of the entire text - Full Text of Standard 02 Delimitation of the public zone of Playa Negra, Cahuita district, canton of Talamanca Full Text of record: 1182CA NATIONAL GEOGRAPHIC INSTITUTE TOPOGRAPHIC DEPARTMENT AND TERRITORY OBSERVATION MARITIME TERRESTRIAL ZONE Delimitation of the public zone of Playa Negra, Cahuita district, canton of Talamanca Notice No. 2017-02 Based on the powers conferred by Article 140 and Article 240, subsection 1, of General Public Administration Law No. 6227, and the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, and Law No. 6043 on the Maritime Terrestrial Zone, and Public Tender No. 2013LN-000010-00100 called "Delimitation of the public zone on the Caribbean coast of Costa Rica"

Considering:

8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget and sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical agency governing national cartography, responsible for the execution of the official Basic Map and the basic geographic description of the Republic of Costa Rica and for studies, research, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.

59, establishes it permanently and in representation of the State as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature originating from the works entrusted to it.

59, Article 62 of the Regulations to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulations states that "The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."

36642-MP-MOPT-MINAET "Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone" establishes, according to Article 18, that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may employ two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, in order to expedite delimitations and provide greater technical certainty to interested parties.

33797-MJ-MOPT, which, among other aspects, designates the National Geodetic Network Horizontal Reference CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in Article 11 that: "The National Geodetic Network Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public agency, person, or private national or foreign entity must be referenced."; while Article 7 indicates that "As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, through appropriate means, that information which has been officialized."

7841-P "Regulations to Law No. 6043 on the Maritime Terrestrial Zone", b) Executive Decree No. 33797-MJ-MOPT "Declares the official horizontal datum for Costa Rica as CR05, and its associated cartographic projection, CRTM05", and c) Executive Decree No. 36642-MP-MOPT-MINAET "Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone".

6227 states that "the administrative act shall produce its effect after it has been communicated to the administered party, except if it grants only rights, in which case it shall produce it from its adoption," a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the appropriate instrument for communicating acts of a general nature by stating: "General acts shall be communicated by publication and specific acts by notification." Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
