in the entirety of the text - Full Text of Norm 166 Regulation for the fulfillment of community work service by the fisherman registered in the closed season COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE (This norm was left without effect by agreement No. AJDIP/094-2024 of April 16, 2024, "Establishes a total closed season for fishing from May 1 to July 31, 2024, from Punta Torres known as Peñón to the Faro de la Isla Negritos, from there to the eastern part of Punta Cuchillos on the Nicoya Peninsula, and from there to the mouth of the Tempisque River in the Gulf of Nicoya," while the closed season period is in effect) (This norm was left without effect by agreement No. AJDIP/071-2022 of March 23, 2022, "Approves a closed season for fishing extending from May 1 to July 31, 2022." THE BOARD OF DIRECTORS OF INCOPESCA AGREES:
Regulation for the Fulfillment of Community Work Service by the Fisherman Registered in the Closed Season
8436, Fisheries and Aquaculture Law.
Cleaning and collection of garbage, waste, or any other contaminating material on beaches, estuaries, and river mouths.
Reforestation of public areas.
Carrying out construction, maintenance, and repair works on roads, various community infrastructures, cemeteries, aqueducts, and others.
Participating in workshops, courses, and other training, outreach, and information activities related to fishing activity or of evident public interest, given by INCOPESCA or by any Public Institution or Non-Governmental Organization, always duly coordinated with INCOPESCA.
Any type of social or community welfare activity in charitable institutions such as nursing homes, children's shelters and soup kitchens, as well as public entities, educational, religious, cultural centers, Non-Governmental Organizations, social organizations, and others.
Participating in cleanup campaigns promoted by community organizations and/or Public Entities with the objective of reducing the negative effects of diseases.
To fulfill the STC in accordance with the activities defined above, fishermen must complete a minimum of 30 effective monthly hours, within which time used by fishermen for rest or meals shall not be counted; the STC shall be carried out on business days.
It shall be the responsibility of the fishermen's organizations with current legal status and duly accredited before INCOPESCA and/or the different entities or institutions benefiting from the STC of the corresponding fishing community, to provide the goods, resources, materials, equipment, and any other necessary logistical support and the respective verification or supervision of the fulfillment of the STC.
9.1. Attendance at judicial proceedings, Medical Opinions (in the latter, indicating that the fisherman cannot perform physical activities), Disabilities, and Medical Attendance Checks, in this last case, personal or to accompany minors or older adults under the care of the interested party, issued in all cases described by an authority of the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social, CCSS).
9.2. Medical Opinions, Disabilities, Medical Attendance, and justifications for participating in training sessions (courses, workshops, etc.) shall only be permitted if they are issued or provided by a public entity; prior to their occurrence, they must be assessed and approved by the National Closed Season Commission (Comisión Nacional de Vedas) of INCOPESCA.
9.3. During supervisions carried out by INCOPESCA or IMAS, when the fisherman is not present during the hours he previously scheduled for the fulfillment of his Community Work Service, it shall be interpreted as an absence unless the interested party presents a justification that meets the provisions established in the preceding paragraphs.
9.4. Any other type of justification different from those indicated above must be analyzed by the National Closed Season Commission (Comisión Nacional de Vedas), which in turn shall have the authority to order the interested party to complete the unfulfilled hours.
The fisherman may not be represented by a third party for the fulfillment of effective hours of STC.
The legal representative of the fishing organization shall submit the form called Delivery List of Fishermen with STC in Closed Season along with the STC Control Report forms, to the Protection and Registration Department (Departamento de Protección y Registro) or the Regional Office of INCOPESCA in the territory of the jurisdiction of the closed season area.
The fisherman who carries out fishing activities in the closed season area and who is in the closed season process shall also be immediately subject to the suspension of the temporary aids by IMAS, according to the communication from the Legal Advisory Departments (Asesorías Legales) of INCOPESCA, the National Coast Guard Service, and the Prosecutor's Office on duty.

Ayuda Social (IMAS) a otorgar una ayuda temporal a los pescadores y ayudantes que cumplan con las condiciones definidas en los decretos de referencia.
