across the entirety of the text - Full Text of Regulation 290 List of species of fishing and aquaculture interest that are found in Appendices I, II and III of the CITES Convention Full Text of act: 119A41 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/290-2017.-Puntarenas, on the thirteenth day of July, two thousand and seventeen.
I.-That the Executive Branch, in accordance with the powers established in Articles 11 and 140 of the Political Constitution of the Republic of Costa Rica and pursuant to Articles 1, 4, 6, 7, 8, 9, 10, 11, 26, 27 and 113 of the General Law of Public Administration No. 6227, exercising its Regulatory Powers, its Steering authority, and its concomitant Prerogative of Modification, proceeded to issue Executive Decree No. 40379-MINAE-MAG, duly published in the Official Gazette La Gaceta, in its Supplement No. 96, on Thursday, May 4, 2017, amending Article 1 of Executive Decree No. 39489-MINAE, regarding the Administrative Authority and Scientific Authorities of the International Convention on Trade in Endangered Species of Wild Flora and Fauna (CITES).
II.-That by means of the Executive Decree referenced in the preceding considering, the Executive Branch, in inter-institutional coordination between the ministerial portfolios of Environment and Energy and Agriculture and Livestock, formally proceeded to define new CITES Administrative and Scientific Authorities, under the terms indicated, requiring, by the normative imperative of the transitory norms contained therein, the regulation of the activity of the new Administrative Authority, which shall fall as material and functional competence to the Ministry of Agriculture and Livestock (MAG), and the new Scientific Authority, designating the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), in this case, solely for fishery and aquaculture species considered of commercial interest, as established in Article 2: ".Designate the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) as the Scientific Authority, in accordance with the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES Convention), ratified by Law No. 5605, Article 1 of the Wildlife Conservation Law No. 7317, and Laws No. 7384 and No. 8436, solely in relation to those species of fishing and aquaculture interest that are found in Appendices I, II and III of the CITES Convention. INCOPESCA must define internally within its organization the department or competent instance that will be responsible for exercising the functions of the Scientific Authority..."; in turn, it will define the communication channels and coordination mechanisms to be established with the Administrative Authority.
III.-In accordance with Transitory Provision III of the cited regulation, the Executive Branch explicitly established: ".It shall be the responsibility of the Costa Rican Institute of Fisheries and Aquaculture to establish, by executive agreement, the functions as the new CITES-Costa Rica scientific authority, the department and/or person who will hold said designation and its term, the coordination with the Administrative Authority and other public or academic institutions, when deemed necessary for the preparation of its recommendations, and the list of fishery and aquaculture species considered of commercial interest, among others, within the following thirty days after the publication of this decree.".
IV.-That INCOPESCA must then dedicate itself to faithfully and accurately complying with the mandate of the Executive Branch (Transitory Provision III) and to this end, determines the following list as the CITES Scientific Authority Costa Rica, for which the Board of Directors, Therefore,
1º-To approve the following list as the CITES Scientific Authority Costa Rica, solely in relation to those species of fishing and aquaculture interest that are found in Appendices I, II and III of the CITES Convention.

en la totalidad del texto - Texto Completo Norma 290 Lista de especies de interés pesquero y acuícola, que se encuentren en los Apéndices I, II y III de la Convención CITES Texto Completo acta: 119A41 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/290-2017.-Puntarenas, a los trece días del mes de julio de dos mil diecisiete.
I.-Que el Poder Ejecutivo, de conformidad con las facultades establecidas en los artículos 11 y 140 de la Constitución Política de la República de Costa Rica y en apego a los artículos 1, 4, 6, 7, 8, 9, 10, 11, 26, 27 y 113, de la Ley General de la Administración Pública N° 6227, ejerciendo sus Potestades Reglamentarias, de Rectoría y su concomitante Prerrogativa de Modificación, procedió a emitir el Decreto Ejecutivo N°40379-MINAE-MAG, debidamente publicado en el Diario Oficial La Gaceta, en su Alcance N° 96, del jueves 04 de mayo del 2017, reformando el artículo 1 del Decreto Ejecutivo N° 39489-MINAE, sobre la Autoridad Administrativa y Autoridades Científicas de la Convención Internacional para el Comercio de Especies Amenazadas de Flora y Fauna Silvestres (CITES).
