorizados durante el tiempo que realice el trabajo de campo.

Supervisión técnica: actividad en la que el personal profesional del Incopesca, verifica que el investigador esté realizando las labores técnicas descritas en el proyecto de investigación y que le fueron autorizadas, así como velar porque la estrategia de comunicación de resultados de investigación, se realice e implemente y para lo cual podrá apoyarse en las consultas con especialistas.

Requisitos para obtener permisos de pesca para investigación científica o de fomento, pesquera o acuícola.

• 1)El Director General Técnico, quien fungirá a su vez como coordinador (a) del Comité.
• 2)El Director General de Organización Pesquera y Acuícola o su representante.
• 3)El Jefe del Departamento de Investigación y Desarrollo o su representante.
• 4)El jefe del Departamento de Acuicultura o su representante.
• 5)El Jefe del Departamento de Estadística o su representante.

• 1)Entregar el Formulario de Solicitud Permiso de Investigación (FSPI) que para tal efecto proporcionará COTICIF, debidamente lleno, al coordinador de dicha Comisión.
• 2)Aportar un Plan de Actividades, según los requerimientos establecidos en el artículo 22 del Decreto Nº 36782- MINAET-MAG-MOPT-TUR-SP-S-MTSS (Reglamento a la LPA), el cual deberá de estar en idioma español.
• 3)Los objetivos del estudio o proyecto deberán estar enmarcados dentro de los objetivos de conservación, protección, aprovechamiento y uso sostenible de recursos marinos y acuícolas.
• 4)Currículum vitae del investigador principal, que contenga los datos personales, último grado académico, experiencia laboral y científica; publicaciones, entre otros.
• 5)Carta de Respaldo Institucional: Copia del Acuerdo de la institución académica, acreditando que el permiso de investigación o de fomento que solicitan es una investigación oficial del centro académico, indicando en la misma el cargo (función), teléfono, fax, correo electrónico, u otro, de la persona firmante.
• 6)En el caso de tesis de grado universitaria, bastará con copia certificada del acuerdo del Comité de Tesis, junto con una copia del anteproyecto de investigación aprobado, para solicitar el respectivo permiso.
• 7)En aquellos casos en que los investigadores y/o participantes tengan un grado profesional, deberán aportar una Certificación haciendo constar que se encuentran incorporados y activos con el Colegio Profesional respectivo.
• 8)Los solicitantes nacionales, personas físicas deberán aportar 2 fotografías tamaño pasaporte, recientes y tomadas de frente.
• 9)Aportar fotocopia y original para su confrontación, de la Cédula de Identidad o Documento de Identificación vigente.
• 10)En el caso de Personas Jurídicas se deberá aportar Certificación de Personería Jurídica con un máximo de 3 meses de haber sido expedida y presentar fotocopia y original de la Cédula Jurídica vigente.
• 11)Cuando para la realización de la investigación medie el uso de embarcación (es), deberán aportar su matrícula y Certificado de Navegabilidad vigentes en original y aportar fotocopias de ambos documentos.
• 12)En el caso de la investigación a realizarse por parte de las universidades que no son de carácter nacional y estatal, deben de presentar recibo o certificación, de que rindieron la garantía económica correspondiente a un 10% del costo total de la ejecución del proyecto (esto según artículo 26 del Reglamento a la LPA).
• 13)En el caso de que el investigador o la institución, que solicite permiso de investigación y no haya presentado el Informe Final a la COTICIF de alguna investigación anterior y dentro del mes calendario posterior a la finalización del proyecto, no se le concederán más permisos de investigación, hasta tanto no cumplan con este requisito.
• 14)En el caso de investigación en proyectos acuícolas se deberá de presentar ante el Incopesca la autorización para operación de proyecto acuícola, según los requerimientos de la LPA.

Trámite de solicitudes de permisos de investigación científica o de fomento pesquero o acuícola sobre los recursos vivos marinos, acuáticos continentales o acuícolas fuera de las Áreas Marinas Protegidas bajo jurisdicción del MINAE.

El coordinador de esta comisión informará al interesado acerca del acuerdo, para que inicie la investigación o para solicitar las correcciones, si así lo decidiera esa Junta Directiva.

Vencido dicho plazo, si no se presentase la información adicional, la COTICIF procederá a archivar la solicitud.

Derechos y deberes de los investigadores

Del consentimiento a la realización de la investigación

• 1)Que estén declaradas en peligro de extinción.
• 2)Que estén declaradas como poblaciones reducidas.
• 3)Que estén declaradas o catalogadas como especies en peligro, por alguna organización científica o académica relacionada (OSPESCA, CIAT, UICN, CITES u otra).
• 4)Que estén dentro del grupo de especies poco estudiados o con poca información sobre su estado poblacional.
• 5)Que se encuentren dentro de ecosistemas poco representados o únicos del país.
• 6)Que estén reconocidas como especies endémicas para el área de estudio.
• 7)Que vayan a ser capturadas con métodos autorizados y de bajo impacto para esa especie, para otras o para el ecosistema del que forma parte.
• 8)Que vayan a ser transportadas de forma adecuada.
• 9)Que quien vaya a realizar la recolecta demuestre contar con la experiencia suficiente o cuente con asesores reconocidos.

