in the entirety of the text - Full Text of Regulation 40302 Regulation for the Awarding of the National Medal for Agricultural Merit Full Text of acta: 1169FD No. 40302-MAG THE PRESIDENT OF THE REPUBLIC THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by Articles 33 and 140, subsections 3), 18), and 20), and Article 146 of the Political Constitution, Articles 25, 27, first subsection, 28, second paragraph, subsection b of Law No. 6227 of May 2, 1978, General Law of Public Administration, and the Law for the Promotion of Agricultural Production FODEA and Organic Law of the Ministry of Agriculture and Livestock, Law No. 7064 of April 29, 1987.
1. That by Executive Decree No. 8443-A of April 20, 1978, the award of the "National Medal for Agricultural Merit" was created, as public recognition to stimulate meritorious work carried out in the agricultural field.
2. That the Executive Branch considers it necessary to continue awarding this national public distinction, as gratitude and incentive for those who have distinguished themselves through their contributions to the development of agricultural activities.
3. That the procedures for awarding this distinction are the purview of the National Sectoral Agricultural Council (Consejo Nacional Sectorial Agropecuario, CAN), in accordance with the provisions of Article 33 of the Law for the Promotion of Agricultural Production FODEA and Organic Law of the Ministry of Agriculture and Livestock, Law No. 7064 of April 29, 1987.
4. That, in the international and national environment of the agricultural sector since the enactment of this award, significant changes have occurred, posing a new paradigm in agricultural production oriented towards sustainable intensification of production, with added value and social and environmental responsibility; whereby a rethinking of this regulation is required.
5. That, by final Resolution of the CAN, in its Session No. 09 of November 17, 2016, the repeal of Executive Decree No. 8443-A of April 20, 1978, was unanimously approved; and its replacement with one more in line with the global and national environment of Costa Rica's agricultural sector.
6. That the Cost-Benefit Evaluation Form, Section I, called Prior Control of Regulatory Improvement, was completed, with the result being negative and the proposal containing no procedures or requirements.
THEY DECREE:
REGULATION FOR THE AWARDING OF THE NATIONAL MEDAL FOR AGRICULTURAL MERIT
CONSIDERING
Therefore,
Nominations will not be accepted after the specified date. Subsequently, Sepsa shall forward to the Commission all documentation received from the nominees, for the purpose of initiating the selection process.
To this effect, the nominees distinguished with the award shall receive the medal and a parchment accrediting them as holders thereof.
8443-A of April 20, 1978, published in La Gaceta No. 90 of May 11, 1978, is hereby repealed.

en la totalidad del texto - Texto Completo Norma 40302 Reglamento para el otorgamiento de la medalla nacional al mérito agrícola Texto Completo acta: 1169FD Nº 40302-MAG EL PRESIDENTE DE LA REPÚBLICA EL MINISTRO DE AGRICULTURA Y GANADERÍA En uso de las facultades que les confieren los artículos 33 y 140 incisos 3), 18) y 20) y 146 de la Constitución Política, los artículos 25, 27 inciso primero, 28 párrafo segundo inciso b de la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública y la Ley de Fomento a la Producción Agropecuaria FODEA y Orgánica del Ministerio de Agricultura y Ganadería, Ley N° 7064 del 29 de abril de 1987.
1. Que mediante Decreto Ejecutivo N° 8443-A del 20 de abril de 1978, se creó el galardón de la "Medalla Nacional del Mérito Agrícola", como reconocimiento público para estimular las labores meritorias que se desarrollan en el campo agrícola.
2. Que el Poder Ejecutivo considera necesario continuar otorgando este galardón público nacional, como agradecimiento e incentivo para quienes se han distinguido por sus contribuciones, en pro del desarrollo de las actividades agrícolas.
3. Que los procedimientos para otorgar este galardón son potestad del Consejo Nacional Sectorial Agropecuario (CAN), de conformidad con lo establecido en el artículo 33 de Ley de Fomento a la Producción Agropecuaria FODEA y Orgánica del Ministerio de Agricultura y Ganadería, Ley N° 7064 del 29 de abril de 1987.
4. Que, en el entorno internacional y nacional del sector agropecuario, desde la promulgación de este galardón, se han presentado cambios significativos, que plantean un nuevo paradigma en la producción agrícola, orientada hacia una intensificación sostenible de la producción, con valor agregado, responsabilidad social y ambiental; por lo cual se requiere un replanteamiento de esta normativa.
5. Que, mediante Acuerdo en firme del CAN, en su Sesión N° 09 del día 17 del mes de noviembre de 2016, se aprobó por unanimidad la derogación del Decreto Ejecutivo N° 8443-A del 20 de abril de 1978; y sustituirlo por uno más acorde con el entorno mundial y nacional del sector agrícola de Costa Rica.
6. Que se procedió a llenar el Formulario de Evaluación Costo Beneficio, Sección I, denominada Control Previo de Mejora Regulatoria, siendo que el mismo dio un resultado negativo y la propuesta no contiene trámites ni requisitos.

CONSIDERANDO
Por tanto,
DECRETAN:
No se recibirán postulaciones después de la fecha señalada. Posteriormente Sepsa remitirá a la Comisión, toda la documentación recibida de los postulantes, con el propósito de que se inicie el proceso de selección.
Al efecto los postulantes distinguidos con el galardón recibirán la medalla y un pergamino que los acreditan como poseedores de la misma.
Dado en la Presidencia de la República. -San José a los veintiocho días del mes de febrero del año dos mil diecisiete.
