in the entirety of the text - Full Text of Standard 066 The institutions of the Transport and Infrastructure Sector must prepare the "Institutional Environmental Management Program" (Programa de Gestión Ambiental Institucional, PGAI) in accordance with Article 3 of the Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector Full Text of record: 117AD9 No. 066 -MOPT THE PRESIDENT OF THE REPUBLIC and THE MINISTER OF PUBLIC WORKS AND TRANSPORT Based on the powers conferred in Articles 50 and 140 subsections 8) and 18) of the Political Constitution; Articles 25 subsection 1), 27 subsection 1), 28 subsection 2) subparagraph b), 99, and 100 of Law No. 6227 of May 2, 1978 and its amendments, General Law of Public Administration; Law No. 3155 of August 5, 1963 and its amendments, Law for the Creation of the Ministry of Public Works and Transport; Article 28 of Law No. 8839 of June 24, 2010, Law for Integrated Waste Management; Executive Decree No. 36499-S-MINAET of March 17, 2011, Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica; and Executive Decree No. 38536-MP-PLAN of July 25, 2014, Organic Regulation of the Executive Branch.
1st- That according to the provisions of Article 5 subsection i) of the Organic Regulation of the Executive Branch (Executive Decree No. 38536-MP-PLAN), the Minister of Public Works and Transport is charged with the stewardship of the Transport and Infrastructure Sector, which, as established in Article 15 subsection i) of said Regulation, is composed of the Ministry of Public Works and Transport (MOPT), the Costa Rican Railway Institute (INCOFER), the Costa Rican Institute of Pacific Ports (INCOP), and the Board of Port Administration and Economic Development of the Atlantic Slope (JAPDEVA).
2nd- That subsection a) of Article 6 of the cited Executive Decree No. 38536-MP-PLAN establishes that it is the responsibility of the Minister with sector stewardship to: "Direct and coordinate the respective sector"; furthermore, according to the provisions of subsection g) of the cited article, the Minister is responsible for "Promoting the effectiveness of the management of the institutions of the sector and their accountability".
3rd- That through Official Letter No. DM-3862-06 of July 10, 2006, the Ministry of Public Works and Transport requested the institutions that comprise the sector to coordinate with the Sectoral Planning Directorate all matters related to the National Development Plan, institutional operational plans, and all issues related to the actions of the Transport Sector.
4th- That in Guideline No. 5527-10 issued by the Minister of Public Works and Transport, published in Supplement No. 29 to La Gaceta No. 224 of November 18, 2010, it is established that the institutions comprising the Transport and Infrastructure Sector must respond to the agreements of the Sectoral Council and to the general political direction guidelines issued by the Minister with sector stewardship.
5th- That through Executive Decree No. 39173 of July 9, 2015, the Sectoral Planning Secretariat was created as an advisory and technical support body to the Minister with stewardship of the Transport and Infrastructure Sector.
6th- That in accordance with the provisions of Article 50 of the Political Constitution, the State must strive for the greatest well-being of all the country's inhabitants, organizing and stimulating production and the most adequate distribution of wealth. Likewise, said provision establishes that the State must guarantee the right of individuals to a healthy and ecologically balanced environment.
7th- That the Law for Integrated Waste Management No. 8839 establishes in its Article 28 that the institutions of the Public Administration shall implement environmental management systems in all their departments, as well as training programs for environmental performance in the provision of public services and the development of consumption habits and proper management that will have the objective of preventing and minimizing waste generation.
8th- That in accordance with the provisions of Article 3 of the Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica, all institutions of the Public Administration shall implement an Institutional Environmental Management Program (PGAI).
9th- That according to the provisions of Article 7 of the Regulation for the Preparation of Institutional Environmental Management Programs in the Public Sector of Costa Rica, each institution of the Public Administration must form an institutional commission to prepare and implement its PGAI. Likewise, according to the provisions of said provision, a person responsible for coordinating the PGAI must be appointed.
10th- That in the National Development Plan 2015-2018 "Alberto Cañas Escalante", the Environment, Energy, Seas, and Land-Use Planning Sector incorporated the program for "Strengthening of Institutional Environmental Management Plans (PGAI) in improving efficiency in electrical energy consumption in the institutions with the highest electricity consumption in the public sector," whose objective is aimed at: "Improving the efficiency of electrical energy use in the public sector within the framework of the PGAI".
11th- That in accordance with the provisions of Article 1 of Guideline O 11-MINAE, published in La Gaceta No. 163 of August 26, 2014, it is the obligation of all institutions of the Public Administration to prepare and execute the Institutional Environmental Management Programs (PGAI) for the management of environmental quality, energy, and climate change; as well as the control and monitoring mechanisms. These programs shall contain, among other aspects, the regulations for the acquisition of equipment, luminaires, and fixtures with high energy efficiency requirements.
Therefore; They issue the following:

CONSIDERANADO:
11 °- Que de conformidad con lo dispuesto en el artículo 1 de la Directriz O 11-MINAE, publicada en La Gaceta No. 163 del 26 de agosto del 2014, es obligación de todas las instituciones de la Administración Pública elaborar y ejecutar los Programas de Gestión Ambiental Institucional (PGAI) para la gestión de la calidad ambiental, energía y cambio climático; así como los mecanismos de control y seguimiento. Estos programas contendrán, entre otros aspectos, las regulaciones para las adquisiciones de equipos, luminarias y artefactos con requerimientos de alta eficiencia energética.
Por tanto; Emiten la siguiente:

Asimismo se les recuerda la obligación de cumplir con lo dispuesto en el citado Reglamento, en todo lo relativo al citado Plan.
