REGULATION FOR THE TRANSPORT AND DISTRIBUTION OF DRINKING WATER IN TANKER TRUCKS
POR TANTO,
DECRETAN:
The objective of this regulation is to protect the health of the population by regulating the transport and distribution of drinking water (agua potable), thus ensuring its safety through sanitary controls (control sanitario) and surveillance (vigilancia). This regulation shall be of mandatory application throughout the national territory.
It is thus established that the surveillance of the quality of water transported and distributed by tanker trucks shall correspond to the Ministry of Health, hereinafter referred to as the Ministry, and the sanitary control to the companies and institutions providing the service, which shall be subject to the provisions of this regulation.
For the purposes of this regulation, the following definitions are established:
Any individual or legal entity using tanker trucks for the transport and distribution of drinking water must hold the Sanitary Operating Permit; likewise, each unit used for that activity must hold the respective Sanitary Authorization, granted by the corresponding Área Rectora de Salud, in accordance with Executive Decree No. 39472 of January 18, 2016, published in the Official Gazette La Gaceta No. 26, Digital Supplement No. 13 of February 8, 2016, "Reglamento General para Autorizaciones y Permisos Sanitarios de Funcionamiento otorgados por el Ministerio de Salud."
Every operating entity that supplies water to the service-providing entity for water supply via tanker trucks must guarantee its potability in accordance with Executive Decree No. 38924-S of January 12, 2015, published in the Official Gazette La Gaceta No. 170 of September 1, 2015, "Reglamento para la Calidad del Agua Potable". For the sanitary authorization of each drinking water transport unit, the applicant must comply with the following:
The signing of the sworn statement (declaración jurada), Annex I to this regulation, shall be proof that the Regulated Party knows the provisions of this subsection and that the materials do not represent a risk to health or to the potability of the water, and must declare the construction material of the tank.
Compliance with the prior conditions cited in this article shall be declared by the interested party under oath, in a document that shall be presented to the Ministry of Health, contained in the Annex to this regulation. In said declaration, the interested person must also state that they know and comply with all current specific regulations applicable to their establishment.
The Ministry of Health must resolve this procedure within a period of 10 business days, indicating in the sanitary authorization official notice the particulars of each tanker unit. These authorizations shall be issued for periods of one year and the regulated party must request renewal at the end of this period. The Dirección de Área Rectora de Salud, according to its monitoring schedule, shall carry out inspections after the granting of the authorization, to corroborate the prior conditions established in this article.
Once the tanker units are authorized, the authorized entity must inform all the Áreas Rectoras de Salud where it provides the service, by means of a copy of the Sanitary Authorization, issued by the Área Rectora de Salud where the Sanitary Operating Permit was issued.
The Área Rectora de Salud, according to the monitoring program, and in coordination with the Dirección de Protección al Ambiente Humano, shall proceed to take samples for bacteriological and physicochemical analyses, in addition to measuring the free residual chlorine with its own means. The results must comply with the alert and maximum permissible values in accordance with the "Reglamento para la Calidad del Agua Potable", Executive Decree No. 38924-S of January 12, 2015, and published in the Official Gazette La Gaceta No. 170 of September 1, 2015.
i. Name of the service-providing company.
ii. Filling capacity of the tank in liters.
iii. Date, time, place, and volume of the tank's filling.
iv. Concentration of free residual chlorine measured at the filling site.
v. Destination location for water distribution.
vi. Date of the last cleaning and disinfection of the tank.
vii. Record of the concentration of free residual chlorine measured at the discharge site prior to the start of distribution.

1.- Que el Ministerio de Salud tiene como misión garantizar la protección y mejoramiento del estado de salud y bienestar de la población, mediante el ejercicio efectivo de la rectoría y el liderazgo institucional con enfoque de promoción de la salud y participación social, bajo los principios de transparencia, equidad, solidaridad y universalidad.
2.- Que conforme a las disposiciones legales contenidas en el artículo primero de la Ley General de Salud, la salud de la población, es un bien de interés público.
3.- Que el Estado, a través del Ministerio de Salud, tiene la responsabilidad de garantizar la salud a toda la población y defenderá ese derecho, sin que se obstaculicen las condiciones de competitividad para el desarrollo del país, manteniendo un equilibrio entre las regulaciones socioeconómicas y de salud, velando siempre por la satisfacción del interés público.
4.- Que las entidades públicas y privadas que brinden el servicio de transporte de agua para consumo humano en camiones cisterna deben cumplir con estrictos estándares sanitarios para proteger la salud pública, y que a la fecha el Estado no ha normado dicha actividad.
5.- Que de conformidad con lo establecido en el artículo 12 bis del Decreto Ejecutivo No. 37045 del 22 de febrero de 2012 y su reforma "Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos", esta regulación cumple con los principios de mejora regulatoria, de acuerdo con el informe No. DMR-DAR-INF-005-17 de fecha 02 de febrero de 2017, emitido por la Dirección de Mejora Regulatoria del Ministerio de Economía, Industria y Comercio.
REGLAMENTO PARA EL TRANSPORTE Y DISTRIBUCION DE AGUA POTABLE EN CAMIONES CISTERNA
CONSIDERANDO:
POR TANTO,
DECRETAN:
El presente reglamento tiene por objetivo velar por la salud de la población, mediante la regulación del transporte y distribución del agua potable, asegurando así su inocuidad por medio del control sanitario y la vigilancia. Este reglamento será de aplicación obligatoria en todo el territorio nacional.
