throughout the entirety of the text - Full Text of Regulation 40301 Declares the country free of Velogenic Newcastle disease Full Text file: 116473 N° 40301-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Exercising the powers conferred by articles 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, articles 25, 27.1, 28.2b of Law N° 6227 of May 2, 1978, General Law of Public Administration, Law N° 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and Law N° 8495 of April 6, 2006, General Law of the National Animal Health Service.

1. 1That Velogenic Newcastle disease is an infectious-contagious condition specific to birds, caused by a virus of the family: Paramyxoviridae, and is one of the diseases with the highest morbidity and mortality rates, causing substantial economic losses and threatening food security by producing a lower availability of animal-origin protein with high nutritional value and easy accessibility.
2. 2That by Executive Decree N° 25088-MAG of March 25, 1996, published in the Official Gazette La Gaceta N° 80 of April 24, 1996, the entire national territory of the Republic of Costa Rica was declared free of Velogenic Newcastle disease so that chicken meat and its derivatives could be exported to other countries free of said disease.
3. 3That on April 22, 2015, a high mortality rate in backyard birds in the town of Bella Vista de Santa Cecilia in the Canton of La Cruz was reported and notified to the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA) of the Ministry of Agriculture and Livestock, and that, after the consequent epidemiological investigation was carried out, on April 26 of said year, the diagnosis was confirmed through highly specialized laboratory techniques, revealing that the outbreak was caused by the Velogenic Newcastle virus.
4. 4That the National Animal Health Service, using its powers established in Law N° 8495 of April 6, 2006, through Resolutions N° SENASA-DG-R015-2015 and N° SENASA-DG-R016-2015, both of April 27 of the current year, declared a minor emergency status (estado de emergencia menor) and ordered the application of a series of general and mandatory sanitary measures for the control of the disease.
5. 5That the Executive Branch, through Executive Decree N° 39100-MAG of May 18, 2015, declared a national epidemic sanitary emergency status (estado de emergencia sanitaria epidémica nacional) due to the presence of Velogenic Newcastle disease in the national territory, and the prevention, control, and eradication of said disease were declared matters of public order and social interest.
6. 6That as an eradication strategy for the indicated disease, the sanitary slaughter (sacrificio sanitario) was used for all wild birds in captivity and domestic birds presenting the disease, and the establishment of sanitary quarantine in those areas of the country where mortality cases caused by the Velogenic Newcastle virus were detected, in addition to other control measures such as disinfection, epidemiological surveillance (vigilancia epidemiológica), and control of the movement of animals and risk goods.
7. 7That after the application of the aforementioned measures by SENASA to control the outbreak and after carrying out the corresponding epidemiological surveillance of the Velogenic Newcastle disease, following the international guidelines established by the World Organisation for Animal Health (O.I.E.), the absence of that disease in the entire national territory has been established.
8. 8That by virtue of the foregoing and since it is SENASA's responsibility to re-establish animal health and veterinary public health, as well as to maintain the recognized sanitary condition in the country, in accordance with the provisions of Chapter 10.9, Infection with Newcastle disease virus of the O.I.E. Terrestrial Animal Health Code, it is imperative to issue an Executive Decree that recovers the status of a country free of Velogenic Newcastle disease.
9. 9That in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures, Executive Decree N° 37045-MP-MEIC and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or formalities that the administered party must fulfill, a situation for which the prior control procedure was not carried out. Therefore,

Considering:

en la totalidad del texto - Texto Completo Norma 40301 Declara al país libre de la enfermedad Newcastle Velogénico Texto Completo acta: 116473 N° 40301-MAG EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8), 18) y 20) y 146 de la Constitución Política, los artículos 25, 27.1, 28.2b de la Ley N° 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, la Ley N°7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería y la Ley N° 8495 de 6 de abril del 2006, Ley General del Servicio Nacional de Salud Animal.

1. 1Que la enfermedad Newcastle Velogénico es una afección infecto-contagiosa propia de las aves, causada por un virus de la familia: Paramyxoviridae y es una de las enfermedades con más alta morbilidad y mortalidad que ocasiona cuantiosas pérdidas económicas y amenaza a la seguridad alimentaria, al producir una menor disponibilidad de proteína de origen animal con alto valor nutritivo y de fácil adquisición.
2. 2Que mediante Decreto Ejecutivo N° 25088-MAG del 25 de marzo de 1996, publicado en el Diario Oficial La Gaceta N° 80 del 24 de abril de 1996, se declaró la totalidad del territorio nacional de la República de Costa Rica, libre de la enfermedad Newcastle Velogénico a efecto de que se pudiera
3. 3Que el 22 de abril del 2015 fue denunciado y reportado al Servicio Nacional de Salud Animal (SENASA) del Ministerio de Agricultura y Ganadería, una alta mortalidad en aves de traspatio en el poblado de Bella Vista de Santa Cecilia del Cantón de La Cruz y que, realizada la consiguiente investigación epidemiológica, el 26 de abril de dicho año, se confirmó el diagnóstico, mediante técnicas de laboratorio altamente especializadas, reflejando que el brote era causado por el virus de Newcastle Velogénico.
4. 4Que el Servicio Nacional de Salud Animal, en uso de sus competencias establecidas en la Ley N° 8495 del 6 de abril del 2006, mediante Resoluciones N° SENASA-DG-R015-2015 y N° SENASA-DG-R016-2015, ambas del 27 de abril del presente año, declaró estado de emergencia menor y ordenó la aplicación de una serie de medidas sanitarias de carácter general y obligatorias para el control de la enfermedad.
5. 5Que el Poder Ejecutivo mediante Decreto Ejecutivo N° 39100-MAG del 18 de mayo de 2015, declaró estado de emergencia sanitaria epidémica nacional por la presencia de la enfermedad de Newcastle Velogénico en el territorio nacional y se declaró de orden público e interés social la prevención, el control y la erradicación de dicha enfermedad.
6. 6Que como estrategia de erradicación de la enfermedad indicada se utilizó el sacrificio sanitario de todas las aves silvestres en cautiverio y domésticas que presentaren la enfermedad y el establecimiento de cuarentena sanitaria en aquellas zonas del país donde se detecten casos de mortalidad causada por el virus de Newcastle Velogénico además de otras medidas de control como la desinfección, vigilancia epidemiológica y control de movilización de animales y mercancías de riesgo.
7. 7Que posterior a la aplicación de las medidas antes mencionadas por el SENASA para el control del brote y realizada la correspondiente vigilancia epidemiológica de la enfermedad de Newcastle Velogénico, siguiendo los lineamientos internacionales establecidos por la Organización Mundial de Sanidad Animal (O.I.E.), se ha logrado establecer la ausencia de esa enfermedad en la totalidad del territorio nacional.
8. 8Que en virtud de lo antes señalado y siendo que es competencia del SENASA restablecer la salud animal y la salud pública veterinaria, así como mantener la condición sanitaria reconocida en el país, acorde con lo establecido en el Capítulo 10.9, Infección por virus de la enfermedad de Newcastle del Código Sanitario para los Animales Terrestres de la O.I.E., resulta imperativo emitir un Decreto Ejecutivo mediante el cual se recupere el estatus de país libre de enfermedad de Newcastle Velogénico.
9. 9Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo. Por tanto,
