Considering:
Heiner Méndez Barrientos, Institutional Legal Advisor, of the proposal for the Procedure Manual for the Sale of Fishery Products deriving from the catch generated as part of Research Permits granted by Incopesca has been received, and whereas in the judgment of the Members of this Board, it meets the requirements; the Board of Directors, Therefore;
RESOLVES:

PROCEDURE MANUAL FOR THE SALE OF FISHERY PRODUCTS DERIVING FROM THE CATCH GENERATED AS PART OF RESEARCH PERMITS GRANTED BY INCOPESCA
The purpose of this manual is to establish the procedures, rules, instructions, and calculation principles to be followed to carry out the commercialization of fishery products through the direct sale mechanism, as they are perishable products.
In accordance with this manual, the object is to carry out an organized sale of fishery products generated as a result of the catch or catches made under a granted research permit and which, according to the provisions of Law No. 8436, the Fisheries and Aquaculture Law, Chapter IV, articles 165 to 22, with the purpose of making feasible the utilization and commercialization of the product caught during the validity of the research permit.
The sale shall be of a public nature, in accordance with the foregoing; therefore, the product shall be sold to the buyer making the best offer following the parameters instituted by this manual and always pursuing the highest public interest, in clear accordance with article 113 of the General Public Administration Law, and subsequent and concordant articles.
Any subject of law, whether a natural or legal person, may participate in the sales of fishery products as an offeror to acquire the quantity of product that is the object thereof.
Likewise, Incopesca may create a Fishery Products Buyers Registry, which must be attached to the Marketing Department of the Directorate of Fisheries and Aquaculture Operations of the Costa Rican Institute of Fisheries and Aquaculture.
In accordance with the provisions of this manual, those natural and legal persons wishing to participate in sales of fishery products must be registered in the Fishery Products Buyers Registry, for which they must submit the following requirements:
Natural persons 1)- Full name and surnames 2)- Profession or trade.
3)- Nationality.
4)- Exact address.
5)- Telephone, fax, and email address.
6)- Photocopy of the Identity Card.
7)- Place for Notification.
Legal persons 1)- Qualifications of the generalissimus agent. (Provide the Mandate Contract).
2)- Certification of legal status issued less than one month prior.
3)- Telephone, fax, and email address.
4)- Exact address.
5)- Place for Notification.
Officials of INCOPESCA, the institutions and non-governmental organizations involved in the research project, as well as direct first-degree relatives or natural or legal persons with unexpired debts to INCOPESCA, shall be barred from participating in the sale of the offered product.
The intention to conduct the sale shall be made known to all interested parties, through the means of notification determined by the administration of Incopesca and to those registered in the Fishery Products Buyers Registry, at the place they previously specified; the description of the product offered for sale and its essential information shall be detailed; the invitation shall be for all those interested, especially those who are part of the Supplier Registry of the Department of Protection and Registry.
Only those fishery products caught as part of the research process shall be offered.
The Head of the Department of Protection and Registry shall designate an official, in accordance with the Delimitation of Functions and Responsibilities required by the General Law on Internal Control, who shall exercise the role of representation on behalf of INCOPESCA and shall be responsible for receiving the offers for the product offered for sale, for the purpose of communicating them to the Head of the Department of Protection and Registry.
Interested parties must submit their purchase offers that are selectable and comply with the provisions of this Manual.
The corresponding prices and parameters shall be defined based on the purchase offers submitted and shall take as a basis the market price of the day, which must be established by the Marketing Department of Incopesca.
The sale of the fishery product shall be carried out publicly and directly; it shall be awarded to whoever offers the best economic conditions, in accordance with article 13 of Law No. 6227, with immediate payment in cash or any other means accepted by Incopesca.
From the sale process, the corresponding record (acta) shall be drawn up where the sale is recorded and therefore finalized, all in accordance with articles 270 and 271 of the General Public Administration Law No. 6227.
The INCOPESCA official participating in the entire sale process must, in the record drawn up for that purpose, report on the steps taken, up to the closing of the sale, from which suggestions and recommendations will be fed back to adopt corrective measures and thus manage the internal or external risk that could affect the optimization of the objectives.
The offered good shall be awarded to the bidder making the best offer in accordance with the procedure established herein; however, in the event of not doing so, for duly justified reasons, it may be decided to call a new sale; or failing that, to proceed to donate it, destroy it in the event that the conditions of the product warrant it, or in the absence of offerors during the holding of the sale, to desist from the process.
