Amendment of the Minimum Landing Size for Silky SharkReforma de la TLPC del Tiburón Gris o Sedoso

in the entirety of the text - Full Text of Regulation 142 Amendment AJDIP-105-2017 regarding the minimum legal catch size (talla legal de primera captura, TLPC) for the dusky or silky shark COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/-142-2017.-Puntarenas, on the fourteenth day of April, two thousand seventeen.

1. 1That INCOPESCA, as the Executing Authority of Law No. 8436, the Fisheries and Aquaculture Law, is responsible for determining prohibited fishing methods, techniques, and gear, as well as exercising control over national and foreign vessels engaged in fishing and establishing, in accordance with technical, scientific, economic, and social criteria, management and regulation measures, whether by area or by specific species.
2. 2That on 24-02-17, the Board of Directors of Incopesca approved AJDIP-102-2017, by which the minimum legal catch sizes (tallas legales de primera captura, TLPC) are established in response to the sizes at first sexual maturity and in accordance with the recommendations issued by the General Technical Directorate of Incopesca, providing within the same regulation all the technical and legal basis for establishing said sizes.
3. 3That on March 28, 2017, this Board of Directors received Official Letter DDI-024-03-17 from the Department of Research and Development of Incopesca, by which it informs this Board of Directors that the minimum legal catch size established for the dusky shark is not consistent with Resolution CIAT-C-16-06, dated 01-07-16, approved in turn by this Board of Directors through AJDIP-378-2016, and which is the technical basis for establishing the TLPC for the dusky or silky shark, Carcharhinus falciformis.
4. 4That Article 4 of AJDIP-378-16 establishes the following: "Any medium-scale or advanced fishing vessel engaged in multispecies fishing that has surface longline as authorized fishing gear, that is, those longlines on which the majority of hooks fish at depths of less than 100 meters, must limit the catch of silky sharks measuring less than 100 centimeters in total length to 20% of the total number of silky sharks caught during the trip. The 20% allowance for the catch of individuals measuring less than 100 centimeters shall be quantified from the completion of the fishing trip that they are undertaking at the time of the publication of this Agreement."
5. 5That AJDIP-102-2017 approved a TLPC of 100 cm of dorsal-precausal length, with a 20% tolerance margin on the TLPC, while Resolution CIAT-C-16-06 had approved the TLPC based on total length and the tolerance percentage is based on the number of individuals smaller than 100 cm in total length.
6. 5That having analyzed the opinion presented by biologist Mr. Marín, the Board of Directors of Incopesca

HEREBY AGREES:

1º-Let AJDIP-105-2017 be amended, only regarding the TLPC of the dusky or silky shark, establishing a TLPC of 100 cm total length, with a tolerance percentage of 20% of individuals with sizes smaller than 100 cm in reference to the total number of individual dusky sharks caught during the trip. For example, if a boat brings in 100 dusky sharks, only 20 of them may have sizes smaller than 100 cm total length.

2º-This shall take effect upon its publication in the Official Gazette La Gaceta.

3º-Unappealable Agreement

Whereas:

en la totalidad del texto - Texto Completo Norma 142 Reforma AJDIP-105-2017 en lo referente a la TLPC del tiburón gris o sedoso INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/-142-2017.-Puntarenas, a los catorce días del mes de abril dos mil diecisiete.

1. 1Que al INCOPESCA como Autoridad Ejecutora de la Ley N°8436, Ley de Pesca y Acuicultura, le corresponde determinar los métodos, las técnicas y las artes de pesca prohibidos, así como ejercer el control sobre las embarcaciones nacionales y extranjeras que se dediquen a la pesca y establecer, conforme criterios técnicos, científicos, económicos y sociales, las medidas de manejo y regulación, sea por áreas o por especies determinadas.
2. 2Que el 24-02-17, la Junta Directiva del Incopesca aprueba el AJDIP-102-2017, mediante el cual se establecen las tallas legales de primera captura (TLPC) respondiendo a las tallas de primera madurez sexual y de conformidad con las recomendaciones emanadas por la Dirección General Técnica de Incopesca, dándose en el mismo todo el fundamento técnico y legal para establecer dichas tallas.
3. 3Que el 28 de marzo de 2017, ésta Junta Directiva recibió el Oficio DDI-024-03-17 del Departamento de Investigación y Desarrollo del Incopesca, mediante el cual comunica a esta Junta Directiva, que la talla legal de primera captura establecida para tiburón gris, no es concordante con Resolución CIAT-C-16-06, del día 01-07-16, aprobada a su vez por esta Junta Directiva mediante AJDIP-378-2016 y que es el fundamento técnico para establecer la TLPC para el tiburón gris o sedoso Carcharhinus falciformis.
4. 4Que el artículo 4 del AJDIP-378-16 establece lo siguiente: "Toda embarcación pesquera de mediana escala o de avanzada, que realicen pesca multiespecífica y que tengan como arte de pesca autorizado el palangre de superficie o sea aquellos palangres en los que la mayoría de los anzuelos pescan a profundidades de menos de 100 metros, deberán limitar la captura de tiburones sedosos de menos de 100 centímetros de talla total al 20% del número total de tiburones sedosos capturados durante el viaje. El 20% de captura de individuos de menos de 100 centímetros permitidos, se cuantificará a partir de la finalización del viaje de pesca que se encuentren realizando al momento de la publicación del presente Acuerdo".
5. 5Que el AJDIP-102-2017 aprobó un TLPC de 100 cm de longitud dorsoprecaudal, con un 20% de tolerancia sobre la TLPC, mientras que la Resolución CIAT-C-16-06 había aprobado la TLPC basada en la longitud total y el porcentaje de tolerancia es basado en el número de individuos de talla menor a los 100 cm de longitud total.
6. 5Que habiéndose analizado el criterio presentado por el biólogo Marín, La Junta Directiva de Incopesca

ACUERDA:

1º-Modifíquese el AJDIP-105-2017, solo en lo referente a la TLPC del tiburón gris o sedoso, estableciéndose una TLPC de 100 cm de longitud total, con un porcentaje de tolerancia del 20% de individuos con tallas menores de 100 cm con referencia al número total de individuos de tiburón gris capturados durante el viaje. Como ejemplo, si un barco trae 100 tiburones gris, solo 20 de ellos podrán tener tallas menores a los 100 cm de longitud total.

2º-Rige a partir de su publicación en el Diario Oficial La Gaceta.