Del seguimiento de la investigación

Para tal labor cuando lo considere necesario, coordinará con el interesado.

Esta comisión podrá nombrar a un funcionario del Departamento de Desarrollo e Investigación o del Departamento de Acuicultura, para que dé seguimiento y supervisión a los proyectos de investigación.

De la suspensión o cancelación, revocatoria y apelación del permiso de investigación o de fomento, marino, acuático continental o acuícola

• 1)Se compruebe que se ha ocultado información, se ha utilizado material biológico con fines diferentes a los autorizados o se han realizado recolectas no autorizadas.
• 2)Se compruebe que se ha incumplido con las indicaciones y llamadas de atención que por escrito se hayan remitido.
• 3)Se compruebe que se han realizado actividades no autorizadas de reintroducción de especies sin la debida autorización.
• 4)Se compruebe que se han realizado actividades de investigación no autorizadas, que no se han acatado las regulaciones establecidas.
• 5)Se compruebe que se ha presentado información falsa en la solicitud o en cualquiera de los requisitos presentados.
• 6)Se compruebe que se ha reincidido en la falta o que no se han entregado en los plazos establecidos, los informes de avance o final de la investigación.
• 7)Se compruebe que las actividades de investigación no se están realizando de conformidad con la información indicada en el proyecto.

En base al mismo, la Junta Directiva tomará un acuerdo, donde se cancela el permiso o se solicitan las correcciones del caso al investigador.

• 1)Las actividades realizadas por sus funcionarios e investigadores asociados dentro del contexto del proyecto de investigación.
• 2)Dar acceso al Incopesca, si así lo solicita, a todos los datos y muestras obtenidos a través del proyecto, así como a facilitarle la base de datos digitada en Excel y los resultados de la investigación.
• 3)Permitir al Incopesca la utilización de los resultados de la investigación, para dictar medidas de manejo, en el caso de que lo considere necesario.
• 4)Informar inmediatamente al Incopesca cualquier cambio importante en el programa de investigación.
• 5)Retirar las instalaciones o el equipo de investigación científica una vez terminada la investigación, a menos que se haya convenido una prórroga.
• 6)Las personas físicas o jurídicas, investigadores o estudiantes extranjeros serán responsables, de los daños causados al medio marino resultante de la investigación científica realizada por ellos o en su nombre.
• 7)Los científicos, técnicos y las organizaciones nacionales e internacionales competentes serán responsables por el incumplimiento de las medidas de protección, conservación de los recursos vivos y preservación del medio ambiente que la institución señale, en cuyo caso les corresponderá indemnizar los daños resultantes del incumplimiento.

• 1)Ponerse de pie sobre el coral vivo o aferrarse a él, durante la ejecución de la investigación científica o de fomento.
• 2)Lanzar al mar cloro, aceite, basura, o desechos ordinarios, como bolsas plásticas, latas, botellas y cualquier tipo de contaminante especial u ordinario.
• 3)Caminar sobre los ecosistemas coralinos.
• 4)Extraer coral, vivo o muerto, sin contar con el respectivo permiso de investigación.
• 5)Lanzar el ancla directamente sobre los ecosistemas coralinos.
• 6)El uso de artes de pesca dañinas para estos ecosistemas, que incluye el uso de cualquier tipo de red, línea, arbaleta o trasmallo.

Asimismo promoverá el fortalecimiento de la capacidad de investigación científica marina, continental y acuícola, por medio de programas para proporcionar enseñanza y capacitación adecuadas a su personal técnico y científico.

Se excluye de lo anterior, el monitoreo a las pesquerías nacionales, lo cual es una obligación de realizar, por parte del Incopesca.

Esta lista será presentada a Junta Directiva, todos los meses de junio de cada año, antes de la preparación de los POI institucionales, para que declare de interés institucional, las investigaciones que así lo consideren, lo cual será aprobado mediante un acuerdo de Junta Directiva y publicado en la página web del Incopesca.

El investigador tendrá dos meses para presentar los requisitos para obtener el permiso de investigación, caso contrario, se volverá a poner disponible el tema de investigación, en la página web del Incopesca.

Toda persona, que quiera ser observador a bordo y que cumpla con el nivel profesional y de experiencia que lo faculte para cumplir con esta función, deberá de presentar su hoja de vida y atestados a dicho coordinador, lo cual será analizado en el seno de dicha Comisión, la cual lo aprobará o desaprobara como observador a bordo para investigación.