LA JUNTA DIRECTIVA DE INCOPESCA ACUERDA:
Regulación para el cumplimiento del Servicio de Trabajo Comunal por parte del pescador inscrito en Veda
Limpieza y recolección de basura, desechos o cualquier otro material contaminante en playas, esteros y desembocaduras de los ríos.
Reforestación de áreas públicas.
Realizar obras de construcción, mantenimiento y reparación de caminos, infraestructuras comunales diversas, cementerios, acueductos y otros.
Participar en talleres, cursos, y otras actividades de capacitación, divulgación e información afines con la actividad pesquera o de evidente interés público, impartidos por el INCOPESCA o por cualquier Institución Pública u Organización No Gubernamental, siempre debidamente coordinada con el INCOPESCA.
Cualquier tipo de actividad de bien social o comunal en instituciones de carácter benéfico como asilos de adultos mayores, hogares y comedores infantiles, así como entidades públicas, centros educativos, religiosos, culturales, Organizaciones No Gubernamentales, sociales y otros.
Participar en campañas de limpieza impulsadas por las organizaciones de las comunidades y/o Entes Públicos con el objetivo de disminuir los efectos negativos de enfermedades.
Para cumplir con el STC de conformidad con las actividades anteriormente definidas, los pescadores, deberán efectuar un mínimo de 30 horas mensuales efectivas y dentro de las cuales no se tomará en cuenta los tiempos utilizados por los pescadores para descansos o comidas, el STC se realizará en días hábiles.
Corresponderá a las organizaciones de pescadores con personería vigente y debidamente acreditadas ante el INCOPESCA y/o a los diferentes entes o instituciones que se vean beneficiadas con el STC de la comunidad pesquera correspondiente, aportar los bienes, recursos, materiales, equipos y cualquier otro apoyo logístico necesario y la respectiva verificación o supervisión sobre el cumplimiento del STC.
9.1. Asistencias a procesos judiciales, los Dictámenes Médicos (en los últimos que indique que el pescador no puede realizar actividades físicas), Incapacidades y Control de Asistencia Médica, en este último caso, personal o por acompañamiento a menores de edad o adultos mayores que estén bajo el cargo del interesado, emitidos en todos los casos descritos por una autoridad de la Caja Costarricense de Seguro Social (CCSS).
9.2. Los Dictámenes Médicos, Incapacidades, Asistencia Médica y las justificaciones para participar en capacitaciones (cursos, talleres, etcétera), únicamente serán permitidos las que sean emitidas o impartidas por una entidad pública, de previo a su realización deberá ser valorada y aprobadas por la Comisión Nacional de Vedas del INCOPESCA.
9.3. En las supervisiones realizadas por el INCOPESCA o por el IMAS cuando el pescador no se encuentre en las horas que previamente programó, para el cumplimiento de su Servicio de Trabajo Comunal, se interpretará como ausente salvo que el interesado presente una justificación que cumpla con las disposiciones establecidas en los párrafos anteriores.
9.4. Cualquier otro tipo de justificación diferente a las indicadas anteriormente, deberá ser analizada por la Comisión Nacional de Vedas, misma que a su vez tendrá la facultad de ordenarle al interesado la realización de las horas no cumplidas.
El pescador no podrá hacerse representar por una tercera persona para el cumplimiento de horas efectivas de STC.
El representante legal de la organización pesquera presentará el formulario denominado Listado de Entrega de Pescador con STC en Veda con los formularios de Informe de Control del STC, en el Departamento de Protección y Registro o en la Oficina Regional del INCOPESCA del territorio de la jurisdicción del área de veda.
El pescador que realice las actividades de pesca en el área de veda y que esté en el proceso de veda, también será sujeto de forma inmediata de la suspensión de las ayudas temporales por parte del IMAS, de acuerdo con la comunicación de las Asesorías Legales del INCOPESCA, del Servicio Nacional de Guardacostas y la Fiscalía de turno.
