throughout the entire text - Complete Text of Norm 40478 Repeals executive decree "Declares of Public Utility the Association called National Biodiversity Institute" Complete Text of record: 118D57 No. 40478-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Associations Law No. 218 of August 8, 1939, and articles 27 and following of the Regulations to the Associations Law, Executive Decree No. 29496-J, published in La Gaceta No. 96 of May 21, 2001, Executive Decree No. 38882-MCJ-MINAE-MAG-MICITT of February 24, 2015, published in La Gaceta No. 61 of March 27, 2015, and article 135 of the General Public Administration Law, Law No. 6227 of May 2, 1978.
I.-Article 32 of the Associations Law No. 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated, or confederated associations whose development and activities are particularly useful for the interests of the State, and which thereby contribute to solving a social need.
II.-The Association National Biodiversity Institute, legal identification number No. 3-002-103261, was registered in the Registry of Associations of the Public Registry since August 6, 1989, under the filing references in volume 374, entry 13205, expediente No. 3306.
III.-The entity was declared of public utility by Executive Decree No. 25598-J of October 21, 1996, published in the Official Gazette La Gaceta No. 218 of November 13, 1996.
IV.-In accordance with the provisions of Executive Decree No. 38882-MCJ-MINAE-MAG-MICITT of February 24, 2015, published in the Official Gazette La Gaceta No. 61 of March 27, 2015, it was agreed to deliver to the National Museum of Costa Rica the ex situ biological collection held by the association National Biodiversity Institute.
V.-In accordance with the agreement for the transfer, advice, and support of the INbio biodiversity collection to the Costa Rican State, signed by the Ministers of Agriculture, Culture, Environment, Science and Technology and the president of the association, on May 6, 2014, the transfer of the collection to the National Museum was carried out.
VI.-Upon carrying out the transfer of the ex situ biological collection that the Association National Biodiversity Institute possessed to the State, it ceased to fulfill the reasons for which the public utility status was granted.
VII.-Once the administrative file of the Association National Biodiversity Institute was reviewed, it was determined that the purpose for which the public utility benefit had been granted no longer exists, and that, furthermore, it is not current with the submission of the annual management reports for the years 2015 and 2016. I.-El artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-La Asociación Instituto Nacional de Biodiversidad, cédula de persona jurídica Nº 3-002-103261, se inscribió en el Registro de Asociaciones del Registro Público desde el día 6 de agosto de 1989, bajo las citas de presentación al tomo 374, asiento 13205, expediente N° 3306.
III.-La entidad fue declarada de utilidad pública mediante el Decreto Ejecutivo N° 25598-J del 21 de octubre de 1996, publicado en el Diario Oficial La Gaceta N° 218 del 13 de noviembre de 1996.
IV.-De conformidad con lo establecido en el decreto Ejecutivo N° 38882-MCJ-MINAE-MAG-MICITT del 24 de febrero del 2015, publicado en el Diario Oficial La Gaceta Nº 61 del 27 de marzo del 2015, se acordó entregar al Museo Nacional de Costa Rica, la colección biológica ex sita custodiada por la asociación Instituto Nacional de Biodiversidad.
V.-De conformidad con el acuerdo de traslado, asesoría y apoyo de la colección de biodiversidad del INbio al Estado costarricense, suscrito por los Ministros de Agricultura, Cultura, Ambiente, Ciencia y Tecnología y el presidente de la asociación, el día 6 de mayo del 2014, se procedió al traslado de la colección al Museo Nacional.
VI.-Al llevarse a cabo el traslado de la colección biológica ex situ que poseía la Asociación Instituto Nacional de Biodiversidad al Estado, dejó de cumplir con los motivos por los cuales le fue otorgada la utilidad pública.
VII.-Una vez revisado el expediente administrativo de la Asociación Instituto Nacional de Biodiversidad se determinó, que el fin por el cual se le había otorgado el beneficio de utilidad pública ya no existe, y que, además no se encuentra al día con la presentación de los informes anuales de gestión, de los años 2015 y 2016.