II.-Que mediante el Decreto Ejecutivo en referencia considerativa anterior, el Poder Ejecutivo, en coordinación inter institucional entre las carteras ministeriales de Ambiente y Energía y Agricultura y Ganadería, formalmente procedieron a definir nuevas Autoridades Administrativas y Científicas CITES, en los términos que se indicaran, debiéndose por la imperatividad normativa de las normas transitorias que lo contienen, regular la actividad de la nueva Autoridad Administrativa que recaerá, como competencia material y funcional en el Ministerio de Agricultura y Ganadería (MAG) y la nueva Autoridad Científica, designándose al Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), en este caso, únicamente para especies pesqueras y acuícolas consideradas de interés comercial, tal y como lo establece el artículo 2: ".Desígnese al Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) como la Autoridad Científica, de conformidad con la Convención sobre el Comercio Internacional de Especies Amenazadas de Fauna y Flora Silvestres (Convención CITES), ratificada mediante Ley N° 5605, el artículo 1 de la Ley de Conservación de la Vida Silvestre, N° 7317, así como las Leyes N° 7384 y N° 8436, únicamente en relación con aquellas especies de interés pesquero y acuícola, que se encuentren en los Apéndices I, II y III de la Convención CITES. El INCOPESCA deberá definir a lo interno de su organización, la dependencia o instancia competente que se encargará de ejercer las funciones de la Autoridad Científica..."; a su vez, definirá los canales de comunicación y los mecanismos de coordinación que se establecerán con la Autoridad Administrativa.
III.-De conformidad con el Transitorio III, de la normativa en cita, se estableció explícitamente por el Poder Ejecutivo: ". Corresponderá al Instituto Costarricense de Pesca y Acuicultura establecer mediante acuerdo ejecutivo, las funciones como nueva autoridad científica CITES-Costa Rica, la dependencia y/o persona que ostentará dicha designación y su plazo, la coordinación con la Autoridad Administrativa y otras instituciones públicas o de la academia, cuando lo considere necesario para la elaboración de sus recomendaciones y el listado de especies pesqueras y acuícolas consideradas de interés comercial, entre otras, dentro de los siguientes treinta días posteriores a la publicación del presente decreto.".
IV.-Que el INCOPESCA debe entonces avocarse a dar fiel y exacto cumplimiento al mandato del Poder Ejecutivo (Transitorio III) y para ello, determina la siguiente lista como Autoridad Científica Cites Costa Rica, por lo que la Junta Directiva, Por tanto, ACUERDA:
1º-Aprobar la siguiente lista como Autoridad Científica Cites Costa Rica, únicamente en relación con aquellas especies de interés pesquero y acuícola, que se encuentren en los Apéndices I, II y III de la Convención CITES.
Nota: Actualmente no se tiene ninguna especie en el Apéndice III.
2º-La Lista de Especies Pesqueras y Acuícolas de Interés Pesquero que antecede, no implica un ".numerus clausus."; sino por el contrario, un ".numerus apertus.", por cuanto dependiendo de la especie fáctico jurídico de que se trate, así podrán ingresar especies no contempladas originalmente o salir alguna de esta lista.
3º-Para el caso de algunos mamíferos, tortugas y aves marinas, que no necesariamente son de interés pesquero, pero interactúan con otras especies de interés pesquero comercial, las gestiones para su conservación deben realizarse de manera conjunta entre el Incopesca y el MINAE.
4º-Acuerdo Firme.
5º-Rige a partir de su publicación en el Diario Oficial La Gaceta.
