González Sanz, Minister of Foreign Affairs and Worship, and diplomatic note Wi 468.40/10 dated 26 April 2017 signed by His Excellency Mr. Ingo Winkelmann, Ambassador of the Federal Republic of Germany, concerning the project "Climate Change and Transport in Costa Rica", within the framework of the International Climate Protection Initiative of the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety, the texts of which are the following:

I have the honor to address Your Excellency, on the occasion of acknowledging receipt of your kind note Wi 468 .40 / 10 dated 26 April 2017, which reads as follows:
"Mr. Minister:
In compliance with the Convention concerning Technical Cooperation, concluded between our two Governments on 23 July 1965, as well as the Amending Protocols of 13 March 1986 and 18 December 2006, I have the honor to propose to Your Excellency, on behalf of the Government of the Federal Republic of Germany, the following Agreement concerning the project 'Climate Change and Transport in Costa Rica', within the framework of the International Climate Protection Initiative of the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety:
1. The Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica shall jointly promote the project 'Climate Change and Transport in Costa Rica', if after examination it proves eligible for support.
2. The objective of the project is to contribute to climate protection and to sustainable development in the Republic of Costa Rica, through the promotion of measures for the mitigation of greenhouse gases.
3. The Government of the Federal Republic of Germany shall provide human resources and shall make material contributions and, where appropriate, financial contributions for the project, up to a total amount of 3,500,000 euros (in words: three million five hundred thousand euros).
It shall entrust the implementation to the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.
4. On the part of the Government of the Republic of Costa Rica, the Ministry of Environment and Energy shall be responsible for the implementation of the project.
5. The details of the project and of the respective contributions and obligations shall be set forth in an implementing contract and, where appropriate, a financing contract, which shall be concluded between the GIZ and the institution to which the Government of the Republic of Costa Rica entrusts the implementation of the project and which shall be subject to the legal provisions in force in the Federal Republic of Germany.
6. The commitment of the Government of the Federal Republic of Germany to the project shall cease to have effect if the implementing contract and, where appropriate, financing contract mentioned in paragraph 5 are not concluded within a period of four years counted from the year of entry into force of this Agreement. For the amount in question, the period shall expire on 31 December 2021.
7. The Government of the Republic of Costa Rica shall exempt the materials, vehicles, goods, and equipment imported for the project by order and at the expense of the Government of the Federal Republic of Germany, as well as the respective spare parts used for the project mentioned in paragraph 1, from all import and export duties, as well as licenses, port fees, storage charges, and other public levies, and shall ensure that they clear customs without delay.
8. The Government of the Republic of Costa Rica shall exempt the GIZ from all direct taxes accruing in the Republic of Costa Rica in connection with the conclusion and execution of the implementing contract and, where appropriate, financing contract mentioned in paragraph 5.
9. The Government of the Republic of Costa Rica shall reimburse at the request of the GIZ the value added tax or other similar indirect taxes that have been applied in the Republic of Costa Rica on objects acquired and services used in connection with the conclusion and execution of the implementing contract and, where appropriate, financing contract mentioned in paragraph 5. Special consumption taxes that have been applied in this context shall be borne by the Government of the Republic of Costa Rica following a request.
10. In other respects, the provisions of the Convention concerning Technical Cooperation of 23 July 1965 and of the Amending Protocols of 13 March 1986 and 18 December 2006 mentioned at the beginning shall also apply to this Agreement.
11. This Agreement is concluded in German and Spanish, both texts being equally authentic.
If the Government of the Republic of Costa Rica declares itself in agreement with the proposals contained in paragraphs 1 to 11, this Note and the Note in reply from Your Excellency stating your Government's agreement shall constitute an Agreement between our Governments that shall enter into force on the date of your Note in reply.
I take this opportunity to reiterate to Your Excellency, Mr. González Sanz, the assurance of my highest and most distinguished consideration." In this regard, I have the honor to inform you that the foregoing proposal is acceptable to the Government of the Republic of Costa Rica and that Your Excellency's Note and this present Note constitute an Agreement between our Governments, with the proviso that it shall enter into force on the day on which the Government of the Republic of Costa Rica has notified the Government of the Federal Republic of Germany, through diplomatic channels, of the fulfillment of the domestic requirements necessary for the entry into force of this Exchange of Notes.