Se establece así que la vigilancia de la calidad del agua transportada y distribuida por los camiones cisterna, corresponderá al Ministerio de Salud, en adelante denominado Ministerio, y a las empresas e instituciones prestatarias del servicio el control sanitario, las cuales se sujetarán a lo establecido en este reglamento.
Para efectos del presente reglamento se establecen las siguientes definiciones:
Toda persona física o jurídica que utilice camiones cisterna para el transporte y distribución de agua potable deberá contar con el Permiso Sanitario de Funcionamiento; asimismo, cada unidad utilizada para esa acción deberá contar con la Autorización Sanitaria respectiva, otorgada por el Área Rectora de Salud correspondiente, de conformidad con el Decreto Ejecutivo No. 39472 del 18 de enero de 2016 publicado en el Diario Oficial La Gaceta No. 26 al Alcance Digital No. 13 del 08 de febrero de 2016 "Reglamento General para Autorizaciones y Permisos Sanitarios de Funcionamiento otorgados por el Ministerio de Salud."
Todo ente operador que provee agua a la entidad prestataria del servicio de suministro de agua mediante camiones cisterna, deberá garantizar la potabilidad de la misma conforme al Decreto Ejecutivo No. 38924-S del 12 de enero de 2015, publicado en el Diario Oficial La Gaceta No. 170 del 1 ° de setiembre de 2015 "Reglamento para la Calidad del Agua Potable". Para la autorización sanitaria de cada unidad de transporte de agua potable, el solicitante deberá cumplir con lo siguiente:
La firma de la declaración jurada, Anexo I al presente reglamento, será prueba que el Administrado conoce lo normado en el presente inciso y que los materiales no representan riesgo para la salud o para la potabilidad del agua, debiendo declarar el material de construcción de la cisterna.
El cumplimiento de las condiciones previas citadas en el presente artículo será declarado por el interesado bajo fe de juramento, en documento que será presentado ante el Ministerio de Salud, contenido en el Anexo al presente reglamento. En dicha declaración, la persona interesada deberá también manifestar que conoce y cumple todas las regulaciones específicas vigentes aplicables a su establecimiento.
El Ministerio de Salud deberá resolver dicho trámite en un plazo de 10 días hábiles, indicando en el oficio de autorización sanitaria las calidades de cada unidad cisterna. Estas autorizaciones se extenderán por períodos de un año y el administrado deberá solicitar la renovación al término de este plazo. La Dirección de Área Rectora de Salud, según programación de monitoreo, hará las inspecciones posterior al otorgamiento de la autorización, para corroborar las condiciones previas establecidas en el presente artículo.
Una vez autorizadas las unidades cisterna, el ente autorizado deberá informar a todas las Áreas Rectoras de Salud en donde suministre el servicio, mediante copia de la Autorización Sanitaria, emitida por el Área Rectora de Salud donde fue emitido el Permiso Sanitario de Funcionamiento.
El Área Rectora de Salud, según programa de monitoreo, y en coordinación con la Dirección de Protección al Ambiente Humano, procederá a la toma de muestras para análisis bacteriológicos y fisicoquímicos, además de realizar con medios propios la medición del cloro residual libre. Los resultados deberán cumplir con los valores de alerta y máximos admisibles conforme al "Reglamento para la Calidad del Agua Potable", Decreto Ejecutivo No. 38924-S del 12 de enero de 2015, y publicado en el Diario Oficial La Gaceta No. 170 del 1 ° de setiembre de 2015.

Transitorio único. Se concede un plazo de un año a partir de la publicación de este reglamento, para el cumplimiento del inciso b) del artículo 4° .
Dado en la Presidencia de la República, San José, a los treinta días del mes de enero de dos mil diecisiete.
Todas pertenecientes a este servidor o a mi representada, para lo cual declaro bajo fe de juramento y que de no decir la verdad incurro en perjurio sancionado con pena de prisión según el Código Penal y consciente de la importancia de lo aquí anotado, lo siguiente:
l. Conozco el contenido del REGLAMENTO PARA EL TRANSPORTE Y DlSTRIBUCION DE AGUA POTABLE EN CAMIONES CISTERNA, y cumplo con los requisitos establecidos en los artículos 4 y 6, emitido por el Ministerio de Salud.
2. Cumplo con los reqms1tos de la Ley No. 9078 del 26 de octubre de 2012, LEY DE TRÁNSITO POR VÍAS PÚBLICAS TERRESTRES Y SEGURIDAD VIAL y sus reglamentos.
3. Las unidades distribuyen agua que cumple con la calidad de agua para consumo humano establecida en el Decreto Ejecutivo No. 38924-S del 12 de enero de 2015, publicado en el Diario Oficial La Gaceta No. 170 del 1 ° de setiembre de 2015 "Reglamento para la Calidad del Agua Potable".
Nota: El propietario de los camiones cisternas (persona física) o el representante legal (de la persona jurídica) es responsable de infonnar a todas las Áreas Rectoras de Salud en donde suministre el servicio de distribución de agua potable, mediante entrega de copia de la Autorización Sanitaria emitida por el Área Rectora de Salud donde se ubique la empresa distribuidora (donde fue emitido el Permiso Sanitario de Funcionamiento).