The sale may not be awarded when the price is ruinous in the judgment of the official responsible for making the sale.
The awardee must make the payment at the place where the sale is held, provided they comply with the requirements and conditions established for this purpose in this Manual. They must identify themselves by means of a valid national identity document or passport. Anyone participating in the sale on behalf of third parties or legal persons must prove the representation under which they act, by means of the respective mandate contract (contrato de mandato).
It is the act by which the fishery product is bequeathed to whomever Incopesca determines through the corresponding record (acta), all in accordance with articles 270 and 271 of the General Public Administration Law No. 6227.
When the fishery product results in total uselessness, as declared in writing by SENASA, INCOPESCA shall order its integral destruction, by means of the respective administrative act and shall also draw up the pertinent record (acta) that certifies what has been done, in accordance with articles 270 and 271 of Law No. 6227.
For each process, an individualized administrative case file (expediente) shall be opened, which must contain all the steps taken in the sale, destruction, or donation process; consequently, the sale record (acta de venta), the destruction process, or the respective donation shall be included.
All documentation submitted by SENASA regarding the product in the event of destruction must form part of the corresponding file.
From the total sale of the product, the expenses incurred by INCOPESCA to maintain the fishery product in a harmless state must be deducted, for which reason they must be duly credited in the administrative case file (expediente administrativo). From the remaining balance, Incopesca may allow the corresponding payments to cover research costs, in accordance with the provisions for these purposes in Law No. 8436, the Fisheries and Aquaculture Law, article 18; if any surplus results, these shall become the property of Incopesca.

MANUAL DE PROCEDIMIENTO PARA VENTA DE PRODUCTOS PESQUEROS PROVENIENTES DE LA CAPTURA GENERADA COMO PARTE DE PERMISOS DE INVESTIGACIÓN OTORGADOS POR EL INCOPESCA
El presente manual tiene como propósito establecer los procedimientos, reglas, instrucciones y principios de cálculo a seguir para llevar a cabo la comercialización de productos pesqueros mediante el mecanismo de venta directa, por tratarse de productos perecederos.
De conformidad con el presente manual, el objeto de es realizar una venta organizada de productos pesqueros generados producto de la o las capturas que se realicen al amparo de un permiso de investigación otorgado y que de acuerdo a lo establecido en la Ley N° 8436 Ley de Pesca y Acuicultura, Capítulo IV, artículos 165 al 22, con el propósito de que le sea factible llevar a cabo el aprovechamiento y comercialización del producto capturado durante la vigencia del permiso de investigación.
La venta será de carácter público, en concordancia con lo precedente; por tanto, se venderá el producto a aquel comprador que realice la mejor oferta siguiendo los parámetros instituidos por este manual y siempre persiguiendo el más alto interés público, en franca concordancia con el artículo 113 de la Ley General de la Administración Pública, siguientes y concordantes.
Cualquier sujeto de derecho, sea persona física o jurídica, podrá participar en las venta de productos pesqueros como oferente para adquirir la cantidad del producto que sea objeto de la misma.
Igualmente el Incopesca podrá crear un Registro de Compradores de Productos Pesqueros, el cual deberá estar adscrito al Departamento de Mercadeo de la Dirección de Operación Pesqueras y Acuícolas del Instituto Costarricense de Pesca y Acuicultura.
De conformidad con lo dispuesto en el presente manual aquellas personas físicas y jurídicas que deseen participar en ventas de productos pesqueros deberán estar inscritos en el Registro de Compradores de Productos Pesqueros, para lo cual deben presentar los siguientes requisitos:
Personas físicas 1)- Nombre y apellidos 2)- Profesión u oficio.
3)- Nacionalidad.
4)- Dirección exacta.
5)- Teléfono, fax y dirección electrónica.
6)- Fotocopia de la Cédula.
7)- Lugar para ser Notificado.
Personas jurídicas 1)- Calidades del apoderado generalísimo. (Aportar el Contrato de Mandato).
2)- Certificación de personería jurídica con menos de un mes de expedición.
3)- Teléfono, fax y dirección electrónica.
4)- Dirección exacta.
5)- Lugar para ser Notificado.
Los funcionarios del INCOPESCA, las instituciones y organizaciones no gubernamentales que intervengan en el proyecto de investigación, así como familiares directos en primer grado o personas físicas o jurídicas con deudas que no hayan prescrito con el INCOPESCA, estarán imposibilitadas de participar en la venta del producto ofertado.
Se hará del conocimiento de todos los interesados la intención de realizar la venta, por los medios de notificación que la administración del Incopesca determine y a quienes estén inscrito en el Registro de Compradores de Productos Pesqueros, en el sitio que éstos precisaron con antelación; se detallará la descripción del producto objeto de venta y la información esencial del mismo, la invitación será para todos aquellos interesados en especial a quienes formen parte del Registro de Proveedores del Departamento de Protección y Registro.
Únicamente lo serán aquellos productos pesqueros capturados, como parte del proceso de investigación.
La Jefatura del Departamento de Protección y Registro designará un funcionario, conforme a la Delimitación de Funciones y Responsabilidades que exige la Ley General de Control Interno, el cual ejercerá el rol de representación por parte del INCOPESCA y será el encargado de la recepción de las ofertas sobre el producto objeto de venta, a efectos de comunicarla a la Jefatura del Departamento de Protección y Registro.
Los interesados deberán presentar sus ofertas de compra que resulten seleccionables y cumplan con lo previsto en este Manual.
Los precios y parámetros correspondientes se definirán en función de las ofertas de compra presentadas y tomará como base el precio de mercado del día que deberá establecer del Departamento de Mercadeo del Incopesca.
Se efectuará la venta del producto pesquero de manera pública y directa, el mismo se adjudicará a quien ofrezca las mejores condiciones económicas, conforme al artículo 13 de la Ley N° 6227, con pago inmediato en efectivo o cualquier otro medio aceptado por el Incopesca.
Del proceso de venta se levantará el acta correspondiente donde quede consignada la venta y por ende finiquitada la venta, todo de conformidad con los artículo 270 y 271 de la Ley General de la Administración Pública N° 6227.
El funcionario del INCOPESCA que partícipe de todo el proceso de venta, deberá en el acta levantada al efecto informar sobre las diligencias llevadas a cabo, hasta el cierre de la venta, del cual se retroalimentaran sugerencias y recomendaciones para adoptar medidas correctivas y así administrar el riesgo interno o externo que podría afectar la optimización de los objetivos.
Se adjudicará el bien ofrecido al postor que haga la mejor oferta conforme al procedimiento aquí establecido; sin embargo, en caso de no hacerlo, por razones debidamente justificadas, se podrá decidir convocar a una nueva venta; o en su defecto, proceder a donarlo, destruirlo en caso que las condiciones del producto lo ameriten o ante la falta de oferentes durante la celebración de la venta, desistir del proceso.
No se podrá adjudicar la venta cuando el precio sea ruinoso a criterio del funcionario responsable de hacer la venta
El adjudicatario deberá realizar el pago en el lugar de la celebración de la venta siempre y cuando cumpla con los requisitos y condiciones que para ello se establecen el presente Manual. Deberá identificarse mediante el documento nacional de identidad o pasaporte vigentes. Quien participe en la venta por cuenta de terceros o personas jurídicas deberá acreditar la representación con que se actúe, mediante el respectivo contrato de mandato.
Es el acto mediante el cual se procede a legar el producto pesquero a quien el Incopesca determine mediante el acta correspondiente, todo conforme a los artículos 270 y 271 de la Ley General de la Administración Pública N° 6227.
Cuando el producto pesquero recaiga en una inutilización total, según lo declare por escrito SENASA, el INCOPESCA ordenará su destrucción integral, mediante el respectivo acto administrativo e igualmente levantará el acta pertinente que acredite lo actuado, conforme a los artículos 270 y 271 de la Ley N° 6227.
Para cada gestión, se abrirá un expediente administrativo individualizado, el cual deberá contener todas las diligencias efectuadas en el proceso de venta, destrucción o donación; consecuentemente, se hará incluir el acta de venta, el proceso de destrucción o la respectiva donación.
Toda la documentación que presente el SENASA sobre el producto en caso de destrucción deberá formar parte del legajo correspondiente.
De la venta total del producto se deberá rebajar los gastos en que el INCOPESCA haya incurrido para mantener en estado inocuo el producto pesquero, por lo que deberán estar debidamente acreditados en el expediente administrativo. Del saldo restante, se podrá permitir por parte del Incopesca, los pagos correspondientes para cubrir costos de la investigación, conforme a lo establecido para estos efectos, en la Ley N° 8436, Ley de Pesca y Acuicultura, artículo 18, si resultaren excedentes, estos pasarán a ser patrimonio del Incopesca.
